single question that the state will ask former president trump and then she is transcribing his answers and lets me know essentially point by point exactly what is happening on the witness stand. that has been how we've done things throughout this entire trial including last week when don junior and eric were testifying. so again i wouldn't expect former president trump to speak to the media, perhaps during the lunch break or the morning session. will wrap up in early afternoon and resume at 2:15. i wouldn't expect comments in the middle of the day but perhaps after he is done testifying i would expect to hear from the former president himself. >> dana: we have a few shots inside the courtroom. they allow everybody to get a scene setter on video. that's been consistent every day. there you see president trump. history making, bill, as you said.

such a surprise. there were considerations some of these polls were outliers where it showed trump beating biden, now it's conventional wisdom this is where we are a year out from the election, brian. >> good morning. that's exactly right. this is where we are. even with all of the courtroom drama, despite facing 91 felony criminal counts the polling shows president trump would beat president biden if the election were held today. a poll showing that 44% of registered voters in the six key battleground states would vote for trump today compared to just 39% for biden. there is a caveat. when voters asked if trump were convicted and sentenced to prison biden comes out on top with 49% compared to trump eva's 39%. overall the new poll is good news for trump. shows the former president beating biden in five of the six

critical swing states, nevada, arizona, pennsylvania, georgia, michigan. only a slight lead by biden in wisconsin. trump has cut biden's leads with black and hispanic voters if half. and under age 45 plummeting by 33 points since 2020. support from non-white voters is down 30%. trump called on republican presidential candidates to just drop out. >> it's time for the republican establishment to stop wasting time and money trying to push weak rhinos and never trumpers that nobody wants on the ballot. >> there is no sign of that happening at least not yet. sources familiar say iowa's republican governor will support desantis over trump. reynolds said this to fox in may.

city. but the iranian-backed terror group launched a new rocket barrage against the jewish state. an update from mike tobin live in israel. good morning to you, mike. >> good morning, dana. we had another rocket barrage come out of gaza strip headed in ashkelon five minutes ago. this as israel says they're closing in on gaza city and hamas in gaza city for the first time mentioning the navy is closing in from the mediterranean sea. aerial bombardment has been a lot. they're at the edge of the neighborhoods around gaza city hitting command and control structures. we caught up with emily, an american woman who stopped in to see the in laws in the gaza

strip before october 7th and got trapped. they survived what was left over in the cupboards and made the exit out of the rafah crossing into egypt. >> the night before we left, i couldn't sleep at all listening to the bombing in the distance and counting. i counted within one minute between 14 and 17 booms. it was every 4 to 10 seconds. i just couldn't get over how many i was hearing and i was trying to make sense of it all. >> our cameras captured some of the rocket fire making its way all the way up to tel aviv last night. this was remarkable because those rockets were fired from the middle of the gaza strip. it is difficult for hamas to fire from the northern end of the gaza strip because israeli forces are there now. also there was an evacuation corridor supposed to be open from 10:00 to 2:00 in the afternoon.

it is not clear how well it went. israel says it went well. hamas says the routes were blocked and israel says if they see hamas activity along the route they'll take it out. >> dana: quick question for you. when you look ahead. we're starting a new week here and underway for about several hours now. what should people be preparing for this week now that gaza city is surrounded? >> gaza city at some point they will have to go into gaza city and combat will intensify and more and more of the tunnel structure to deal with and keep in mind as they go into the tunnels, hostages are supposed to be somewhere in those tunnels and hostages are always going ton vulnerable. a very tense situation going forward. >> dana: it is indeed. thank you. >> bill: israel standing firm as forces continue to pound hamas inside of gaza. president netanyahu rejecting calls for any brief humanitarian

pause, there will be no cease-fire without the return of the hostages. that should be completely removed from the lexicon. we say it to our friends and enemies. we will simply continue until we defeat them. we have no alternative. chris o'leary is a former director of the f.b.i. hostage rescue and recovery team, senior vp at another company. i don't know in the history of the world we've had a circumstance like this upwards of 240 hostages at the moment. trey yengst reported on fox around sunrise today that israeli sources he is speaking to believe the majority of hostages are still held underground in gaza city in the relative same area as each other. would you believe that to be the case? >> i would for sure. although hamas likely still doesn't have control of all of them because palestinian islamic jihad has been involved and the assessment as of a few days ago

was 30 hostages were held by them. we're not negotiating with a single entity here. hamas is trying to wrestle control of all of them. the born out of egyptian islamic jihad, islamic jihad, that is who you are dealing with as well. they are slightly more radical than hamas is. >> dana: the fact that we could put pressure on qatar to put pressure on hamas. who are the israelis actually talking to? >> they are talking to qatar and over the last couple years we've used them as an intermediary. they have been a credible partner dealing with networks and iranians and they've worked closely with us and been great partners for us. they are interested in conflict resolution and they see that as a new role for them. >> dana: great way to resolve a

conflict for hamas to release hostages. >> they are advocating for that. >> bill: the israeli ambassador michael herzog. he makes the case hamas is not serious about a cease-fire. >> we are making every effort to get hostages released. when people talk about pause in the fighting, we are all for a pause that would allow for the release of hostages. unfortunately, it is not our impression that hamas is serious about releasing them and they are playing for time. >> bill: i don't know if you agree with that or not. you probably do. i think the circumstance is different from many other hostage matters. you have an active war on right now. you have a powerful military that's moving on this area. this is not a stagnant situation where you can delay this over a period of weeks or months. that is a dynamic, i think, that needs to be understood.

>> i completely agree with his comments, number one. it is not in the benefit of israel to pause this whatsoever. a cease-fire would only benefit hamas. and although if i had a family member there being held hostage i would be concerned about the military offensive but understand with each block that is taken, with each home or apartment that is gone into by israeli military forces they are gathering information and taking detainees, conducting interrogations and taking cell phones and exploiting those things. building a picture of the enterprise that's holding the hostages and their possible locations. that's how this is done and how the targeting cycle is done in coordination with the signals intelligence being collected with the imagery being collected. as they put pressure on the network some hamas leadership with move and we start following them to known areas of interest.

attorney's office in manhattan, hardly indicated it wouldn't take a weak case against trump given what they have indicted, they looked at this and decided not to charge it because there are no victims. the allegation is that he inflated the value of his assets but these are high-end transactions involving very sophisticated financial actors who do their own due diligence. trump's own financial statements, the statements of financial condition that are the heart of this case, have a disclaimer in them basically admonishing the people on the other side to do their own due diligence and not put too much stock in his numbers. i think that's why the prosecutors looked at the case and decided there was no criminal case. the a.g. has this monstrous statute that allows her to bring a civil case even if there are no damages and even if there is no proof of intent to deceive, much less actual fraud.

so this case is really very troubling. >> bill: she is on camera repeatedly over a series of years saying she will get trump and many more things similar to that. there are those who believe this is ripe for appeal. are you one of them? >> i am. i think first of all this whole new york justice system, bill, is fraudulent in the sense that these are elected democrats. she is an elected democrat who as you point out campaigned for office on a vow that she would use the power of the state to get him, which is kind of a soviet way of going about your business. the judge is an elected democrat so the whole system is not like what we have in the federal system where you have appointed prosecutors and appointed judges who are vetted by the senate, at least in the hope that it will insure they won't use their power in an abusive way. in this system they are electing

people on a promise of going after individuals, individuals who happen to be their political enemies. that should be troubling enough. the other thing is just in terms of like a sort of eighth amendment punishment principle where you have in this case a situation where the penalty they are talking about is so out of whack with the infraction that it ought to back everybody up. if you want to tell me that maybe they should fine trump a million dollars because he inflated his assets, you know, wouldn't be my way of doing a system but fine. that's not what they are talking about here. they are talking about in a case where you have no victims of fraud taking away profits and putting him out of business under circumstances where there is not a single person or single entity that actually got defrauded here.

>> dana: there is also this controversy about a gag order and telling president trump he can't comment. the judge wrote the first amendment right of defendants and their attorneys to comment on my staff is far and away outweighed by the need to protect them from threats and physical harm. your thoughts on the gag order. >> i think what the judge is doing, again he is an elected democrat, is promoting this democratic narrative that when trump speaks, it's a dog whistle for people to do physical attacks even when he is not calling for violence. the idea that he, while running for president under circumstances where everyone he is running against, democrat and republican is completely uninhibited about what they can say about these cases, but he needs to be gagged should be very offensive to people. there is no reason he needs to be quiet in a situation where he is up against people who are actually elected democrats who

they're from cuba, venezuela and el salvador. they expect to link up with a larger group of some 7,000 who are about 25 miles to the north in another city. they're traveling on foot but they don't know when they will reach the u.s. border. their anticipated arrival comes at a time when the u.s. is on high alert because of the conflict in israel raising fears that possible terrorists could try to exploit the system. >> we know this is a very real threat to the united states of america. and the fact that we don't have control of our borders, we don't know who is coming in and out of our country is something that the bad guys have been observing for years. >> back in early september border patrol agents in the rio grande valley discovered backpacks with ammo and a homemade explosive device left unattended at the border wall in star county. agents coordinated with mcallen

been trying to revive since day one creating chaos for policy in the region. >> dana: have you been able to observe and can you describe what it is like to watch the internal fighting amongst the democrats on capitol hill? >> yeah, i should admit as a republican member of congress i can't lecture on internal fighting given the last couple months. this is something totally different and we are seeing anti-semitism on the left. there are members of the democratic caucus who have been very strong and outspoken on this issue and politically assuming some risk in that regard. ritchie torres has been very clear and brave in his rhetoric. others in the michigan delegation have condemned tlaib's remarks and asked her to recant. there is certainly tension on the other side of the aisle. a growing the squad has a lot of influence, the progressive left is clearly upset with the

initial support that biden has voiced for israel and it is why you are starting to see the shift, i think, in the biden administration's rhetoric. i'm concerned about that. that could result in israel -- support for israel here domestically waning but israel being isolated in various international organizations and institutions which have an anti-israel bias. we need the president of the united states, commander-in-chief to defend israel in those settings. >> dana: my last question you wrote a piece last week call for five that said why do young americans support hamas? look at tiktok. digital fentanyl made by china and brainwashing our youth against the country and our allies. it got a lot of attention. do you get a sense that anybody is paying attention to the warnings that you are making? >> you know, i actually think for a while there people tried to ignore the tiktok issue in part because tiktok had a sophisticated lobbying campaign. in part because there were a lot

of prominent democratic politicians that didn't want to alienate younger voters. more concerned about the next election than the effect of what it was having on the mental health of our youth. the poison on tiktok right now and we now have renewed interest in taking action in congress and we must act. we must either ban it or force a sale to an american company that can control the algorithm. without that control we don't know whether or not or how tiktok and bytedance and ccp could push anti-american propaganda to pit americans against americans and weaken us internally. >> dana: pay attention to all you do this week. >> bill: we have some updates right now with donald trump on the stand. maria is our producer inside the courtroom. here is her first update. she says trump has been on the stand for half an hour. he is very composed but taking jabs at the judge.

he has been asked to just answer the questions but is providing lengthy narratives. he has made comments about the judge ruling against him a few times as he has said many times he believes mar-a-lago has been undervalued 50 to 100 times. now kevin wallace is an attorney for the state of new york, all right? and wallace is asking trump these questions. and the judge says to mr. trump's attorney can you control your client? this is not a political rally, this is a courtroom. i have asked the witness several times to answer the questions. maybe you should have a talk with him right now. trump's attorney says sometimes the questions call for narratives. and that -- hang on one second, okay? got it. so those are the two updates we have and you, my friends at home, are up to date so far on the first 30 minutes of testimony by the president, the former president number 45.

>> dana: a judge in connecticut order a new democratic mayoral primary after surveillance footage shows workers stuffing absentee ballots in an outdoor ballot box. eric shawn is with us. >> bridgeport, connecticut will take the unusual step and hold the democratic primary election after tomorrow's general election. the reason, as you said, suspected voter fraud in the september democratic primary. look at the security video. it appears to show two women stuffing a ballot box with votes. supporters say those ballots were from family members. critics say they were illegally stuffing the ballot box. the two women, they took the fifth when asked about it in court. incumbent bridgeport mayor defeated the challenger by 251

votes out of more than 8,000 cast. they deny any wrongdoing by his campaign. gomes challenged the loss saying the videos show 420 people used drop boxes. but they had more than 1200 votes in those drop boxes. so a judge ruled that the images showed quote credible evidence of possible ballot harvesting. when you submit multiple ballots for other people. that's illegal in connecticut except if you are handing in ballots for relatives, police, local election official or if you are a caregiver. >> drop boxes are not the problem. people who break the law are the problem. why we're in this situation is massive absentee ballot fraud by operatives within the campaign. that's what caused this and why we're here. >> again, gannon's campaign denied anything wrongdoing but it appears to be a local issue isolated to bridgeport. the state appointed an election

campuses. >> bill: here is the problem. tiktok sells. instagram sells. you look at the incredible popularity of these social media sites. it is hard to counter. >> it's increasingly difficult to counter with billions of muslims in the world and only 15 million jews in the whole world. they have bots most of the messages pro-palestinian on instagram were traced back to two i.p. addresses in malaysia. we're playing a p.r. war that by numbers is daunting. that doesn't mean we stop and doesn't mean we stop fighting for the truth and that we promote and hold accountable truth in universities and hold teachers accountable. for example, the teacher at one of the ivy league schools that said hamas's attack was exhilarating. hearing from the majority of the
