subjects they'll get onboard with something sent to the senate and let that -- chaos ensue. >> and then senate will probably what -- strip it and just sending back. strip out all of the call policy writers, not stuff that's not strictly spending. i think to the point that mark -- made a minute ago, you could have had republicans pick one thing to bargain over like border security. and make that the pongt that they wanted to win over in the senate. but they picked so many things that they want to change, it is just impossible to bargain over any one of them. >> important to manage they control the house barely and don't control the senate or the white house. >> correct this is only one-third of the three signatures you need and so you can set the marker down is a good associating stand point but at the end of the day the president and the democrat controlled senate are going to weigh in and it is going to be a negotiation. so start low -- and then you can negotiate up from there.

norfolk, virginia now with more. hi, nicole. reporter: hi ish sha nor fox, virginia, is facing a significant flood threat as o'fill ya moves north this low-lying coastal city is literally surrounded by rivers and base. so tidal flooding real possibility when you couple that with intense rain bands, well that could spell major trouble but let's first get to some incredible video just in from the u.s. coast guard showing, an intense mission five people rescued off the coast of cape lookout, north carolina last night. that includes three kids after you look at just those incredibly dangerous waves that happened well we faced strong wind gusts before tomorrow ophelia made land fall but a state of emergency that was put in place yesterday afternoon. and that's when norfolk, city leaders decided to take some big steps to try to minimize that flood threat.

months of your life over past several years at the southern border give us context how bad is it compared to your previous tours? >> you know, i've never seen the border patrol agents who have been spent so much time and have admiration for and never seen them struggle so hard to be overwhelmed and their morale is way down because they don't see support from an administration in the way of putting something in place in policy wise or to do things. to try to stop the flow. they're outnumbered. the quick snapshot there's about 50 agents any given day on shift here in eagle pass. obviously, we've seen 750 plus already, and 8 5 to 90% of those agents right now are processing they're not on the line as agents say are in the field protecting the border. mike we'll sending it back to you. mike: griff jenkins aishah. aishah: heritage foundation

mike: let's start with attorney general on capitol hill. >> does anyone from the white house provide a direction at any time to you personally, or to any senior official at the doj regarding howed hunter biden investigation ftion to be carried out? >> no. mike: what is the fallout from the attorney general appearance on capitol hill, brian? >> yeah hey mike i was disappointed and i felt like his appearance was underwhelming that didn't instill confidence that americans wanted to see about our u.s. attorney general why do i say that? in his opening statement he made comments about like we have to uphold constitution and equal justice for all, yet he didn't give anybody an explanation as to how the doj presented this bogus plea deal a few months ago on behalf of hunter biden that clearly violated the constitution. so he's talking a lot but in my

opinion he's not walking the walk. and what was so staggering to me mike was that one point during his appearance in testimony he pretty much said hey look i'm trying to stay out of those two investigations the two that jack smith handling and then the -- the other investigation as well. and he's saying i'm going to keep out of this so as not to create any discourse. that is shocking. he's the captain of the ship. he's the quarterback of the team these two two highest profile investigations in decades. and he's telling the american people that he's trying to stay not involved. >> what questions do you have about his actual leadership at the department of justice? >> yeah. it's failed leadership mike. and here's why. if you're a head football coach and your team gets slottered and media comes and says hey, what went wrong how do you fix this? coach would take responsibility for the loss, mike.

hey look it is on me, the buck stops with me. all we heard from merrick garland was he's saying oh look i'm not that involved go to david wise there are occasions where he's actually saying oh let's go ask david wise that are you serious dude? you should be answering these questions. you are the one that should be signing off on plea deals you are the one that should be defining the parameters of these investigations not underlink and one question i would have for david wise when he comes to testify before the white house judiciary committee mike is i would ask him point blank. did you have this evidence about these gun charges in your possession when the first indictment came down? because nothing changed mike. why are there additional indictments now when all of this evidence was already in merrick garland's hands? >> meanwhile hunter bide is suing irs when his father is head of the united states government.

what about that? >> yeah. i think this lawsuit is just a flexion again trying to take the attention off himself and put it on the government oh the governments coming after me. when by the way, there was little if any investigation done with this member the irs whistle-blower hardly anything was done to investigate that. with allegations of the doj not falling proper protocol, potentially committing perjury not following evidence or executing search warrant on hunter biden's home what about that and his lawyers are now trying to sue the irs because an irs agent filed a complaint a whistle-blower complaint. >> meanwhile congress is preoccupied with a fiscal funding deadline coming up, but what about the biden impeachment inquiry? >> yeah. i think the biden impeachment inquiry should focus on one
