ready to fight. they kicked donald trump off the republican primary ballot and the former president says he will fight back. i'm harris faulkner, you are in "the faulkner focus." colorado's highest court claims donald trump violated the 14th amendment by inciting an insurrection. that decision is unprecedented and it just so happens to fall along party lines. it's the first time section three of the 14th amendment has ever been used to disqualify the presidential candidate. critics and legal analysts point out trump has never been charged or convicted of anything in connection with the january 6th capitol hill riot. trump's campaign with this. democrat party leaders are in a state of paranoia over the growing dominant lead president trump has amassed in the polls. backlash was fast and furious. >> it is a strikingly anti-democratic holding. in my view, the court is dead

wrong. this court just handed partisans on both sides the ultimate tool to try to shortcut elections. and it is very, very dangerous. this country is a powder keg and this court is throwing matches at it. >> it is terrifying to me as an american that this kind of law fair is being waged. >> an effort to stop donald trump at the ballot box. >> i read it. it is a couple hundred pages of hot garbage. >> harris: even trump's republican rivals support him. ramaswamy says he will withdraw from the colorado primary ballot unless trump is on it. he called on the other gop presidential candidates still in the race to do the same. colorado's republican party responded to ramaswamy. you won't have to, meaning he won't have to withdraw, because we will withdraw from the primary as a party. and convert to a pure caucus

system if this is allowed to stand. in "focus" attorney and fox news contributor leo terrell. we'll begin with mark meredith in aims, iowa, january 15th is about to get here. >> it sure is. the date is fast approaching. this morning former president trump is getting support from his republican rivals. they are saying that they, too, are outraged over this decision by the colorado supreme court that it would keep trump's name off the ballot in 2024. former president trump was here in iowa just last night holding the rally in waterloo. i was surprised he did not directly mention the colorado case but during his tumble speech as he has done at recent rallies he urged his supporters to see the attacks against all republicans. >> they want to silence me. they are after you, i just happen to be standing in their way.

>> the trump campaign already vowing to appeal this decision. we'll be looking to see who else maybe files an amicus brief in support. we heard from florida governor ron desantis the latest among the gop candidates to weigh? . >> there was no trial on any of this. they basically said you can't be on the ballot? how does that work? what's the limiting principle for that? >> i don't think donald trump needs to be president. i think i need to be president. that's good for the country. but i will beat him fair and square. we don't need to have judges making these decisions. we need voters to make these decisions. >> this case, of course, will go well beyond colorado. there are more than a dozen states considering similar legal challenges trying to keep trump's name off the ballot. harris, within the last few minutes for the first time reporters had a chance to get the white house's reaction to what has been happening. the white house has asked whether or not they think trump should be kept off the ballot or if they think he is an insurrectionist. they offered a no comment right

ruling, four democratic judges telling the citizens of colorado you cannot select the candidate of your choice. this is something that is impossible to even imagine because president trump, at least understanding the law, is not guilty of any charge. i'm under the impression you are innocent until proven guilty. i would submit to you and the viewers president trump hasn't been found convicted of a federal crime and the supreme court that's to rule not 5-four harris, 9-0 that there is a message to every state in this country that the constitution prevails and president trump is a viable candidate on the ballot. >> harris: the argument is also he hasn't been charged in the rioting on jan six. you talk about no conviction on any of the counts against him. this specifically is tied to that by the state of colorado. we're learning more, by the way, about the four democrat-appointed colorado

justices who kicked trump off the ballot. we circled them for you so you will know who they are. three are ivy leaguers. one is an icon in the gay community and another a jazz musician. they had little difficulty coming to their decision. the three republicans on the court voted in favor of trump. is this partisan as partisan as it looks? >> yes, harris. the hardest thing for me is for people to try to assume that the legal system is working. this is all politics. it's all politics. you just laid out the background of these individuals. their party affiliation. it is silly for anyone to honestly believe the legal system is working correctly. the legal system has been hijacked. a dual system of justice against president trump. if anyone looks for a legal analysis as to the decision of yesterday by the colorado supreme court, you are kidding

yourself. it is pure politics plain and simple, harris. >> harris: "politico" playbook had this on the colorado decision quote, the impact on the primary seems clear enough. if anything it will help trump rallying his supporters and rivals to defend him. that is already happening. for any doubters trump's poll numbers jumped by nearly ten points after his first indictment by a manhattan d.a. alvin bragg. numbers held steady through the next three indictments and continued to grow. an average of national polling has him at 63% in voter's choice for the republican nomination. i was saying that at the end of mark meredith east great reporting. this only potentially helps trump but hurts the system. >> it destroys the system. harris, there are people who dislike president trump. but the system is being challenged. what makes us unique is our rule of law. it is being questioned.

trump haters are now supporting trump on the issue that he deserves to be on the ballot. he deserves to face the voters, not four judges. and this is a problem right now. our legal system is being tested and this is why the supreme court has to rule 9-0 harris. it has to rule 9-0. they know what is right. 9-0 is the only ruling they can come up with. >> harris: can other states look at this and try to do the same thing? >> right now, yes. until the supreme court rules, yes. in is what you are having. you are having 50 possible different outcomes because they don't like a particular candidate. in this situation they don't like president trump. due process out the window. you don't need a conviction to even make such a ruling. that's what the colorado supreme court has done. they have opened up a pandora box that allows every state to make their own individual ruling in defiance of the constitution.

an exceptional vice president if she were to choose to join donald trump. in my opinion, this race is over, the primary is too far away for any of the candidates nikki haley, ron desantis, vivek ramaswamy, any of these guys to catch up to donald trump. the more we keep seeing things like colorado, the court cases, only provides a greater support system for donald trump because republican voters see it as an attack on them. >> harris: in fact, richard, my earlier guest leo terrell said something interesting. he wants to see a profile in courage from the president and vice president on the whole thing playing out with donald trump and keeping him off the ballot in colorado. what do you make of it? >> colorado is unprecedented. we have to see what happens. i think you will likely hear something from the white house today based on sources there and hear from the supreme court. the ultimate determiner on that. where i agree with gianno on the idea this court case provides

fodder for trump as we get closer to the mid-term election and tightens his base even more. with that being said i'm not sure that this primary is quite over yet until voters actually have their say. i think the rise of nikki haley in the polls and after iowa the fact that you will see chris christie, maybe ron desantis and vivek ramaswamy drop out of the race, this could become a two-person race and if you add those numbers up there is a -- not a big window, a small window, maybe a crack in that very small window for nikki haley to make a play to be the potential nominee for the gop. >> harris: it is interesting to hear democrats say that. she leads all of the republicans, including donald trump in a percentage above joe biden. let's move to this if the race were held today, the presidential election. low approval ratings, voters down on joe biden on the top issues, but another number is raising some frustrations among

repelling the russian aggression. now we're engaged in an effort to help ukraine stand on its own two feet, democraticly, militarily, economically. not only dealing with the current challenge that russia continues to pose, but setting it up for the long term. and a lot of very important and good work has been done and continues to be done on that. militarily we have 30 countries around the world helping ukraine build a future source to deter aggression and defend against it in the future. we're extensively engaged trying to bring private sector investment and activity into ukraine so that it can thrive economically and we're having some real success there. that creates a cycle where investment comes in, tax base goes up and increasingly ukraine can pay for itself and working

to deepen democratic reforms and help ukraine combat corruption which is necessary for getting that investment to flow and also for ukraine to be a strong democratic state going forward. we just had the e.u. open talks. all of it takes time and effort but we're in a place where not only have we helped ukraine repel russian aggression but we're putting it into a place where it can stand strongly on its own and succeed and thrive in the future. when it comes to sudan, we've been actively engaged there as well in trying to end the horror of the civil war between two military groups. and as recently as about a week ago, we helped get an agreement that the two leaders, the
