success. >> dana: bill melugin is in deknown. let's begin with nate foye in new york. >> police on long island investigated a swatting incident at justice arthur engoron's home. already a contentious day as day 45 of this $370 million civil fraud trial is set to begin at 10:00 a.m. donald trump is not expected to say closing argument after they couldn't agree on restrictions about what he could say. trump's legal team will be arguing on his behalf. that will be led. defense is starting at 10:00. trump spent the night at trump tower in manhattan. when he arrives at the courthouse within the next hour not a surprise to hear him speak on his way inside the courtroom.

trump testified earlier in the trial he, his adult sons and several trump organization executives are accused of defrauding banks and insurance companies by inflating assets. trump argues all the loans were paid back and no victim in the case. he calls it a political witch hunt brought by new york attorney general james. she wants to ban trump and his family from doing business in new york as well as a large fine. his defamation lawsuit trial is set to start next week. trump separately faces the new york hush money case, georgia election interference case and federal cases involving january 6th and his alleged retention of classified documents. the civil fraud case today is a bench trial which means justice arthur engoron has sole discretion in deciding trump's punishment. keep in mind, engoron ruled before this trial even start

evidence that trump is liable for fraud. this entire trial was more about just deciding the scope of it and his punishment. engoron says that a written decision will be coming at the end of this month at the earliest. a decision won't be coming today. send it back to you. >> dana: thank you. leticia james is the attorney general and put out a statement echoing that. remember that the court ruled in our favor. found that donald trump engaged in years of significant financial fraud and unjustly enriched himself and his family and confidence the case they presented will end up with the rule of law on their side. you have that from her. very unusual for an attorney general to spend all her time in one particular courtroom for one particular case but that's what she decided to do. >> bill: some states you have state supreme court justices not elected or appointed. she was elected and she campaigned for years going after donald trump and today she is going to have her say in court. legal analysis now with our

editor. take the legal question of what is fair and apply it to this case as it relates to other cases in the history of courtrooms in new york when it comes to real estate. >> well, according to our research the law in new york in this case has never been applied someone in the way it is against donald trump full spot. we were unable to find even a single instance of finding someone liable for overinflating their real estate values. this is why donald trump has continuously complained about this case saying that it is a political hit job. you mentioned the attorney general in new york campaigned on going after him. and he says she is doing this because she wants to prevent me from being president and she didn't like my politics when i was. >> dana: we heard nate foye the judge in this case had a

swatting incident at his home this morning. he said i won't debate this yet again. take it or leave it, now or never. you have noon. i will not grant any further extensions he put in all caps. he seems exasperated. >> effectively he didn't want him to litigate the ugly parts of the case. he didn't want donald trump to say a lot of things that we would be saying. now, i'm not sure why, because if you don't have him say it i'm going to say it. imagine free speech being completely slashed not for a normal person, never mind us, but for the leading candidate of the republican party. it's so obvious what they are doing. >> dana: this is all so unearl. we've pointed out all the interesting pieces of it. one of them would be that donald trump feels confident enough to have wanted to give his closing argument. he will be denied that. it is likely he would talk to the media. does the judge in this case if

it's outside the courtroom take any of that into account? >> he could. with respect to inside the courtroom, a judge gets to decide how he or she runs his or her courtroom. the judge my understanding was yes you can deliver your portion of your closing arguments, of course that's highly unusual. you would typically see that in a pro say defendant, someone who represents themselves. the judge says you can do that here but you can't impugn me, my staff, the court system, a.g. and not a campaign speech. on its face normally one would look and say it's reasonable. the problem, though, of course, is that this goes to the heart of what donald trump is arguing saying it's a political hit job. the a.g. campaigned against me and i'm running for president and decide to prevent me from doing so. it's a tricky one and they weren't able to come to an agreement. here we are. >> bill: we would expect the judge to stand by his initial decision and we'll move toward

history of our country. >> dana: last night he fosse iowa. now you can see he is on his way to the courtroom we just talked about beforehand. the real clear politics average has trump at 52.2%. haley and desantis at 16% apiece down below. your thoughts that morning. >> i thought the town hall last night was really interesting. the clip you played earlier i thought to me was the one that stood out the most where he talked about how he is not going to have time for retribution. the best retribution is success. that's a different tone than we sometimes get from donald trump. donald trump last night was very engaging, very thoughtful. he got asked some very tough questions both from bret and martha but also the audience members asking him about abortion and some other things. and he was not -- he was very engaging and very i think very thoughtful about a lot of those things.

it is kind of interesting. the other thing i thought was interesting was he was asked about the whole idea that chaos follows him everywhere and something we hear a lot from nikki haley. and his argument was look, i can't help it if democrats level this chaos against me. they don't like what i'm doing. they're doing everything they can. on the split screen we see the chaos that democrats, and democrat politicians level against donald trump because they don't like donald trump. that's why i think that line about the retribution and how he is not going to have time for retribution and the best retribution is success is probably a really good argument for him. >> dana: a great line. >> in the primary and then going forward to the general election. >> bill: he ticked off a list of things. people go woke, the border, russia, on and on.

chris christie slipped or was intentional, i don't know what it was caught on a hot mic before he withdrew in new hampshire. a quick listen on that. >> she is going to get smoked and you and i both know it. she is not up to this. desantis calls me petrified. >> there is a little tease we say on desantis and haley. trump took that on last night by saying this. >> chris christie was in and he got a hot mic, i heard. i thought the bigger story wasn't the fact he dropped out. nobody cared too much about that, but he had a hot mic talking to somebody about the weather and happened to say that she doesn't have what it takes. she will be creamed in the election and i know her very well and i happen to believe that chris christie is right. one of the few things he has been right about actually. >> bill: everybody will parse the odds. him dropping out if it will have an effect on this race. do you think it will?

>> certainly not in iowa. 3% in iowa. hard to see where that 3% goes. i don't think it really matters. but he is also does not appear he is going to be endorsing anybody and so it is bizarre because, of course, during that whole dropping out speech was this weird soul-bearing thing where he talked about how he dropped out last time to support trump and he won't do that this time and talked about how all these people don't like trump but only whisper about it in back rooms. as he is doing that the hot mic moment whispering about stuff behind closed doors leaks out. it is unclear what exactly he is trying to do here but i don't really think that he has tremendous support among republican voters, anyway. there was a lot of cross over support from democrats who may have supported chris christie. but long term maybe that helps a

that harrowing alaska airlines incident is renewing fears from babies lap sitting on airplanes an aviation expert told the "washington post" if there had been a passenger holding a kid close to where that panel blew off, the explosive force was such that the kid being held would have been torn from the hands of their parents and they would have been sucked out of the plane. officials recommend buying a ticket for infants and strapping them in a car seat. that will be a real wake-up call for a lot of parents. obviously you want to comfort your child when you are on an unusual experience on a plane especially when their ears adjust to that. you might have to buy them a ticket. >> bill: altitude 15,000, 16,000 feet. 30,000 would have been a very different matter.

and spend time with his family and her. the judge denied that. apparent there was a suggestion that the judge felt the security guards at the courthouse perhaps had already been paid for and didn't want to waste the money. that excuse has not been fully flushed out. there was a request. also a request for donald trump to make his case for himself and that was denied as well by the judge. >> dana: this case and the conviction of president trump appears to be unprecedented in new york. we had our lawyers check here. they were unable to find any other examples of new york state convicting someone for inflating the value of real estate assets without a victim. in addition, this judge as leticia james pointed out, has already ruled president trump had misbehavior here. the question is the scope and scale of that and whether and how a punishment would be rendered by this judge. that could happen today.

>> bill: trump's lawyers have said consistently that the valuations on the property were subjective and that banks were not harmed by any alleged inaccuracies because they actually profited from the loans that were made. and there was a leading real estate expert who testified on trump's behalf who made a pretty strong case for him. but whether or not the judge takes that into consideration. i think it's doubt doubtful. he ruled against trump months ago before he came into this courtroom and now the a.g. will in all likelihood get in front of a microphone and make the case she won. this was her quest going back several years to get trump. she pretty much said that repeatedly on camera. >> dana: she campaigned on it and continuing to do a lot of media appearances. it is very unusual for an attorney general to not be manning the helm at the headquarters of the attorney general's office but to be in a

courtroom any time this case has been on. but she has been there. there has been a lot of media attention on this case and for good reason. she has not missed out on any of that. >> bill: the judge was concerned about trump would make some sort of campaign speech in court. maybe, maybe not. his attorney was played the clip half an hour ago. helene yeah said earlier if he doesn't say it, i'll say it. there will be a camera spray inside the courtroom but not follow it minute by minute. we have to read the emails that flow out of court today. >> dana: mr. secretary, mike pompeo is still with us. let's go back to him and get back to this. i want to play the sound bite from antony blinken about the consequences for the houthis if they continue these attacks on ships as we have the breaking news the ship just boarded, turned around and going towards iran. watch him here. >> as we made clear and many other countries made clear, there will be consequences for the houthis' actions.

we've also repeatedly tried to make clear to iran, as other countries have as well, that the support that they are providing to the houthis, including for these actions, needs to stop. it's not in their interest to see the conflict escalated and we're not the only ones who sent that message to iran. >> dana: how do you evaluate the biden administration approach to reaction on this. >> it's not working. you can see that plain as day. you can threaten, bluster, have the secretary make statements but if you don't impose real costs on the iranian regime itself this will continue. the escalation risk is from weakness, not strength. iranians understand serious responses. we have not provided a serious response. until we do you will see more of this whether it's commercial vessels or attacks on our soldiers. >> dana: the other thing happening and not a chance to hear from you yet is questions about the secretary of defense

does he call you and answer the phone? >> why did you talk to him during business meetings if he had nothing to do with your business? >> a couple folks of jumping on the comment that he confessed his dad called him and not vice versa. was that some sort of indictment, jessica? >> i don't think so. i think people will go back to archer's testimony and read the transcript. not the republican translation of it and see what devon archer said about the phone calls and he also said that joe biden was not on the take. he didn't personally profit from this and not part of their business. i agree it was a complete p.r. stunt but it will get him more than an hour, maybe a whole day. we'll see what happens today in court for him facing the federal tax evasion charges. but the narrative has switched on this over 50% of americans think that this is a complete waste of time and in election season. what are you delivering and doing? this is now the most ineffective congress in american history.

i told you off aref en dana was stunned by this. she is the stalwart on the show when it comes to sports. i think there are a couple of big time takeaways here. nick saban is the greatest college football coach of all time. seven titles, bill, his teams were ranked number one -- listen to this, 2008, nine, ten, 12, 11, 18, 19, 20, 21, 22. it takes that long. number one in the season during that time. the most extraordinary college coaching career of all time. then bill belichick probably the greatest coach of all time in the nfl, too. now, what will be interesting is belichick seems to want to take another job now. his tenure, i think, took a little hit when tom brady left and went and won a super bowl with the tampa bay buccaneers.

have been brought. we have looked to see if anybody else has ever been indicted or prosecuted for this. hard to find anything on it. should it have never happened? >> i think donald trump has two fights that he is fighting right now. one is the fight that this should have never happened and there aren't comparable cases and it seems like even if you had some degree of comparable cases, the amount of punitive damages that letitia james is going for a astronomical and the second point. there is a case to make in mitigation. even though there has been a finding of fraud going into today to say to the judge there is no damage, there are no complainants. nobody lost anything here. so whatever the punishment should be, should be extremely limited. >> bill: in the state of new york, what is -- what is the appeals process like? how would that unfold in a civil trial like this? >> well, after a verdict, then you have a time window open in order to file your appeals. that goes on usually
