the cash for prisoner exchange. but biden's decision to release $6 billion iran, some are calling it a ransom payment. morgan, great to see you. always good to have american citizens who are wrongly detained back on american soil, but critics of the deal say we may have opened ourselves up to more hostage taking. >> i think that's true and we have talked about this a few times we have been able to get americans home, variations on a theme. britteny griner out of russia, and i was critical of it, not that we don't want her home, we do, but trades against the interest of the american people it ups the ante and raises the ransom payment, so to speak, for future americans. look at the five americans, dual citizens coming home, it's $6 billion payment. the largest in u.s. history, and administration has never paid this much before to get american hostages home. and if you look at what the

biden administration said, they said well, we had to pay this to get americans home. that's just not true. and the trump administration under mike pompeo's state department where i worked, we got two americans out of iran, for $0. so it is possible to negotiate with iran. >> john: the payment, john kirby insists is not ransom. >> it's not ransom. these are not u.s. taxpayer dollars. and we have not lifted a single sanction on iran. iran will be getting no sanctions relief. >> john: he says it's not ransom because it's not our money. whether it's our money or iran's money that has been frozen and held in abeyance, it's cash they didn't have before the deal. >> and they didn't have the money, it was frozen because of sanctions. so you can say, argue i'm not lifting sanctions and maybe you

are not technically lifting them, but when you are not actually executing the sanctions, enforcing the sanctions, which they have not been doing on iran to the fullest extent of the law, and the trump administration, we had to call and the world, had to get china, india, russia, all of these countries not to purchase iranian oil during the pressure campaign. that's how we got the $6 billion in south korea in the first place. so you can say it's not a ransom payment, say we are not lifting sanctions, but if you are not enforcing them and giving iran the world leading state sponsor of terrorism $6 billion, then we are arguing semantics. >> john: part two of that, whether or not we needed to pay them the money at all. in the briefing our jacqui heinrich said wait a second, we exchanged five iranian prisoners, who don't want to leave the united states and go back to iran. >> why would you. >> john: for the five americans, why did we need to give the money at all.

>> this is the deal that we were able to strike to secure the release of five americans. it would be great, wonderful, if we could just pick up the phone and call them and say we want our americans back, send them back on the next plane. you and i both know it's not going to happen, particularly with iran. >> john: it's the best deal we could get. what we had do do to get the deal. the world's greatest superpower, why are we negotiating from such position of weakness? >> listen, i know and respect john kirby, i think everything he said is true. it's accurate. this is the best deal that the biden administration can get. if you ask robert or brian, our hostage negotiator before he became national security adviser, or mike pompeo, are they great negotiators, absolutely. but, they were able to go in from a position of strength because of who backed them up in the white house. so when you look at the negotiators the biden team has, they don't have that same kind of backing, the same credible

voters view the president and his vice president unfavorably. if the party wants to make changes, it's running out of time. white house correspondent peter doocy live on the north lawn, how complicated would it be to swap a different democrat in as the nominee at this point? >> very complicated, john. dnc is not impartial this cycle. they have already said president biden is going to be their candidate. so it would be almost impossible to swap him out unless he bows out. >> this president has said i'm running, his team is running him, they haven't done anything to turn around the numbers yet. they are going to have to start pulling some rabbits out of a hat. they need some economic turn around. but looks like they are going to hold up under this pressure. i don't see any potential change here right now. >> and that's what david ignatius got at in the "washington post," a column the president has almost certainly read at least once.

understanding yet why he couldn't be here for at least part of it. john. >> john: any president that i've ever seen going to the u.n. general assembly typically goes up the morning of the speech, gives the speech, spends the day there, maybe overnight, and then comes back after some meetings. but -- never heard of a down day ahead of the general assembly in new york. maybe we can find out why. >> we'll ask. >> john: peter, appreciate it. >> it's very clear hunter biden's attorneys are desperate, did not expect a gun charge because of the agreements that delaware prosecutors should never have been in the position of anyway, but now their flailing. >> sandra: the attorney for irs whistleblower gary shapley, after a new lawsuit filed by hunter biden's attorneys. he claims agents targeted him and sought to embarrass him by disclosing confidential tax

information in testimony and media interviews. just last week, special counsel david weiss filed federal gun charges after his plea deal collapsed. fox news contributor and law professor jonathan turley. do you believe hunter has a case against the irs? >> i don't. you know, this -- they may be able to find a sympathetic trial judge, but in the long run, i can't see how this plays out because the federal law expressly allows the house committee to release tax information. there's a special exemption for certain committees, including this one. and if you look at the senate report that went into this law, they said that public disclosure of tax information is part of investigations was part of the intent of congress. so, what these whistleblowers did is they spoke to these -- to this committee.

committee released the information. you'll notice from the hearing the whistleblowers repeatedly refer to that statement. they are very careful to say within the confines of the statement, and indeed, if you look back at the hearing, they repeatedly declined to answer questions that were not within what they gave the committee. that was all in compliance with this federal law. >> sandra: jonathan, this is just part of the lawsuit hunter is filing against the irs. it reads mr. biden has no fewer or lesser rights than any other american citizen and no government agency or government agent has free rein to violate his rights simply because of who he is. yet the irs and its agents have conducted themselves under presumption the rights that apply to every other american citizen do not apply to mr. biden. if it's released through the congressional committee, is that different than if the irs whistleblowers are out there sharing this information themselves? >> well, there is a difference

there, but the committee did ultimately release much of this information, and we can go line by line, but it seems like the committee made the decision that this was to be made public. that's why they held a public hearing. they decided that what they told the committee had to be given to the public. and so that's the reason i can't see how this is going to work out, because congress is pursuing its constitutional function of oversight within the federal government. this is a corruption scandal. they are alleging that hunter biden was given special treatment and protection to hide an influence peddling operation. that's going to require the disclosure of some of this money and also how the investigation was handled. i can't see how a court's going to thread that needle without limiting the constitutional function of this committee. >> sandra: finally i'll ask you what it means for the republicans impeachment inquiry

and investigation into the biden family's financial documents and releases. there is evidence the wall street journal says for an impeachment inquiry. reads the biden money trail goes through at least 20 shell companies. vice president used different email pseudonyms, at least 170 financial transactions with hunter and james biden were flagged as suspicious. to say no cause for investigation is to deny the reality of all we have learned about the biden family business. based on what you just told us about not really seeing a case here at the irs, is it safe to say that the outcome of this filing by hunter biden won't get in the way of the republicans' investigation? >> no, no, it won't. it's -- hunter biden is screaming at an approaching storm. it's not going to change its course. the fact is that the house has an obligation to see where this evidence goes. impeachment inquiry is that, it's an inquiry, it's not an

actual impeachment. this may or may not lead to an impeachment. but even the polling is showing that the public believes that joe biden was involved in this influence peddling. we have to find out. that's the constitutional function of congress. and they are going to pursue that money trail and i think it's going to increase in speed as we go forward now because an inquiry is being conducted. >> sandra: all really important stuff. good to get you on all of that, jonathan. thank you so much. >> john: sandra, this is terrible. a gruesome hit-and-run claims the life of a retired police chief, it's all caught on video recorded by the people who allegedly did it. police now hunting for the person who filmed this video. plus, dress code drama, the senate will no longer require lawmakers to wear business attire on the senate floor. senators already speaking out

>> sandra: the u.s. senate will no longer enforce the chamber's dress code for elected members allowing senators to now wear whatever they choose. the move allowing pennsylvania senator john fetterman to take part in votes on the senate floor wearing the casual attire he is now known for, like a hoodie and shorts. mark meredith has more on the updated rule taking effect this week. mark, is there reaction to these changes? >> sandra, there sure is. outrage happening, good afternoon to you. the senate is a place where tradition is sacred, but one

tradition is going out the window, that's the formal dress code. no longer enforced at least for lawmakers. chuck schumer plans to wear a suit and tie but others will not be forced to wear business attire. critics say one man is likely responsible. pennsylvania democratic senator john fetterman has drawn a lot v affection for his clothing choices, the campaign trail and events and here in washington. often hoodies, shorts, anything but the traditional suit and tie. two years ago he addressed his style online, writing you do not look like a typical politician nor like a typical person. i even lack the sleeves to roll up. all i ever wear are short sleeve work shirts because hard work is the only way to build our communities back up. fetterman's office has not responded to our request for comment, there's been some twitter posts online going after some of the lawmakers that have called him out like marjorie taylor green --

marjorie taylor green, who tweeted "the senate no longer enforcing a dress code for senators to appease fetterman is disgraceful. dress code is one of society's standards that set etiquette and respect for our institutions. stop lowering the bar." and this from another, awful, the senate chamber is not your home, gym or outdoor park. if you can't dress professionally for work on the floor of the senate of the united states, do us all a favor and get a different job. what's interesting is that this change in the dress code is only for senators. staffers still have to adhere to a dress code. >> yes, the help still has to look really good. it's -- and i suspect, i suspect most senators are going to keep showing up in a suit as they already have. as a matter of fact, you almost wonder, why couldn't they pass a rule for senator fetterman, one member of the u.s. senate and said if he wants to wear a

t-shirt and hoodie i guess he can. but you know, you wonder -- senator schumer, the majority leader the man who made the change, why he's doing this. as i said for senator fetterman's branding, his imaging, goes -- pre-dates the stroke or hospitalization for depression, it's not a result of that. this is the image and the kind of branding that he has cultivated for quite a long time. >> john: however, an article in the associated press suggests that being able to wear a hoodie and shorts and his running shoes makes him happy, and highlights his recovery. but then i went back and i thought oh, wait a minute, here are some other folks in the senate and in the house, kirk, johnson, on others had strokes, and tim johnson a stroke as a result of a massive aneurysm and

>> john: video showing the moment a retired police chief was struck by a car and killed is going viral online after it was posted by someone who appears to be in the car with the driver. 64-year-old andreas probst was out for a morning bicycle ride when a car hit him from behind, seemingly intentionally. police are searching for the person who they say recorded that video clip. cops already arresting the 17-year-old driver on murder charges. his family and community mourning the loss of a man known for his laughter and fatherly demeanor. alexis mcadams has the latest. i watched this video several times and could not believe people could do this. what are police telling you?

>> it does not just show a crash but could be an intentional hit-and-run. left the former police chief, father and husband dead on the side of the road. watch. and we stopped the video before the impact because it's just so gruesome and tragic. the fatal crash happened mid august when andreas probst was out for a morning bike ride, around 6:00 in the morning in vegas, a path he took pretty often. only a few miles from his house, he was struck from behind and killed. happened right after the driver also, according to investigators, slammed into the back of this white car causing it to spin out of control. all part of the ongoing dangerous joyride with the teens. the passenger in the car recorded the hit-and-run, posted on social media, now at the center of an investigation. but they have not found the teenager just yet, only the driver.

california joined the lawsuit. california is being sued by smaller states and parties, but obviously california elevates the issue. the journal had a long article on the topic. do they have a case, we will find out in court. with respect to the company's misrepresenting themselves, they have spent billions of dollars over the last couple of years developing, acquiring and investing in alternative fuels. does that mean exxon is going to generate more revenue from alternative versus traditional fossil fuels, of course not. but to suggest or imply that they are not meaningfully attempting to shift is to deny the reality on the ground. >> sandra: american petroleum institute says it's an ongoing and coordinated campaign to wage meritless, nothing more than a distraction from important national conversations and enormous waste of california taxpayer money. meanwhile, this is all happening while people are paying sky high
