>> brian: yep. ♪ >> steve: all right. let's start with that fox news alert. families who lost loved ones on september 11th, 2001, are outraged, some are, after learning the alleged mastermind behind the attacks and two other terrorists are striking plea deals with the federal government. >> brian: yep. that agreement takes the death penalty off the table for the detainees awaiting trial at gitmo. >> ainsley: lucas tomlinson joins us with the details. >> the pentagon says the mass per mind of the 9/11 attacks khalid sheikh mohammed has agreed to a plea deal sparing him the death penalty. ksm as is he known was al qaeda's propaganda chief. the president of 9/11 justice whose own father was killed in the terrorist attacks spoke earlier on fox. >> it's just terrible, and it's shocking. they cannot put these animals away and not let them see a trial and have a court, which or their right to justice. america is founded upon the

all the charged offenses, including the murder of the 200976 people listed in the charge sheet i said he personally killed daniel pearl in pakistan in 2002. >> they have been there for almost decades, actually decades. one of the problems was with the waterboarding. and they were afraid if it ever went to a trial of sorts, that all that evidence would be thrown out about it, right? >> that's right. and it's worth remeeting our viewers, steve, that 23 years after 9/11 attack, none of these prisoners at gitmo has been to trial. and a big part of that, as you mentioned, some of those sites, the c.i. a interrogation centers and getting that information. it's also worth noting it's cost over $12 million a year per detainee to house these. >> steve: per person. >> over $540 million to date.

>> ainsley: i talked to a friend who lost her husband in the 9/11 attacks. she said all of the victim's families were tuning in to the discovery hearing. where all the evidence was unseeltd. and she said they were not warned about these plea deals. did everyone find out yesterday it was a shock to these families? >> it was a shock to many of the families, including reporters here in washington that this plea deal was being organized. i traveled down the 20th anniversary of 9/11. i was down in gitmo covering for fox. what was notable is the defense of ksm. these are navy jacks. these are lieutenants, commanders. the judges rotate every few years. critics call it a kangaroo court down there. almost two years almost starting from scratch. a lot of people wanted to see justice. they think justice has not been served with the death penalty off the table. >> brian: yeah we did it. kill me. we want to die. we want to be martyrs. our legal system got involved. let's build them a defense.

seriously injured in the assassination attempt. starting at the 1-minute mark. can you see what appears to be a person on the roof of the building adjacent to where trump is speaking. the person is visible. until about the 2:50 mark. eerie timeline that falls three minutes before investigators say would be assassin thomas matthew crooks began firing. crooks was killed by a secret service counter sniper and former president donald trump's ear was grazed by a bullet. we know 50-year-old retired firefighter tragically killed corey comperatore. david dutch and james koppenhafer were both critically wounded and are now recovering. koppenhafer's attorney telling fox digital his client is sad about the state of politics in this country. >> overall, he just wants people to understand that how unnecessary it was. and that the political divide in this country has become so great. people are literally willing to

be watching and looking out for more details fbi stated later today back to you. >> cb, thank you very much. we saw a little of the woman who donald trump referred to as the computer genius who saved his life. she is still unidentified. we don't exactly know what her name is but, what's interesting about that is, remember, he turned to look at the gratification. you know, the graphic he has said, mr. trump, has only been used in about 20% of the rallies, and the computer genius said the day of the shooting, she was flabbergasted because he called for it so early it. probably took a second or two to get it. and eventually she put it up. he turned, and that saved his life. >> ainsley: so interesting, i called dave mccormick at the election, at the senate in pennsylvania. he said he was supposed to be on stage at that time. the president made a split decision -- a split second decision to have that graphic put up. much earlier than he normally does.

normally waits in the end of the speech. >> i still don't know was it the first shot at the president's ear in the second shot a straight shot, a third shot? a fourth shot? we need to know who got hit and when? everywhere i go people are coming up probably you too with a theory. sure there is only one gunman? are you sure about that? can you please start answering these questions? why is the secret service director and the fbi director saying well, he was flat on his stomach, it would have been impossible for him to see. yet, fox news digital gets the video of him running on the top. now, i'm always under the assumption that they get all the video and they -- for the investigation purposes they might hold it back. but they probably never even saw this unless they had cable and watched fox news yesterday. which is crazy. >> ainsley: one of the people that was shot. that was this person, his video. he released it. you are right, brian, all these unanswered questions. that's why america is suspicious in all of this. if they were just transparent and we knew all the details.

after a school shooting generally we know all the details immediately. why weeks later is donald trump now sitting down for this victim interview? you think that would be done the day of or the next day. >> steve: this is something pretty regular order, apparently. it takes -- you know, it's only been a couple of weeks. umght matily, i think the investigation has been so big and so all incouple passing and everybody is pointing fingers at each other. but, when you watch that video where the guy is running along the ridge line, keep in mind, that video was from one of the guys who was shot. is he low. all you see is a head going across there. >> brian: why isn't there someone behind the president? >> steve: there are. you have got the counter snipers on the buildings behind him. here's the thing. if you are just down there where the guy was and you see somebody going across there, you probably think oh, somebody up on the roof. that must be a cop. and, of course now we know with the miscommunication, you know, the feds thought somebody was on the roof. the people -- the local people apparently they were in a

warehouse, not out on the roof. there is a lot of finger pointing. >> brian: this guy didn't look like a cop. strang but i 120-pound guy. >> steve: that guy. you could only see the head across the roof line. >> brian: fcontacting israeli firm to to get through the encryption. three separate firms. why this guy didn't contact one of those platforms before in three separate countries right before he did the event, there is still a ton of questions. >> ainsley: we have so many wonderful secret service agents and you hear donald trump talk about that all the time. i just wish the top brass would be very transparent they are trafficked with protecting the president or former president. anyone who is on the campaign trail. they are tasked. that's their job, period. >> steve: that's why the acting secret service guy said the other day, i'm baffled. i can't figure out why they did all the bad stuff. so anyway, is he going to sit down with the fbi today. so, from the fbi to the dnc. today the d.c. is set to hold a virtual vote to select kamala

harris as their official nominee for president. democratic party delegates begin voting in just a few hours. >> brian: this comes after the former president returned to pennsylvania yesterday for the first time since the assassination attempt. and he delivered a big announcement. accepting vice president harris' challenge to debate. >> in one of the most astoundingly phony moments in her speech last night, kamala harris bragged that, quote: i will proudly put my record against donald trump's any day of the week. i will put it against donald trump. got one of the worst records in -- anywhere. well, kamala let's go. challenge accepted. are you ready? >> steve: okay. >> ainsley: what is her record? flip-flopping again every day by the minute. all right. meanwhile, outside the trump rally in harrisburg, fox's bryan llenas caught up with a handful of blank voters who said this about the two presidential

candidates. >> that is so -- there are two things. it's a silent vote for trump and it's a silent no vote. so that's what you will see. she won't get the numbers that they perceive that she will. it's either going to be a black vote for trump or a no vote. >> that's out of frustration. >> that's out of frustration. that's out of disappointment. black people can only blame themselves. you keep listening to democrats decade after decade. show up in your neighborhood eat chicken when it's time for the election. >> the pandering. >> pandering. identity politics. democrats have got that down to a t. >> as far as i have seen she is not winning the black vote at all. now, from what i see, black women, yes. black men, no. no. >> explain that for me. >> she has had pretty bad history putting innocent black men in prison. black men just not buying it. it's a no-go. >> ainsley: and just yesterday, she, vice president harris, she was notably absent from the association of black journalists that conference in chicago. >> steve: but she did have a lot to say about former president

trump's appearance later. >> brian: brooke singman took notes on that and a wants to share it now. hey, brooke. >> brooke: that's right. things got heated at that event pretty quickly starting with this exchange between the former president and abc reporter rachel scott. look. >> a lot of people did not think it was appropriate for you to be here today. you have pushed false claims about some of your rivals. you have used words like animal and rabid to describe black district attorneys. have you had dinner with a white supremacist at your mar-a-lago resort. why should black voters trust you after you have used language like that? >> first of all, i don't think i ever been asked a question so -- in such horrible manner. i think it's disgraceful that i came here in good spirit. i love the black population of this country. i was told my opponent, whether it was biden or kamala, i was told my opponent was going to be here. it turned out my opponent isn't

here. you invited me under false pretense. >> harris' campaign says the vice president could not attend because of scheduling issues. and said she would not be free until, quote: some point in september. the reporter attempted to ask the former president if he believes kamala harris was a dei hire and this is how he responded. listen. >> do you believe that vice president kamala harris is only on the ticket because she is a black woman? >> well, i can say now i think it's a little bit different. i have known her a long time indirectly. not directly very much. and she was always of indian heritage. and she was only promoting indian heritage. i don't know she was black until a number of years ago when she happened to turn black. >> the harris campaign did comment on trump's remarks saying, quote: the hostility donald trump showed on stage today is the same hostility he has shown throughout his life, throughout his term in office, and throughout his campaign for president as he seeks to regain power and flip his harmful

project 2025 agenda on the american people. and our own harris faulkner who was at the event said the q&a with the former president went into the wrong direction. listen. >> so by getting the conversation tipped off by making it so emotional and so personal with one journalist and one interviewee, abc news reporter vs. donald trump, what happens there is that you keep the issues out. >> after the event, trump posted on his truth social blasting the reporters for asking him rude questions. guys? >> steve: all right, brooke. thank you very much. and the former president is right. you know where was kamala harris? i was reading into where was she? keep in mind, joe biden -- apparently this association, national association of black journalists had been negotiating with joe biden and trump through january and then, you know, at the end of july, july 20th, or

something like that. joe dropped out. and they had earlier been asking kamala harris to be on an in person panel, but she said i have got other stuff to do. now the campaign says she is not available in person or even on a virtual thing although they are trying to work something outs in september. here what happens they are doing. keep innuendo moo, every event she has been at since she essentially became the nominee, essentially later this week she something kept away from the press. why would she show up at a press event and answer hard questions about her record and everything else? >> ainsley: i understand his perspective when he says, look, i made time my schedule to come here for this. i came here in good faith. i wanted to show up for the black community. and then kamala harris, you told me she was going to be here. now she's not here. y'all are 35 minutes late. i'm a busy man. and the equipment is not working. it was hard -- if you watched the whole thing. harris is asking questions. he says harris, i can't hear i

o -- i can't hear your questions. she really stuck to the issues. but the first question right out of the gate was critical of him. and so he is like, listen, y'all didn't tell me the truth about kamala being here. y'all are asking me these tough questions right out of the gate. no thank you, no welcome, mr. president. thanks for being here. i understand that perspective. he was set up for that right from the get-go. >> brian: karen, "the washington post," just because the former president showed up, she stepped down as co-chair. she is basically a lot of people protested. >> ainsley: criticized for inviting him even though it's a tradition, brian. >> brian: why wouldn't you invite him? he it is a president running for president again. his polls have never been stronger ever even in 2016 when he won. he walked into questions. she was two seats away he said i'm sorry, i can't hear you. adding to the frustration of the whole thing. it seems to me you're probably

that situation you should be briefed ahead of time that you are probably go be walking into a hostile environment. i think it caught him by surprise. i also don't think that it's a winning issue to bring up kamala harris indian, black, it doesn't matter. just running against a democrat. that's what i think the thing is. president trump is sun so unaware of race and gender. a lot of people say wow you don't talk to women like that. you don't talk to minorities like that. he said i'm running against that person. that's all he sees. and we all know this by now. not people that know him personally. and people that have been in the public -- watched him in the public for the last 8 years. how can you say that to ominority? how can you say that to a woman? all he sees is i have to win. i don't like what that person is saying. i cannot believe they are not here and this is where we are. >> and, you know, a couple of days ago we showed you how essentially how trump was going to take on harris. he, and the campaign had decided that what they were going to take -- hit her hard on was

migration. and the border. and we saw that ad, and it was a very powerful ad. and then she came out and she said sudden sudden bely, upside down world. no, donald trump made it worse. >> brian: no way it's not going to work that will never work. >> steve: ultimately, all of that got derailed yesterday, and now it's all talking about his appearance at the journalist convention. but, when you look at the record of kamala harris, just as they were looking at donald trump's record, that's what they were asking him about on stage. listen, i have great faith that people like harris faulkner would have asked kamala harris about how she has flip flopped on all of these things. when you look at her far left record, and it's right up there i mean, you could go through it. >> brian: let's hear it. >> steve: first we look at it and it's a lot of stuff. and unfortunately for her, has been detailed in the "new york times" and elsewhere, she is on tape describing a lot of this

stuff. >> ainsley: yeah, listen. >> generations now. been defunding public schools. but, yet, militarizing police departments. it's not working. can't just be about talk. it has to be about forcing change. >> i am prepared to get rid of the filibuster. to pass the green new deal. >> and so we set an ambitious goal to cut our greenhouse gas emissions in half by 2030. and to reach net zero emissions by 2050. and if it's about emissions that effect everybody, everyone should be able to partake in moving into this new green energy and clean energy economy. >> we have to have a buy back program and i support a mandatory buy back program. it's got to be smart. we got to do it the right way. >> brian: she was opposing fracking and now she is for it. according to somebody with her campaign. the wrong headed thinking by hiring more police officers makes you safer is no longer her feelings.

no longer wants felons to vote. no longer wants a mandatory buy back program. usually there is one major flip fellowship and try to rationalize and talk about how you evolved when you go to the middle. she wants to sayhe evolved on everything she stands for, which is why she wasn't a viable candidate that didn't get through the iowa caucuses. unless every media outlet continues it spin and she refuses to do any interviews, this cannot stand. >> ainsley: she was this so liberal as a da, senator, vice president, now she wants us to believe she going to change everything? this is why a lot of americans don't trust politicians. they flip flop, they change their minds, it's not just one issue. i understand can you change your mind on one or two issues. this is the whole list. >> brian: why the way, why? here's the question why? you ran on this, from the left coast. what made you change? did you have a near death experience? >> ainsley: who is the real president? >> brian: did you go to a think tank? tell the american people why you

changed your mind to have any substance at all. >> steve: she changed her approach so she could win, because the other things are not winnable subjects. i was thinking about it this morning. >> brian: that's what we think. she lived off, this she was winning something. she won as a senator. she won as attorney general. she won as a d.a. why stop now. >> steve: well, i was thinking about it this morning. it's almost as if kamala harris has gone into the witness protection program. okay. we are going to change your entire path. if you want to win, you can't say that stuff anymore. and that's why they are keeping her abe from reporters and everything else. you know, that is why she is doing these flip-flops. but the flip-flops are all on paper. we haven't heard her actually rebut anything because then that would make a very clean commercial for donald trump. instead, you know, the stuff was leaked to the "new york times" about okay, she is going to do a 180 on all this stuff. witness protection program. i wonder where they are going to move her? omaha. saw that in a movie.

that ad when she is trying to say she is trying to fix the problems and donald trump is stopping her? >> well, let me say this. for three and a half years, america sheriffs, specifically national sheriffs, western states and southwest border sheriffs have worked hard to get vice president harris, the border czar and president biden to even engage with us, acknowledge and it prioritize it. it hasn't happened. ainsley, i will say this. this is why american sheriff, western state sheriffs, sheriffs of the mississippi, southwest border, texas sheriffs have a vote of no confidence. issued in 2022 to president biden, because of her failure to do all three of those and secure our border. >> ainsley: and you are hosting j.d. vance today. i know you talked to him yesterday. he arrived yesterday. and had the rally. and now is he going to tour the border today. tell us what's in the works for today. >> well, first of all, i applaud him. beam ask me this is political. well, there might be some politics behind, this ainsley, the reality is this. that we have a former president.
