ms. carroll is asking for at least $10 million in damages. >> dana: republicans are following the money trail right now preparing to interview a key player in hunter biden's financial deals with a chinese energy company. this is all part of the house impeachment inquiry against president biden. welcome to a new hour of "america's newsroom," i'm dana perino. >> bill: good morning. still going. you too, right? >> dana: yeah. >> bill: i'm bill hemmer, good morning. today's closed door interview will focus on millions of dollars in funds sent from china following a closed door interview with hollywood lawyer kevin morris who loaned hunter millions of dollars to pay off back taxes and other bills. house oversight committee chair james comer telling sean last night it does not pass the smell test. >> we have a guy that has a loan i've never seen in my life. hunter biden doesn't have any assets or income. and he owes at least five to

$6 million if he will have to pay interest on it. how will he make that payment? it's not humanly possible. >> dana: david spunt at the justice department with this. >> good morning. today's line of questioning is not a deposition, a transcribed interview, a former business associate of hunter biden will not be under oath but lying to congress is a big no no. the first two met back around 2017 according to sources. they say that the two came together through cefc, a chinese energy company with reported ties to the communist party of china. the company has since shut erred. according to house oversight investigators, yen will be questioned about money that came through there and various companies allegedly that money made its way to joe biden. $40,000. it was a payment listed as a loan repayment from the

president's sister-in-law, sarah biden. oversight chairman james comer says the origin of that money going far back or edge gnats with a company that benefited from cefc which in turn benefited from the chinese communist government. this is just one of many impeachment-related interviews. you saw kevin morris last week. he loaned hunts more than $4 million. a large chunk paid off hunter's taxes. hunter is still heading toward trial for federal tax crimes in june in los angeles for failing to pay in a timely manner even though eventually paid back his taxes with help. at least $1.4 million in taxes. tomorrow on capitol hill another behind the scenes closed door interview transcribed interview with a man named rob walker, a former business associate of hunter. the big day we're looking at is february 28th, when hunter himself will be on capitol hill behind closed doors. he will be under oath for a

deposition in that transcript will be released soon after. back to you. >> dana: david spunt at the justice department. thank you. >> bill: president biden in texas locked in a stand-off over the mounting migrant crisis there. the lone star state bolstering its razor wire fence along the border and the park there that's fueling the latest dispute. the president is facing pressure from democrats to seize control of the state's national guard. texas governor greg abbott standing by his response. we'll get to him in a moment. first to the news and what we hear from the white house with mark meredith from that side of the story first. hello. >> hello. you use the word stand-off. that's exactly what things feel like between the governor of texas greg abbott as well as president biden. the governor says he is taking steps to secure the border because he believes the president has failed to do so. the white house insists it is all about politics. now governor abbott lately has taken a lot of different steps to try to take over some of the border patrol functions

installing razor wire in certain sectors. the move has drawn outrage from the white house but one person who is a fan of all this, the speaker of the house. he posted this overnight writing i stand with governor abbott. the house will do everything in its power to back him up. the next step holding secretary mayorkas accountable. this week the supreme court and 5-four ruling decided the border patrol can take down razor wire on the border. the white house is calling the wiring a stunt saying it's more focused working with congress to get more resources to the border. >> what i can speak to is what we try to do on the policy and funding side to make sure border patrol, law enforcement on the ground have what they need. >> for months now a bipartisan group of senators have been working to come up with a sweeping border security bill. the white house says it is engaged with the lawmakers trying to get something accomplished sooner than later. reports that senate minority leader mitch mcconnell believes

a border deal may never get out of congress because of an election year and an issue of former president trump. he hasn't made the comments publicly. there will be questions whether or not a border security bill can be accomplished or split off from any potential national security bill tied to ukraine funding. that's the debate. there is a lot of focus on what the governor of texas is doing and what he is about to say in your interview in moments. >> dana: ask about the white house plans today for a briefing. i imagine this will be a big topic. >> the president is on his way to wisconsin today. he will be doing an event on bidenomics in superior, wisconsin. there won't be an on-camera briefing just a gaggle on the plane. not the way. >> dana: they used to do those without audio back in the day. >> bill: wasn't too long ago, was it? this is the section of texas in

of them 26 criminals they find. smuggling cases. this is happening every week and just going on and on. slide back over here. now the biden administration has taken its position, the state of texas has fought back and lost a lot of these so far. it appears right now the rubber is about to meet the road. >> dana: as it continues going up on the merits of the case it looks like texas could be in a strong position. joining us now is the governor of texas and great to have you here with us, sir. can you explain what did you decide was the breaking point for you to take the steps that you did? maybe also just back up and let people know what are you saying about the compact between the federal government and the state of texas today? >> so it was the states that created the united states. when the states voted to create the united states and have the constitution, included in that agreement was the compact that these federal governments would take care of the states and

article four section four of the constitution speaks to that and says that if the federal government does not take care of the states, the states are in danger, we can ask the federal government to live up to its obligation. then the authors of the constitution knew the federal government wouldn't live up to its duty and in article one section ten states have the right of self-defense. what texas is asserting is our article one, section ten right of self-defense because the president of the united states is not fulfilling his duty to enforce the laws passed by congress that deny illegal entry into the united states. >> bill: governor, will you instruct your officers to physically prevent federal officers from accessing that part of the border? >> so what texas is doing is just very simple. that is because the biden administration has really truly

abdicated its responsibility to secure the border and enforce the laws, texas very simply is securing the border. so we've put up the razor wire you were talking about and put up all the barricades that have denied illegal entry. as you pointed out also in that screen there are criminals coming across our border. texas has a right as a state to stop criminals from coming into our state. to make arrests of those criminals. we have national guard as well as texas department of public safety officers who are there to make those arrests and to deny illegal entry. and joe biden actually does have an option here. joe biden's option is to enforce the laws of the united states and stop this illegal entry. >> dana: doesn't look like they'll do that. listen to karine jean-pierre. what she said about you yesterday. >> it is unfortunate there is a governor in texas, governor abbott, who has politicized the issue of what happened on the border.

it is not making people's lives safer but harder for law enforcement at the border to do their job. >> dana: she just said that this morning. how do you respond? >> well, obviously it's a very uninformed comment on her part. there is only one person in america not doing their job, the president of the united states who is not enforcing immigration laws. also as she has already been called out and the president and other democrats and media, they have cast a false narrative about some people dying on the border that apparently texas denied border patrol access to. that's been completely debunked. the only thing that the spokesperson for biden can do is to cast aspersions and lies hoping people will believe them. the truth of the matter is what texas is doing is what americans expect to be done. americans expect the border to be secure because joe biden has

abandoned that responsibility, texas is stepping up and doing it with the razor wire you're showing right now. >> bill: you've committed to putting up more razor wire where the u.s. supreme court said the feds are allowed to cut through the wire. that you've been watching yourself for a couple of years now. to go back to your first answer that you mentioned there, this was your statement yesterday. federal government has broken the compact between the united states and the states. executive branch has a duty to enforce federal laws protecting states including immigration laws on the books right now. if you lost this week at the u.s. supreme court, does this now go back there and how would you expect to win a second time around? >> sure. quick point of clarification. something you just said that everybody is saying. and that is that the supreme court -- you said the supreme court said what texas cannot do. if you look at what the supreme court actually issued, they didn't write any type of

opinion. they just vacated a circuit court of appeals back to the court of appeals. two sentences. there was no opinion about anything about razor wire, what texas is doing or anything like that. and -- but that point aside, regardless of what federal statute may exist, the supremacy clause means the constitution itself is the supreme law of the land. the constitution itself provides texas with a right of self-defense in this case because the united states has abandoned its responsibility to defend texas. >> dana: if you can get this case on the merits to the supreme court, you could win. >> so dana, first -- now i think maybe we'll get it to the fifth circuit on its merits where i believe we can win and i do believe when it gets to the supreme court we can win. we already -- i don't know how and why the justices voted the

way they did. four justices had an appetite to keep the case as is. the case presented to the united states supreme court actually did not have very much of a record upon which an appellate court could make a decision. so those who may not have voted in favor of texas or those who voted to send it back to the fifth circuit may have thought in their mind that there is not enough record for them to make a decision. but we don't know that, dana. this is very important again because there were no sentences or paragraphs or pages of an opinion written by the supreme court. so no one knows at all what they were thinking. they wanted to send it back to the fifth circuit. >> bill: i know you paid attention to new hampshire the other night and exit polling and voter analysis, immigration is top im number one. we saw it in iowa and new hampshire. americans are thinking about this. i'm curious of a shadow story

that a lot of people don't talk about. what the administration is doing with mexico and this has been going on for some time. maybe a month or more than that and antony blinken and the president's deputies coming to washington, d.c. do you believe this administration is ready and prepared to change policy at the border in an election year with ten months to spare that would make the issue less potent for democrats come november? >> it's hard for me to tell what is going on. what is clear is that joe biden has from the time he took office, during the time he was campaigning had no intent to secure the border. he talked about open border policies and a lot of americans not knowing what they meant. now people in new york know what it means and people in chicago and people across the country

welcome back to you. like i said, i guess it gets attention. at a minimum. >> it feels like an intentional play by the governor to push herself back in the front of the news cycle. she was a close second choice for biden. biden is clearly bleeding young voters across the country. a play to get those young voters in michigan back on her side showing president biden she can pick up those voters that he is leaving behind. this feels like a political ploy to me. >> dana: free community college, no more student loans on that front. jessica, when you look at this, if whitmer had been the pick in 2020 would biden be running right now? >> yes, i still think he would be running but i think the democrats would probably feel a lot more secure about what the next four years and probably a lot of moderates and independents. his coalition would not be -- not be speculating as much. we don't know what will happen

until people show up and vote but gretchen whitmer has out performed legislation. flipped the legislature in michigan. democratic governor from pennsylvania through the midwest have just done an incredible job and are really the bright light that everyone is looking to as the next generation that's coming up. and gretchen whitmer is a big part of that. >> bill: you are talking about pennsylvania and michigan. here is biden and harris disapproves at 58 for biden, disapprove for her is 57. they are kind of neck-and-neck. if that means much. >> i think it means a lot. ten months away from the election and democratic party doesn't have their base. they don't have clarity on the left and the extremism of everything that whitmer is done. why she is a shining light. she is the second most extreme governor in the country, lock downs and covid.

let's get an update from nate foye. the latest details on the case. >> the brother of one of the victims tells fox there are many unanswered questions and he believes the only person who can answer those questions is jordan willis. his attorney initially said his client went to bed with his friends inside his home. attorney now claims he misspoke and that willis actually said goodbye to his friends as they left through the front door. willis is an hiv data scientist claiming he spent the next two days sleeping and working from home all without realizing that his friends died on his property. >> if you have to change your story, then how do we know any time where you are telling the truth? it doesn't make any sense. i mean, that part makes no sense to me especially when it seems like you are a responsible individual, a responsible enough individual to get a ph.d. >> that's ricky johnson's brother.

you see him here. he is one of the three men who died. the 38-year-old leaves behind three young daughters, family and friends reportedly tried contacting willis when their loved ones never returned home. willis's attorney says that his client received only one message, a facebook message, from one of the victims' fiance. she actually found the first victim and alerted police. right now kansas city police do not consider willis is suspect. we're awaiting the results of the autopsy and toxicology reports to learn how these three men died. >> bill: let's go deeper with a former kansas bureau of investigation special agent. good morning to you. a couple things here. the families are talking and they want answers. a father said i believe he drugged them, dragged them outside. waited two days to call police. he may have done drugs in the past but i don't believe all three of them did drugs and fell over dead in the backyard.

the attorney for willis, the man who owns the home said this. the number one thing people need to remember is that these were three buddies. these were his three buddies. if they were in danger he would have helped them. if he knew they were out there he would have called the police himself. anything beyond that is pure speculation. what is your theory? >> well, certainly these folks had been friends for quite a number of years is my understanding. i think there is four key areas here that need to be looked at. the first is the autopsy. i've done quite a few autopsies with pathologists and so much information can be gathered during the autopsy to not only know the time and date of when the death occurred, but what was in the content of the stomach so you will know what they ate, drank, you are going to know whether or not there was any damage to the body, whether or

not there was any blunt trauma. getting the autopsy report back will be extremely important. the key to this case is toxicology. what is the any kind of alcohol limits, what are the drug limits going to be? hypo thermia sets in rapidly if somebody is under the influence of drugs or alcohol. and the weather at that time was considerably colder. we've been in a significant cold spell through the month of january. this happened at night. they went outside for some reason sometime after midnight because that's when the last witness saw them alive. and so they went outside but there was coats found inside the house and they weren't -- at least one of them wasn't wearing a coat. the third is going to be some unanswered questions about the holes in the case of whether or

not -- why did the guy sleep for nearly 50 hours in and out? the cars of the victims were still outside in the driveway. one would wonder why someone wouldn't say what's going on, where are my friends at, and do a search for them? and then last but not least, you have to understand the use of technology and find out when their cell phones were pinging, when they were last used, any information on social media will be key to gather information in this case. >> bill: so you answered a lot. give me one more answer on this. when do we get the results of toxicology and the autopsy? >> autopsy results come out sooner. the forensic pathologist is seeing it in realtime and using their notes. toxicology could take a month. and kansas city, missouri is high crime. they have a lot of death investigations and the lab is overworked. it could be even longer than a

it's unfortunately what we're seeing on campus today. >> dana: it seems like harvard is the bud lite of the ivy league. it can't get out of its own way. keeps making mistakes. maybe it's not a mistake. larry summers wrote this. after friday's new anti-semitism task force announcement, i have lost confidence in the determination and ability of the harvard corporation and harvard leadership to maintain harvard as a place where jews and israelis can flourish. that's a serious blow. do you want to be at harvard anymore? >> so here is what i'll say. it seems like harvard is focusing on protecting themgs as opposed to taking accountability and doing what is right. one of the main reasons i came to harvard it's known as the center of leadership. when things go wrong and don't

do a good job you take accountability and work to make things better. i would love to see harvard say listen, we failed the jewish community by not taking anti-semitism seriously from the beginning or being transparent and by enforcing our policies with a double standard. it is wrong and we'll take concrete steps to be better. instead, as you heard, they sent congress letters of support from nonprofits instead of providing information. my emails asking for clarity and the law school's own policy is getting ignored. now they hired as the co-chair of the anti-semitism task force someone who stood against israel and downplayed the issues on campus. >> dana: is it hard to focus on your studies when all this is going on? >> in all honesty i've spent more time trying to combatant i semitism on campus than focusing on my studies. hopefully moving forward, you
