here, that picture, that's your statement in life? you've got big problems. go solve them on your own time because we need serious people in the united states senate who dress properly who are solving our problems and it's not getting done with a clown show like this going on. >> john: it's interesting even the "washington post" in an editorial came out against the change. we'll see if it lasts or if it doesn't. charlie, great to see you. thank you. >> great to see you. >> not just a robbery, but a horrific assault that changed his life and our family forever. >> john: a family coming to terms with a brutal attack, a delaware business owner pistol whipped and then bashed in the head with a hammer. it was all caught on camera. >> sandra: the victim's injuries are so severe, even one year later he is still undergoing rehabilitation. >> john: the jury in the case
11:01 am
failed to reach a verdict, and now the question is why. "america reports" starts hour two right now. john roberts in washington. that hour went by quickly, sandra. >> sandra: a lot of news and continues. trial ended in a hung jury, even though there is video of the minutes' long attack. bryan is on the story for us, here now. what more are we learning about the suspect? >> sandra, we did a little digging and the suspect in this horrific case, calvin ushery, has a long rap sheet, everything from disorderly conduct to multiple felonies, including carjacking, kidnapping and robbery. this time around, he was charged with six felonies and faced up to 107 years in prison, but the jury could not agree to convict him on any of the charges despite surveillance video showing what is him attacking the owner of a jewelry store. a warning, the video we are about to show is very graphic.
11:02 am
the store owner, 68 years old, is grabbed and pistol whipped three times. su is then kicked and stomped in the head over the course of the next 25 minutes as the store is robbed. investigators used the surveillance video to match the bike seen at the robbery with ushery's, and the distinct walk with video of him at local pawn shops. ushery was caught selling more than 200 pieces of the store's stolen jewelry. some think the jury needed more evidence because he covered his face. >> you could not make a direct connection to him being there at the location and committing the crime. >> attack left su bloody and dazed. his family says he was in a coma three days, suffered permanent brain damage and a year later is still suffering from ptsd and
11:03 am
still cannot drive. critics, sandra, say the surveillance video should have been enough to convict him. prosecutors say they are going to retry the case. >> sandra: thank you very much, bryan. >> john: you'll want to see this. following a story blowing up on the internet right now, and it has to do with accusations of media bias at one of the biggest newspapers in the world. barstool sports founder got word a washington post food reporter was planning to write an article on an upcoming event he's throwing called pizza fest. but the tipoff he got is the article was shaping up to be more of a hit piece. he had not gotten a call himself from the "washington post" reporter, so he reached out to her and recorded the conversation. here is a snippet of it. >> we have this pizza fest happening on saturday and you are reaching out to our advertisers and you are basically sending an email that says to the effect dave's a
11:04 am
racist, you want to defend yourself. i totally disagree with the assertions of what you said, and all that stuff, so like it kind of backs people into a corner. >> it's sort of a reporting tactic when you said someone to respond, you have to indicate there might be something negative and then you get them to engage. that's all i was trying to do. i really wanted them to engage with them. >> that is a sad state of journalism if that's a tactic that you have to -- what i would say is make up something about somebody. >> john: so hold that thought for a moment, jump to the white house briefing. karine jean-pierre answering a question about the illegal immigration, the massive surge that we are seeing on the southern border. >> in congress to do everything that we can to deal with this issue and let's not forget what the republicans proposed. their continuing resolution would lead 800 cbp agents and officers being fired and rules are in 50,000 pounds of cocaine, 300 pounds of fentanyl, 700
11:05 am
pounds of heroin and 6,000 pounds of other drugs to enter the country. that is what they propose a day ago. and that's what that would do to the border. it would hurt and harm and not deal with the issue. so, they are doing the opposite of what the president is trying to do is actually move forward in a way that is humane, safe and has an orderly enforcement pathway process here. >> thanks, karine. so, what do you call it here at the white house when 10,000 people illegally cross the border in a single day? >> what do you call it, peter, when gop puts forth -- wait, no, no, no, no, no, no, no, ok, we are going to move on. no, no, no, no, we are moving on. in the back. >> you said you were -- >> i tried to answer, peter, i tried to answer the question, you stopped me. >> footage of border patrol cutting some of the razor wire
11:06 am
that texas had installed. governor abbott has vowed to reinstall it, they have -- his border czar has pictures of people taking fresh razor wire to reinstall it. is there a federal policy of removing the barriers that texas is installing? >> so here is -- here is what i'll say. i would have to look into that. i did see those reports yesterday but as it relates to governor abbott, we know what he has done this past -- these past couple of years while this president has been in office. he's turned this, when it comes to the border, he's turned it into a political stunt and what he's done over and over again. that's what i can speak to. i would have to get a sense from the team and answer on that. >> enormous amount of concern, the mayor of eagle pass tells us at least 5,000 people crossed probably yesterday or in the last two days, maybe a lot more. you've already talked a little bit, but what resources specific to this surge are being --
11:07 am
>> i just laid out three additional announcements that we did to deal with -- to deal with the border that we announced yesterday. announced tps, venezuela announcement as well yesterday. and so this is a president again that has taken action without the help of republicans in congress. he has taken action over and over again to deal with this issue. let's not forget, you know this very well, having as you're covering that region this is an issue that's been around for decades. this is a broken immigration system. why the president on his first day put forth a comprehensive piece of legislation to try to deal with this immigration system. we put more -- we have put cbp, 24, 25,000 cbp agents out there, try to make sure we deal with the smuggling that's happening. we have tried to make sure we continue to deal with this in a humane orderly way and that's what we are going to continue to promise to do. we announced three more
11:08 am
additional enforcement pathways or ways to move forward, the president will continue to do what he can from this administration. >> thanks, karine. stay with the border. how many people coming into this country illegally is enough for president biden then? >> say that last one. >> how many people illegally coming into the united states is enough for president biden administration? >> enough for what? >> 5.9 million people have been encountered illegally. >> enough for what? >> to stop the flow. >> as i mentioned, a problem around for decades, a broken system. the president has done everything and is going to continue to do what he can without the help of some republicans in congress to deal with this issue. and i just laid out what he has done over the past two years, right. 24,000 cbp agents and officers along the southwest border,
11:09 am
more, historic number, more than any other president has been able to do, and that's 2600 additional civilian personnel, those are going to be helpful in dealing with the issue, increase border holding capacity to 22,700, and so we are going to deal, trying to deal with the smuggling issues we are seeing as well on the border. so the president will do the work. he made announcement as well yesterday as i just mentioned. look, we are going to continue to implement a strategy that is humane, safe and orderly as it relates to enforcement. that's a promise you can see from this president. again, gop, the republicans, put up a continued resolution that actually reverses the work that the president is trying to do. makes the situation worse, that's what they were trying to push. and so look, we would love to do it in a bipartisan way, and really fix this issue that's been around for some time now,
11:10 am
but right now the president is doing it on his own. >> did you see the president try and get directly involved in trying to avert this possible government shutdown and will he be speaking with speaker kevin mccarthy and if so, what's his message? >> so the president talks often to members of congress, that is something he does pretty regularly, that is, and something he will continue to do. i don't have any conversations to lay out, but i said this moments ago, right. which is the president and the speaker came to a deal in may, this is not for us to fix, this is for house republicans to fix. the extreme house republicans, this is on them. there is a deal, a deal is a deal that they voted on in a bipartisan way. it is up to them to fix this. the message is very clear. what he says in private is certainly what he says in private is the same as what he says publicly, which is there is no reason for republicans to shut down the government. house republicans should stop their partisan games and keep their promises and also do their jobs.
11:11 am
that's the message the president is sending. >> john: so we are going to jump out here after karine jean-pierre just went to the big book of talking points on the border and did not directly answer the questions, particularly from peter doocy, she decided that she didn't like the fact he was trying to steer her back off of her talking points to the question that he asked, sandra, so she passed him over and moved on. >> sandra: our team will alert us when they get back to the border, that is the issue of the hour of the day of the year right now, and this administration has to answer for what is happening there. 10,000 in a day, john, and she didn't answer the question from peter doocy. what she did say, she said the president has worked very, very hard to implement a strategy when it comes to the border that is humane, safe and has orderly enforcement. that is something that we have tried to do and worked really hard to do the last two years. we'll let everybody at home decide as they look at the
11:12 am
pictures whether or not they think that the work he's done is working at the border. she was also, john, asked if the venezuelan tps, temporary protected status announcement, could exacerbate migrant numbers in eagle pass, texas. she did not appear to directly answer the question. difficult to do so when you see these images, john. >> john: yeah, decide for yourself as you are watching this as sandra said. is this humane, safe, and orderly. let's bring in brian kilmeade, "fox & friends" co-host and one nation host, karine jean-pierre saying to peter doocy you don't like me deflecting, ok, i'll talk to the next person in line. >> no one is more experienced in that room than you, but as a viewer and a watcher and someone cares about the country, not one word of her -- that she said was correct. there is no blame that belongs with anyone except this administration. they loosened all the rules, they got rid of title 42, they are flying people from other
11:13 am
countries into the middle of other states without informing the mayors or governors. they filled up new york city with 84,000 illegal immigrants, they refused to provide money or resources or information to a democratic mayor and governor. they are the ones who have no interest, including a vice president that was supposed to be in charge, lip service, most worthless series of sentences i could imagine hearing. >> hold on, there is more. >> president has taken action upon action to try and deal with what is happening at the border. historic action without the help of congress. and so we have asked over and over again to do this in a bipartisan way, which is why the president, his first piece of legislation was to deal with the immigration system. and he -- understanding how critical that is, it was to do that. and so we have taken actions, we have taken multiple actions but again, this happens, ebb and
11:14 am
flows, that's what we see at the border for different trends, different reasons, and so i think we think three important enforcement announcement yesterday is on top of what we have been able to do, and you know -- and then you see and you see it for yourself what congress has tried to do, put forth a piece of legislation, a cr resolution that does the opposite of what we are trying to do. we are trying to fight fentanyl, trying to deal with smugglers, trying to put more legal enforcement at the border. they are trying to reverse that and so that is the reality that we are dealing with. and so the president is going to continue to be committed, make sure we do this in a humane way, make sure we do this in a safe and orderly fashion. and that's the commitment that the president has to the american people. >> a lot of focus in here about what's happening at the border and what the white house can do and congress can solve that
11:15 am
problem. one thing the white house can do is foreign policy. who is talking to venezuela why these people are still coming? who is talking to panama about the gap and allowing them to come in. and whatever happened to the state department and spain and canada centers that were going to be set up along route to make sure the people would have p options. >> diplomatic conversations are important. conversations blinken is having, secretary of state is having, the president, let's not forget just last fall brought 21, 22 countries together to talk about how migration is affecting the region, and remember, they signed a declaration. look, these diplomatic conversations will continue. it is not an easy issue to deal with. right? but they are going to continue. the point that i'm making, the point that i think you all have, some of you have reported on,
11:16 am
this is a president that has taken historic action on an issue, on a system that has been broken for some time. and we have been very clear. we would like to do this in a bipartisan way, we would like to do it with the help of republicans, but right now we are doing it in the best way that we can, taking diplomatic actions you just laid out, right, having those conversations, seeing how we can work with this issue, because it's a regional issue. it's a west hemisphere issue, right. and so we are going to continue to do that, and also make announcements like we did yesterday to deal with what's going on at the border. take one more question -- >> thanks, karine. the president is expected to announce a new office for gun violence prevention to coordinate the administration's efforts. obviously has been a proposal on the table for years from advocates, and this white house has always maintained that this falls under the domestic policy council. i'm wondering if you could tell us why the white house has
11:17 am
agreed to accept this proposal now -- >> john: so karine jean-pierre there again, sandra, saying that the president is dealing with this in the best way that he can but when you look at the situation on the border, that's the best way that this can be dealt with, perhaps another way is necessary. >> sandra: and what we have heard time and time again from this administration, including karine jean-pierre, is that the president's working hard, he believes what he is doing is working, we have heard from them, so what exactly are they using to gauge those results that they are touting, and if he's working so hard at the border, why are we seeing these images? john, that's an important question. the but to go back to peter doocy's attempt to question here, she clearly seemed to change her minds on taking the question once it was put to her. >> john: that's because he was trying to knock her off her talking points and she didn't want to be toppled off the three-legged chair. brian kilmeade again, "fox & friends" co-host and one nation co-host, said the president is
11:18 am
taking historic action. it's historic, all right. there is going to probably be historic 2.4 million people who cross the border illegally in the last 12 months. 230,000 in august and tying a record set back in may, historic 10,000 plus people across the border yesterday. brian. >> when you were covering the trump white house used to get questions because he was too tough on the border. put tariffs on mexico, how dare you do that, he pulled back aid to guatemala, el salvador, and until you get control of the borders, and aoc crying fake tears at a fake fence, and you have the president totally ignoring the border, and put me in a tough spot. i have to 0 in on what's the bigger disaster, the way he decided to leave afghanistan and ignore from there, or the way he's treating the border. this is not close to stopping.
11:19 am
we saw 10,000 yesterday in just one area. we are seeing people under the bridge, remind us a year and a half ago with haiti, and now you have mexico who is basically providing the trains for illegals to go right through the country. previous administration said mexico if you don't knock it off you are getting tariffs, and put 20,000 on the border. they lost track of 84,000 children, so for you to say i'm working hard and republicans i have a plan that no one has seen, the republicans did not pick up and sign into legislation, and that is enough. i hope people at home aren't buying that. >> john: karine jean-pierre said you know, ebb and flow along the border, it's true. sometimes 6,000 cross, sometimes 10,000 people cross in a day. that's the ebb and flow we are at right now. the dave portnoy issue, barstool sports is sponsoring one bite pizza fest, and the food writer for the "washington post" contacted some of the sponsors
11:20 am
of that event with a very pointed inquiry, suggesting that dave portnoy had a record of being misogynistic and racist and did they want to be involved in this event. she -- he called her up and said hi, it's dave, i hear you are talking or at least writing about my pizza fest, and she denied she had sent that email to of the sponsors, so how he responded to her. >> planning to write about the festival and how some of the sponsors and participants have drawn criticism by seeming to associate themselves with dave portnoy, a history of comments and other problematic behavior. >> he called her out and then she said well, that's a tactic, we hit these people that we want to interview with the negative so that they'll engage with us. >> it's unbelievable and i think you have a lesson.
11:21 am
they want to make dave portnoy radioactive and he's anything but, people know different. he's not a perfect man but a great successful entrepreneur. the phone call goes on for 12 minutes and promised to get back in touch with him 10:00 today and canceled, he is expecting 5,000 people out at his one bite festival, i believe it's in coney island and they are trying to intimidate sponsors. where have you heard that before, how about everywhere, to not supporting him and hurting his business. if that's your job to destroy people instead of reporting on something and seeing maybe why sponsors are so important to, to be part of the edgey company barstool -- so much credit for
11:22 am
going the offense when other businesses would knuckle under, and he called the "washington post" when he thinks it is and i would love to see his show, a left wing operation out to crush a guy that's not even right wing. >> john: he was respectful enough as we can see there, blur out the phone number of the washington post reporter. he's posted that on x, it's definitely as you suggest worth listening to. brian, as always, good to see you. thank you for hanging with us through the roller coaster. appreciate it. >> sandra: thank you so much. back to the border, john. these live images continue to come in, seems they are all getting up. we can't tell you exactly what's happening, we don't have a microphone on them, but this eagle pass, texas, they declared an emergency there because of the influx of migrants. they continue to pour over the border, cbp says they encountered 10,000 migrants at the border just yesterday. and brings us back to all time
11:23 am
record highs just before the end of the title, the lifting of title 42. john, this is unbelievable. and to bring it back to that context that melugin brought us earlier, the new york city mayor singing the blues over the crisis here saying he can't handle 10,000 migrants per month in this city, the border just had 10,000 in a day. and we just saw the live pictures a second ago, you can see in the back top right corner that the wire that they have been climbing through all day, so the barriers that have been put up to try to stop this is not stemming it. >> john: and the fact that the president extended temporary protected status to nearly 500,000 people in the last 24 hours is being seen as a humanitarian move, at least that's the way the white house is describing it. and they are denying that the idea that it could be a pull factor for people who want to come to this country illegally. if you take people in this
11:24 am
country illegally and you are extending the temporary protected status, what signal is that sending to the tens of thousands if not millions of people in this hemisphere and elsewhere around the world that if you make the effort to get to the united states, there is a really good chance that you'll get to stay, and that's what bill melugin talks about. he talks to these folks. they say the border is open, abierto, they will tell him and they mreef they are going to get to stay in the country. the message sent out from the dhs secretary, alejandro mayorkas that the border is closed, the message that kamala harris sends out the border is closed, message the press secretary sends out, the same, message the president sends out, that the border is closed is not being heard or taken seriously by these migrants because they see the pictures. don't listen to debbie wasserman
11:25 am
schultz. what you are seeing on the screen is in fact what's happening and they say we'll make it across the rio grande, get into the country, and a really good chance we'll get to stay. so, why wouldn't you try? >> sandra: and the latest extension temporary protected status 18 months, applies to nationals in the country on or before the country july 31st. venezuela was last extended but not designated for tps, not open to new applicants. this redesignation will open it up to new applicants and officials are telling fox they estimate it will protect nearly 500,000 foreign nationals. and just a reminder that this designation, john, is typically based on conditions in the designated country, and is based on three grounds. armed, ongoing conflict, environmental disasters, or extraordinary and temporary conditions, john. >> john: and now you've got
11:26 am
officials in new york state wanting to expedite work permits for the tens of thousands of illegal migrants there who are weighing down new york city to the point where eric adams, the mayor said the other day, that it may have the net effect of destroying the big apple as we know it. so you've got people in the hemisphere, or even people in subsaharan africa, a lot of migrants come from there, looking at this and saying they are giving these folks work permits now, so we are not going to be sitting around in a hotel to figure out what to do with ourselves, we'll be able to get jobs. if you are a person in an economically disadvantaged country and looking for a better life in america and don't want to do it the legal way, when you see what's happening in the blue states and the blue cities that have declared themselves to be sanctuaries, for illegal migrants and then said oh, wait a minute, we are dying under the weight of this, so we have to do something, let's give them legal
11:27 am
status, why wouldn't you attempt to come to the u.s., and you have an organized pipeline to pay money to to get you there. >> sandra: the question also put to karine jean-pierre by edward lawrence in the briefing room, how many is enough, she did not go near it or answer that question, and very similar to a question that a resident of chicago asked in a community event this week and it was very telling of the situation, the crisis that's growing city by city, chicago, new york, all the cities dealing with this that are not border cities. i want to know if there is a capacity limit, this resident asked, and what is that limit if there is one? and why can't we close the borders of chicago or the state of illinois. can't close -- if we can't close the border. you have residents asking this question all over the united states right now and john, i
11:28 am
want to get this story in here, the migrant crisis as we have been reporting, exploding in new york and also chicago, there is a huge story that is breaking there right now, and that is that quietly the city of chicago, through new progressive mayor, brandon johnson, he has just reportedly signed a $30 million contract with a security firm for "winterized base camps for migrants" in chicago, essentially tent cities, the cost of $29 million for taxpayers, the press secretary is telling chicago sun times the contract mentions no specific sites for the camps and none have been chosen yet. the issue is dividing chicago, we are told, especially the black community with protests that are breaking out as migrants have moved into abandoned school buildings and some neighborhoods there. l this is a huge story. the firm they hired is guarder world, they say it's going to
11:29 am
include six locations, john. i mean, you think about it -- just looking through, they are saying it's going to be zoned to hold between 200 to 1400 asylum seekers. include bedding, laundry, showers, three meals a day and security. and you think about the problems that city has aside from this, crime spiking, you know, carjackings, john, the economy struggling because so many have left the city. >> wages, ways. ultra cheap labor that is going to bring down wages for americans who are holding jobs. >> john: and again -- >> larry: we have already seen it. the wage, i don't mean to cut in. republican debate in a week or so. this has to be an issue because what biden is doing, among all other things you are covering, coverage is fabulous, there is a wage impact. americans who have these marginal jobs but need them,
11:30 am
right, families are underwater because high inflation and high oil prices, wages are going down because of the ultra cheap labor. >> john: and now again, larry, you see new york state and new york city wanting to expedite work permits for the tens of thousands of illegal migrants there, and right now there is an illegal economy that's growing up around that. you inject those folks into the legal economy and what's that going to do to wages and the potential for people. >> larry: 100% right, john. >> sandra: larry, let's stay on this, live pictures out of eagle pass. and talking about chicago having to deal with it with tent cities, they're numbers pale in comparison to what the border is experiencing, 13,000 have arrived in the city since august 2022 we are told. expected to cost taxpayers 302 million by the end of the year. we were just chatting, that sounds low. >> larry: way low. >> sandra: you talk about the economic impact of dealing with
11:31 am
the surge city by city, and hard to even estimate. >> larry: by the way, for whatever it's worth, polling shows immigration comes in first as the economy, and inflation, second is safety and crime, and third is immigration. but immigration is about equal to safety and crime. and so that tells you how important political side of this is, and look, the bidens want, the bidens want open borders. they will do anything to generate open borders without thinking through any of the consequences, you know, the safety consequences, we are talking about the economic wage consequences, they have never thought through this. they just see this in terms of human rights and a point that john made earlier so crucial, you got a lot of people, a growing number of people coming in, they are not from venezuela, they are not necessarily from central america, they are from all over the world. people coming in from russia, people coming in from china,
11:32 am
people coming in from africa, and make no effort, dhs, mayorkas is making no effort to track them whatsoever. these permits whatever they run out, nonsense. you'll never see them again. >> sandra: mayor adams said not only getting asylum seekers from venezuela, to your point, but west africa, russian-speaking areas, south and central america. governor hochul doing an about face, unbelievable, we welcome them with open arms, remember her messaging, we are a sanctuary city and state, we don't have capacity she is saying, so we have to message we are at our limit. she apparently has a limit. the white house, maybe you were en route. karine jean-pierre was just asked by edward lawrence. what's too many? >> larry: there's no limit. 10 million, 15 million. by the way, for what it's worth, a story on the fox digital
11:33 am
website, brooks singman, a great reporter, trump is in iowa saying he will engage in the largest deportation ever in american history, and he's citing laws that eisenhower used in the 1950s to deport people. in other words, in terms of the upcoming debate, i'll go back to that fox business is running in simi valley at the reagan library, these candidates must come out and talk about this. what exactly will they do. specifically, what will they do, and there has to be a major deportation aspect to any policy. may not be easy, because it's going to be hard to find a lot of these folks, they are scattered throughout the four winds around the country, but nonetheless, they have to have a policy to contrast with mr. joe biden. very important. >> sandra: this is hillary vaughn from fbn. >> larry: another great reporter. >> sandra: we were told the screen right a second ago, we
11:34 am
have kinds of lost that shot, those were migrants that had just crossed through the wire. and as you saw, those were large and growing numbers of migrants. this was hillary vaughn on the hill pressing house democrats about this issue. listen to this. >> can i ask, is the border out of control? >> what is -- our immigration system is broken. >> we need republicans to stop talking about open borders. >> when you see the cbp officers releasing migrants en mas on the street, do you think that sends a message to people the border is open? >> the border is not open. >> when you see is different than what happens in actuality. >> sandra: whoa, ok. cue the live pictures. what you see is different than what happens in actuality, larry. whoa, whoa, whoa, the border is not open said max frost. >> larry: who do you trust,
11:35 am
politicians or your own eyes. that's the issue. who are you going to trust? >> sandra: what is it going to happen here, what's going to give? >> larry: unmitigated catastrophe. ever since title 42 expired, and the biden administration chose not to put anything in its place, they have just reopened the border, and they have done it with gusto and all their statements -- look, what are work permits? work permits equal open borders, work permits equal asylum, work permits equal amnesty. this is a massive amnesty program and want to do it for many years. another political point, some people say the democrats are doing this because they want to get these people to register to vote and going to vote democratic. i just want to say, we don't know that. we don't know that. because the history of immigration coming into the united states, and the last 20
11:36 am
years, the last 40 years, is that they, many of them will vote republican because they want law and order and they don't want open borders and they do want jobs. so i don't buy that, you know, i don't buy that argument at all. this is -- this is -- the biden -- consumed by the human rights argument and all of their foreign policy, human rights is the first thing. and human rights in iran, human rights everywhere. the this is human rights story, that's what they are saying and it is not a human rights story. it is a border story, a sovereignty story and economic story and trafficking stories and the bidens are in complete denial about this and virtually the entire democratic party are in complete denial. >> sandra: they are waking up to it, legacy media is covering it more and more. this is greg cesar, a member of congress spoke to hillary vaughn, said republicans refuse to actually fix the system.
11:37 am
it's their fault. part of why we are stuck here today. >> larry: what does that mean, what is he referring to? >> sandra: and she talked to another democrat, saying there are security challenges at the border. is that an admission or an under estimation, i'm not sure. "new york post" cover, anarchy, we are sitting in this city, 4,000 illegal migrants cross the border in one day, noting the unlawful economy, they say is exploding in new york city, this gig economy, working, not paying taxes. >> larry: underground cash economy. underground cash economy. eric adams woke up late, ok, i'll give him credit, but -- but, but, but, all these big city mayors should call for border control. top the open border. that is the ultimate, ultimate solution here. they are going to be faced with a financial crisis, no question
11:38 am
about it. here in new york we see it. but he's got to say close the border. that's the key point. until you say close the border, you have not changed the policy. >> sandra: there you go. larry, thank you very much. and by the way, you talked a lot about the debate that is coming up, i know you'll be hosting the hour that leads into it. >> larry: yes, ma'am. >> sandra: a huge night where you can be sure this will be a big discussion on that stage. >> larry: i hope so, everybody has a position, with clarity. >> john: a big issue in the debate, in contrast to the majority of the american media. which has tended to ignore this so far. by the way, we are going to get congressman tony gonzalez, whose direct includes what you are seeing there, a huge district from el paso in the west to southeast of eagle pass. we'll catch up with him in a second. until then, bill melugin has done a little relocation here and joins us now from a little
11:39 am
bit of a different perspective on the border there, and bill, we see these folks being processed by i guess dps and the border patrol. what's the situation like on the ground now? >> bill: yeah, john, this big mass of migrants is ten yards away to my left-hand side. border patrol moved our first live shot location because they said we were in the way, they moved us up here and now all the migrants are walking through, we are in the way again apparently. this is the group that just crawled under the wire a short time ago. now waiting to go underneath the bridge and out of the texas heat and be processed by border patrol. you saw they had a texas dps escort here, the interesting juxtaposition of texas and border patrol working with each other but some friction at times because you can tell border patrol is frustrated with the razor wire that's deployed all over the place, their job is to apprehend and process these people as fast as possible. the state of texas says we don't want people coming in, we are
11:40 am
not going to let them in, so we are going to place the wire. so their jobs go against each other a little bit and you see the result of that at some points. and this long line of people here, under the bridge, border patrol will line them up, calling in the border patrol busses, they'll get shipped off to processing centers, and like i most of them will probably be released on their own rec recognizance, and they will be mass released into the community, and they are going to go all around the country, likely to you in r new york, d.c., chicago, and four areas i would say we hear they plan on going to are new york, chicago, miami, and los angeles. although mostly cubans who tell us they are going to miami. but i was listening in or watching in on the white house press conference earlier and heard our colleague, peter doocy asking karine jean-pierre what do you guys call 10,000 migrant encounters in a single day at
11:41 am
the southern border and she essentially cut him off and would not answer and moved on to another question. it's an important question because remember, just three weeks ago in late august karine jean-pierre was up there at that white house podium saying that they were "stopping the flow" here at our southern border. i mean, i'll let our viewers decide. does this look like stopping the flow, the images the last few days here, eagle pass has been completely overrun, they had 2,500 people cross in one group early monday morning. you saw what happened yesterday out here, the massive single group of about 3,000. activity is nonstop all day long out here. eagle pass is a small community. population of 30,000. the mayor is a democrat. he's declared a state of emergency because of what's going on out here and he's directly appealing to the white house. he says either president biden or kamala harris, somebody has to put a statement out saying that there is law and order here at the border and that there will be consequences for crossing the border illegally. guys, i was on a background call
11:42 am
with dhs officials last night as they were announcing this new tps extension for venezuelans, and on the call, officials acknowledged there is a surge in the border numbers but attributed it to economic fallout to covid, to climate change and authoritarian regimes. guys, in the more than two years i've been doing thshgs the amount of migrants that have told me climate change is a reason they are coming here would be 0. 0. everybody tells us they are here for work, to link up with family in the united states or yes, some fleeing horrible regimes all over the world who do intend to seek asylum. nobody has talked to us about climate change. they want to work, they want to meet family here or they are fleeing from a bad government. and you guys see the result right here. this has been going on all morning long, you've been watching the drone shots. >> john: seem to be just as hot on the texas border as in venezuela, bill. so, if they are trying to get away from climate change, they are going to the wrong place, at
11:43 am
least initially. you mentioned the white house briefing. karine jean-pierre insisted the president has taken historic action since he took office january 20, 2021, to address the border crisis. you've been covering the border crisis pretty much since the day he took office. how have things changed there on the border in the midst of this "historic action?" >> bill: the biggest thing the white house did, they thought was going to solve the crisis was the cbp1 app and mass parole in the country. about 1500 people per month, they were going to give them appointments on the cbp1 app, tell them to show up to a port of entry and then paroled into the united states, excuse me, i think 1500 a month, it's 1500 a day. so 30 to 40,000 people per month show up to ports of entry and get paroled into the country. idea being we are going to cut
11:44 am
out the muslim smugglers, don't want people crossing in the river, don't want the images of crossing at the river, have them at the ports of entry and get them in. the problem is, the migrants are not happy with the cbp1 app, say it takes forever to make an appointment, the app crashes on them, they don't want to use it. why wait for that when you can cross the river and get entered into the community. lawful pathways after the end of title 42, remember, mass paroling cubans, haitians, venezuelans, they thought it was going to push the numbers down a little while and it did a little bit, but now most are venezuelans. bottom line is the migrants don't have a fear of consequence for crossing the border illegally. they believe if they get here they are going to get released into the country and i sound like a broken record saying that all the time but it's true. we talk to these migrants, they
11:45 am
don't fear removal and they smile and they wave and they say the border is open, and i mean, i've made notes on what karine jean-pierre has said at that podium before, she has falsely stated that "reduced illegal immigration by 90%" she said "nobody is walking across the river," also false. and said "they are stopping the flow," false. and she said president biden has done more than anybody to secure the border. the viewers can decide the answer, but the numbers have never been higher. border patrol agent morale is never lower, and with the new tps announcement for venezuelans, expect the numbers to go higher. they expect they are going to want to surge to the border if well, if i can get into the united states they are going to redesignate and extend tps next year and it will backfill for the people in the country now. so, it's just a mess, guys. and little border communities like this, eagle pass, have to
11:46 am
deal with the brunt of it. two years ago it was del rio. the bottom line, why it's more national attention, the migrants don't stay here, they are going to sanctuary cities and the cities and states have said there is receipts, you know, they put out tweets years ago saying we welcome everybody, we are happy to be a sanctuary city, kathy hochul is one of them. now saying on cnn last night, don't come here. we are full. >> sandra: that was before they started showing up at their doorstep. before they showed up and now they are saying they just can't handle these numbers. bill, to add to what you just said we have heard time and time again there this administration, and through karine jean-pierre, the press secretary, a few moments ago we played it out live here, she said this president has taken action upon action. she followed up with by calling it historic action on the border. she then blamed any of the problems at the border on
11:47 am
republicans. she said, talking about their efforts to stop fentanyl and smugglers from coming over the border. she said republicans are trying to reverse the actions this white house has taken. in fact, hillary vaughn spoke to more democrats on the hill, one telling her republicans refused to actually fix the system, that's why we are -- we are here today. eric swalwell, another democrat, saying merely calling these security challenges at the border, but bill, to go back as we look at these live pictures to that frustration you are hearing on the ground, when those who are living through this see this blame game that is happening in washington and all over the country. >> bill: and the bottom line, what border patrol agents tell us, title 8 is already u.s. law, what existed before title 42. that allows them to deport people and remove from the country and all the agents are
11:48 am
saying let us enforce the law that is on the books already. that's all we need. we don't need new crazy law, it's already on the books, let us do what we know works. let us impose consequences, but the biden administration is so hesitant to have images of overcrowding, they have really moved towards a policy of mass catch and release and we have seen that for the last two and a half years now. the border patrol union tweeted out earlier today in the last three weeks alone, more than 100,000 migrants have been released into the united states. that's a massive number, guys. 100,000 releases in three weeks. and it's a magnet. people believe if they cross this border, they will be released into the country. back to you. >> john: bill melugin showing us the real deal. as always, thank you so much. joining us on the phone now is the congressman for the 23rd congressional district of the great state of texas, which includes eagle pass, del rio, el paso, the bulk of our
11:49 am
southwestern border in texas. congressman tony gonzalez. we were texting a few minutes ago, you've been watching our coverage. when you look at what's happening there again today after 10,000 people plus came across the border yesterday, what do you say to karine jean-pierre who says this president has taken historic action to address this crisis? >> the problem is, john, thank you for having me, and probably the most pointed response i could tell her is if you continue down this route, you are going to lose -- you are going to lose the election in 2024. the reason i say that is because this administration thinks this crisis is a political problem, not a policy problem. so if they want to go down this route, they are going to lose the white house. in the meantime, i represent these images that we see. the part they don't understand is the city of eagle pass has
11:50 am
received 0 federal dollars from the white house. all these millions of dollars are going to new york city and all these sanctuary cities are getting all this money for a handful of migrants that go there and turn their cities upside down. meanwhile, this little town on the border of texas gets absolutely nothing. it's absolutely wrong. not only are they hurting real people, they are going to lose the election. >> sandra: well, congressman, thank you very much for joining us and jumping on the phone as we continue to look at these pictures. as bill melugin just noted, the mayor of eagle pass where we are watching all the migrants come in, is a democrat. i mean -- you've got democrats in new york, they are crying for help, singing the blues. saying we don't have any more in the city, we can't handle it. governor hochul, democrat, mayor adams, democrat. i mean, you are hearing from more in the democratic party to stop this. will the white house listen?
11:51 am
>> i hope they do. you know, eagle pass, maverick county is some of the bluest part of the district i represent and i'm the only republican that has won that county in 200 plus years, and the way the people that live there, they don't view it through a red or blue lens. they just want people to help and make this stop. it doesn't take a genius to look at the images and go this is wrong. when they pull a baby, a lifeless baby out of the water, how does that not break your heart. you have these folks in the white house think it's a political problem. and tps extension that they did for the venezuelans, all that does is make the problem worse. i've been an advocate, a staunch advocate for legal immigration, for legal pathways, people to come over and work and do it the right way, and administration has been an advocate for illegal immigration and it impacts everybody in a negative way and it's dangerous.
11:52 am
>> john: congressman, when you and i were texting earlier, we had been talking about the economic aspect of this in terms of new york state wanting to expedite work permits for people who were in the city illegally because they can't keep up with providing social services on the taxpayer dime. so they have to let these people, they think, make a living themselves to take some of the burden off of the state and off of the city. but the suggestion from you is that's just going to make the situation worse because people, whether it be in the western hemisphere or the eastern part of africa, or the western part of africa or other parts of sub saharan africa, say oh, the cash register is open, let's go to the united states. >> that's it, john. in what universe do we live in where people that break the law and come over illegally are rewarded and those trying to follow the rules are punished. what is the solution? the solution, think back a few
11:53 am
years ago in dell rio. the solution was you enforce the laws on the books. if people do not qualify for asylum, send them back to the country of origin. until the administration does that, we will only see the crisis become as bad as we have ever seen it. >> sandra: you wonder how governments can regain control and tax the people. writing about the unlawful economy that is exploding in new york city right now, congressman. >> that's exactly right. and what about the border patrol agents? you know, a lot of images are on eagle pass, but right next to that is kinney county and medina county. i was speaking with the judge and one of the sheriffs, randy brown from medina county. they are getting crushed. it's not just this one image here that is very powerful, it's the entire area and you have everyday americans going hey, what about us? we don't feel safe. i did a town hall in el paso which is 800 miles away, i had a
11:54 am
constituent call in and say hey, look, they are releasing people in the street. i'm a veteran, and i work for the police department, i don't feel safe. so i know these images are in texas today, but we are already seeing what's happening in new york. it's california next, it's chicago, it's the small little towns as well. we have to stop this. part stops with the finger pointing. everyone is to blame. but the white house certainly cannot just punt the ball, how do we solve this problem, we do it by increasing the number of border patrol agents and enforcing the laws. if they don't qualify for asylum, send them back. i understand venezuela, we don't have an agreement with them. where is the state department, where is secretary blinken, instead of talking about other issues, he needs to go to venezuela or colombia and work out an agreement, maybe they don't go back to venezuela but maybe to panama or colombia, a third country. this is how you solve real problems, until they take that
11:55 am
level of interest in this, you are only going to see it get worse and they are going to get their butts kicked in the 2024 election. >> john: congressman, you've been watching along with us as we have been following this group of illegal migrants as they crossed the rio grande, they crawled underneath the concertina wire, apprehended by the border patrol and now in an area where they are now being processed. and our intrepid hillary vaughn, who is fantastic at bird dogging democrats on very touchy issues got a quote from debbie wasserman schultz when she asked her about the situation on the border. your colleague from florida said what you see is different than what happens in actuality. what do you make of that? >> i mean, she is partly right. if you are on the ground, you can -- you can -- what you don't see is you don't see the smells, you don't see the frustration on the border patrol agent's faces,
11:56 am
you don't see the direness of the people that are there. it's all sad. i mean, just even looking at the images, you know, small little children running around, having to wade through the water, that's the part that you don't see. so, it's actually worse. i would say she's on to something. it's actually worse than what you see on tv, not that it's the other way, and bill has been covering it, fox has done an amazing job of covering. but when you are on the ground, you cannot unsaw some of the images or the smells, you know. and some of the facilities. >> john: i guess we should put that down as don't believe your lying eyes because they are not giving you the full sensory experience. >> that's it. >> john: all right. >> sandra: all right, congressman, appreciate you jumping on with us. >> john: thanks, appreciate it. >> sandra: lieutenant christopher oliveras joined us at the top of the show from the texas department of public safety, he's back on with us
11:57 am
now. as right before our eyes this is the numbers just continue to grow, lieutenant. you've heard us discussing the number of democrats who say what we are seeing is not reality. what is reported is not real. and these pictures are happening right before our viewers' eyes. your thoughts. >> you know, sandra, it is a clear reality of what's happening on the border and if it wasn't for great reporting from bill melugin and of course from fox and other outlets, other correspondents reporting the facts and the clear reality of the border, the american people would not have an understanding of what's taking place. and when you see before your eyes and what the viewers are seeing is this constant influx of illegal immigrants coming across our border, which is a clear example that we do in fact have an open border. no one can undermine that or say otherwise because when you have thousands that are coming across between the ports of entry, which is -- which i might say is an inhumane process to allow children and women to cross a
11:58 am
river, dangerous river where we already had a body recovered this morning, and yesterday we recovered a 3-year-old that drown in the river. a week before that, recovered a 10-year-old that drown that was crossing with his mother and his mother is in critical condition right now. so when the federal government does not put any type of deterrent measures, does not put consequences to prevent those from entering the river, they are complicit to the fact we continue to see the influx of illegal immigrants coming across and unfortunately it's going to get much worse and right now it's on the burden of texas to try to do as much as we can to try to stop it, and that's what we are doing right now. but of course, we do face challenges, not just the ground level but also the federal government constantly challenges us and what we are trying to do. >> sandra: lieutenant, appreciate you joining us on the breaking news. thank you very much sir and best to you and your efforts there. >> appreciate it. thank you so much. >> john: boy, i mean, i don't know how anybody on either side of the political aisle can take
11:59 am
a look at these pictures and say the things that were being said to hillary vaughn earlier today. it just does not make sense at all. >> sandra: and now some breaking news. >> john: yeah, this is very concerning. we are learning moments ago that a bus carrying a high school band from farmingdale, new york, central long island, overturned in new york state, on the western part of i-84 near middletown, new york. according to state police, reports of one fatality at this point. we do not note extent of any other injuries. but as you can see, that bus came off the road there on i-84 westbound, flipped over and went down a ravine. so you can imagine that a bus jammed with people, instruments and everything else associated with the band project would probably result in some pretty severe injuries. apparently the band was going to an undisclosed location in pennsylvania.
12:00 pm
i don't know if it was for a competition, or something else, but we'll keep watching that. >> sandra: and no word yet. new york state police confirming one fatality at this time but no word who it was, whether it was a student or administrator or the bus driver. it was about six busses that were being transported with these students. no word on a press conference yet, but certainly we'll be looking for any information. is that a live picture coming in to us now? that was -- middletown, new york. >> john: you can see a ladder there probably to help the students evacuate from that bus, but clearly there's a lot of damage to the structure of the bus. >> sandra: we will pray for the absolute best for the outcome of those rescue efforts happening right now. and we'll bring our viewers any update on that situation. it's about an hour, farmingdale, outside of new york city. john, great to be with you. a lot of news. set your dvr, never miss us. sandra smith.
