we begin by saying you're watching "fox and friends first" on friday, i'm todd piro. >> carley: i'm carley shimkus. major breaking news at the southern border. the white house is pinning on maga republicans despite the fact 100 migrants are passing into eagle pass every hour and our border is being overrun by a migrant surge happening on land, in the sea and air under president biden's watch. >> todd: the jolliness of our open being matched by this horrificness. migrants are barrelling through by train this week. president biden has flown 200,000 migrants from four countries on secret flights across the u.s. alexandria hoff has more on the failing response at the border. alex. >> alexandria: the white house does not consider their policy to be failing, they say safe and orderly enforcement, despite the

>> todd: a vegas judge handing down 21 charges to the two teens accused of murdering retired police chief in a hit and run last month. the 16-year-old driver getting hit with 18 counts, 12 felonies. the 17-year-old passenger faces three counts for murder, battery with a deadly weapon and attempted murder. this tragic moment caught in this gut-wrenching video. the pair is accused of intentionally striking the biker. they are laughing as the passenger tells the driver to hit him. we are not playing it. andreas probst was thrown into the windshield and killed.

one of the boys' mothers speaking out, i don't know why he did this, i don't know if god can forgive this. the passenger's mom is saying there is a lot more to the story and the details will come out. >> carley: that could be a mom saying that for her son. they stole four cars that day, as well. from one tragedy to another. six students in critical condition after a bus crash in orange county, new york. the bus was bringing kids to band camp. law enforcement is trying to figure out what happened? >> it is preliminary, it is likely a faulty front tire contributed to the accident, although this is still under investigation. it is a preliminary determination. >> todd: steven newhouse joins us now. thank you for joining us under pretty tough circumstances. do you have any updates on the

six students reported in critical condition? >> all i can tell you, good morning, thanks for having us on. they are still in critical condition. i've been in contact with the hospital. they are getting more stabilized, but they are in serious, serious condition right now and we're asking everybody to keep them in their prayers, it is a critical time right now. >> carley: do you know yet what caused this crash? >> all we know, after that 1 in the afternoon we got multiple 911 calls of a bus rolled over in the median. it looked like damage to the front left side caused it. right now, we'll wait until we hear results from state police investigation. we heard about the tire, we can't be positive on that right now. >> todd: there were a number of buses on this trip, 300 students

total, do you know what how they are being taken care of in this horrific tragedy and horrific time right now? >> very, very tragic situation. we had reunification center set up, very emotional for the other five buses and the juveniles on there. emotional. we had grief counselors there. this was a traumatic event. a lot of students when emergency responders showed up, had started climbing out of the bus. the ones most critical had to be removed. this will require a lot of support going forward. >> carley: two adults died. do you know if they were teachers, the bus driver, a parent maybe? >> we don't know yet. if you look at the ages, one was 43 year old female and one in

their 70s, both females. we could not confirm they were the drivers. it was chaotic and the people were so emotional we can't make any positive conclusion until this settles down a little bit, that is how tragic it was. >> todd: ntsb is investigating looking at the safety of reigency transportation. this bus traveled 50 feet down a ravine, this could have been much worse. prayers to all involved. steven, thank you. no label party registered 15,000 voters in arizona. pay attention to the number, it means something. is this enough to be a spoiler for joe biden? >> carley: daughter of a music mogul isir taking gavin newsom to shreds over his failing policy in san francisco and across california. >> he is who is running our

votes away from joe biden. obviously a third party signing up 15,000 is getting the democrats scared. do you think in 2024 no labels will cost joe biden the election? >> it is possible. in arizona, joe biden won the election by just about 10,000 votes, any party that can swing numbers like that in any state could be a threat to him. you are right, todd, not just people on the left who want to see calming of relations in politics. i don't think it is accurate when they say it is just joe biden. bring it on, no labels, joe biden is not doing debates, not acknowledging primary challengers. let them bat issues around. >> todd: we both agree with that

quality of life and she doesn't have those things under gavin newsom. he is looking to run for presidency and he is terrible at being a governor, which is usually a prerequisite. the podcast sounds lit, i will have to check that out. >> todd: will how democrats handled their time in office, especially in big cities and federal government, force people that said, i will never vote for trump to vote for trump in 2024 because they can't stand what our country has become under joe biden and all democrats? >> so todd, think about this for a second, there are people who don't like donald trump and it is a personality thing, might be something he said on twitter, something like that, end of the day, you go to the store and package of steaks cost $33, now costs $43 and milk is $9, when it was $3 or $4.

bail out and run in separate directions to give them the greatest chance of evading border patrol. what happened to raul last year? >> yes, that was it. he was working and it was at night, so as he was on a pu pursuit, he came into contact with a barrier that they have that also protects immigrants from coming in. and then he was just found unresponsive. they said that he did not wake up, like he just passed away at the scene, from my understanding, he had some internal bleeding and yes. >> carley: i'm so sorry, tammy. how did you two meet and tell us about him, what was he like?

>> so i was actually stationed in washington and in virginia and so with the influx of migrants coming in, they needed help, so they asked if we, as cbp officers, could come help them. i took a detail down to mcallen and we were working hand in hand with border patrol agents and that is where we met. he actually gave me covid. so we kind of quarantined together. he would say that was the best thing that came out of covid was meeting me. >> carley: awe. >> yes, from there we dated. i would come visit him at least two times a month and then he finally proposed and i moved down here. >> carley: you were engaged?

>> yes. so then i finally moved down here and i was like, okay, we're going to start our life together and unfortunately this had to happen. i feel like everything happens for a reason. this is put in action, this could save many other agent lives and this could make them think twice when trying to evade agents and think that hey, if i try to evade any of the agents, i could face jail time and not only them, but they put at risk the people who they are smuggling in, children, women trying to come across, as you see in the bailouts, there are people in the back of the truck, if they get in an accident, they risk and can face -- >> carley: life sentences. >> a car crash. >> carley: tammy, you are a

done? >> what we need to do, look, most of us are fine with a deal crafted by a group of our colleagues last week. we actually ended up with a number lower than we had passed in the deficit reduction deal we got with the president and democrats a couple months ago. the number is 1526, we need to get to that and pass appropriate that show good faith to republicans that want to make sure we are cutting spending. we are the only ones talking about cutting spending, the democrats want to continue to spend, spend, spend. we need to show that and pass the defense appropriations bill and make that part of our plan and hopefully maybe get a funding resolution that will keep the government open for a small window while we finish the rest of the appropriations and

send to the senate. i hope that is what we will do this coming week. >> todd: before we continue with the shutdown potential, circle back to ukraine for a moment. to date, the white house has given ukraine $75 billion in aid, take a look at germany, 22, uk, nor way, japan, those four nations have given colbiened 55 billion as of july 31. putting aside the fact we are spending more than the other nations, especially those in europe there, my question, when does it end? when do the american people get to stop sending their taxpayer money to ukraine? >> we need to have a clear plan of how we can help the ukrainian people against the russian aggression. most of the money is munitions, weapons, shells, tanks and hopefully airplanes to help ukrainians repel this invasion.

the europeans need to step up, without a doubt, the germans especially. they have to demonstrate their willingness for us to continue this effort. if they don't, this is their backyard, they are going to have a more difficult time of getting usa to help ukrainians. a lot of different people have to step up and help ukraine defend against russia. i'm not a fan of russia, but again, look, you got to hand it to ukrainians, they are fighting this. they are fighting for their freedom and i think americans need to help that, but the whole world needs to help ukraine, not just america. >> carley: few questions on the government shutdown. what are the biggest sticking points? are you guys heading home for the weekend? why not work through? the biden administration is loving this and released a statement listing everything that will happen and it is all republican fault, according to them.

they say it will force service members and law enforcement to work without pay and endanger response, undermine research on cancer and other diseases. if government shutdown happens, republican party only has itself to blame for negative coverage, it seems inevitable. >> i don't think you can say it is the republican party, it is a few members of the republican party and frankly are more interested in my opinion, of getting off air time and funding opportunities that are really causing this. this is not -- look, 95% of the republican party and republican conference is ready to move on, there is a very small number, four or five causing the issue. we only have a five-seat majority and the majority isn't everything. the majority is the only thing. only ones talking about reducing the government and government spending and reducing our debt
