well, the kamala harris campaign has shown a lot of momentum in the last couple of weeks. one democrat strategist is warning their excitement don't count on it. there is a lot of irrational exuberance on the democratic side of the aisle right now because there was despair for some period of time about what november was going to look like. >> steve: they have a lot of excitement but what about the record? we're going to dive into kamala harris' record on policing just ahead. steve. >> ainsley: plus, for the first time since ji j.d. vance became v.p. i sat down with his wife to talk about life has changed. and her time as a clerk for justice kavanaugh. >> real requirement for people who wanted to clerk for him is can you be a decent person? can you be the kind of person people trust and respect? he really modeled that. >> brian: wow. that is so cool. meanwhile, in just a minute.

big fox weather alert. hurricane debby officially makes landfall right near stein hatchy, florida. the historic rain putting millions across the southeast at risk in the days to come the second hour by the way of "fox & friends" starts right now. we start this second hour with a fox news alert. breasting for potential attack from iran that could come as early as today or tomorrow mind is getting ready to meet with the national security team later today. >> brian: meanwhile trey yingst joins us live in israel with the latest. trey, attacks could be coming from all sides. >> trey: yeah, exactly. israel is on edge. proxies the "wall street journal" reports that iran told u.s. and arab diplomats it didn't care if counter strike led to war. jordan foreign minister in iran

meeting. and president biden is scheduled to speak with jordanian king abdullah ii. there has been very public iranian interaction with those trying to alert a crisis. with this in mind, israel is taking steps to prepare for a prolonged conflict as reports indicate the initial iranian response could come in waves and include extensive missile and drone attacks. a document sent to mayors of northern cities told officials to prepare for water outages, power cuts, and evacuations. and in jerusalem, an underground command bunker for government officials was open by the shin bet security agency. preparations for war in the north and with iran come as the conflict rages on inside the gaza strip. israeli negotiators traveled to cairo egypt this weekend for talks about a possible soos ofire but made no progress. israel has ramped up strikes against gaza going after hamas but killing dozens of civil yaps in the process. the question now is what comes next? of course, there are diplomatic efforts underway to try to alert

a larger war at this point israeli officials say it is not a question of if iran attacks but rather when. guys? >> steve: hey, trey, i have a question for you. i was looking at the jerusalem post. they say there is a new source there in israel where you are, they are reporting that israel is considering a preemptive strike to deter iran if it uncovered air tight evidence that tehran was about to pull the trigger. have you heard that? >> yeah. absolutely. that's being reported by the khan public broadcaster in israel. the source on it appears to be accurate. this follows an overnight meeting with top security officials, including the prime minister the defense minister, and the military chiefs trying to determine what the best course action here is just to give you a sense of how serious the situation is the meeting lasted for nearly four hours and ended after midnight after which there was a call we're told

between secretary of defense lloyd austin and israel's defense minister gallant. so these messages being ferried back and forth between the israelis and americans understanding that the current situation is unpredictable and israeli defense officials say the biggest concern for israel right now has to do with the timing. remember, back in april when iran projectile. gave them time to form a coalition to shoot down many of these incoming missiles and drones. this time they don't expect to have that runway. guys? >> brian: yeah. this is what they say, the iran might be adjusting its targets to after last time in april. they say this time they will change the number of locations. or conduct a series of attacks over an extended period of time. not a quick couple hour event. and then iran could also simultaneously attack u.s. forces to further divide. trey, these things sound solid change. how damaging, if at all, was it

for it to leak out that president biden told benjamin netanyahu to stop b.s.ing him and showed how how he was clamping down and upset by the prime minister? what does that do to the middle east in general? and to israel's enemies? >> israeli officials, especially those close to the prime minister, were furious about that information leaking. and many of them were talking to israeli channels behind the scenes following that reporting out of washington. but we should note here that when we talk about the broader threat of what's unfold right now, the israelis understand this may not just be an attack from iran but it could also come from other key proxies across the region that they have been funding and supporting for the last decade. so we're talking about hezbollah in southern lebanon. a force has around 150,000 rockets and missiles. they have precisions guided components smuggled into the southern part of the country by the iranians, houthis in yemen that have ballistic missile,

cruise missile, and drone capabilities of their own. and when you talk about the possibility of u.s. forces being attacked in the region. there were hundreds of attacks since october 7th that have taken place against american interest in the middle east. and so it's part of the reason that you see the americans on high alert, understanding that these threats do from iranian backed militias. >> brian: what a mess. >> ainsley: don't you remember biden and harris took the houthis off the terrorist list and the houthis start attacking our ships. >> brian: one of the first things they did. >> ainsley: throwing drones into israel. what good did that do us. >> brian: then they said saudi arabia was a pry a nation helping iran. getting houthis off the terror list that helped iran. allowing them to sell oil, especially china, that helped iran. so in the end you have totally enabled the worst actor in the region to create chaos, and, guess what? they did. >> steve: they did and now it's a waiting game. we will keep you posted. trey is standing by in hal haif.

>> mark: ainsley, steve and brian we should now within a few hours who vice president harris plans to pick as running mate. plenty of names being floated around out there including arizona senator mark clerks governor beshear of kentucky, governor shapiro of pennsylvania and governor walsz of minnesota. one person trying to read the tea leaves senator kelly posted something on twitter that sort much indicated he might not be on the race anymore. my background is a bit different than politicians. i spent my life serving in the navy and at nsa where the mission always comes first. now my mission is serving arizonans. some people thinking maybe that means is he foundationing on arizona as opposed to the white house. one of the candidates long considered a front runner is governor shapiro of pennsylvania. shapiro getting blowback after comments he made back in the 1990s resurfaced op-ed in college. he wrote that the palestinians do not have the capabilities to establish their own homeland and make it successful even with the aid of israel and the u.s.

they are too battle-minded to be able to establish a peaceful homeland of their own. so that could complicate any support he would have within the pro-palestinian community. the eventual pick that harris makes is going to be on the trail with her. they are going to be making stops all over the country. look at this map where they are going to be going places like hsavannah, mexico, detroit. i'm going to owe layer, wisconsin myself. while democrats are who they are going to be supporting. the trump campaign says the running mate selection is not going to sway this election? >> i don't care. let them do whatever. they still want to have open borders. if she picks shapiro, she is going to lose the palestinian vote. >> i think whoever she chooses, the problem is going to be kamala harris' record and kamala harris' policies. the american people are suffering because kamala harris keeps on making bad decisions. i don't really care who she chooses as a running mate. >> mark: vance also just said that he is glad to be on the ticket and dismissed any talk of him being a drag on the ticket political chatter and nonsense. we do expect trump to be back on the trail at the end of the day

week, is he going to montana for a rally. >> steve: is he indeed. mark, shapiro has come out and said you knows, those comments i have made while i was in college. i have evolved in my thinking which is kind of what we are hearing from kamala harris because two weeks ago she was against a whole bunch of stuff that suddenly she is for. she also has evolved in her thinking. >> mark: you are right. the governor and through his staff have also made it clear that they felt that this op-ed was something that was from so long ago. i think he was 20 at the time that he wrote it. that his opinion had changed. but there really is going to be a question about what kind of electoral impact shapiro pick would have. obviously the governor of pennsylvania. you know, he has been in office now for -- got elected in the '22 midterm. been a little under two years now. there is talk maybe he would be a boost in pennsylvania. would he be beneficial in michigan? that's unclear at this point. but, no matter who she picks, obviously. there is going to be a lot of focus on past comments. all resurfaced. harris getting a lot of heat, maybe more this week, why she

hasn't done a press conference yet or really spoken to reporters. >> brian: it just seems like we are the only ones concerned about that. doesn't seem like any other outlet is concerned about them not giving any interviews to any outlet. period. >> ainsley: mark, the difference is governor shapiro made those comments 30 years ago. more than half of his life ago. she made these comments about what she -- her progressive ideas two weeks ago. she just flip flopped. >> brian: right. >> mark: a the loft comments i know she is taking criticism for back when she was a 2020 presidential candidate herself. remember, she didn't make it in the primaries. but she had made a lot of comments. did a lot of interviews and doing a lot of the media. >> ainsley: that was four years ago and that was one of the reasons that biden chose her. >> mark: obviously though she is feeling like she has got the momentum. look at the money that just came out. july fundraising numbers last week. a lot of money that can be used on ads to try to change any of the polls which would show her maybe slipping in some battleground states. but, right now they file like

they have got the winning message. i was just with trump down in atlanta. he had a huge turnout but there was a lot of criticism from some republicans after he attacked the sitting governor down there. anybody who tells you they know what is going to happen is lying to you. >> brian: mark, i preach the name-dropping. seem even more important when we find out all your different assignments. >> mark: if only hawaii would come up on the calendar. >> brian: governor kemp says is he not going to endorse him. i would say the 538 poll the cbs poll shows a extremely tight rate. at love democrats rex extremely optimistic that this is the right pick. >> ainsley: they have to be careful because she is still in the honeymoon fades. she hasn't spoken yet. she doesn't have a good track record for her speech. >> steve: they will continue that. >> ainsley: that's what they did with joe biden they put him in the basement. >> steve: exactly. axios, to mark's point about the enthusiasm of the democrats. you know, the number one concern that was tamping down democrats'

enthusiasm of joe biden is he is too old and i don't know if he is really there. then she comes in and now axios has put up in the last 90 minutes an item that talks about how harris' entry could actually put georgia, arizona and north carolina back in play and cause donald trump, who thought that those were safe states and spaces to actually spend money there. in the meantime, when you look at the polls, and, brian, to your point, about how trump is ahead, david axelrod, who is very smart when it comes to democratic politics, was on over, i think cnn over the weekend, and he was talking about there is so much excitement but, if the election were held today, well, you watch this. >> there's a lot of irrational exuberance on the democratic side of the aisle right now. because there was despair for some period of time about what november was going to look like. now people feel like there's auto chance.

but it is -- a chance. but it is absolutely trump's race to lose right now. he is ahead. he is ahead most of the battleground states. they are close. they could be won by either candidate. >> ainsley: i think that's why she raised so much money 24 hours after she -- it was announced she was going to be probably the candidate. i think the democrats were just so happy that joe biden got out and they thought now we might have a chance because they knew they didn't have a chance when he was running against trump. and that's why they gave all of this money. but i don't know if that had anything to do with them absolutely loving her. i think when donald trump goes out there and he had these rallies, instead of focusing on governor kemp. i think he needs to focus on kamala harris and her issues. play her soundbites and play everything she said over the past four years or 10 years or whatever the course of her political career has been. and let the crowd react. just stick to the issues. because she is so progressive. >> brian: on pure policy. look at this, ainsley, they did a poll. cbs did a poll what's most

important in the battleground, minnesota, pennsylvania, wisconsin. economy wins almost double and trump kills her on the economy. >> ainsley: show his record against hers. >> brian: if the economy matters, and it does, everybody says the trump years were better than the biden years. and that's her years. he focuses on issues. is he going to be extremely tough to beat. the other thing that's going to be interest is, if he does not win, and kamala harris does win, goodbye filibuster, hello two new states. and let's find out what else is going to go by the boards. if you listen to senator murphy yesterday on "fox news sunday." he says we are going to reform the supreme court. andand he says they are solely owned by corporate interest. and we're going to make sure they have ethics rules and make sure term limits of 18 years. neil gorsuch was asked that by shannon bremen. he has a book out. here is his warning. i'm not going to get into a

political issue during a presidential election year. i don't think that would be helpful. i have one thought to add it is that the independent judiciary. what does it mean to you as america? it means when you are unpopular you can get a fair hearing under the law and under the constitution. if you are in the majority, you don't need judges and juries to hear you and protect your rights. you are popular tips there for the moment on you. when the government is coming after you don't you want a ferociously independent judge and jury of your piers to make those decisions? isn't that right as as american? so i just say be careful. >> steve: is he absolutely right. brian, to your point about he has written a book. that's what he was on the show for. the book sounds fantastic because it's called "overruled." the human toll of too much law.

there are too many laws in the united states right now. he says, you know, some people don't realize that they are breaking the law. they call the irs and they say hey, i need help with my taxes. and he says about a third of the time the irs gives you wrong information because it is so complicated. and things need to streamline. >> ainsley: yeah. he wrote: as a judge for now for 18 years, i just came to see case after case in which ordinary americans just trying to live their lives not hurt anybody, raise their families were just getting whacked by laws unexpectedly. >> steve: indeed. all right. speaking of supreme court justices. >> ainsley: yes we went counsel to swited usha vance who he is the wife of j.d. vance running with president trump. we spent time with her on friday. we asked her about clerking for supreme court justices. and she did clerk for kavanaugh when he was with court of appeals. he was a judge in d.c. and she

clerked for him. before he became a supreme court justice. but she did clerk. and these clerkships are very hard to get for chief justice roberts. i believe when she was at yale. and she talked about watching kavanaugh after she had worked for him. knowing who he was when he went through all of that through the confirmation process. listen. >> ainsley: you clerked for justice kavanaugh. when you watched what happened to judge kavanaugh, or justice kavanaugh now, when you watched him go through all of that and just be bee rated and reputation from years and years and years before were brought out and brought to the forefront and people were saying different things. it how did you feel to that and can you relate to that now? >> everyone just loved him. he hired people from all over the political spectrum. real requirement for people who wanted to clerk for him is can you be a decent person? can you be the kind of person other person trust and respect? he really modeled that my experience working for him was overwhelmingly positive. he was such a good boss.

yes, it was really really challenging to see not a different side of him but a different way of people engaging with him. and to just to struggle with that that was really hard to see. i do think that gave us a little bit of insight what it might be like. again, at the time, that wasn't the way that i was thinking about it. now i look back and it and i think about mrs. kavanaugh, the way she carried herself was incredible. it showed a lot of strength. and it's a model for the way to proceed. receive. >> steve: see, so much about her we did not realize. >> ainsley: she talked about the negative press. and she can probably relate a little bit to what kavanaugh's wife went through because she said a lot of the negative press people don't know the j.d. that i know. >> steve: during the confirmation period? >> ainsley: exactly. >> brian: so the other thing to keep in mind he must really be reluctant getting into brings after the way kavanaugh was treated. destruction of a person not their views. they tried to destroy him

we're having some technical issues with our audio back there. but you see these outer bands come in. we have landfall. hurricane debby moments ago making landfall here on the big bend area. not too far, about 40 miles or so from where we are standing. and now you're seeing that counter twist coming in here and the ebb and flow of these hurricane force rain bands. really, you know, the problem is with all of this rain is when the wind kicks up. it is sideways. it hurts and it also begins to tear off pieces of structures. i just want to have you take a look at this. and lloyd alford behind the camera doing his best in these tough conditions. lloyd, look at that, if you show them just one of the pieces of aluminum and steel that may be in a compromised scenario if these winds continue as hard as they are right now. and so, the sun just came up we

worst day since 1987. and we remember what a dark day that was. fox business' gerri willis joins us now. gerri, make it stop. >> i wish i could. steve, good morning to you. >> steve: good morning. >> we have a global market sell off underway as recession fears hit investors. as you were saying the nikkei index falling 12.6%. worst plunge since black monday in 1987, 37 years ago. behind all of this, fears of recession stoked by a poor employment report friday. the jobless rate rising to 4.3%. not expected. shocked investors. on top of that, large consumer product companies are reporting that folks out there, consumers are weakening in their spending. among those companies reporting this, mcdonald's, proctor and gamble, that's the maker of tide and sharman, pepsi, who get this frito lay unit is reporting that

real menace to everyone around his area. he finally gets confronted by cops, shoots him. both ends up in the hospital. and he gets arrested. and when he is -- when the photographer shows up to take a picture of him, he flips off the camera. isn't that the attitude that cops feel that they are getting from criminals because they feel they have the power these days? >> absolutely. i mean, imagine the arrogance of this dirt baggage member after he just robbed someone and tried to murder two nypd sergeants that he flips off this camera. but it's just a stark reminder, just like the illegal immigrant who stomped an nypd officer's head in and flipped off the cameras of how these criminals feel because they know they are not going to be held accountable for their actions. i mean take this career criminal going to get the golden glove treatment alvin bragg downgraded 60% of felony cases in his

office. criminals are laughing at police officers. they are laughing at the law-abiding citizens because they know they will be right back out because we have a group of rogue d.a.s in this country don't have a spine do their job. it's a complete joke. >> brian: by the way in new york it's the city council, too, backing up defund the police. terrible weak on crime attitude. their goggle is to empty the prisons and we are all going to be the victims. they want to tell us that crime is down in america? do you believe that? >> no. crime is not down in america. why don't you ask washington, d.c. whose murder rate is up 40% or kansas city who just had highest murder rate in record history or why don't you just ask law enforcement? because we have had over 2230 police officers shot this year. 60% increase in 2018. lat yeast highest number of assaults on officers in the last decade. we are going to work with targets on our back and every single police officer in country knows that crime is through the roof. >> brian: joe thanks so much.
