carley. the compassion only goes so far as i guess the illegal immigrants because, you know, what they have done here to rachel morin is they have, you know, completely dehumanized her. they have, you know, dramatically made her just a statistic. and, you know, collateral damage from really radical policies of where they opened the southern border, allowed millions of people to come into our country and now we're suffering the consequences of that. and alexander mayorkas, president biden, none of them seem willing to confront the real issues, and the consequences of their policies. instead, you know, they just seem to be willing to ignore the death and destruction, you know, whether it's these murders that we talk about all too often, or whether it's the other crimes. it's just staggering. it's heartless iematt can the

morin family sue the federal government over the death of theory daughter. >> in this case it would be complicated but it doesn't mean they shouldn't and i think the federal government is responsible for her death. i want to be very clear about that. that this was a senseless unnecessary crime, a victim that should not have been victimized and a family that now has to live with the consequences and i think the federal government is responsible for that and particularly joe biden and alexander mayorkas and their radical policies. >> todd: that sound bite from alejandro mayorkas is shocking because this administration can name every single trans influencer on tik tok but they can't remember the name of that murdered woman. it is sickening. meantime want to get your thoughts on this. we are awaiting a supreme court decision on former president trump's claim of immunity in his federal classified documents case and former ag eric holder is worried. watch. >> wait a minute. a president can violate the american criminal law if he or she is doing something in their

official capacity. that is an absurd and dangerous conclusion. and i'm worried, given the length of time that it has taken for the supreme court to decide this case, that something along those lines might come out of the supreme court. >> todd: from one ag to another, do you agree with eric holder, matt? >> well, that sounds like a lot of liberal hand ringing. remember, they have placed a lot of their faith in beating donald trump in their lawfare strategy, whether it's the cases from jack smith, whether it's fani willis in fulton county or the case up in new york city, you've seen since president trump hasn't been in court how he's been traveling and communicating, whether it's -- you know, he's going to pittsburgh soon. he was in wisconsin recently. you know, the huge crowds. you see why they want to keep him in a courtroom. why they want to keep him off the campaign trail but the supreme court is going to say what the law is. obviously there is presidential

immunity for official acts. our system would not function without that and the supreme court is going to say the parameters of that. in fact eric holder knows his history he knows the nixon case already established some of that precedent at lowest in civil cases and a lot of us expect that they'll extend that to criminal cases. >> todd: so how should ultimately -- you say what you think they will do. how should this court rule. put yourself on it for a moment, matt. how should they rule? >> well, remember i'm not an elite harvard or yale grad. i'm a state school iowa law school. i'm not sure i'm qualified, at least under the modern definition but i'll take a stab at it todd. i think what they should do is they should say that presidents do have immunity. that our founding fathers intended them to not make decisions with fear that they would be prosecuted by the next administration. so i think they should say that

that the outer bounds of presidential immunity are all the official acts that can be contemplated in a president's job under the constitution. you heard that in the oral arguments tovmentd you remember when there was a lot of back and forth but it was pretty clear that many of the justices were coming out that there was presidential immunity for official acts and they were just trying to find kind of where that extreme edge is. but, you know, it is also, to me, not these crazy hypotheticals about sort of ordering, you know, your political opponents assassinated, it is the practical doing the job of president, making decisions to protect the american people, one thing that joe biden, based on the last story we just talked about, doesn't seem to want to do. >> carley: well today is a decision today at the supreme court, so is tomorrow so we're going to be watching if they come to a conclusion. matt thank you so much for waking up and joining us. we appreciate it. >> good to see you both. >> todd: iowa's finest by the way. justin timberlake's attorney speaking out for the first time since the pop singer's dwi

you are vivid but one had serious injuries. the moments all caught on camera as you said here's the video taken from the rear of another bike. you can see a man and woman riding in broad daylight. the suv not even slowing down before striking the two from behind. now we paused the video to avoid showing you the graphic content so what you don't see is after the driver hits the two cyclists, the car swerves and runs over the man in blue who had fall ton the ground. the driver never stopped and kept on driving. the other cyclist in the group ride and followed this vehicle until police arrested the driver. one survive 61 year old tom said he's lucky to be alive. he said quote i was unconscious for a number of minutes i guess some people thought i wasn't breathing. i don't feel 100 percent, injury to the hamstring, fractured rib on the backbone here just overall amazingly lucky i'm alive. as far as that alleged driver highlander faces several charges including aggravated assault with a deadly weapon dwi and

right? >> yes. because what makes me so sad is because the coach, most of who we correspond with when we were down here, we called for help, just assist us. because they want us to come to the station. we don't have a broom to sweep the broken glass out of the van. and we just called the coach and said can you assist us? i said we don't know where -- we don't know around here, we don't know nothing, we don't even know the glass like this and can you assist us in any way, get the broom to sweep out the glass so that we can go and bet in the van to drive to the station and he said no he can't come. the only thing he can tell me tow do is bring my son at the dorm and leave him. and i said, sir, would you leave

♪ >> todd: a brand new fox news poll shows president biden leading in the presidential race for the first time since october and it comes just as biden is set to leave for camp david appear begin his prep for next week's cnn presidential debate. kaylee is the editor of restoring america at the washington examiner and a steam boat institute likely fellow. she joins me now. kayleigh should trump be worried by those numbers? >> i don't think so. he's gained a lot of ground over the past few months. and, sure, they're going to go back and forth over the next few months but this debate is a huge opportunity for him to solidify his recent gains and really gain some more ground over biden. we all know that biden is going to struggle in this debate and the only question is how much. >> todd: remember, this is an overall number doesn't necessarily focus on the swing states and quite frankly those seven states that are in purple right now are all that really matter of while biden is hunkered down prepping like you

mentioned it's not like trump is drinking milk shakes he's prepping as well. what advice would you give to donald j. trump as he preps for this debate? >> i think the advice is twofold. the first is, let biden talk. everyone has their own suspicions about biden's mental capacity at this point. let biden confirm those suspicions and we all know that he will especially if he's expected to think on his feet, to give lengthy policy answers and to rebut trump's points. and the second thing is that when trump does talk, he should focus specifically on policy. one of the mistakes that he made back in 2020 when he debated biden was he got too personal. he rambled on at length and he continued to interrupt. now we know that that last point is not going to be as big of a concern this time around because the rules are different. but if trump remains focused on the policy he's going to appeal more directly to the swing voters. i think about my own generation of young voters the latest new york times polls shows biden is up by just two points among

gen-z voters. there is a huge opportunity for trump to appeal to them on the grounds of policy. >> todd: let's heard more into the youth vote. the new fox news poll shows voters under 30 favors biden by eight points little different than the new york times you're talking gen-z this is you should 30 in general but back in 2020 fox news voter analysis shows biden won that group by 25 points so you can see if you compare these two trump is really chipping away at biden. do you expect him to further chip away at biden's lead with the young especially especially kayleigh to your point if he focuses on the policy a week from today. >> i do. and it all comes back down to the issues. if you break down these polls. when young voters are asked specifically about the issues that they care about and which candidate best alliance with their positions on these issues, they almost always choose trump. and they're just like older voters in that in that they care a lot about inflation, they care

about the economy in general, they care a lot about illegal immigration. when trump is heading into the debate there will be a lot of temptation to give into biden's personal attacks biden will call him a convicted flown and trump should remind all voters and all other voters that biden just let eight suspected terrorists across his southern border. biden will go on trump's role in the jeff capitol riot. trump should remind vote what ares the economy was like before biden took office, keeping a really narrow focus on the issues that voters care about is the best way to make a good standing in this debate. >> todd: there's definitely a juxtaposition on the issues but boy oh boy is there a juxtaposition on these two individuals ability to communicate a week from today. kaylee we appreciate your insight carley. >> carley: we have an update on the horrifying situation out of queens the ecuadorian migrant arrested for raping a 13-year-old girl at knife point

>> yes. i'm part of what you call a common sense caucus in the city council, which is somewhat rare considering it's republicans. it's all of us, republicans, and only three democrats. which goes to show you, out of 51 people in the city conway, only five of us, and we could only get three democrats to latch on to the common sense end of things. we did introduce, just last week in a news conference, to bring back the sanctuary city status. if that should not succeed, which it will not in our city conway as it exits today, we want it on the back of the ballot in november so that the people can vote and decide and make sanctuary city status come back. >> carley: something needs to change and you are fighting for that. conway woman palladino thank you so much for joining us.

violence. i wanted to be the change. i wanted to be able to make the city safe. so what better way than to become a police officer. >> todd: mr. allen iii that's the way i'm going to distinguish you, why did i answer the call and quite frankly follow dad into the family business? >> oh, i have always looked up to my father. seeing what he does and coming back late nights, that's why i chose to do it. >> carley: well, dad, st. louis police numbers are down in the year 2020, 1197 officers. now that's down to 883. so why in your opinion should someone become a st. louis police officer? >> what better way to serve your community than to become a police officer. to say make it a safe place to live in. grow up in, to work in what

better way to become a police officer. >> todd: doing stories about young men being why ward. we also have stories about young people looking for that purpose. the iii, again, i'm going to refer to you as that. what message do you have to other young people who are looking for that purpose in life and may be considering a career in law enforcement? >> it's an eye-opener. it really gives direction. it gives, you know, how can you say it lifestyle. it gives you a purpose. it gives that you direction. it gives you what you need to sort of contribute to the world. >> speaking of up, dad, have you great background as well. you were also an army veteran tell us your feelings about this country and continued service as well. >> the country is a great place to live in.

i got three years active duty. five year reserves. one tour in iraq. and, you know, serving your country. serving your community is a great way to do it. >> another question for you, dad, with the environment for law enforcement so challenging as it is in this current day and age, were you hesitant to have your son join you on the force? >> sort of, kind of, what better way than to serve your community and then to have your namesake, you know, following in your footsteps is a wonderful feeling. >> so you guys work the same shift? do you share the same squad car and what do other police officers say about -- you are both very young, too. what do other police officers say about you guys serving together on the same police force? >> they like it. but, you know, as far as emails, we both get emails that is supposed to be for each other because we have the same exact name. but it's great.
