8:00 pm
tulsi gabbard, i'm greg and i love america. >> it's 11 p.m. on the east
8:01 pm
coast 8 p.m. in los angeles and this is america's late news "fox news at night." breaking tonight nine-year-old girl who went missing while camping with her family in new york was found alive and well. she may have been targeted and in great danger because the suspect reportly left a ransom note. the governor of new york kathy hochul just had a news conference that broke up maybe 30 seconds ago. let's get live to jackie in the news room with the information how they found the girl. >> good evening. new york state place say charlotte cena is located and is with her family report arrest made less than 3 hours after police expanded their search. police believe she may have been kidnapped while camping with her family in upstate new york.
8:02 pm
charlotte was rising bikes with her family in rose state park located north of the state capital. we are told charlotte wanted to do another loop by herself. 15 minutes later she still hadn't returned. her parents grew concerned of course. her bike was found. but she was still missing. police were called and after search amber alert issued. >> it's just a wonderful family. no one deserves this but it's very sad to think they're going through this right now. >> and new tonight trace sources tell fox news digital a male suspect plus a ransom note we learned police were able to match a fingerprint on that note to identify the suspect. the suspect has been identified as 47-year-old craig nelson ross, jr. police say this is a very active investigation tonight and charges have not been brought
8:03 pm
but those charges are expected to come. trace. >> jackie ibanez. thank you. former fbi special agent nikole parker, craig nelson ross fingerprint was in the criminal database. we know he left a ransom note. the rest of the information is slowly trickling in. what do you take from this so far? >> this is a very fluid ongoing investigation, so we want to be careful what we speak but first and foremost i am so grateful that charlotte was found and is safe with her family. having worked these types of investigations a lot of tiles it doesn't end up this way. within 48 hours of the call to law enforcement she was brought back to her parents. the ransom note is extremely important. a fingerprint is just good old-fashioned police work.
8:04 pm
the fingerprint was found in the existing database the law enforcement database to match the individual and i believe there were cell phone towers used to track pings of cell phones and probably coordinate the information and evidence that led to ross, who was the suspect. >> and nobody knows better than you the first 48 hours i've covered and abductions in my career, the first 48 hours is important because beyond that it's dire for these young people abducted. >> it's absolutely crucial. these are the most vulnerable members of society. all hands on deck with law enforcement. when i listen to the press conference and they mention this suspect was reluctant i wasn't shocked. s.w.a.t. team would have been going in there. anybody lows law enforcement those that are hurting children are the most violent. they know they're desperate and have no problem fighting back. >> i've got about 20 seconds left.
8:05 pm
targeted. we heard this in the news conference potential this girl, this family may have been targeted. >> potentially yes. law enforcement could be reviewing all relationships between the parents the family the friends, did they have a friendship with this individual did, this person know the daughter through some form that can be reviewing communications social media posts everything. >> we are going to get more information on this and get back to you as news breaks. thank you. more breaking information new tonight a member of congress has reportedly just been carjacked at gucht in the navy yard area of washington, d.c. now this is according to sources. these you're looking at on screen are live pictures. as you might imagine there's a heavy police presence. the member is henry cuellar of texas.
8:06 pm
axios is reporting the car or location here is near a dorm that houses dozens of members of congress in that navy yard, the reporter said at least 3 suspects were involved and cuellar's phone and vehicle were taken in this incident. we will keep you updated and check back with live pictures and find out if we can get congressman cuellar to come on and talk about what happened. we are learning on top of the rampant crime across the san francisco bay area police are dealing with a new type of criminal practicing old trade, homeless pirates stealing both targeting boat owners. matt finn is live. >> burglars who are part of the homeless crisis in the bay area are being nicknamed pirates for raiding houseboats and yachts docked near the oakland harbor. they steal what they can and sink the both.
8:07 pm
outraged residents shared their experiences and demand action be taken. >> crime has risen to truly intolerable levels. multiple vessels have been stolen and ransacked. victims have had to resort to personally confronting the criminals to recover their property, without the benefit of police support. is this an appropriate activity for a 79-year-old senior? >> now the alameda police chief says that department does not have a full-time marine unit so they are working with oakland police and the national guard to address the crime on water. the police chief knows fewer than 1 percent of crimes happen in the marin had a but residents host property is being destroyed says that 1 percent figure is unacceptable. >> matt thank you.
8:08 pm
fox news a night common sense department finds it unusual to hear the words pillage and plungeder in 2023, sounds like more calico jack would say on the jolly roger but in the san francisco bay area as you just heard there appears to be a pirate revival of sorts. only these aren't the patch wearing pirates of the past, mostlyly homeless people who use smaller both to pillage bigger both. common sense has learned that patrolling the waterways especially the oakland alameda estuary has become a bits of a problem, turns out alameda sheriff's department has only part-time marina patrol and only one oakland police officer working the estuary. one boat owner says they've been forced to fight off the bandits trying to ransack their both.
8:09 pm
he says the boat owners now have a gun knife stick or sword to protect themselves. sword in pillage plundzer and swordfights? common sense thinks the homeless are changing tactics. the authorities are not. we have long known the streets of san francisco are unsafe but crime and violence on the waterways is a troubling new spin on a centuries old ploy. criminal attorney vince. i want your take on the breaking news congressman cuellar carjacked in d.c. this is showing you there's a lot of members of congress who live in this area near the navy yard and these are live pictures going back to d.c. and this is part and parcel of something we have been talking about a long time about how the crime is not just affecting the most vulnerable. this is affecting some of the highest ranking members in these
8:10 pm
cities. >> that's correct and these crimes trace that have proceed pensive for violence when you approach a vehicle you don't know whether that person has ccw bats or baton but you can be sure you're inviting violence and we see this invitation of violence happening indiscriminate of who the victim is and that's because it may just be one quick check in to get a citation or be booked in and have your picture taken until only a few hours later you're on the streets perhaps to rio fend. >> we are trying to contact cuellar see if we can get him on live. meantime i go back to the bay area. it's almost like these homeless pirates realize vick they're not going to be thrown in jail. there's not resources to catch them. >> you know trace about 27 years ago when i was a young clerk with the public defenders office
8:11 pm
i ribbed being so excited going into custody to interview my client. that client taught mow me more about release conditions and bail than i learned in law school so these are opportunistic crimes there. is void in apprehension investigation and surveillance in the areas of the waterways and those are particularly vulnerable places but don't forget if the district attorney really want to lay down the hammer and make though communities safer those are dwellings under the california penal code. those are residential burglaries and robberies. >> talking about code zero cash bail now in effect in los angeles county, here is former l.a. county sheriff villanueva. >> october 1st starts zero bail schedule. >> what is that? >> if you're caught in say a smash-and-grab cite release or the funny one is called magistrate review, where they'll order you not to commit to additional crime.
8:12 pm
>> magistrate review one people are like really, don't do it again is very seldom a workable tactic. >> yes right and there's studies cbs just published one which looked at the rates of recidivism. are you more likely to commit a crime if you're released without having the anchor of having to pay for your liberty and some studies find you're three types likely to commit a crime, domestic violence and violence. sometimes the immediate arrest and the bail conditions such as stay away orders are crucial to protect the victims of the initial crime. >> target says it might lose $1.2 billion in theft and want to team up with homeland security. maybe they should protect the border first. >> we have talked about smash-and-grabs and that theme in california and states around the nation and we have talked trace about the federal
8:13 pm
government intervening. here you have federal data being used in a private business to combat organized retail theft and you're going see more of that in the future. >> vick thank you. >> thank you >> president biden's son hunter off to delaware courtroom hours from now the younger biden set to be arraigned on felony gun charges. kevin cork is live in d.c. with what to expect. >> good evening, trace, the 53-year-old biden facing three federal charges stealing from a .38 caliber colt revolver charged with two counts of making false statements for claiming on a form required for the gun purchase he was not using drugs illegally at the time. he also faces a third charge based on the statement that he illegally had the gun for 11 days in 2018 before it was got rid of. possibly unlawfully. we don't expect to see a mug
8:14 pm
shot as this is federal court and a magistrate judge will actual oversee the initial appearance and arrangement. which means we also don't expect to see judge mary ellen annoying which famously denied the sweetheart deal offered by doj to mr. biden and more of the same from the top that is to say they deny that there is a two tier justice system in the u.s. despite growing evidence to the contrary say critics. >> well that's absolutely not true. justice department prosecutors are non-partisan. dloent allow partisan considerations to play any role in their determines. >> biden's lawyer abby lowell has informed the court the president's son plans to need not guilty as tuesday 10 a.m. appearance and of course we will bring the latest tomorrow morning on fox news.
8:15 pm
>> thank you. let's bring in article iii project mike davis and political investigative reporter at the washington examiner sarah bedford. mike to you first hunter biden in court tomorrow will plead not guilty to three felony gun charges. your thoughts. >> this is a charade. this is part of the biden justice department's cover-up charging hunt weather these gun charges that are constitutionally dubious and do not tie back to his father joe biden when there is clear tlaefd the bidens are that joe biden is corrupted and compromised by 10s of millions of dollars in foreign bribes and other corruption from china ukraine russia kazakhstan. this is a cover-up. this is not going to go anywhere. will pardon his son. >> email hunter biden was suspected of hiring prostitutes
8:16 pm
from eastern european sex trafficking ring during drug bijs and falsifying documents. does the plot thicken a bit here? >> the irs whistleblower says the entire reason the hunter biden investigation was opened in the first in 2018 was because after nexus with some sort of on line pornography ring the irs was investigating respirately so obviously this has always been a sordid part of the tale we know from the irs whistleblowers hunter biden had written off some payments to prostitutes as a business expense on his taxes. those are the types of things that make americans sick. there is a double standard at the justice departments when you see how aggressively justice department is going after people like donald trump for financial crimes for things that most people might think are maybe even lesser offenses and then hunter biden seems to skate by
8:17 pm
year after year, the investigation ongoing the investigation has been sitting at the justice department for years and nothing done. >> and she brings up the former president so let's go that direction he was in court today for this fraud case and said this. >> anybody that does business in new york state is crazy. when you have a radical left attorney general like latasha james who is elected on the fact we are going to take down president trump, she knew nothing about me but got elected on nab basis. >> i think it's important to renote mike that the new york attorney general campaigned on getting trump. she said she was an illegitimate president. >> she is a rabid partisan democrat who has made it her mission to take out trump.
8:18 pm
this is part of a campaign two impeachments for indictments now this civil lawsuit for a businessman paying back sophisticated wall street banks in full with interest. where is the damage? where is the fraud? this is nonsense. they have this democrat clown partisan judge going along with this sha ray. i hope the new york appellate courts fix this. >> sarah hard to campaign from the courtroom your final thoughts on this. >> that's right think donald trump probably won't be there for most of the trial since it's going to stretch until the end of december according to this judge although he will have to be back to potential testify as a witness. this is serious fraud. i think it's clear the way the justice department behaved a law enforcement agency would have enforced this long time ago but the fact is no law enforcement agency was interested in pressing this which is why it's proceeding as a civil case and much revealed in court today may fall outside the statute of limitations but there's no jury
8:19 pm
to decide it's a part san judge so tough break for trump. >> sarah mike thank you both. first up in tonight's round ford motor company announcing more layoffs blamed on the auto workers strike on top of 600 workers laid off from a plant in december and pope francis is indicating the catholic church might bless same-sex unions at some point in response to 5 cardinals asking him to affirm the church's teaching on homosexuality. he said blessings for same-sex unions could be studied as long as they did not confuse the blessing of marriage. heritage foundation suing the biden administration on behalf of moms for liberty seeking information about how the parent rights group was labeled extremies organization. cofounder moms for liberty said in a statement.
8:20 pm
with that let's bring in the director of outreach for prager kids school board president zone what shaw thanks for coming on. it's interesting here because you have the heritage foundation and they're saying that you know that, the department does not, the southern poverty law center is not really just going after them alone, right? they think they might be in cahoots with the biden administration saying the splc officials have made 11 visits to the biden white house and potentially coordinated with federal agencies to create wait calls unhinged mob harassment campaign. they say they're going after the parents and maybe they had some help from the biden administration. >> absolutely i believe it because right now they're labelling moms for liberty as
8:21 pm
the enemy and you can sigh all over the nation they're trying to give my mom or parent who voice concerns about not having a right in their child's education as being tied to moms for liberty so you take down moms for liberty you take down every person trying to fight for parents rights and sticks and bones may break our bones but the government bull list not going to stop us. >> they keep trying. so the palmetto family christian parents rights group you probably know or heard of them they were holding an event and wanted to on the dangers of transgenderism for minors selling tickets on a site called event bright. they're being told quoting here, we have determined that your event is not permitted on the event bright platform as it violates our community guidelines and terms of service specifically our policy on hateful dangerous or violent content and events.
8:22 pm
and the transgender person who was wanting to second thoughts is saying this is ridiculous and your thoughts. >> it is ridiculous and sad and one thing we always continue to champion at prager u kids with parents and teach horse subscribe be brave don't be afraid to assert what truth is and chloe cole the young woman involved in this actually came to interviews with us at prager u, and my question is event bright cites hate speech as not wanting the event to go on but chloe cole's story is true, there's nothing hateful about so event bright i ask you as a mom how is your speech not hate speech toward someone like chloe cole who is trying to sheds truth and light? >> exactly right you bring somebody saying i made a mistake and wish i hadn't done this and want to warn other people it's
8:23 pm
not hate speech. it's your personal experience and is one of those things you're surprised they're taking this route. this is parents families and friends of le beens and gays and this is april the group from nazareth together are bank the moms for liberty again and the quote is libraries are essential especially in small towns where diversity is not prevalent. moms for liberty is not going to ban any of these books. they're simply saying we don't want 5 and 6-year-old's reading books filled with sexual content and innuendo. >> that's correct. they use the words book banning because they know that can be unlawful but the fact is we are getting rid of books that shouldn't be in the hands of children. neither should porn. people that don't stand up for
8:24 pm
this are part of the problem and putting porn in cartoons to try to get the kids to see it is digs turk. all of them should be arrested in my opinion. book banning call it is what it is we are going to continue to get rid of that nasty stuff out of the reach of children. >> 15 seconds. >> one of the books maumgs for liberty is calling to be banned is called push by and author named sapphire and if i were to read aloud any of the pass acknowledges in that book the fcc would shut down fox news and i would be arrested. >> they almost shut down the congressional hearing when the senators were reading some of the books in public libraries. thanks for coming on. brand new polling on what voters think about the presidential frontrunners. it's all about the enthusiasm and one democratic candidate is lacking it. later in the night there's a list going around social media sharing habits that can help

>> first up in tonight's real crime crisis round up new video from philadelphia police showing people let'sing businesses last week nearly 70 now charged with participating in the multi-day
8:31 pm
crime spree targeting apple and other retailers. new york city professor who threatened the life of a veteran "new york post" reportser with machete pled guilty to menacing rodriguez must complete 13 months of behavioral therapy. new polling from monmouth urmts insight what voters think of the presidential frontrunners. leslie happy birthday former spokesperson for the recall gavin newsom economy. this is too old to serve another term our first poll it's interesting because you look there biden too old 76 percent a number of two trump too old 48 percent, and 76 percent that's a big number. >> it is a big number but i think it comes down to who is ask tenth. sometimes trace with age comes
8:32 pm
wisdom but in politics nowadays it's got to be such a divisive war the age number now is a hindrance. i know a lost 80-year-olds who are even members of congress who still have it together but it doesn't take a rock it scientist to figure out there is something amiss with joe biden and even with donald trump. if presidency ages people. it really does and that's and fact. >> you wonder because if democrats are reading into this you tell me this is the enthusiastic about the candidate becoming the party nominee and you look at these numbers and what's important is you have biden and trump the enthusiasm 37 percent but you look at republicans how enthusiastic they are 78 percent look at democrats, 68 percent for joe biden. it's one of those things you wonder if maybe there's a little bit of enthusiasm gap. >> this is deja vu.
8:33 pm
they said the same thing in the last election, my party wasn't enthusiastic, people came out in voted in record numbers for joe biden. i think that's going to happen again. this is why. in the last several general elections we have seen a repeat and i think are going to see that for some time which is we have a country that's almost exactly split down the middle. we have that sliver of about five swing states and independent voters in those states that push somebody over the line but at theen of the day republicans most likely going to vote for their candidate, democrats for their candidate even if they think they're old and are not enthusiastic. >> we will see biden 26 percent approval on handleing the border crisis new york governor hochul says this. >> we want them to have a limit who comes across the border.
8:34 pm
it is too open right now and people coming from all over the world are finding their way simply saying they need asylum and the majority of them seem to be ending up on the streets of new york. that is a problem for new york city. >> it is a problem for new york city and other cities. the democrats are coming out. the border has become a prominent issue for the democrats. >> the border used to just be between the southern bother. now it's the entire world is invading the united states and sometimes be careful what you ask for in politics. be careful if you believe in sanctuary cities like kathy hochul and gavin newsom and everybody believes in sanctuary cities but again even during the recall campaign against gavin newsom everybody believed in sanctuary cities. now people who run those cities say i need help. i'm being invaded. >> final thoughts. >> immigration is not something any president left or right is going to fix with stroke of a
8:35 pm
pen. this comes to congress republicans and democrats who failed the people by not putting together a comprehensive immigration package. you can't have an antiquated system and people coming here to a my for asylum. >> i keep saying comprehensive immigration form does not close the border. i don't care what you do. it doesn't close the border. to close the border you have to close it. there's no piece of paper or law that will slow gown -- down migrants. are you ready for it? taylor swift getting people to watch football. guess how many millions watched the chiefs jets game last night. and a look inside the high tech las vegas sphere and is this house fire real or fake? here is a fox news at night trip live look at seattle, washington. well we had it and it went away,

8:42 pm
her. lip readers say swift was making comments about kelce and seen embracing his mother. the game drew 27 million viewers and the chiefs ended up beat the jets. the nfl is reportedly seeing an economic boost as swiftys who don't typically watch football are buying kelce gear and game tickets. >> texted that maybe i'll see travis and taylor hug or wave at each other. maybe that's impacted my motivation to be here. >> however not everyone is in tune with swift taking the spotlight at a football game. bar stool sports fuounder tweeting. the average cost for ticket to yesterday's game shot up 35 percent after the news that swift would be there.

8:44 pm
and i heard one story after another, one particular girl who was isolated alone in her closet praying she didn't wake up the next day and this was just one of many stories of girls who felt like they couldn't cope and they were not okay and so, i felt like i knew the answer and i had to do something and the answer was prayer and we began meeting on auburn's campus once a week every friday from january to may we met we prayed. it grew from 5 students to about 200 and then on september 12 god moved on our campus as a result of those prayers. >> the pictures are amazing and it is one of those astonishing things we saw happened last year and i wonder if it's bubbling up again. to you jeremy because freedom from religion says about coach freeze and the athlete pap tichl quoting auburn sports programs are full of young and impressionable students at
8:45 pm
athletes . . . and you say what, jeremy? >> well, it's unfortunate someone has such a cynical take on what is otherwise a remarkable movement across this country and there in auburn where lives are being changed because people like tanya and others are spending time praying and hoping that thing will get done on campus for students in desperate need of some of the love and it happens to be others like tanya that come and love them and coach freeze doing christian things as a christian. founding fathers wouldn't be bothered by that whole thing. i want to talk to students across the country at their campus, don't shy away the from this. the free exercise of religion protects your right to do this type of thing and moms across
8:46 pm
the country you can too. the first amendment is here to protect you and if you have any questions about that go to first liberty.org so we can help out. >> lastly to you tanya what do you think is happening at some of these universities across the country including auburn? >> i think that christians are rising up and they're want to go not just unite their student body not just unite their college campus. i think they're rising up. they want to unite the nation also they want to see god move. they want to see freedom come. we have students that are saying hey, i was invietdz to this event. didn't know anything bit. i walked in contemplating suicide. i walked out with the most joy i've ever had in my life. we had one of the guys that was baptized said i've been battling addiction for ten years and for the first time i felt free. that's what it's all b. prayer
8:47 pm
