hunter biden about to appear in federal court in delaware. we expect he will plead not guilty on that felony gun charge. at the same time, here in new york former president donald trump about to head downtown. it is day two of his civil fraud trial. also in new york, the crypto king, sam bankman-fried, appears for day one of his fraud trial. we'll watch it unfold together coming up. breaking news from overnight. sitting u.s. congressman carjacked at gun point in the nation's capital. good morning. i'm bill hemmer. dana has the day off today. welcome to a big show to our colleague and friend, gillian. >> gillian: i'm good. thank you for having me back for day two. i'm gillian turner and this is "america's newsroom." the victim identified as henry cuellar. as he was parking his car tonight three armed assailants

approached and stole his vehicle. he wasn't harmed and working with local law enforcement. thank you to metro pd and capitol police for recovering the congressman's vehicle. let's go live to griff jenkins on the scene. what can you tell us this morning? >> well, i can tell you the residents walking these streets this morning are rattled. they say this is far too common. i will let you take a look here. you mentioned capitol police have a cruiser parked here in the navy yard area just a few blocks from the capitol in between the capitol and the national major league baseball stadium. the buildings here house many professionals on capitol hill to include members of congress. this is the one that congressman cuellar lived in parked out front when it happened 9:30 last night. three assailants approached him at gun point. his phone, ipad and luggage were in the vehicle. this morning his car was

recovered by the carjackers are still on the loose as officials look for them. it comes as carjackings are surging in the nation's capital. 750 so far this year, up more than 100% from last year. 75% of those cases, a gun was involved. now, a sad note, there is only a 25% closure rate on these carjacking offenses. james craig, running for the senate, says when he took over in 2013 in detroit more than 700 carjackings, got it down to 200 but far too unacceptable. here is what he had to say earlier. >> it's a very violent and intrusive crime. here we got per capita more law enforcement and not just the texas congressman, you had another lawmaker who was a victim of crime just in the recent past. >> interestingly, congressman

dan kildee, democrat of michigan walked out of the doors a few minutes ago. i asked him about it. he said it was very concerning. he spoke to congressman cuellar but said the attacks are far too common. remember in february, gillian, angie craig assaulted in her elevator building had to fight him off. this is all a part of concerns both among now members of congress and residents in d.c. that the policies towards crime in the nation's capital are far too soft and they need to get this under control. gillian, send it back to you. >> gillian: i'm grateful to be in new york for the day. thanks very much. >> bill: ted williams, homicide detective. what's up with this? motor vehicle theft up 106% from a year ago in washington. robberies up 68%, homicides are up 37%. happens at 9:30 at night and a nice part of town, ted. >> a very nice part of town.

but i have to tell you, crime is off the charts. there is a crime wave going on in the district of columbia. i have to tell you where this carjacking took place is not too far from my law office. it also is not too far from police headquarters. just think about it. over 700 carjackings alone in the district of columbia. not only that, but we've got over 200 homicides that have taken place. we've got everything in this -- when it comes to crime is out of control. guess what, guys? remember when the city council wanted to defund the police? and they also now have put in a reform bill that support criminals more than the police. they've got to make some changes in the district of columbia. >> gillian: there is a lot going on in the city, obviously.

in july we got a new police chief. i live there. i'm a d.c. resident. the same month that there were those two shootings at howard and catholic university resulted in somebody being killed. the high-profile murder of the lyft driver and you have the mayor in a heated fight with d.c. city council about putting forward some legislation to try and curtail the crime. what do you see is the best way forward from here? >> the best way forward is for the city council and for mayor bowser to get on the same page. mayor bowser is wanting to do something positive. the city council is more concerned about criminals and putting in reform to protect criminals than to protect law-abiding citizens in the district of columbia. >> bill: i want to share this with the viewers, a republican from wisconsin, his district is outside of milwaukee.

back in mid september, two weeks ago, he did this with a group of folks who live in d.c. >> how many people at some point during the past year have felt unsafe in washington, d.c. for their personal safely safety? how many people know someone who has been a victim of crime in the past year in washington, d.c.? >> just about everybody in the room raises their hands. your point is well taken. go down to philadelphia now and roll this video. this is a road rage case with a bunch of kids inside a car. the driver of a motorcycle, the driver of an atv and the driver of the car, they just start going at it, ted. it goes on for some time. he jumps on the back of the car starts breaking in their windshield of the driver there. this is center city, philadelphia. we've been reporting on this for years in that town. >> it is very scary because the incident in which you are here describing is that guy got on the back of that car to break

out that windshield, a gun dropped out of his pants pocket. he got out. put the gun back in. the one thing i was very concerned about looking at this video is that the occupants, the driver of that car, the mother of two of the children that was in that car, got out and confronted this guy. this is something that you should not do. you should not confront somebody like this. drive, get to a safe place, use your phone, call law enforcement. but you should not get out and confront somebody under these circumstances. but this is what is going on. this is the exception, guys. this is sadly this is the norm of what is going on with crime waves these major metropolitan cities. >> bill: you are right. more to come in all likelihood. >> gillian: an update on the

story we brought to you yesterday. state police have rescued a 9-year-old girl who vanished on saturday in a family trip. she was inside a cupboard in an rv. they have a custody in jail. >> after a terrifying 48 hours, you have basically given the most amazing detail. the 9-year-old was found alive. she was found safe and reunited with her parents and a suspect is now in custody. the fourth grader had been found hidden covered inside a cabinet inside a camper where the suspect lived behind his mother's double wide house. 47-year-old craig nelson ross junior, was arraigned overnight facing kidnapping charges. additional charges are anticipated. new york governor kathy hochul detailed how ross, 46-year-old

led to his own capture. investigators believe he dropped a ransom note at 4:20 in the morning yesterday. a fingerprint from that note went into a state database hitting a 1999 dwi out of saratoga. police leaders praised the special operations response team that performed an entry and subdued the suspect who suffered minor injuries. >> highly trained and capable unit we use for this type of thing and what they train for and live for is to make entries like this and save someone's life. >> charlotte's aunt released a statement saying we're thrilled that she is home and we understand that the outcome is not what every family gets. a huge thank you to the f.b.i., new york state police, all of the agencies that were mobilized and all the families, friends and volunteers. a family friend of the sena family says charlotte is doing well thanks to police.

>> i went to albany for examination and by all accounts everything is good. >> charlotte is home and ross is now being held in the saratoga county jail with no bail. gillian. >> gillian: molly line for us. what you look at there, viewers at home. we got this into the newsroom. a mug shot of the suspect after he was taken into police custody there. first time we get a look at him. >> bill: crazy story. shows up at the house at 4:20 in the morning. we wonder if he knew the girl and family. police maybe shed light on that at the news conference. 47 years old. about 45 minutes north of albany, new york. that mug shot is rather interesting. you wonder what was going on in his own personal life. we may get details on that also but again i think the key in this is to whether or not he knows the family. how did he know where that mailbox was and the residents

hunter biden both facing legal challenges on the same day at the same time. former president expected back in court as i mentioned. that $250 million civil trial against him. also in delaware hunter biden will be arraigned on gun charges that were filed after his earlier plea deal collapsed. this thing has gone back and forth and now it is where it is back before the judge. david spunt has more for that case outside the courthouse now. david. >> bill, good morning. we're waiting for hunter biden to arrive here to this federal courthouse in wilmington, delaware. not here quite yet. court begins at 10:00 and we expect at some point soon they have to go to security and talk with the attorneys before the hearing begins. we're told hunter biden will plead not guilty. we know so because his attorney said so in a court filing just a few weeks ago. it relates to three felonies surrounding a gun purchase from

2018. he is back in this federal court building after this plea deal famously fell through in a very public way. he was charged with lying about drug use on a form to purchase a gun, lying to an employee at a gun shop and physically possessing the gun. his attorney maintains he had it for less than two weeks. now this plea deal was supposed to be just maybe about an hour back in july. it went several hours when the judge asked pointed questions about the proposed deal. it ultimately fell through. now hunter could face up to 25 years behind bars but that's unlikely given no prior felonies. part of the original plea deal included a diversion agreement on this specific gun charge, bill. it would have allowed hunter to avoid jail time by pleading guilty, special counsel david weiss said that agreement is null and void. hunter's attorney said it is valid since it was signed. the tax charges are still out there. we know they are out there because special counsel david

weiss said he would likely refile tax charges against hunter biden in either washington, d.c. or california where he lives. another quick note, hunter biden will appear before a magistrate judge today, not the same judge who famously blew up that plea deal. of course, it is notable today he is pleading not guilty to something he was ready to plead guilty to just about two months ago. >> bill: remarkable stuff. turn of events. see how it goes. not expected to be a long hearing. we expected the last one to be brief. we'll see. david, thank you. >> you never know. thank you. >> gillian: let's get into it with jonathan turley, law professor at george washington university and constitutional law attorney. jonathan, you have today for hunter biden as sort of the culmination of this four-year investigation into taxes and foreign business dealings and

today it's illegal gun possession. it's interesting. >> it is interesting. in nightmare i shall way for the biden family. it was rip it up. those were the words of defense counsel when this matter back controversial before the judge in delaware. the judge had asked why the gun charge provisions of the plea agreement contained a sweeping immunity deal for hunter that would seem to hold him harmless of any crime. the prosecutors admitted at the time that they had never seen anything quite like that and the whole thing collapsed. in the middle of all this, according to reports, defense counsel stood up and told the prosecutors to just rip it up. and they did. and this is what happened. because once you basically have

a deal like this collapse in court and you break off any agreement with the department of justice, they tend to go at you full bore. they tend to go for all of the possible charges and we're already seeing that on the gun side. we may see it on the tax side. >> bill: today's hearing he will enter a plea, the judge will tell him what is expected and what do you expect from the hunter case? because the trump case could go into december if not into the new year. but on the biden case, how long? >> well, the interesting unknown here is whether the biden team will challenge the underlying federal law. this is a law that hunter's father supported and they would have to challenge it on the basis of supreme court cases that president biden opposed vehemently from the supreme court. so it would be a bit of a reversal of fortunes and that could indeed be their plan.

they could be arguing that recent federal cases makes the underlying statute unconstitutional. that would create a rather interesting dynamic for the white house. >> gillian: let's look at former president trump now on his way or about to get on his way from trump tower back to the courthouse in lower manhattan. his team seems to believe they had a pretty good day yesterday, if you listen to what his attorney said this morning on our air. take a listen. >> that's right, so remember originally we had a decision that came down from the appellate division that disimmediate aivanka trump and addressed the fact that statute of limitations and limitations on years that they can go back. our position. this judge did not acknowledge it until yesterday when he said you just spent the entire day wasting my time effectively. 2011 is what we looked at.

it was great. i'm happy that he acknowledged it. it was a good step in the right direction. >> gillian: what do you think? >> well, it's hard to say how the judge will actually rule. that acknowledgement was important, although it is notable that it's rather belated. the trump team had to go to court to force this issue on the statute of limitations. if the court ruled along those lines, it would be a huge advance for the trump team. i think that quite frankly yesterday was a success because the former president got what he wanted most, which was an appeal to the court of public opinion. every time he is shown being dragged to this court in this long procession, i think it's going to inflame people in the country who view this as a political prosecution. it will also thrill many. that's the problem.

is that we're watching the same scene and this country is seeing two vastly different things. but trump knows the public well. he was the head of one of the most successful television programs on television. he reads the public pretty darn well. he showed that when he won the presidency. i think that he views this as a no-brainer, that everything about this case fulfills his narrative. you have an attorney general who ran on the pledge to bag him on anything. she didn't even have a specific crime. she just promised that she would get him. you have a case where there is no real victims in the sense of banks saying they lost any money. you have an extraordinary prosecution in size and scope. all of that works for trump. he knows it. >> gillian: jonathan, we have to leave it there. >> bill: don't go far.

damage control for pulling a capitol hill fire alarm on saturday. his office then released a memo which suggested talking points for democrats. one of them says this, i believe congressman bowman when he says this was an accident. republicans need to instead focus their energy on the nazi members of their party before anything else. karl rove is with me now. good morning to you. and then bowman tried to clean it up and went to x and said this. he said i just became aware that in our messaging guidance there was inappropriate use of the term nazi without my consent. i condemn the use of the term nazi out of its precise definition. it refers to members of the nazi party and neo-nazis. it sounds like a mess. who believes him? >> it is a mess. it is a mess and rather than apologize, he could help make this thing go away by saying i apologize. i was unaware of this. completely inappropriate and

apologize to my republican colleagues. and that it was an accident. it wasn't an accident incidentally. he is standing at a door that says emergency exit only and he goes to a box that says fire alarm and pulls it. what did he think it would do? somehow open the door? no, he was deliberately calling a fire alarm in order to delay the vote on the continuing resolution. and he should be in some way, shape or form punished for this. i do not believe that the effort to expel him, however, is a smart thing to do. better to censure him or make him a public spectacle. the try to expel him. in the history of the u.s. house of representatives only five members have been expelled. three of them were expelled in 1861 for taking up arms against the united states. one of them a missouri congressman was the commander of the confederate forces at

carthage and expelled him after that. we expelled one in 1980 for anticipating bribes and i was at the white house during this one. one was indicted on ten counts of bribery, tax fraud, racketeering and other things and ended up serving seven years in prison. those five members of the house were expelled. pulling the alarm is worthy of censure but expulsion is over the top. >> i don't know why it's gotten so much attention. i was in a rush to go vote, man. aoc said give me a break. they are filing a motion to kick out a member in a moment of panic was trying to escape a vestibule. peter gave a good try at the white house yesterday. >> would president biden ever try to get out of a meeting by pulling a fire alarm? >> are you talking about

doing something stupid to delay a vote. >> bill: love the history lesson as always. have a good day. >> gillian: another closely watched trial this morning. crypto king sam bank man fried is due in new york federal court and jury selection is good to begin. kelly o'grady is outside the courthouse in downtown manhattan. kelly, what's the scene? >> hi, well federal prosecutors are calling this one of the biggest financial frauds in history. it also is one of the quickest demises of a business we've ever seen. 11 months ago sam bankman-fried was living in the bahamas and having influence in washington. now he is charged for stealing billions for his use. where did all that money go? bankruptcy efforts have

recovered 7.3 billion of the missing 8.7. unclear if you will ever see the 1.4 billion. today's trial is not about the complicated crypto world but good old-fashioned fraud. he is charged with seven counts of fraud and conspiracy. if convicted of all the charges he faces up to 110 years in prison. one of the big questions we've been getting a lot. what narrative you believe. monster or incompetent ceo how did he get such storied people to invest? we talked to a number of folks close to him. it was a mix of missing out on the crypto space and pedigree. jury selection today is very important. it doesn't matter whether he committed fraud or didn't, it matters if the 12 jurors think he did. >> gillian: thank you. >> bill: as you can tell we're tracking several fronts live this hour. hunter biden set to arrive in federal court in wilmington, delaware. this is a reversal of a case he

great significance for hunter. he is looking at a potential of 25 years even though that is nothing like any sense that he would likely get. he is a first offender. this isn't connected to any crime. indeed, he wouldn't be facing these charges if they simply renegotiated that plea. but things fell apart and now the government is going full bore. what will be interesting is not just the question of whether they will challenge the underlying law, which his father supports vigorously. but there was a suggestion by his lawyer abbe lowell who got out of the car first, that there may be a factual dispute that lowell suggested that despite this long period of addiction, that he signed this form during a period of sobriety. so what lowell said is we believe that he sort of came out of his addiction, even if it's

briefly so, because he finished rehabilitation. so when he signed the form, he actually wasn't using drugs. that's going to be a rather curious argument to make because they have been using his addiction as sort of a get out of free jail card in the past scandals. >> bill: professor, this is an extraordinary moment. we have a split screen where the son of the sitting president who for all intents and purposes we believe will run for re-election in 2024, while at the same time the former president is also before a judge at the same time, the same hour of the day and he, too, is seeking a trip back to the white house. this is biden versus trump so far as we can tell at the moment. it is just an extraordinary moment in american history to merck this. >> gillian: it was just sunday that we saw the attorney general insisting there are not two systems of justice in this country. the split screen you just put up there is going to be the

ultimate test of the var tee of that statement. >> bill: you mentioned, professor, he could face up to 25 years in prison in convicted. what is your realistic expectation if a conviction comes? >> it would not be uncommon to see a judge avoiding jail time for a first offender. but often the department of justice, when a plea bargain falls apart like this, will seek some jail time even if it's relatively short. the idea is that, you know, if you break the deal you face the wheel. and here the justice department is going with all of the charges they think they can bring on the gun side. they could ask for some relatively short period. i would be surprised if this was a significant jail period that was even sought by the justice department. we have to see how it unfolds. there are still torpedoes in the water, that includes the tax

warning democrats to wake up to the nightmare that's playing out across the country. blue cities once boasting about being a sanctuary city changing their tune in a significant way. in chicago migrants forced to sleep in local police stations. in new york the mayor eric adams deterring migrants from trying to enter the u.s. illegally will go to the southern border and tell them that. jeff paul has the latest in eagle pass, texas, to bring us up to date on today. jeff, good morning there. >> we are off to a steady start here in eagle pass, texas. the sun has been out for only an hour and a group of 50 migrants cross into the u.s. they were crossing over the rio grande, over the razor wire and still made it onto u.s. soil. it's a similar story southeast from here where over in brownsville our crew on the ground found a large group of migrants that turned themselves into authorities for processing. right up the road from there, that is where we're seeing some

of the largest groups coming across the border. this is just one video. the sheriff's department shot it at the fort brown golf course in brownsville sunday night. over the last 72 hours authorities say more than 3,000 have crossed in this area. that steady flow of migrants up and down the u.s./mexico border here in texas has some business owners all over those border towns on edge and worried about their bottom line. >> have had multiple people throughout the week tell oils we don't want to go downtown at night anymore. you don't know if it's safe. it has me wondering do i get security cameras and make sure to have every corner covered and stuff like that. >> that business owner is in el paso where you can see many migrants are now camped out in the city's downtown area. there are so many in the area looking for shelter and food. the city just opened up a new shelter at an old middle school in the area. as we know and as we've seen,
