program, you went to court to fight for that. if this is such a problem, building 20 miles of wall, why not just go to court. >> we went to congress. congress appropriates the funding, we asked them to not use the funding for that particular purpose they denied it and now we are complying with the law. >> if you have to build a border wall but you don't think it's going to work, once it's done are you going to tear it down? >> i'm not getting into hypotheticals from here. i'm just telling you what i can tell you from here, the facts are, that dhs is complying with the law. this is from fiscal year -- under fiscal year 2019, under republican leadership and dhs is required to do this. the president asked multiple times of congress to reappropriate, they did not. and we are not complying by the law. thanks, everybody. >> sandra: clearly peter doocy getting questions at the end. if he had the chance, you know, she has obviously left the room. if the president continues to

believe the border wall is not effective, why is it not effective, and he's challenging her on are you going to go to court over this? tear down the wall once it's built? and what is more effective? what are they offering up to stem the flow over the border that mayorkas is clearly identifying is building a massive problem for this country. >> john: i mean, she came up with a litany of things, none of which experts think will stop people across the border. >> sandra: steve hilton is jumping on, your reaction to what you heard. >> and everything we heard. i heard most of the briefing. honestly, sandra, i don't know, what, nearly 35 years of me being involved in government and politics one way or another, i don't think i've ever seen a more degrading and despicable spectacle. shamelessness of the lying exactly as you pointed out.

this is the big story of the day. you know if you are the press secretary that you are going to get most of the questions on this. you know that your team will have shown you before the briefing all the relevant information, including the statement from mayorkas. and yet she pretends she has read it? that is just a bare face lie and it degrades karine jean-pierre even to say that. it's despicable because what you just saw there is this administration treating the american people like fools. the idea that they claim they are standing behind this idea that it's not their policy to break the law, they are going to follow the law, exactly as peter doocy pointed out. they break the law the whole time when it suits their political needs. as he pointed out, on student loans, by saying it's all because they have to do it. if they had to do it, why are they rushing through all the last-minute waivers of federal law in order to get it done. it is absolutely despicable.

and one final point, the most important, that gets to the substance of this. the actual policy change that we are seeing here. not the handling, but the substance. it goes to their character, because why is it that they are finally acting after all these years of seeing the cruelty, the inhumanity, the chaos at the border affecting so many people across america, the final moment when they actually act is when it starts affecting them politically, in the states and cities they run. when they get democrat mayors and governors and activists as we saw in chicago, complaining about it. that's the only moment that they actually act. they don't care about anyone except their own political fortunes and what biden has always been, a cynical, small-minded, machine politician, and that's this in action. >> john: it's clear, steve, the offices at the white house said here is how we get out of this. tell them we are going t break the law, we have to comply with the law but as sandra pointed

the same degree of pain and resentment in border states at any point in the last, what, two and a half, three years. yuma, arizona, one example, 250,000 people? you know, it's just been an absolute catastrophe for border states in those parts of the country, tend to be more republican voters. they didn't care about it at that point. they couldn't care less. but now when they see on their doorstep and their back yard, suddenly it's a problem and they are reversing this policy of being against walls because they are racist, honestly. >> sandra: let's not forget, it's not just a reversal on the administration, as far as president biden is concerned, it's a complete reversal from where mayorkas a short time ago said he stood on this issue. this was mayorkas talking about the -- in his own words saying the border is not open, that it's secure. here is a bit of it. ok, the border is not open, i'm sorry, i think we are confusing

this. sot 3 for hilton. >> the border is not open, congressman. >> it would be wrong to think that the border is open. it is not open. and i just want to be very, very clear about that. >> the border is secure. >> sandra: ok, the border is secure. ok, and that is now -- now fast forward to today, mayorkas with the statement to the federal register, there is presently acute and immediate need to construct physical barriers and roads in the vicinity of the border of the u.s. in order to prevent unlawful entries to the u.s. in the project areas. steve, since you and john and everybody keeps talking about it, this was the moment in the briefing room where karine jean-pierre just minutes after she stepped up to the podium took a question about that statement and said she didn't know anything about it. listen. >> border wall is ineffective, why is the homeland security secretary saying it's necessary to prevent unlawful entry to the united states. >> i have not seen that full -- i hear you, i'm saying i have

not seen his full statement on that. >> sandra: how concerning is that? steve. >> she's lying, of course she's seen it. it's a total lie. if the idea is that she goes into a premeeting, that's what they do, we all know that's what happens as john said, all the different policy shots from around the federal government, they come in with prepared answers for what the questions might be, the big story, idea she has not seen the statement that initiated the whole process is preposterous. she's absolutely lying. she has to have seen that statement. that's the heart of the story. and so what you've got here is a bunch of people who are so embarrassed and ashamed of what they have done, first of all, the policy failure that led to this catastrophe, and now the absolutely humiliating policy u-turn they are building the wall that they decried as racist and despicable, what do we tell our children, if you make a mistake, own up to it and

apologize. and here we have the leaders of our government behaving in the opposite way. totally disgusting. >> sandra: and steve, by the way, i remind our viewers, john, that is -- these are live images, eagle pass texas. our flight team brings us this drone footage and this is happening right now. think about the split screen, of the white house insisting still the borders are closed, that walls don't work, and this is the flow that is happening as we speak. >> john: and it has just grown so much since the first border crisis in the last couple of decades, in 2014. it's unbelievable. steve, thanks for your thoughts. really appreciate it. now let's turn back to 1600 pennsylvania avenue, peter doocy is on the north lawn, he was just in the white house briefing as we know. peter, what did you make of karine jean-pierre basically popping smoke and hiding behind it? >> well, there was something else you were talking about this

federal register where mayorkas puts in plain black and white text that there is an acute and urgent need for new physical barriers to stop people from coming across. and the press secretary was characterizing this as old news, something that they announced a couple months ago in june and this is just a step in the process. however, i went back and looking at this, federal register, part of the announcement that was posted overnight says as of early -- as of early august, 2023, border patrol had encountered over 245,000 such entrants attempting to enter the united states between ports of entry in the rio grande valley sector. and so this is something that is brand-new, and we appreciate the press secretary getting to us there under the wire at the end. it does seem like there's going to be a lot here tomorrow. >> sandra: peter, i could not

help but think when hearing the questions from the media in the room, while great questions, where have you been? what did you think or make of the change in pressing of the press secretary by members of the media there? >> i think that might be the first briefing since the baby formula shortage where the whole entire room basically for the first time is on almost the same subject. there are very few things that happen, but really this is an easy one. we ask about immigration all the time. president biden was on camera by zoom during the 2020 campaign, he said there will not be another foot of wall constructed in my administration. not in my administration except for what the trump people appropriated. something else that's interesting is that when we ask about this pretty routinely, we are often told that they are

just not getting any help from republicans. they put forward funding and republicans keep blocking it. well, in 2019 the money that would be appropriated down there would be from a republican president. this is republican money. and we see them go to court to fight policies that either congress or other, lower courts say might not be constitutional, might not be right. and they fight them. this is something that they are choosing not to fight and just saying it's part of the process. >> sandra: well, good of you to get those questions in there, peter. you are helping everybody by seeing what exactly this white house is thinking, and a stark contrast to what mayorkas just announced. so -- >> and something else that is just worth pointing out from that briefing. we know that president biden has been to the border once in his life. it was as president earlier this year. mayorkas is down at the border

all the time, and so it does seem like his opinion on this has changed but he's also the one that goes a lot. >> sandra: great point. >> john: our viewers saw the sausage being made today, peter. good job at the white house today. see you again soon. all right, the other big topic at the briefing today, the white house also being pressed over the handling of president biden's 2-year-old german shepherd, commander, who has now been removed from the white house campus after going on a biting spree. seems he's developed a taste for secret service agents. our next guest specializes in improving behavior of the nation's most aggressive canines. dog training expert and host of the "no bad dogs" podcast, tom davis. it's been said and you say no such thing as a bad dog, just a bad owner. why do you think commander is biting? >> i think it's a bigger picture of it's his responsibility. from a dog training standpoint,

our job is to train the owner of the dog in how to make better decisions and how to be trained and how to behave in any situation. and if you are somebody who hires somebody maybe for landscaping or plow your driveway or fix your car, you are hiring an expert to do that. with dogs, we are hiring, you are hiring us to work with you. so this is major. there are so many dogs out there getting put down and killed and shot in the street for way less than what's happening. and you know, there's a great post, joe rogan posted, imagine if my dog bit 11 people, 11 secret service members. it's sad for the german shepherd community, they are great, loyal, smart, intelligent dogs and the fact this dog has been able to bite 11 people on staff is -- it's frustrating, it's sad, and it's everything that no dog trainer or no dog lover

wants to see. there's millions of americans that are probably shaking their head at this regardless of what you believe in politically, it's a shame this dog is getting the short end of the stick of lack of accountability, structure, and -- >> sandra: so well said, tom, dog owners and lovers all over the country said so many said bad dog, bad dog. well, a dog like this needs a lot of rules, a lot of barriers, a lot of boundaries, that's super important. but those boundaries, they also, they protect the boundaries. so if they ever feel threatened. is this just a tough environment in general for a german shepherd who are very protective dogs to have so many different people coming and going, so many strangers? >> i think it's a tough environment for any dog. i mean, you have to think, you know, dogs come into a home, they live with a handful of family members and have friends and family coming and going naturally. but this is a really challenging environment for anybody. but you know, there are other presidents in the past that have been able to do it successfully,

but this isn't -- this is not the first time this has happened. this is the second dog that is being pushed out the back door in this administration. so this isn't something that is just happening out of nowhere. again, from an expert professional standpoint, when we see a dog come in and they have all these behavioral problems and then two years later they bring another dog in, same breed, with a lot of behavioral problems, and these are probably knowing the bidens, probably well-bred german shepherds. so genetically they should not have aggression, should not be biting people, so it's not a fluke thing and i don't think any environment is suitable when you don't have good control. i don't care if you live in the white house or you live, you know, on the streets. if you don't have a good leader giving structure and boundaries, good communication, then it's going to be challenging for any dog to be successful in this environment. at the end of the day -- to help

applaud fox news for covering this regardless because this is happening every single day. dogs are getting put down because other people are coming up, sticking their hands in dogs' faces, trying to pet other people's dogs and i have a slogan, no bad dogs. i really, really believe that people need to give the dogs respect and boundaries, and it's inhumane -- you know, commander's situation, it's an inhumane type of environment. the dog is let basically to bite people. the first time, ok. the second time, ok, it's not good. the third time, ok, we have to do something. fourth, fifth, sixth, etc. i would agree, any dog paraded around to just be the best dog at all times, no matter if they are tired, sick, hungry, if they are hurt or old or elderly, are supposed to be good, and it's just not the case. i think we have to show dogs a little respect. >> sandra: so many of us they're

reversing trump policies, including stopping construction of the border wall and other immigration-related policies. trump is saying the president has changed his mind clearly based on what dhs has announced. >> sandra: we don't know that yet, karine jean-pierre was pressed on the issue and said the president feels border walls do not work. who is right, who is wrong, we'll see. what does he mean the former president by terrorists who have already come into this country, brooke. >> what he's talking about are the 1.5 million people that are what dhs officials call known got-aways, people that have been able to enter the united states between ports of entry. so, dhs has reported this year 151 people have been on the fbi terror watch list. those 151 people, they are apprehended them in between ports of entry, but what trump and a lot of republicans have been warning about here is you know, 1.5 million got-aways, how

many of those got-aways could have popped up on this fbi terror watch list, we don't know. and that's what a lot of republicans have continued to argue and like you said, the white house, you know, they say they did not reverse their policy, did not say that a border wall works, they are relying on this 2019 law and have to use this funding, but we'll see what ends up working here. >> sandra: there's just no way to even fathom a number who may have slipped through on the got-aways, and that trend has only gone up, the number of those caught in the terror watch list. hemmer and i were looking this morning, a few years ago 0. >> the 151, the highest number in six years and you remember, sandra, dhs was founded after 9/11 to prevent terrorists from entering or posing a threat to the united states. so, this is a large number we have seen. >> sandra: really interesting stuff, fresh off the phone call with the former president yesterday. good to see you, brooke. >> john: and experts say the wall stops got-aways, or at least cuts them down.

a police report says indicted senator bob menendez' wife killed a man with her car in 2018. at the time the two of them were dating. prosecutors allege the damaged vehicle was quickly replaced with a brand-new mercedes as part of a bribery scheme. alexis mcadams live with the details. how long after the crash did she get the new car? >> john, it was only a few weeks according to court documents before she got the keys to a brand-new benz after she ran over a guy and killed him. now new dash cam video shows the moments after the fatal crash, watch. >> why was the guy in the middle of the street? >> that's what we are trying to figure out. our job is to investigate everything that happens, that's what we are trying to do. obviously the more information. >> i didn't do anything wrong. >> no, no. >> and president menendez is willing to suppress the charge, it shows, now the wife of

senator bob menendez, in new jersey after the crash that left her car, you are looking at here, badly damaged so she wanted a new one. police questioned here and charges were never filed and the crash stayed out of the headlines because of that. this comes as menendez and his wife have been charged in the federal indictment for bribery, alleging this miss menendez needed a car is badly that the senator was willing to try and suppress that unrelated criminal prosecution for a new jersey businessman in exchange for a $60,000 mercedes convertible. she said congratulations, we are the proud owners of a 2019 mercedes, sending that texas the guy's family was grieving. senator menendez addressed the video on the hill as 31 senators are calling for his resignation. >> your wife was involved in a

hit-and-run in 2019. do you have any comment on that? >> that was a tragic accident and obviously we think of the family. >> also on the dash cam is the voice of a guy, identifies himself as a retired cop, telling investigators he showed up to the scene after the fatal crash as a favor, authorities are trying to figure out who that guy is, but as you continue to look through the pages of the indictment, things don't seem to get much better. >> john: it's going to come out as the court case progresses. alexis, thank you. >> sandra: women swimmers from roanoke college in virginia are speaking out about having biological men competing in female sports. they say they were forced to accept a transgender male on their team and that that swimmer took a year off to transition. before that swam on the school's men's team. the case has many similarities to that of lia thomas, the first trans athlete to win an ncaa

championship. brian kilmeade is here. i was just saying to this off camera, i can't help but think, i follow this so closely,ing, track and field, we are reporting on the women who do speak up as hard as that is. this is happening all over the country and there are women afraid to speak up, they don't want to be targeted or labelled as something awful. but this particular case, why does this keep happening? >> brian: and this is unbelievable. thank goodness riley gaines has something to turn to, and roanoke, i did not check out the swimming record, but all 17 swimmers are very tight. before the athlete decides to transition, they seemingly know him and says i'm going to transition, they go best of luck. he comes back and oh, he's going to swim for the women. they said he can't swim for the women. they go to the coach and the

coach says i talked to the athletic director. if you go ahead and insist on not swimming with the trans athlete, i'm allowed to coach one athlete and i choose that athlete. so the coach instead of siding with the team, they say we are upset about this. put it in a letter. they put it in the letter and he goes i will read it to the trans athlete, they are nameless right now, at which time they decide to meet together and sit there and says we don't feel comfortable swimming against you, and that person, the trans athlete says i aall sides, vote should be part of the team and text message they voted for -- they all felt pressure and every day they are freaked out by it and speaking up the guy, or the trans athlete is breaking records, destroying the moral of the team and all the time they hoped to have in the career, the three captains are 19, 20, and 21. >> sandra: the swimmers today on all of it.

>> every single woman on my team did not matter, only one person. we were silenced. our school is prioritizing one individual swimmer over 17 women. i have two younger sisters like me are both multi-sport athletes. i never want them to have to experience this heartache. women's sports are separate from men's sports for a reason. we are not the same but we deserve to be equally respected. >> sandra: where is this going to go. how are we going to handle this? >> brian: ncaa says you have to be on testosterone suppression drugs for a year, but these players, you know what the swimmers are saying, we are the adults. why are we forced to handle this, where are the coaches standing up and saying this is not ok. why aren't you standing up for your players, swimmers, athletes, why are the athletic directors not standing up to the colleges, they leave the players and the swimmers to compete and

look like the bad guys in the situation, all they want to do is compete against other women. that's why riley gaines group is so important. where would they reach out, and say ok, tell me about your swim team, i'll let you know. riley gaines calls a press conference, and now other teams will say i have a path to know what to do. >> sandra: they are demanding they get together, the captains have to decide on a blueprint to deal with this. they need, like all around the country see how they handle it successfully. i've been watching a case maine, track and field, 157th overall and switched over and now winning the races. the kids are having to stand up, they are targeted as a result. riley gaines is doing amazing things. >> brian: and martina has spoken

early tally suggest they both lack necessary support to get the majority of the votes. olivia beavers, let's put up the candidates declared and potential on the screen to follow along. declared, steve scalise and jordan, strong possible, hern, leader of the republican study group, and patrick mchenry, the interim speaker. i would expect out of that group, likely to come down to a race between scalise and jordan. >> that's my sense talking to republicans and there are meetings happening right now on capitol hill, phone calls, both sides are working it. but they have to make different pitches. jim jordan has been a freedom caucus person transformed possible an mccarthy ally, built more support in recent years and much more of a team player. but he still has some of the lingering doubt about him among the centrist rank and file. he tried to kick out john boehner, grudges are a thing

held very long on the hill. with steve scalise, he has to win over some mccarthy allies who have never trusted him. some bad blood, always sort of seen as vying for the position and some of those mccarthy allies are either trying to support jim jordan or trying to draft patrick mchenry and some say they don't think he wants it, look at what the job did to kevin mccarthy, but that's the nature of the job these days, and then you have kevin hern, and he has been making phone calls like crazy and trying to also pitch himself as the other option. >> john: your colleague at politico did a good break down between scalise and jordan, scalise is the heir apparent, and the story, with the dear colleague letter to say he wanted it. biggest weakness, old feuds,

distrust with mccarthy's folks. dark horse, jim jordan, trump card, trump does support him. weakness, history, tactics and fundraising. how would you see the house on the republican side being different, depending on which one of those became speaker, if it does come down to it? >> it's going to be pretty tough either way to move forward. you have different factions of the party with a thin majority. right now reporting that jim jordan is trying to promise he's going to protect moderates, the majority makers, republicans on the more conservative side, than the more centrist rank and file wings, more institutionallists. and they don't even agree on the motion to vacate. so these different leaders have to sus out how do we convince enough republicans to agree to let me be speaker and it's going to be very unclear, you know. something that could happen, they could go to conference next
