welcome back. former new york clerk and another legal battle after murder charges against him were dropped. you might remember josé in july 2022 he stabbed a shoplifting suspect to death. he said it was self-defense after he was threatened and attacked to suing the city for damages and now there is a push to toss the case. cb cotton is live in new york state with the very latest on this. cb, this case made a lot of headlines when it was happening. >> a deadbeat new york city lawyers now arguing its officers had every right to arrest exit bodega worker josé alba after fatally stabbed a customer. the city's lawyers trying to get his wrongful arrest lawsuit thrown out claiming video

evidence and witness testimonies including from the victim's girlfriend supported arrest and the initial criminal charges against him. he filed a lawsuit this fall against manhattan d.a. alvin a bragg nypd detectives, resting officers and department of corrections officials and progressive policies here in new york city violated his evil rights when he was charged with second-degree murder and locked up back in july of last year. surveillance video of the ordeal it ignited public outrage after footage appeared to show alba was not the initial aggressor. investigators say the fight between him and austin simon began after simon's girlfriend tried to pay for a bag of chips but her card declined for the d.a. or drop the charges with this office i got homicide case could not be proven and a trial beyond a reasonable doubt. the city is trying to back pedal as the city tries to seek

laurette lynch a founding member of the dixie chicks died in a fatal collision the texas apartment public safety confirmed the deadly crash happened around 5:45 p.m. friday afternoon about 70 miles east of el paso, texas but investigators say the driver of a dodge ram heading w west crossed into lynch's weight on a two way highway and hit her ford f50 head on. she was pronounced dead at the scene. the other driver was taken to the hospital with non- life-threatening injuries were to talk to someone from texas dps moments ago but i was told the other driver is still in the hospital. i am told he will likely face charges. now the country music world is a dealing and coping with lynch's traffic loss she cofounded the disk checks in 1989. lynch was the base a player then she started singing with the band in 1992 print she left the group back in 1993 before the band achieved huge commercial success with hit songs cowboy

race. >> look it is absolutely true that trumps legal troubles keep him in the news. it is a very important historic story to cover. there is no world in which major news outlets couldn't or shouldn't cover a former president's legal troubles. but because he is the center of attention and because he is running against a couple people who used to work for him and a lot of other republicans who have very similar platform decisions it is more difficult for other candidates to gain attention. and frankly how difficult it is for all of these and site trump, trump alternative candidates to get any sort of base to coalesce around them. i will do it differently i have a different style but a lot of it is the same is very difficult sell to voters who still like
