>> thanks, ainsley. >> ainsley: thank you. the second hour of "fox & friends" starts right now. >> pete: we begin this hour with the latest on the hunter biden indictment. the president's son is facing federal gun charges. and now the president is saying he will get in trouble if he takes any questions from reporters, brian. ains. >> brian: lucas tomlinson is never in trouble. there are no parameters. say whatever you want. >> with that here we go. president biden is waking up this morning, brian, as the first sitting president in american history to have a son indicted. president biden made no mention of this when he spoke outside the nation's capitol, yesterday. >> let me close with this, there is a lot more we could talk about. i wish hiv a chance to take all your questions but i'm going to get in real trouble if i do

that. >> it's been a tough week for the president. first house speaker kevin mccarthy launched an impeachment inquiry. new inflation report as prices continue to rise as all of our viewers know when they go to the grocery store and gas station. "the washington post" columnist david ignatius said biden shouldn't run for another term in 2024 and neither shawd kamala harris run. the uaw went on strike last night and, of course, the president's son was indicted. hunter biden's attorney reacting to the gun charge. this office has never brought a charge like this against anybody. therefore you have to ask what changed. it is the folks like chairman comer and the republican ultra maga crazies who have been pressuring this u.s. attorney to do something to vindicate their political position and, guess what? they succeeded. >> hunter is accused of receiving millions of dollars from china, russia and ukraine while his father was vice president. democrats insist there's no evidence tying joe biden to that cash. here's a statement from the top democrat's spokesman on the house oversight committee.

quote: mr. schwerin who served as then vice president's bookkeeper from 2009 to 2017 explained that he was not aware of any transactions in to or out of then vice president's bank account related to business conducted by any biden family member. now, when it comes to this gun charge, that's for the purchase of a 38 special. if you recall, one of the photos on hunter biden's laptop was him holding a separate handgun that people were asking questions about that. that looks like a beretta px 4, guys. >> brian: lucas, maybe can you help me with this. republicans didn't talk to eric schwerin they said we did. we didn't do it in a formal setting and we didn't describe it. what's going on here? >> a lot of finger pointing right now. of course, the democrats are coming to the president's defense. they are all saying that joe biden had no connection, no direct ties to this cash. of course, the best of lucks are saying some $20 million was handed over to hunter biden. of course, he was on the board of that powerful ukrainian energy company, burisma, which many people felt was

inappropriate while his father was vice president in handling the ukraine poferl, brian. >> brian: all right, lucas, thanks so much. >> ainsley: his attorneys say they didn't share any money. of course his attorney is going to say that. republicans are going through all the bank records and all the sars reports to try to find out to look at the money trail. >> pete: that was the point. remember tony bobulinski saying believable didn't. james biden always said they wanted multiple layers. there is no way there is going to be straight line connection to a certain bank account. you got to figure out that's why it takes time on inquiry and to look at those bank records and get a sense of where the money really flowed. the interesting part about this charge and miranda devine was on our network yesterday is that it's the one charge that doesn't seem to have a connection to joe biden. everything else could lead to the big guy. but, miranda suggests maybe in some ways this has a connection, too. watch. >> i think it was a good point that james comer made that this is the only one of the crimes that doesn't lead to joe biden.

but, there is one little element of it that does. and that is that at the time that the -- all the state and fbi police and other police were converging on that wilmington, delaware grocery store where the gun had been tossed in the trash can by halle biden, two secret service agents turned up. and they asked the buyer of the gun store for the gun background check. this charge would never have been brought, this indictment, if they had been successful in taking that away. now, the secret service denies it was their agents. but i think that's right for investigation. >> brian: in this case, if it goes forward, to a trial, the family has got to go. in comes haley, the widow of beau biden. and in comes hunter, again, and anybody else who witnessed it. why was the secret service there? nobody wants the scrutiny.

why was the secret service buzzing around hunter biden fishing out what i thought was the gun? and brought it back and how did they get it. whole thing is, too they did say, the special prosecutor we are not done. what is next on this. we know for the inquiry, comer says i want to talk to james biden. so, i would love to see him under oath. >> pete: to your point, it continues to baffle my mind that considering -- you mentioned manafort, take any other example, that the extent of the international dealings he was doing, you have to register with our government in order to do those types of things. he never did. no one is saying he ever did. and, yet, nothing has yet been brought up about that. that is ripe for charges. all -- and well within the statute of limitations. and that shows you how the two tiered system still exists. >> ainsley: next step in the investigation for the house, according to comer, they are pursuing the personal and

business bank records that belong to hunter biden and to james biden. if you look at the timeline with the gun, october 2018, hunter bought that floifer delaware. talking about haley who he was dating at the time we believed used to be married to bo, when bo passed away, hunter started dating her, so that's haley. haley takes that gun and throws it in the crash behind the grocery store. we believe it was retrieved by secret service. then he writes this book: "beautiful things." he says that he was smoking crack every 15 minutes in the spring of 2018. so, that dates it back to october, when he bought the gun. and allegedly lied on that application. then in june he agreed to plead guilty to the two misdemeanors. but that all fell apart in july. and then yesterday david weiss charges him with these three counts and many people wondering is david weiss doing this because he was being accused of of going too easy and knowing about that plea deal, the sweetheart plea deal and allowing that to happen.

>> pete: will there be another plea deal at the end of this road? >> brian: a few things are happening. this could be unrelated but it might be related. this investigation is moving quick and deliberate enough that many democrats are getting so nervous. looking at the polls and where this could be going that joe biden can't win. so, why we stay in? and kamala harris should not be next up. and you will see that on one tract. the other tract is joe biden's performance west virginia made up dog faced pony soldier for no reason. wrong didn't happen. brings up stories that things that didn't happen. good morning vietnam was a great song. it was a movie. >> pete: 9/11 the day after. >> brian: at 9/11 the day after messed up. >> ainsley: trying to see nelson mandela he was arrested. he divisioned his son's death. he sometimes said that he died related to the service. said when he went to maui. he had a kitchen fire and he almost lost his cat and his wife

and his corvette and turns out i think the fire was like put out in 20 minutes and he didn't lose anything in it except that little portion of the kitchen. he says that the border is secure. we know that's not true. he said afghanistan was a success. we know that's not true. he continues to embellish and his latest one happened. he was at the maryland community college and was talking about how he teaches or did teach political theory at penn. listen to this. >> i taught at the university of penn for four years and i used to teach political theory. >> pete: so the problem is, according to all research that's been done and records that are out there, he never actually taught a class. so there are plenty of professor emeritus and b.s. jobs that exist in politics and academia so can you say you are affiliated with an institution. ben biden center where they were running cash through there and others, but he didn't teach a

class. and he tea seems to want the audience to think he is deep thinking. >> ainsley: he never taught a class there on campus to promote a book once. he answered some q&a with administrators. he did a lecture at what are tan. and did some public events when the mexico president, former president was there and the u.k. deputy prime minister was there but he didn't teach a semester class. >> brian: did he keep his -- he did keep classified documents. >> pete: he did. >> brian: we still don't know what was in those classified documents. >> ainsley: does he believe this stuff or do you think is he just getting older and he is mixing things up. >> brian: he doesn't talk to the press. we wouldn't know. he claimed to a group of rabbis yesterday that he was raised in synagogues in my state. there is no sense ever that he was raised in synagogues in his state. so what -- he also said he went to more black churches than anybody. i'm pretty sure that nobody believes that.

>> pete: so much it's almost unfact-checkable. another story that you can fact-check because we are following the numbers here is the chaos at the border. watching the numbers explode not just of overall border encounters, known got-aways, it's the number of suspected terrorists arrested at the u.s. border. as of july, for this fiscal year, look at that number. 160 suspected terrorists. those are -- these are just the ones arrested at the u.s. border. >> ainsley: they are on the terrorist watch list. >> pete: look where it was in 2020. three. we are at 160. >> ainsley: they know it's open. they know the border is open, y'all. that is so scary. do you remember after 9/11 how our country was so united about this? gosh, so many things were put into place to prevent terrorists were getting into our country. after 9/11. and now we just have an open border. >> brian: in 2019 there, was one. in 2020 there was three. and now 160. those are the ones we g got were dumb enough to come through the port of entry.

>> ainsley: how many that we haven't caught? how many are living in our country that we haven't caught. >> pete: if you know you are on a list and the southern border is open. you are probably capable of paying smugglers to get you across without being detected as the border patrol is overwhelmed with scenes like this and effectively just a processing center. >> brian: bill melugin yesterday was in the tucson sector. and he said there are 2,000 illegal crossings per day over the last three days. it is picking up big time. over in texas, 7,000. so this is -- after august, went up significantly. now we're seeing the numbers are going up big time. now that the heat has subsided and no one cares about title 42. it's dissipated. no one is signing up in their own countries. they are making too much money. and look at where we have to keep people because we have no idea where to put them and in tucson they said they are just letting them out into the streets. >> ainsley: in that area i guess you in arizona the retired ice director john fabricortei.

the united auto workers are officially on strike against the nation's big three automakers. about 13,000 union members walking the picket line overnight at three different plants, one in ohio, michigan and missouri. >> pete: first time for employees for george, g.m. and stlants walked out at the same time. robin is live in michigan. >> yeah. we have been talking about the possibility of a strike here for weeks and weeks now. and it is now a reality. at 11:59, we had a number of workers walk off the job here at the ford, michigan plant in wayne. i'm going to step out of way. [horns blowing] >> this is 20 minutes away from detroit. as you mentioned this is really a historic moment for the uaw. this is the first time that uaw workers are striking 9 big three at the time. the ford michigan assembly plant here in wayne that does employ

about 4600 workers. they make the ford bronco here. about 4100 workers at that stellantis assembly plant in toledo, ohio, they were part of this first wave of walkouts. they produce the jeep wrangler. and then about 4100 at g.m.'s plants in missouri. they also went to strike at the stroke of midnight. they build the chevy g.m.c. vans as well as pickup trucks. now, again, this is a complete work stoppage. union leaders will call in more facilities to strike if needed to put more pressure on automakers. take a listen. >> and if we need to go all out, we will. everything is on the table. >> talk to these guys. let them tell you what they deal with every day on the job. that's what it is all about. getting their justice. >> they acting as if they will go bankrupt if they give a dollar extra. so i feel like, you know, we are are going to have a little bit of a struggle. i do have hope that we will get a deal done.

>> well, he wants a couple things from president biden for sure. one is sustained continuous support. and certainly he hears, you know, some of the political opposition in the united states to continuing very that he will get from president biden. i think that commitment has been there for some time. and i think that's why it's important that zelenskyy does come to the united states. so, you know, can he talk beyond the president. you know, to the american audience itself and to in a sense to american representatives of that audience. so that's very important, he may have, you know, specific weapons on his shopping list. he has been pushing for these atacms for some time. for our audience that's very long range rockets, close to 20. he wants those things so can he routinely do what you saw cruise missiles do the last couple of days and the russian's naval

base where it looks like they may have destroyed two ships, a surface ship and a submarine. at least they severely damaged them. they want to be able to do that routinely to logistical infrastructure bases, ammunition supply points, in crimea. >> brian: we have just now started training pilots and we have not, i understand, delivered one of the 31 abrams tanks we promised. why? >> well, this is a request that was made last year. it's one of the incremental decisions, the administration has made. and our audience has seen this played out where they have made a request. and it's delayed for months. in this case, you know, for well over a year. but eventually, it's a europeans that put the pressure on us, on the f-16s because they have them themselves. but they needed presidential permission to be able to train ukrainian pilots as the europeans who put pressure on us to provide the tanks. for the life of me, i don't know why only 31. we could have given them a couple of hundred tanks.

the marines aren't using those. we have tanks in storage. hundreds of those. and not arriving until the fall of the year. and it's only 31. we have breaching equipment that they need very desperately to be able to get through these defenses. this is engineered, design equipment to get through mine fields and other obstacles. they got a very small portion of what they needed to do that. that is the major impediment on the battlefield. so, i think zelenskyy has a shopping list for sure that he keeps in his back pocket. he's going to put that to the president. and what we need here, certainly, is accelerate the training of the f-16 as much as possible and don't under estimate them. if you think it's going to take six months it, will probably take two or three. that is what they have proven, they're technology savvy and absolutely determined. they are fighting for their families and their homeland. >> brian: kim jong un went to russia, siberia. is he touring all their space program and their rocket program

and missile program. to me, in many ways, it looks desperate. russia is going to the poorest nation on the planet, one of the most vilified and saying, hey, be my friend. what comes out of this for russia? >> yeah. well, they need artillery ammunition. think about this. the ukrainians are actually using more artillery ammunition now than the russians are. and they are using di it as a mr system suppress russian artillery and fires. reaches many of their logistical as possible. credit the administration and the coalition that they're leading the getting this ammunition to them and the scale they are getting it to them and they are able to sustain it it's really quite remarkable. they have had to go to many countries to get it. russia defense industrial base cannot keep up with them. and that's a good thing. so he has got his hand out, which is something unusual. not seen this before. and you are absolutely right. the word desperate is very appropriate.

towns like cape cod facing the possibility much danging winds, life-threatening storm surge and even tornadoes. our senior meteorologist janice dean is tracking this storm. where is it supposed to hit? >> tomorrow. we think canada. but the effects are going to be felt all the along the new england coast line. take ha look at it. you saw the latest track. we are still thinking a hurricane within the next 24 to 36 hours. and then it's going to downgrade a little bit. but, also become extra three-point line and that means expansion of the wind field a bigger storm. and that's going to bring, you know, more effects along the coast. so here's the forecast wind field as we go further out in time. can you see how expansive it is 530 miles across. that's going to mean the outer bands are going to move in

july. the president's son now charged with three counts, including lying about his drug addiction when he bought a firearm back in 2018. all adding up to a possible 25 years in prison. here to break down the new accusations against hunter, fox news legal analyst gregg jarrett and criminal defense attorney lexy rig none. thank you both for being here. greg, how much confidence do you have that david weiss is going to prosecute this aggressively? >> zero confidence. i don't think he will. remember. david weiss was forced by the judge, pete, to bring these felony charges. he wanted to plead them away with a slap on the wrist. and remember what the whistleblower said that weiss spent the last five years acting as hunter biden's defense attorney. refusing to bring felony charges for the millions in tax fraud and evasion. he let the statute of limitations deliberately expire, the most abridge gentleman's

crimes. he ticked off hunter's lawyers. ignored the fara violations. now we are supposed to believe that david weiss will act like a responsible prosecutor? i don't think so. i suspect he'll attempt another plea deal without the hidden immunity this time. you know, hunter will get to skate with probation. and weiss will pretend that he is going to bring other serious tax charges, influence peddling but he won't do it. >> pete: lexy gregg lays out well the implications of these charges. let's take them on their merits, when you look at the evidence, and you look at the charges, how much jeopardy is in hunter in at this point? >> well, i think the evidence is pretty strong. and so if they do end up doing a plea deal, it's probably a result of how strong the evidence really is. because this is not a complicated case. he wrote in a book that he was a

significant drug user. he signed the form. and let's face it, he was going to admit to it before to do the diversionary program. you can't plead guilty to something that you didn't do. you are essentially lying under oath if you do that. so, i think that the evidence is pretty strong here. and it may result in a plea deal simply because there is no real reason to take this case to trial for hunter biden one charge tough to tie to joe. how can they ignore the business. can you ignore that? >> sure if you have unfettered power which david weiss, the u.s. attorney, now special counsel has. i mean, he can weather all the condemnation from the american public that this is unfair, it's preferential treatment, but he can basically do what he wants. i mean, he has the backing of

merrick garland. garland picked weiss as special counsel because he knew that he go soft on hunter biden and absolutely will not bring any of the influence peddling, money laundering, fara violations, tax fraud cases because he knows that will inevitably involve joe biden. and both garland and weiss, it appears to me, are trying to protect both of the bidens. >> pete: no doubt, lexy, play this forward for me, what's the timeline? how does this play out? >> this is going to be interesting. there will have to be an arraignment. he will have to arrange to turn himself. in meet go ahead or not guilty. likely not guilty at this point. he has probably seen a lot of the discovery already that i would be entitled to considering he was going to enter into a plea. there are no doubt going to be motions on this case. there is u.s. supreme court case law. there is case law out of other circuits that cast doubt on the

>> pete: back with a fox news alert. joe biden set to deliver remarks on contract talks between the united auto workers and the nation's big three auto makers. >> ainsley: about 13,000 union members walking the picket line overnight three different plants ohio, michigan and missouri. fox business correspondent grady trimble is in detroit with the latest. grady? >> good morning, ainsley, pete, and brian. this is the first time the united auto workers union has gone on strike against all three of the detroit automakers at the same time. as you mentioned, this morning, on the picket lines are members of the uaw at a general motors plant in missouri, a ford plant in michigan, and a stellantis plant in ohio. this is not the full blown strike of nearly 150,000 workers the uaw initially threatened. but it's already causing disruptions for all three automakers and the uaw says it could still expand the walkouts. >> this strategy will keep the

companies guessing. it will give our national negotiators maximum leverage and flexibility in bargaining. and, if we need to go all out, we will. everything is on the tactical. >> the automakers say they are putting generous offers forward and negotiating in good faith. the latest prop proposals from d and general motors include a 20% bump in pay in addition to cost of living increases. ford says the uaw waited until just hours before the deadline to put forward a counter offer and that the union barely bundle from its initial demands. >> there is no way we could pay people $300,000 to work four day work weeks. we would have lost $15 billion and closed most of our plants in the last couple years. that's not a future. so we're not going to do a deal like that. there is a different line, a line in between those two things. and but you can't negotiate with yourself.

and much more than a tesla worker. >> brian: just keep in mind, when you get that car out, it's got to compete with other cars in other nations. if you can't sell that car because the price point is too high because the salaries are too high, then that is a bad math situation. and i am not in there. we're not in there every day. i got it. but i think that the fact is you don't counter propose until the last minute. that is an issue. jim farley was on last friday to say we have our own proposal. and they went up significantly and didn't hear a thing afterwards. so, to me, i feel bad and the other thing is, i think republicans would be smart to stay on the sideline. they have amassed huge blue collar support. there is a lot of great pima union. >> pete: absolutely. >> brian: who work hard. a lot of republicans are quick to go against the union. i think they would be smart to lay back because a lot of those union workers are revisiting who the worker party is. >> pete: their grievances are grounded in many ways on
