>> jacqui: former president trump was hoping to wrap his first day in court soon. nate foy live outside the courthouse in lower manhattan where the former president just spoke, i believe. how did former president trump handle today's proceedings? >> jacqui, he just walked out of the courtroom, the morning session ended, the afternoon session to begin at 2:15. former president trump said everything went well but he feels that the judge in this case has already made up his mind. president trump said that he will probably be returning for that afternoon session but opening remarks have been made by trump's lawyers, as well as lawyers for his sons, eric and don, jr. and lawyers for the state. the state argues family regularly submitted false financial records, whereas trump's lawyer argued those records were in fact true. take a look at this video from inside the courtroom, former

president trump is looking very serious. the judge in this case, justice arthur engoron is seen smiling. trump denies any wrongdoing, he calls the whole trial a sham. this is a no-jury trial, meaning justice engoron has full discretion deciding trump's punishment. he said trump overly valued his properties, including trump tower for bank, tax, and insurance benefits. trump calls engoron deranged and took aim at letitia james and president biden before walking into the courtroom. >> the crime is against me because we have a corrupt district attorney, we have a corrupt attorney general, and it all comes down from the doj that totally coordinated this in washington because i'm leading, the leading candidate, leading biden by ten points and leading the republicans by 50 and 60 points.

and trump match-up in 2024. only 37% are enthusiastic about trump, and 32% enthusiastic about biden. it comes as questions swirl over whether a third party candidate will enter the race. that may be the case for robert f. kennedy, jr. he has reportedly expected to drop his bid for the democratic nomination and instead run as an independent. potentially libertarian. how will that impact the front runners? david and -- here is a guy with the last name of kennedy, the son of robert f. kennedy, jr., and he feels like he doesn't have a home in the democratic party. all i can say to that is wow. >> wow, john. listen, i think as you saw, the process play out over the last couple months, the more that democrats heard from robert kennedy, jr., the more they understood his policy positions,

the lower rating he got in terms of polling. so i think he's making this tactical decision the only way he can be relevant in this race with joe biden far and away the leading candidate on the democratic side is to become a libertarian, allow him ballot access come november. >> jacqui: aside from the discussions of a third party and no labels and that bid, you have had some democrats in biden's orbit suggesting that rfk could hurt trump. hear what he said. >> i think that may end up hurting donald trump or the republican nominee more than joe biden. i also think the fascination with rfk, jr.'s candidacy was elite media fascination. >> jacqui: david, your take. >> you would not have democrats calling for a time for joe biden to move on, which you continuously hear increasingly. and the kennedy family is so interesting. robert kennedy pushed johnson,

president johnson to finally decide he was not going to run again. it was ted kennedy who pushed jimmy carter decided ultimately went on to lose. and now you've got this kennedy who has now taken on a third democratic president. there is something about the kennedy family that they don't like incumbent democratic presidents. >> john: in terms of who this might benefit, call for number one, biden way out in front, 64.9%. kennedy, 14.9%, not insignificant, in a very close race. williamson, 4.8%. look at who might benefit from the 14%, go to call for 3 here, quinnipiac poll, viewed favorably by 48% of republicans and only 14% of democrats. viewed unfavorably by 18% of republicans and whopping 57% of democrats which suggests if he

were to get into the race as an independent, whether he runs on the libertarian ticket, green party, whatever, he would draw more from republicans than biden. >> it's a good point. as i said before, some of the robert f. kennedy, jr. views on vaccines, covid, diseases are more in line with what you see on the republican side. and that could be the case he pulls from trump's support. >> the suggestion that trump would not get votes, that kennedy will take from him, and no polling suggests that right now and certainly as you are looking at kennedy as he makes his case, has been making his case to democrats and look at cornell west, it is that combination, it's the more people that get in that start pulling from biden and ultimately who has the most of their base. does biden take more of his base in and then the third party candidates pull away from that, or trump have more of his base.

there are questions of tubberville, paying taxes in florida and living in alabama. and newsom has trusted butler over the years, a close confidante of kamala harris, and she can run for the seat, doesn't have to be a lame duck, make for an interesting dynamic with the three really well established candidates in the race. >> john: interesting observation this morning watching fox, that every time a question is asked of a democrat you hear what the republican is doing. so, we just want to play from the same rules. tell me what the democrat is doing. i don't care about tubberville. she may be able to run for the senate. >> gavin newsom is biding his time until biden time is behind us it's all about 2028. emily's list moved from hillary clinton to barack obama he got a huge base.

properties. smaller houses on less property that don't even have ocean or intercoastal waterway frontage are going for $35 million. now, it is -- it's zoned currently as a club, so that may devalue it, he got it rezoned as a private residence, but it's got to be worth more than 18 million. >> jacqui: seems he's making it about the politics of the case and able to do that because he thinks it's an open and shut thing for him, to prove his point that it's a political prosecution and improper. >> john: look at the judge and the way he's comporting himself, this could be over for trump in this courtroom. he'll definitely appeal it. >> jacqui: absolutely. target is teaming up with the biden administration to address out of control shoplifting. but not the department you might expect. details on this puzzling

basic real estate practice so. they are saying the judge has misunderstood basic real estate practice. i say they are wrong about that. he didn't misunderstand it. this is a rigged court. he's put there to do a job on trump. now, this comes from highly respected officials in palm beach county. also apparent mistake by judge engoron surfaces in the use of a palm beach county appraisal of mar-a-lago and expert says is detached from the true value of the property. now, i don't know the people that we are talking about in palm beach county, but they saw this agregious trial, this horrible, horrible trial going on while at the same time people are being murdered outside in the streets and nothing happens to those people that do the murdering. they go after trump. so this is just released by palm

indictment because you have seen his support get -- growing every time he faces something like that, and he's making a very strong case, also on truth social, calling the attorney general racist and corrupt, a trump hating judge who refuses to follow the appellate court's decision, continuation of the greatest witch hunt of all time and election interference. how he's framing this. >> john: one of the big things that gives trump the latitude to say that is that letitia james, unlike what's going on at the department of justice here in washington, d.c., where merrick garland was questioned on "60 minutes" to whether or not the doj was out to get trump, merrick garland said no, but letitia james campaigned on getting trump. >> jacqui: he makes that point frequently. >> john: should an attorney general be campaigning on getting trump, i guess you could campaign if you were, you know, running for the prosecutor position in the city of chicago, say i'm going to get al capone, maybe that might get you into office. but i guess maybe we should put

this question to john with us now, former deputy assistant attorney general under george w. bush. it's been a while. this idea that letitia james campaigned on a pledge to get trump, how should that be looked at by the general public? >> people should understand in states like new york, attorney generals, even district attorneys like alvin bragg are elected by the people of new york. they are partisan elections. republicans versus democrats. but is what they are doing in the best interest of the people of the state. is it a good idea for the state of new york on behalf of its people to use its vast law enforcement powers and single out president trump, nobody is claiming they were harmed, no one claims they were actually defrauded, there doesn't seem to be any losses suffered by any

banks or law firms or accounting firms here. on the other side, what the attorney general of new york may be doing, and what the courts may be doing here, is sending a message. new york city is the greatest financial center in the country, if not the world. are they now going to start using their vast powers to say we are happy to have you come to new york as long as you are a democrat to do business. but a conservative, we are going to use the powers of law enforcement against you. that may undermine the position of new york, the city and the state as the nation's great financial capital and place to do business. >> jacqui: john, there was some reporting to suggest perhaps the former president wanted to show up voluntarily because he can make his own strong argument effectively himself, and "new york times" called it back to his decision not to appear at the civil case involving the carroll allegations, found liable in that and that his

voluntary appearance here could change the outcome. where do you see that at all? >> i think there's a real conflict between president trump's best legal strategy and his best political strategy. he's already lost this case. all that these proceedings are doing now is deciding how much punishment is going to be given by the court. compared to a criminal trial, it's as if he's been convicted, now a question of a sentencing. so, if his legal would be to not attack the judges or the district attorney, reach a sensible compromise but political strategy is attack the judge, he called him a rogue judge, and called the attorney general of the state of new york a racist. this is all going to defeat his efforts to do better in court but may help him in his political campaign, of course. >> john: he may believe he's been defeated in court, he takes a look at the judge and the public posture the judge is taking and thinking to himself i

don't have a hope in h-e-double hockey sticks here, but help us if you could with your vast legal knowledge on the legal aspect of this. nobody was hurt here. you don't have banks screaming that oh, we were defrauded and we gave him loans that were never repaid. property is worth what somebody is willing to pay for it. so, whether or not the judge in new york says mar-a-lago is worth 18 million, or trump says it's worth a billion dollars, it's worth whatever somebody is willing to pay for it. where is the crime here? americans are having a difficult time trying to figure that out. >> john, it's a great question. and when you put aside trump's political attacks on the new york justice system, he has an interesting argument there. can a state say someone has defrauded the people of new york when they have not committed

fraud against any individual person or party that's wanting to go and produce themselves in court. how is the state of new york, how are the people of new york harmed if president trump borrows money, maybe he exaggerated his financial statements, maybe not, he repaid the loans. the banks complained, no one complained. one other important thing, john, it's not a criminal case. so president trump is not going to go to jail. none of the family members are going to go to jail. it's a civil case, the state is trying to get money back and trying maybe to get an order of putting the trump organization out of business in the state of new york. >> jacqui: big deal for sure and something that is very important to the former president, his businesses, obviously, central function of everything about him. john yoo, thank you for your time. appreciate it. >> john: illegal migrant crossings at the border shattering records for the month of september and sanctuary cities and states are feeling

the impact. new york city mayor eric adams scrambling to make way for more migrants and looking to move the homeless from surrounding county. one is pushing back. republican oneida county executive for more on this. mayor adams is handing out vouchers he says are good in surrounding counties of new york to say if you want to get into a shelter, take this and give it to folks and you are saying no way are we going to allow that to happen unless we say yes. make your case. >> well, this goes back, thank you, john, goes back to, you know, the initial order that we put in to keep migrants out of our shelters and hotels when they started moving them or attempting to move them to other counties. now it's a bait and switch and sort in which well, we'll move your homeless up so that they can make more room for the migrants and we are saying no,

that's not the way to fix this either. and at whose expense, at my county's expense i need to protect my border and my border is my county and in this case, this is just another effort or attempt at not fixing a problem, of passing the problem to other areas. that's what the mayor is doing, the governor is doing, and what the white house and president biden are doing. >> john: although the other day the governor of new york, kathy hochul, appeared to throw up a white flag. listen to what she said. >> well, we want them to have a limit on who can come across the border. it is too open right now. and that is a real problem for new york city. 125,000 newly arrived individuals and we are being taxed. >> john: she says it's too open right now. she proudly touted new york state designation as a sanctuary state, is this a case of be careful what you wish for, you

might get it? >> it certainly has, and she's talking out of both sides of the mouth. she wants to give them permits to work and the other saying we have too many but nobody is doing anything to stop the flow and that's what we are saying. until you stop the flow and stop accepting them in new york city, and in new york state as a whole, you are never going to fix this problem and look to do it. instead it's just the shift of now homeless people coming from new york city up to upstate, parts of upstate new york with vouchers in hand that will give them market rate pay for housing that will disrupt the market, marketplace in our area, if it's -- if it's accepted, and displace who, everybody, anybody that a landlord wants to make more money on, and we are taking in homeless people from the city that again are not, you know,
