at hvcu baltimore police and fbi issued a shelter in place order as the swat team went dorm to dorm in search of the gunman. the order has since been lifted. >> brian: class at morgan state canceled. we will continue to monitor the story and let you know what happens when police make an arrest. hopefully soon. >> brian: talk about the other big news that happened and yesterday it's just stunning. from the press conference that followed from the vote that took place, we saw something that we haven't seen in american history. after 200-plus day stay as speaker of the house, speaker kevin mccarthy is now done, ousted and right now they have no idea who is next. >> ainsley: he is the shortest serving speaker since 1875. he says he is not going to run for speaker again. he is calling these eight republicans not real conservatives. only 8 of them that ousted them. matt gaetz just needed a handful of republicans to side with the dems. 4% of the g.o.p. g.o.p. were those eight republicans and they joined with 208 democrats.

and paul ryan ended up being the speaker. we saw the vote after vote for him to become speaker. and part of the thing. the criticism that was made during that period of time is that the speaker made concessions with the freedom caucus, and he said that there was going to be 12 appropriations bill by september the 30th, they did not happen. there was no balanced budget amendment. that did not happen. term limits did not happen. and many republicans say even the ones that decided to note to oust him that the speaker had this coming because did he not keep his commitment to the american people. >> ainsley: sorry, lawrence, he took those six weeks off this summer. >> lawrence: without getting appropriations bills. >> ainsley: everyone is upset with him those voted against him he said he made those promises so we could balance the budget or we could fund the government and that didn't happen. he didn't follow through with his promises and also took those six weeks off in the summer. what does this mean for you and

i mean, we're getting email fundraisers from him as is he doing it. join in quickly. that's not governing. that's not becoming of a member of congress. and regardless of what you think, i have seen the texts, it was all about his ethics. but that's all right. >> steve: you know what result ultimately had the democrats, who he has worked with in the past about a dozen of them said okay we will help him out, he would still be speaker today. apparently yesterday morning hakeem jeffries who is the minority leader, he said okay, we thought about it, let's not support him. and then what he did was he went through a laundry list of republican unwillingness to break with maga extremism is the way he suggested it. he said that the democrats were unhappy with mccarthy's vote to overturn the presidential election results. after january 6th. mccarthy was one of 147 republicans who voted that way.

hates kevin mccarthy. >> no doubt about it. >> was determined to get to today. i think it's disgraceful and i hope they expel him from the conference. >> in the meantime the big question is who will ultimately take the job, filling n the meantime, congressman patrick mchenry who is speaker pro tem. is he reportedly not interested in the job already making waves as fill-in speaker. he asked congresswoman nancy pelosi to clear out of her ceremonial office last night. she is held in the capitol saying it will be re-keyed today. one name though that has been recirculating majority leader steve scalise who has been calling republicans overnight seeking supports for speaker, is he meeting with a group of texas republican members today, a powerful voting block in his bid for speaker. congressman tony gonzales announcing last night. scalise has his vote. another name, house judiciary chair jim nt jordan could also be a possible pick if if he were to officially want to campaign for speaker. is he reportedly making calls.

remove him from committees. that's a precedent that democrats set when they were in the majority last congress removing people from committees. so they could isolate and alienate gaetz and do whatever they can to try to segregate him from the larger conservative republican caucus. >> steve: put him in a box. >> ainsley: hillary, it's been reported that steve scalise has been calling people behind the scenes i would like to be speaker. are you hearing that? >> yeah. exactly. he is already getting some support. congressman tony gonzales backing scalise officially. and we're hearing from a lot of the members he was a name that repeatedly came up during the several rounds it took for former speaker mccarthy to actually get the gavment he was someone who had a lot of support from the very beginning, but he has said himself he is not interested in the job. now that mccarthy has said i'm stepping aside. scalise, it seems, is interested in trying to coalesce some support. >> brian: the word is they weren't speaking much to each other anyway even though he has the blood cancer and the other situation. >> ainsley: how is his health.

son was doing and whether or not he participated in discussions the goal post may move again with regard to the hunter biden case. >> so now i'm not going to talk about anything they talked about. >> right. it's a little crazy. real quick, one other thing. the judge down in lower manhattan imposed a partial gag order on the former president because of disparaging remarks he made on truth social about the court clerk supposedly being chuck schumer's girlfriend or something like that. he put that up and took it down. >> that's barely a gag order. will a typical gag order substance of the case intimidation of witnesses and meant to prevent prejudicial information getting in front of the jurors. if there were a gag order potential for challenging it. because it is so narrow and limited they are not even going to gor challenge it. >> steve: one other point you were talking about during the commercial. you think the president is trying to do something here. >> i have a theory it hasn't gotten much play. i think is he actively engaged in the civil case.
