ice telling fox quote, in a statement the subjects were believed to be fleeing the state of new york from their suspected involvement in a coordinated assault on multiple new york city police department officers. the only suspect who is being held on bail in new york in this case brito is set to be arraigned next month when the charges for his alleged role in the assault will be unsealed. he had a brief court appearance yesterday for two prior cases. after his client pleaded not guilty. yesterday new york city mayor adams defended manhattan d.a. alvin bragg when pressed about his decision making in this case. >> they determined how they will prosecute crimes and which crimes they'll prosecute. they have been real partners in this pursuit of making our city safe and i think they will continue to do that. >> new york republican lawmakers have penned this letter to kathy

beverly glen. a hilly, steep neighborhood. the hills are simply so soaked with water that they are giving way. we're on the scene of o1145 mudslides. more than have measured more than a foot of rain. you can hear it and see it on the ground. there is still water flowing down this hillside even though the rain hasn't been falling for the past couple of hours. there have been 50 motorists needed to be rescued by firefighters in los angeles. 400 trees and branches have gone down in the storm. unfortunately this has been a deadly storm for california. at least five people confirmed dead. some of them killed by falling trees. another person killed in the tijuana river trying to cross into the united states from mexico. power outages have also been widespread. at its peak around a million customers were without power.

things have drastically improved especially in northern california where the bulk of the power outages. we look at 70,000 without power now. down in southern california things are improving, though there is still that risk of mudslides. evacuation orders have been lifted in ventura and santa barbara counties and l.a. county. again, the mudslide risk remains with the soil simply so saturated. back to you. >> dana: max gordon, thank you. >> bill: a lot more to come, too, precipitation is in the air. home on the range where the cattle herds are shrinking. the shortage of cows making the cost of burger and steaks more expensive. kelly from fox business is live at a family-owned farm in illinois. >> we're right in the middle of it here. i am with allen adams. an illinois cattle farmer who will talk to us about the usda report that revealed 2% of the inventory nationwide has fallen

for cattle. talk to me about why this is. >> well, the biggest part of it has been the drought out west and certainly ranchers just haven't been able to maintain their herds and had to liquidate. the other part is they've had low returns over the years and there hasn't been a big incentive to keep their herds growing or at least at the rate that they were. >> we're talking about how prices are already high. you are telling me that there is also going to be more to come on this. what's the timeline we're looking at? >> at least for the next two years. even if ranchers decide today to increase the size of their herds, that decision won't be felt until another two years because of the time it takes for them to start the whole process, the reproduction process and bring them to places like here where we feed them out. that's about a two-year process. >> thank you, really appreciate it. we are going to send it back to

ever a jury gives a guilty verdict for a mother of a school shooter. we have the follow up on this trial today. >> good morning to you, bill. this is a groundbreaking verdict and set a precedent in holding parents responsible for the actions of their children in cases of mass shootings. the mother was found guilty on four counts of involuntary manslaughter after prosecutors said she ignored some pictures he drew and wrote help me and blood everywhere. on november 30th, 2021, jennifer and her husband, james, were summoned to ox ford high school in michigan after staff found ethan's drawings. they were asked to take their son home and advised they could get same day mental healthcare

services. they said they couldn't take ethan because they both needed to go back to work. hours later, ethan shot dead four of when his classmates and wounded seven others. jennifer's attorneys had earring ofd she couldn't possibly have foreseen the violence her son would turn to and holding her responsible would set a dangerous precedent for parents everywhere. prosecutors argued text messages between the mother and son showed she could and should have taken action when her son made clear his mental struggles and they argued she was more interested in her two horses and her extramarital affair than she was in her son's well-being. a point emphasized by a parent of one of ethan's victims. >> he wouldn't have had to go through any others if you had just done your job as a parent. you can't foresee certain things like this and you don't really

shelters because the money is maxed out. ross, 800 migrant families will be kicked out of denver shelters and i no he the mayor feels like the city is at a breaking point. what happens after a breaking point? >> that's a darn good question. so folks understand kicking people out of shelters. the mayor had this policy where you could be in for two weeks as a single person and about five weeks if you were a family. they paused it for a while. now they are just restarting that. it's not exactly new but people are getting kicked out. dana, here is where i think the problem is. we have the giant electro magnet in denver. we keep telling people you are welcome and give you free housing and food and try to find you a job and then the mayor seems to wonder why we get so many people rather than just turning off the power to the magnet. but getting to your point, one of the things that will happen starting to happen a little bit

is they will try to push these migrants out to the suburbs and other cities which some will say yes but many like colorado springs will say no thank you. >> dana: a statement from the city of denver, as of monday denver has supported 38,380 migrants from the southern border at a cost of more than $42 million. in addition to that the mayor said denver council approved a contract for up to $25 million to house immigrants. i'm curious how other people -- you have a talk radio show and a lot of people calling in. from there i know that people have big hearts but are they getting to a point where they maybe feel like something tougher has to happen in this regard? i don't know what that looks like. i don't know if pushing them to the suburbs will help if a lot of these people end up being homeless. they continue have work permits. if you offer them work permits as you said more are going to

come. >> right. look, i think that what we're going to end up seeing is private charities having to jump in more. but right now the situation is a mess. you talked about some of these numbers. i will share one other with you. denver is talking about potentially having to spend 180 million and to put it in context ten to 15% of the city's entire budget for the upcoming year to take care of these illegal aliens. even good-hearted folks of colorado and denver, democrats are saying -- you are seeing it in other cities, too. you talked about what is going on in chicago and new york, and, you know, liberal democrats who have supported these policies are seeing that these policies can have some negative ramifications. i don't know whether it will change how they vote, though. >> dana: well, they will have a chance. it is not for another nine months. ross, great to have you here. thank you. >> thanks for having me.

father's illness is enough to bring these feuding royal brothers back together again. king charles iii is recuperating at his country residence after getting that cancer diagnosis, he will come back to london once a week for treatment and other business. the matter so important it prompted prince harry to fly from california on his own to see his father. the meeting yesterday was said to have lasted about a half hour. and then reports are he overnighted at a london hotel. he, his wife megan and kids have been kicked out of the royal residence on the windsor castle ground. william and harry haven't been on speaking terms, that did not happen aides close to william had said there was nothing in his calendar. william has a few excuses. one of the royals picking up the slack for his father who won't conduct public duties for the future. he presided at a ceremony today

for what happened. an event like this must not happen on an airplane that leaves our factory. we must do better with our customers and passengers. ceo has been public in saying it's on us. it's our fault. i just don't get it how such a critical piece of a plane can leave the factory not in tact like that >> it's inexcusable. when the ceo says the accountability rests with us stating the obvious. unfortunately what we're seeing is more of this accountability is transferring to the passengers and crew. i read the ntsb report myself and i just -- there is a glaring omission in the reports, i have to tell you. there is no -- still looking for the paperwork supposedly that authorized the rework that was done in the factory. that paperwork should be immediately available. it is push a button and that paperwork should come out of the computer. i don't understand why the ntsb still doesn't have that

information. >> bill: take us inside the factory. what you describe is the pressure the employees are under. what's that all about? >> well, the employees are under tremendous pressure. they all have to do certain jobs every day and if everything is perfect, the parts come in, they have good supervision and good quality control, they do amazing work. what we've seen more and more is they've just been basically on fire just trying to get planes out the door. the pressure is deliveries. that's where the focus is, not on the quality of the product. we've seen this plane already have at least 20 serious production quality defects and lots of reports of incidents in service. our foundation just announced that we are recommending the planes be grounded. this is serious. ist is not just the bolts, the whole production system is unstable. >> the faa administrator

yesterday. >> can you speak to the level of confidence once again today in the faa approved inspection steps for the 737 max door plug? >> it was a thorough inspection process and the mechanical fix to that defect we have a high level of confidence that takes care of the problem. >> so you would fly on the 737 nine max? >> yes, i would. >> i know mr. whitaker is the new faa administrator and listening to the staff too much. those planes are not safe in our opinion. proof of that in the incident reports we're seeing. the company is still questioning engineering exemptions for flight safety related systems that should have been done years ago. i think unfortunately mr. whitaker is being told everything is fine but i think if he gets out in the factory and his people spend time there and again they have been absent. they aren't there. just a couple of people in the giant facility. they deployed 20 people but this

is not about nuts and bolts. this is about production quality problems. >> bill: they have been there just not in great numbers. >> this is a gigantic facility. i can't emphasize this enough. several thousand people, 30 different stations in the facility. for them to have i think just a handful of employees, less than ten. it is really completely inadequate to monitor the operations of the facility. they shouldn't be surprised we're having these problems. this is also unfortunately reminiscent of what we saw after the two crashes, the ntsb did not investigate the manufacturing and these reports that are coming out where they can't go back and find these production records. again, completely inexcusable it is a month after the accident and they can't find these things. these things are readily available for employees. i'm befuddled by that. >> bill: thank you for your time. look, a lot of people don't check what kind of plane they are flying when they show up at the airport. they get on board the plane.
