we're 60 minutes away until a hearing on the hill. a.g. merrick garland will appear before the house judiciary committee expected to get a drilling on hunter biden and the former president donald trump. we're all over this this morning. a big story today. stand by for more on that. meanwhile, bloodshed at the border. authorities arresting an illegal immigrant who was in texas for murder. sources say he was captured and released just a few months ago. still piecing the story together as we say hello from new york. team is back together. i'm bill hemmer. good morning. >> dana: missed you yesterday for a good cause. we might talk about that later. i'm dana perino and this is "america's newsroom." i didn't realize it was ainsley's birthday. i sent her a text saying she looked like an angel. happy birthday to you. the suspect crossed illegally in texas from peru in may and officers processed and released him. court date set for 2025.

>> suspected criminals aren't the only ones get ming through the cracks. agents have stopped a staggering 160 migrants on the terror watch list. that's not counting the ones who got away from authorities. take a look at this for a moment. [shouting] >> dana: this is in southern mexico. haitian migrants storming an immigration office. the dangers of mass migration that surnld under president biden. according to at least one democrat this is all republicans' fault. >> do you think president biden's border policies are working? >> i think that part of the challenge has been he has been trying to resurrect an immigration system decimated by president trump. >> cbp in the past 24 hours apprehended 9,700 migrants. people are not using these legal pathways. >> what we need is for

republicans to stop talking about open borders that facility state smugglers and get to work passing comprehensive humane immigration reform instead of vilifying immigrants constantly. >> bill: folks on two planets on this. bill melugin in eagle pass, texas with more. bill, hello. >> this alleged murder you guys mentioned off the top is another example of what can possibly go wrong with a policy of mass catch and release taking place here at our southern border. look at the mug shot here. 64-year-old illegal immigrants from peru, he was arrested by the sheriff for a murder that happened here in eagle pass on monday. according to multiple cbp sources to fox news border patrol caught this guy crossing illegally back in may. he was processed with a notice to appear with a court date in 2025. he was transferred to ice and then ice released him at an ngo

in eagle pass with atd. alternatives to detention. sometimes a cell phone, sometimes an ankle monitor. now he is charged with murder. we don't have any information on the victim or facts of the case. we're waiting on ice to give us a response to this story. we'll update our viewers when we get more information. take a look at this video out of mexico. more migrants heading our way. footage showing another train, this is in mexico, this train is loaded with migrants venezuelans. stopped by mexican authorities. they weren't happy. started chanting let us through, let us continue. this is 150 miles away from where i'm standing now. the train was heading towards the eagle pass area potentially for another mass crossing. as a result, the train company in mexico has now stopped 60 of its trains from heading north to the northern part of the border with the united states because of the sheer number of migrants trying to get on their trains as these migrants are doing

anything they can to get to the u.s. look at this wild footage out of mexico. southern mexico right across the border with guatemala where there was just an avalanche, a stampede of predominantly haitian migrants rushing a refugee center there in the town. what they were doing is demanding papers to get expedited processing to the border. they started rushing into the area. trampled some officials there and trampled some migrants there. two people were hospitalized. you can see how desperate some people are to try to get papers and north through the country and arrive here at the border where we are. literally causing a stampede and injuring people. back live we can take a live look at the fox news drone. we continue to have activity. people are crossing here all morning long. you can see people who have just crossed over. they got through the barbed wire at the edge of the river trying to get past shipping containers set up by the state of texas

here. what's interesting is there is mexican national guard and mexican police deployed along the river but not having any effect. the migrants are walking by them. getting into the water and crossing illegally in front of them. the deployment of force by mexico is having 0 effect at our border. send it back to you. >> bill: staggering stuff. bill melugin kicking it off in eagle pass, texas. >> dana: stunning to me this isn't getting more coverage. american people are telling pollsters they are concerned about the border and reason why. they see the pictures and video. there was other video, too. >> bill: the thing that kicked it off was the video over the weekend. i think it crossed on sunday afternoon perhaps, dana. as bill melugin just reported the mexican government or those who are running some of these train systems now have suspended them. it is too dangerous. a lot of migrants hopping on along the trail.

here in new york president biden has been in town for four days and so far as we can tell, he has yet to even speak with the mayor of new york. remember eric adams has been going after the white house, mentioning the president by name. so what's up? how serious of a mayor if you will allow this opportunity to slide by? the governor met with him yesterday. waiting for details on that meeting from new york. >> dana: just getting started here. check this out, out of vegas. they arrested the passenger accused of filming the killing of retired police captain. the 17-year-old driver was arrested shortly after the incident. the attack was intentional. both teens will be charged with murder. the victim was a husband, father of two, his daughter described him as a man of honor with more than 35 years in law

enforcement. he was also a jokester and prankster. we mourn his loss. >> bill: that was difficult to watch. that video. meanwhile new power rankings as we look at democracy 2024. here is what we find in that republican race for the nomination. frontrunner still clear and away is donald trump at number one. challengers, there are five in the second category there. some of them have moved a bit lower, dana. some of them have moved a bit higher. let's go through that right now. desantis decline is what we're calling this. you see the chart for trump right around august? that's when he was getting hammered with all these court things. desantis right after that first debate we had in milwaukee, you see his decline there. meanwhile, though, we have a bit of a rise for ramaswamy in red there. he seems to have scored some points for the debate and getting a bump.

>> dana: maybe took those directly from desantis if you look at the numbers. >> bill: here are the shifts we find in our power rankings as of right now. ramaswamy up one, nikki haley up one and tim scott seem to be neutralized in that debate and dropped two spots as of now. all right. you got that? >> what do you think we're analyzing there? >> love the new fox power rankings. last time i came ton to talk about them there hasn't been a huge change. trump is still the dominant candidate in the republican primary. ramaswamy moving up a little. tim scott moving down a little. i think nikki haley will be the republican candidate to watch at that next debate on fox business in california. but i think the big trend, the big picture is that you have this divide between the populist and trump leads that side of the

party. ramaswamy is starting to move in that space as well. then you have the more traditional republican candidates like a haley, scott, mike pence in that field as well. look, the populists are winning. trump dominating that one spot. ramaswamy getting a lot of momentum over the last couple months. the divide in the republican party now in the presidential primary and what's going on on capitol hill. >> dana: we were talking about the border. at a town hall last night chris christie was in new hampshire the border came up and economy as well. curious about his approach really focusing on new hampshire. listen to him here. >> new hampshire, that's it. i'm not being coy about this or trying to act like i am running a campaign that's in 40 states right now. i am not. i am here. >> dana: trying to remind everybody that the campaign is not a national primary. that you have the first voting

in iowa less than four months from now and then new hampshire. what about the strategy of focusing in one of those states primarily. >> for chris christie, that really is his only option because his numbers among most republican voters are quite low. trump voters don't trust him and it is the anti-trump faction of the republican party that is looking at chris christie as a serious candidate. new hampshire independents can vote. a lot more moderate republican voters in that voting space. so christie is putting at his chips on the new hampshire table. i think big picture, too, a lot of these candidates looking to take on trump are focused on one state. ron desantis originally it was going to be a big national campaign. now his campaign very focused on iowa and doing well in iowa. maybe defeating trump in iowa. christie looking at new hampshire. nikki haley looking at south carolina. the challengers to trump are

looking at one of those early states to make their moment. it will be really hard for anyone given the polls right now. that's increasingly the playbook for the leading challengers. >> bill: on the democratic side joe biden is in, right? i'm pretty convinced of that. we can debate it later. his communication team now has a strategy revealing. one quote talking about the consumer media. they say that not only booking -- regarding news and policy, also working on human interest pieces and profiles to illustrate a more personal side of the administration officials. they will try to reach people through different means. makes sense. the president seems to be insistent on his own strategy. check this out. interviews with legacy media "new york times," 0. "washington post", zero, "wall street journal," 0. in the meantime you go to india,

vietnam, you come here to new york and he takes very few, if any, questions at all of these places, josh. >> it's a real problem for the white house. a lot of people close to biden know that. the bully pulpit that presidents use to communicate to the american public, it is broken for the president. he is not able to drive home a message. not able to talk even about what the administration views as his successes. he had a clunky press conference in vietnam. trying to talk about the economy. you aren't hearing a lot of sound bites from the president. in fact, the president's re-election campaign went out with new ads over a last couple of weeks. not a single ad features joe biden talking in the ad. i think that tells you a whole lot. biden not just his age or questions of his health, it's about his ability to drive a message. you can have as many magazine spreads as you want. if the president isn't out there

persuading the american public it will be a broken message. >> bill: erika used to work for marie claire, 17 and cosmopolitan and the one doing -- >> dana: honestly, if you are a democratic communications person in washington, d.c. and you are trying to get profiles of your people in legacy magazines, in feature stories, basically you throw out seeds and watch everything bloom. it's a good strategy i get it. one other thing, josh. the white house is doing this thing called the split screen every day. they're not letting the biden voice but they are doing this picture. today's split screen. here is what president biden is doing today and they want to run against the few extreme congressional republicans they are calling them and they are contrasting that. will that help him? >> look, that's the best play in the biden re-election campaign trying to contrast his record with what they view as the

>> bill: from the commonwealth of massachusetts police are investigating the death of a patriots fans after what they are calling an incident involving another fan at a football game. nfl game between the patriots and dolphins on sunday. molly line outside gillette stadium in massachusetts with more on this disturbing story today. molly. >> good morning, bill. the new england patriots were playing the miami dolphins sunday night inside gillette stadium where the incident unfolded. 53-year-old dale moody came

here. he had a medical event. he was rushed to the hospital and died. one witness says moody was unconscious hit immediately. >> a fan delivered two punches to the victim, dolphins fan wearing a dolphins jersey. the victim slumped over at that point. >> gillette stadium officials are working with authorities in the investigation and released a statement saying in part we're heartbroken to learn of the tragic passing of dale mooney, a life long patriots fan. the national football league has expressed its condolences to his family. our top priority is the safety of the 1 million fans who attend games each week. we deplore activities with fans that -- we work closely with our clubs and law enforcement officials to support our fan conduct and stadium security initiatives. his death comes a week after a

video of brawling fans at a washington commanders game went viral. another graphic video also showing a bengals fan knocking unconscious a raven's fan with a head-butt. the nfl says disorderly conduct reports are down this season compared to this time last season. no one charged at this point in time in mooney's death and awaiting autopsy results. >> we must protect our kids and not allow a hostile foreign government to indoctrinate them. congress pass a law to ban schools from accepting money from -- >> dana: oklahoma state superintendent testifying before congress yesterday pushing for a ban on foreign-funded school programs because he says they are used to spread anti-american propaganda in our classrooms. he joins us now. what did you find? >> the actions of joe biden and

nancy pelosi to allow the chinese communist government's infiltration of our schools is tree sonous. they've funded the confucius classrooms inside american schools is a propaganda campaign of a soft power attempt to undermine the american constitution and american values. tulsa has allowed this into their schools and asking congress we have to act. we can't undermine our way of life. i've heard from parents from the state of oklahoma and around the country that are appalled by this national security risk that the democrats have opened our schools up to. >> dana: take us back a couple of steps. what does the curriculum or program or the propaganda try to do? what does it say? >> the confucius classrooms and institutes come in and talk to kids and embed curriculum that

says communist china only talks about the benefits of communism and actually sensors what can be said in the classroom. you can't mention taiwan. white brush view of chinese history while undermining democracy and america's view in the world. they funded our schools through a series of ccp affiliated institutes so it's very hard. our agency has been working to track down all the dollars and all the curriculum. they have put up barriers to make it hard to track. so you've seen the trump administration crack down on it. joe biden has released these programs and nancy pelosi sat there in congress and allowed these to continue. it is a risk to our national security. we've seen china do this for years and now we allow them back in the classroom. >> dana: president biden released the program. what does that mean in particular? released what? >> what president trump did is cracked down on the confucius institutes into our schools.

so much so colleges ended the programs. what we've seen over the last few years the biden administration has not used the department of education to crack down on these different institutes. so what is allowed to happen is creeped back in and this is just another example of democrats aligning with a hostile foreign government. >> dana: we reached out to tulsa public schools for a statement. let me read it for fairness. they say contrary to accusation the district takes no funds from the chain's government and has no confucius classroom programs in its school. a controversy brewing there something to watch. we appreciate you coming on the program to tell us more about it. thank you, ryan. >> thank you. >> bill: so 26 minutes past the hour. in 34 minutes from now top of the hour might get fireworks inside this hearing. big hearing, too. house judiciary committee will sit down and a.g. garland in the hot seat. on the docket the hunter biden investigation and more coming

about oversight, bill, of the department of justice we expect much to focus on one subject. that subject is the president's son, hunter biden. republicans believe there is a dual system of justice and the first son received -- he was indicted late last week on federal gun charges. he will distance himself from the investigation to show d.o.j. is not playing favorites. singling out individual career public servants who are just doing their jobs is dangerous particularly at a time of increased threats to the safety of public servants and their families. we won't be intimidated and do our jobs free from outside interference and not back down from defending our democracy. garland appointed david weiss in august to oversee the hunter biden probe. he was already looking into the probe as u.s. attorney in delaware. garland will likely deflect questions on hunter and say they need to ask the questions of

david weiss. to be fair to members, they have asked weiss questions in letter form and received written responses, they want to speak to him in person. garland has said weiss was able to talk when he wanted to and d.o.j. has made weiss available to testify but bill the big question is will david weiss testify and when and will he use his special counsel status as a shield to delay? but i expect hunter biden will be a big topic. the overall dual system of justice that republicans feel they're seeing right now at the d.o.j. >> bill: jim jordan will gavel it to order at 10:00. he is usually on time. we'll take it when it begins. thank you, david spunt, on capitol hill. >> dana: crews have begun recovering debris from an f-35 jet. the incident raising questions how the marine corps lost track of its most expensive aircraft. john kirby is here.

good to have you here. what specifically have leadership at d.o.d. said about finding this plane? by when do they want to know? will we get to know what happened? >> you absolutely will. the pentagon will have mishap like this they'll investigate it. not only what caused the aircraft to crash, could be mechanical, we don't know. but also they will look at the search and recovery operations to see if there is something they could have done differently or better. comprehensive investigation. i talked to my counterparts at the defense department as recently as yesterday afternoon. they still don't have all the answers to these questions but they are going to pursue this very aggressively. you saw the marine corps did a two-day stand down. exact right thing to do since you don't know what happened to bring the aircraft down, you want to take a couple of days and review safety procedures and make sure that nothing like that can happen in the imminent future. >> bill: a few more things to get to.

a button on this. it flew for 60 miles and the pilot ejected. as opposed to the air force or navy the u.s. marines jets have an auto eject function for the seat of the pilot sitting in there. how likely that that mal functioned and shot that pilot out of the plane? >> they'll look at everything. i am not qualified in aviation mechanics but they'll look at everything that could have happened and want to talk to the pilot. thank goodness he is in stable condition and they will be able to interview him and get his perspective on what happened. >> dana: what about the fact we had this week you are here for the u.n. general assembly and glad you are here. new yorkers aren't glad everybody is here at the same time. the iranians came on a sanctioned plane, sanctioned people. they come here and they get the swap with the hostages, the $6

billion in humanitarian aid and yet then from the podium attacking americans. why do we allow that to happen? >> that's all in the structure of the united nations. lavrov was here from russia. we have significant issues with him and his government. we preserve the sankty tie of the united nations and because we believe in the united nations and you heard the president talk about this as a forum to solve these problems, you can't say you believe in that and you can't say you believe in it as a venue and block other diplomats from coming even those you have significant issues with. >> bill: he stood there and accused us of stoking the war in ukraine and the israeli ambassador got up and protested and he was the one who was apprehended. this is all within days of them getting the $6 billion.

a lot of americans watching this are like what are we thinking? >> look, it's not as if -- first of all, nothing that he said yesterday should have been a surprise to anybody. that is what the u.n. is for for these leaders to be able to get up and talk about the interests of their nations. it is also not like he swayed any real minds there. it's not as those iran somehow put points on the board yesterday with respect to their beef with the united states or with any other country. most of the rest of the world knows what iran is up to and iran is one of the most isolated most heavily sanctioned countries in the world. i just find it not credible that he was able to move any minds or change. >> dana: at home he gets to say i came to america and gave the big speech and trashed the president in front of him. i got in, i got $6 billion and our people back. is there some point we could

have tougher? >> he got two back and there were sanctions issued on monday with respect to wrongful detentions and additional sanctions on friday. >> dana: are any of these sanctions working anywhere? >> yes, they are. their economy is tough. >> dana: innocent people there still continue to suffer under them and we're watching them create a nuclear weapon. >> why the humanitarian money is so important. we don't have a beef with the iranian people. the regime will not get their hands on any of those funds. it will go to vendors we select to get that stuff. the agricultural products and food and medicine to the iranian people. we don't have a beef with them. >> that's not what the iranian president said. >> he is just wrong. >> bill: jacque heinrich when president biden meets with president zelensky he will not receive the long-range missiles.

attack themselves. 190 miles they can travel. seems like they would be absolutely lethal on behalf of ukraine in fighting the war with russia. why won't they happen? >> the president has said this. we're still in discussions about them. they have not been taken off the table. i won't get ahead of the president at the meeting tomorrow. i can assure you have we have to provide assistant to ukraine. weapons and capabilities to defend themselves. >> dana: why not give them something that moves the needle? it's like we provide them with enough to keep them in the fight but not enough to win. what we're doing is helping them and it feels like they are losing slowly and you are at a critical moment where you need members of congress to come forward and say yes we'll do this funding. and you also have a morale problem with the ukrainians. not them personally.

they want and believe that they are going to win but they are worried the rest of the world is not there to help them especially us. >> the western world is very much there to help them. more than 50 countries gathered in germany this week, the ukraine defense contact group to contribute more security assistance. not just coming from the u.s. we're leading it. i just have to beg to differ a little bit we aren't giving them what they need to win. they are succeeding. president zelensky has even said so himself as recently as yesterday. in the southern line of advance they are making progress. they are moving forward. they are moving forward because of the training and the tools that we have given them not just us but our allies. >> dana: but they're not as far as you thought they should be at this point. >> they aren't as far as they thought they should be. russians have entrenched. >> dana: why not help them more? >> you will hear more when president zelensky comes.
