>> this just breaking. we are getting a reaction in this hour to the stunning new report that president biden has told an ally, he is weighing whether or not he should continue in the presidential race. that is big reporting. the president's conversation is the first indication to become public that he is seriously considering whether he can recover after a devastating performance on the debate stage. hello, everyone. this is "outnumbered." i am kayleigh mcenany. director of the tech policy center at the heritage foundation and former dod counterterrorism analyst and fox news contributor attorney and former nypd inspector paul morrow. president biden has been facing calls to step aside from the 2024 raise for days now. some from elected officials in his own party. the panic over us biden has

intensified that biden alludes to trump. house democrats are prepared to call for biden to end as election effort. we will see if that letter actually comes out. several top democrats have publicly said it is time for biden to drop out of the race. this blockbuster "new york times" report on biden allegedly telling an ally that he is weighing whether or not he should drop out of the election. if this is true, this would be the biggest indication that he is taking all of these calls seriously. biden's team punching back immediately denying this report on camera and off. here's biden's deputy campaign manager on cnn saying that this conversation simply never happened. >> that is false. there are a number of rumors floating out there. the president is in this race to win megan. he's the democratic nominee.

we will continue to do i may not be able to continue. i may not be able to win this race. >> the president has been having conversations with a number of democratic leaders. the president and his own words acknowledged a poor debate performance. at the same time, what we are sensing from people is a sense of urgency. i think the conversations at the president has been having with democrats across the country is one to reassure them that he is in this race. he knows that he needs to reassure the american people and the campaign will continue in november. >> course role denial. what are you hearing? >> put this in context. the president and his family is first after the debate was very defiant. there was no reason for him to drop out.

this was a one-off situation. he had a bad night and was still the best candidate to be dro drowned. his administration and campaign likes to dismiss the pundits. they have been bracing for all their media chatter and tuning it out. as we have been watching these calls from democrats for him to step aside or at least to have a serious conversation about what the path forward is, should he decide to step aside, that seems to be getting to the president if there is any truth to this "new york times" report. within the report, the ally who spoke to "the new york times" also said he remains deeply committed to the race but acknowledging he's going to have a tough time convincing the american public that he is a viable candidate if he can prove that over the course of the next few days. indication that he's tossing this question around. the white house immediately responded to this. andrew bates tweeted that claimed by "the new york times" is absolutely false.

if "the new york times" had provided us with 7 minutes to comment, we would have told him so. you played the campaign denying this on the airwaves. we've heard from a couple of folks. this is a big piece of news this morning. the major piece of news which speaks to the landscape he is facing is this report that 25 house democrats are preparing calls for the president to step aside if he has a shaky performance over the next few days. we are going to see the president at a medal of honor ceremony. prepared remarks with no indication he will take any questions from the press. it will be an opportunity to field questions of what is normally a teleprompter event. we are also going to see him meeting with democratic governors who had been asking for a meeting with him just to make sure that he is okay. listen to what andy said. >> i think the governors want a direct and candid conversation

with the president. we want to make sure he is doing okay. we know him. he has formed a personal relationship with us. we take him at his word. and it's always good to see somebody in person. >> he saying these democratic governors want to lay eyes on the president before they get out there and continue to pledge their support for him moving forward as a candidate. there is an all staff call arranged by the white house chief of staff following reports that staffers are melting down, not getting any good explanations that will quell their own concerns about the president's mental fitness. the report was there was no explanation for what happened in the senior staff operating as business as usual. expect more of these. they want to be sharing their internal data, giving a landscape of what to expect and keeping the biden allies close.

delegates could select someone other than biden. he says he hasn't spoken to biden in the same interview. the one he was extolling the virtues of kamala harris who asked, would he support her? he went on a very long tangent about it. in that interview on cnn, he said because of legal issues involving ohio, it is my understanding we will have some kind of a virtual roll call before the convention opens. they are already planning this and already getting ready. that is very clear. i want to say on the other side of this tell you and i talked about this before the show. we have more and more calls for biden to step down. this is mostly left leaning democrats and major donors to biden who were saying in a letter, 400 business leaders and executives, it is time for you to step down.

>> if you thought it had ended, think again. the justice department will press on with 2 kim, criminal cases against former president donald trump even if he wins in november according to "the washington post." the doj has a long-standing policy of not charging sitting presidents. according to the report, they think a president-elect is still fair game. lawyers in the doj think the rules against prosecuting a sitting president would not kick in until inauguration day in january. george washington university law professor jonathan turley joins me. this is unbelievable. i literally said yesterday, lawfare has ended on july 2nd, 2024. i go to sleep and find out they want to continue this until

inauguration day. >> apparently you can continue to 11:59 and january. we will have to see. this is not too surprising when you look at jack smith's approach all along. his overriding priority in his cases has been to try trump before the election. he is attempted to short-circuit the appellate process and cut corners to make that happen. the supreme court rejected that effort and ultimately, he lost in spectacular fashion before the court and the recent immunity decision. that was actually the second blow. he effectively lost 2 on his counts in the fisher decision. the court rejected the use of obstruction, and made a very difficult to be used against trump and others. it recognized that he does have immunity and a wide array of communications and actions. it doesn't surprise any of us that smith is not giving up the

ghost. he is saying that he can try this case all the way through the election. they -- they aren't seen as trying to influence the result. smith has flipped out on its head. his findings in court. he says that he wants citizens to know the outcome of his case before they vote. >> you are exactly right. that is a fantastic point. i yesterday asked professor john yoo about that january 6 case and played analysis of jeffrey toobin. not a friend of the former president. he says that january 6 case is gone because of the rules of evidence put forward in the immunity case. he agreed. what say you? >> i think it is very, very difficult to do this. after the opinion came down at the court had ripped the wings off this case.

smith is still trying to get it off the ground. he has a very favorable judge. i can imagine a more favorable judge. she is very motivated. she was working to get this trial on a rocket docket before the election. she is likely to continue to try to do that. that was part of the problem. she was moving so fast, she never bothered to create a record. there was no record for the court to decide these questions. it has to be sent down. if she comes back and says these are private actions that are not protected, that can be appealed. i think that the supreme court saw this development. they gave her some very clear navigational beacons to stay with him. they were very clear that when he spoke on the... , he was doing and asked that presidents are expected to do to speak to points of great public

interest and indicated that i could be part of his official functions. she's going to have a very difficult time. he has a right to speak with people at the white house and for that to be protected. how is smith going to prove this case once you eliminate that evidence? many of us have doubts he could do this before the election or inauguration. she stopped doing pretrial motions. it will take 30 days for this case from the issuance of the opinion to be released at district court. she promised a defensive 80 days when she gets the case back. she has to do pretrial motions and deal with this and the fisher decision. i don't even think the inauguration will give him enough runway to take this case off the ground. >> they will try. we have learned from "the washington post." thank you very much. breaking now, the leaks keep coming. we are getting a lot of readouts
