helping mccarthy get the bill across a spending line. it will include industrial relief funds, lawmakers drop money to secure our southern border and to help ukraine, those items expected to be restored in separate senate legislation. arthel: it's a victory for mccarthy but how long for the cwill thecelebration last? senior congressional correspondent chad pergram is alive on capitol hill. chad, what's going on behind the scenes. what is happening in terms of leader mccarthy's a job? he said earlier he is concerned what will happen in the long-term, what do you know? because it's interesting the house of representatives after he finally passed that bill and keep in mind as you say the senate still has to act to avoid a government shutdown later tonight. matt gates, his antagonist the republican from florida was trying to get recognition on the house floor and stephanie republican from oklahoma was a presiding she gobbled the house out of session until monday at noon.

matt gates has been pretty consistent sink he would try to have a vote of no confidence in speaker mccarthy if he were to move a temporary spending bill with the coalition of democrats and republicans. that is exactly what happened today. it has been clear for several weeks now that's the only way to keep the government open was to move that sort of both a mixture of democrats and republicans. that is where matt gates he's been threatened to drop on kevin mccarthy. he did not get to do that today but we'll see if he says something about that publicly in the next couple of days. or if he does something coming up. democrats said there is a way to get out of this cul-de-sac. democrats can help straight spending bill and that's what happened today. here's what hakeem jeffries the democratic leader said after the bill passed. >> we went from devastating cuts that would have impacted the health, safety, economic well-being of the american people in 24 hours.

thought there was a senate bill that have been on the senate floor that commanded the support of more than three quarters of all senators that could pass. the senate was going to jam the house. what might have happened in the past couple of hours is the house might be jamming the senate because you're down to the stumping post they are running out of time that's the only thing that can pass your to avoid a government shutdown. not we had some drama here on capitol hill. kevin mccarthy put out this bill this morning, democrat said boom to make sure we understand what is in the bill. keep in mind republicans were several units have talked about we want to have 72 hours, three days to read the bills they all had a few minutes. democrat said can you give us 90 minutes to read this? all of a sudden there's a fire alarm in the cannon house office building just across the street for the capitol. we learned a little bit later it was jamaal bowman the democrat from new york who apparently pulled the fire alarm that's according to sources i've spoken with and also the u.s. capitol police also questioned him from

the criminal investigation unit there but here's what kevin mccarthy, the speaker of the house had to say about bowman perhaps trying to disrupt and may be delayed the roll call vote as democrats were trying to buy time to understand what is in the piece of legislation. >> this should not go without punishment. this is an embarrassment. you are elected to be a member of congress. you pulled a fire alarm? in that minute hours before the government being shut down? trying to dictate the government would be shut down? what is going to a person's mind like that? >> i should note jamaal bowman before it was a middle school teacher and also a principal in somebody who might know something about fire alarms and buildings and what happens. however spokeswoman indicated he did not realize they would evacuate the building if he in fact pulled the fire alarm. he said he did that as he was rushing to make the roll call

vote. we probably have not heard the end of that. now to as to any potential charges or something like that you could not a rest a member if they're going about their congressional business. that's on the called the speech or debate clause article one section six of the constitution. we probably got heard the end of this. we do not know if there be something happens in the capitol police with congressman bowman or the house ethics committee back to you. jon: that explanation seems very fishy but i would imagine minority leader hakeem jeffries will have to have a talk with the congressman as well because he was in the process of exercising that the magic minute was doing the very thing that is allowed to do there on the floor to buy some time to get through to buy 90 minutes instead of 15 minutes the democrat said look, we don't trust what you potentially could have thrown into that measure, to this proposal. i think that is unnecessary when you call that in football and

minibus where we have a continued resolution or a portion of it. we take the bills we've already passed and make those he continued resolution. in a perfect world the senate would mark up the bills we sent to them shows areas of need to come to compromise and we will come to compromise. but at the senate does not act, speaker mccarthy the republicans have proven that with a lot of consternation, but with determination to speaker mccarthy we will act. eric: are you concerned the lack of ukraine funding sends a message of vladimir putin? >> not at all. we have more than enough votes on a bipartisan basis to fund the stopping of his aggression. there are members and members of good intention world war weary or want the money to be spent in the u.s. and cannot see the history of unstopped aggression. cannot really appreciate the ukrainians bleeding for their country and o us and the rest of the free world providing him the

eric: you mentioned your republican friends the conservatives matt gates for example in those congressman has called for a motion to vacate if the speaker relied on democratic votes he did just that. do you expect to move to a motion to vacate and bounce speaker mccarthy out of his job? >> to paraphrase a speaker as best i can, bring it on. matt gates represents the waters of the gulf of mexico. i represent over 50 miles of the mexican border. so quite frankly i want to get back to the other parts it had to be taken out too. matt gates and others were not willing to step up and realize getting a win, getting half a loaf of bread is better than getting done. i want the half a loaf of bread. i want to have my san diego district secure again. so do the people on my side of the border. on the people in mexico wanted it fixed to print this is not good for them.

acting department of homeland security secretary chad wolf. secretary wolf good to see you. it looks like lawmakers will buy themselves 45 more days we are not sure yet the certainty of the uncertainty still looms how does this affect morale among border agents? quick sums all the border patrol agents are exempt from a government shutdown. obviously they continue to work should a shutdown occur per they've been through this before they understand the situation. obviously almost always get back pay. so one paycheck, two paychecks they can usually withstand that. many more than that it starts to get very painful for a lot of border patrol their families. glad to see we did not have a shutdown for i would've liked to seen border security measures and a continuing resolution. as you are showing some the pictures now the board is really out of control. we need to be doing something i'm also glad the border patrol agents are being paid as well.

>> as you well know if congress agrees on a short-term way to pay the bill credit cards are still due. the border patrols have to pay them with or without a paycheck for the next 45 days and beyond. you have to consider the spouses and families there in limbo. meanwhile as you just heard casey report you have cbp agents record levels of migrant of the southwest border. are you concerned at all about a complete breaking point and breakdown of protection at our southern border? >> absolutely. the crisis we received the soutn border has gone on now for two and half years every month it gets worse and worse. the month of september we are hearing the numbers after ugly hybrid probably overthrown a thousand apprehensions nationwide which is a number we've never reached before absently unconcerned about the border in the border patrol

agents. there is no doubt a long term government shutdown impact border patrol agents. no doubt in my mind short-term they can withstand but not a long-term prett. it's very difficult for those agents who often time' live paycheck to paycheck along with their families along that border. it will impact them. they are doing great worked on that right now. but they are struggling in the midst of a crisis the likes we've never seen before. >> they are continuing to do great work. meanwhile we can question whether congress is doing great work. meanwhile you have a cartel. it is a well oiled business as a business operation so how might the managers of the cartel take advantage of congress inability to pass a long-term spending bill not to mention overhaul immigration laws. low pay attention for government shutdown again border patrol

agents are exempt. again that's very difficult on the home front. the cartels will look at that they play close attention the fact that we have not had a change in strategy that is impacting the border i think tells you everything you need to know and the numbers in the pictures we see almost daily now are getting worse and worse and worse because the cartels have the predictability they want along that board up right all of those individuals coming across almost all of them are being released into american communities which is what they can sell other migrants coming to the border as well. >> and finally it chad you heard in the report how he just had

seen a hearse drive by. what does that do to the psyche of the border agents? >> it is difficult. it's difficult to work in those types of circumstances for there's all sorts of deaths that occur unfortunate along that boarborder the numbers we are sg today the deaths and the number of deaths are going up dramatically. you are absent one -- two deaths a day along that border. whether it's in the river or in the desert. that impacts border patrol agents who are trying to save and rescue some of those individuals. you've got those folks clashed with border patrol agents there deaths that occur that way. it's a very dangerous situation going on down there right now. we need to change the strategy. >> listen, we thank you for stopping by to speak with us ensuring the perspective of those with us. former acting home unsecured secretary chad wolf, thank you very much.

eric: this afternoon was on major progress to avoid a government shutdown. that about seven and half hours now at midnight raid the house were this afternoon to approve a temporary funding for the next 45 days. the measure is now sitting on the other side of the capitol building in the senate, switches in rare weekend session today but right of the democratic caucus meeting what they are going to do planning to invoke. meanwhile some members of congress the republican members are calling on the justice department to prosecute a democrat. congressman jamaal bowman of new york for pulling a fire alarm during the debate to allegedly

delay up at his offices that was an accident as he rushed about. senior congressional correspondent chad pergram on capitol hill with much more on this. >> good afternoon. we just talked to her a few moments ago with jamaal bowman. he has what seems to be a bit of a plausible explanation here. what he is saying in seat went to a door that's usually open in the cannon house office building across the street from the capitol. and it was closed, it was locked and tripped a fire alarm or he quote i was trying to get the door open it's usually open i did not realize is going to trip the entire building. now, to be fair to congressman bowman that might be a bit of a plausible explanation, why question of the house and senate are in session on the weekend. a lot of these entrances and exits are closed on a saturday and a sunday. it's possible the doors usually go through are actually open. regardless though, republicans are saying wait a minute. there is a problem with this. kevin mccarthy the house speaker has indicated he should be

presented to the ethics committee. we have also just got notice from nicole, republican representatives from staten island who has indicated he should be expelled over doing this. sheet 110 expelled bridges going to introduce a resolution in the next couple of days but take the two thirds vote to expel somebody i think that is probably very unlikely. u.s. capitol police have also put out a statement they are setting the alarm was pulled on the second floor this is run 12 oh 5:00 p.m. eastern time they factored the building of their investigation continues. that is what we have the latest on this issue with jamaal bowman on the door. this does not appear to be a regular fire alarm that you have on the wall that you would pull. this is a door that is guarded and locked it. sometimes those doors are open. sometimes they are not. maybe there is a plausible explanation for this parade that is why this investigation continues. now, as the government shutdown but we've been told in the past few minutes he senate democrats

are meeting their writing with a coherent capitol hill a hotline for this is where they go around with all centers democrats and republicans and say can we put a piece of legislation on the floor quickly questioned in other words not go through all the parliamentary traps? that would usually take two or three days just to get that bill on the floor and then maybe another day or two to pass it for they do not have that obviously they don't have the time. they're trying to see if they can take this house bill quickly and put her on the floor. ended this right now seems to bit a bit of a victory for the time being for house speaker kevin mccarthy, listen. >> today democrats have ensured that those interests, the american people have won out over the demands of mega- extremists. but, only after months of speaker mccarthy and that maga majority playing chicken with the lives and livelihood of the american people.

part i will tell you i support ukraine. i think ukraine winning that battle against russia is incredibly important for world stability, i believe that. most of the conference doesn't certainly most the congress does. it was serving as a road block for us to fund our own find ourn government. we cannot shut her own government down due to foreign aid we should take that up separately. we will take that up separately. and i think it will pass if it's put on suspension just like today's vote was it will pass. arthel: that's great to hear but i understand they separate it from today. but you think in the future because of that action it is going to get a green light. again you are the cochair, that is good to hear. you're the cochair of the problem solvers caucus. once we get past this conundrum if you will you think there is going to be a continued resolution i feel very confident about that.

what are the hurdles you're facing be on that your carcasses? >> owell, i think the challenge has been and we have a broad array of political beliefs in our conference, arthel. i'm actually the leader of the bipartisan block in congress hard-line conservatives and our conference as well but do not begrudge anybody for the perspectives or their approach. i think everybody's got to respect the fact we report her bosses back home which are our constituents represent very different districts. as long as we keep it respectful and ultimately let democracy take hold on the floor the house like we did today by putting bills on suspension not necessarily confine them to the rules about. that is where the votes have been failing for there have been a small number of our colleagues had been taken down the rules. again i do not begrudge them for their do what they feel they need to do to represent their constituents reported 35 districts in america when he ald all americans to be represented.

arthel: 4035 districts you have a few members of the far rights action of congress who seem to be creating problems rather than solving them. so how do you as part of the problem solvers caucus, how do you deal with them directly? and say guys let's get together for all of america. >> arthel, i respect them and their perspectives. if you take the believe every one of us our responsibilities to represent the people that sent us here. all of them. not just the people voted for us but the people voted against this the people did not vote at all but that is the only way our system works. i encourage all mcculloch to take t their perspective. never going to judge them for their vote representing the district fits between them and their people back home and they are accountable just like i am. that is my approach. i do believe the will of the congress but not the will of the conference but the world of congress is what we need to
