eric: vice president harris with that answer for critics who say she's been avoiding tough questions ever since she replace president biden at the top of the democratic ticket. that was nearly three weeks ago. recent column in a new yorker magazine put it this way saying quote the task of filling and what harris prefers to leave blank would usually fall to the press. but to date they have not been allowed or widespread calls for her to sit down and answer questions. as there were for biden after his catastrophic debate. but it is getting louder. liz peek is here to you think the strategy is intentionally to try to avoid tough questions for as long as the vice president can? >> yes absolutely and why not? after all she has a tremendous honeymoon going for her right now her approval ratings have been increasing. all she can do and she sits down for a press interview is begin to fill in the blanks. and there are a lot of blanks. that media has been very helpful

and basically expunging every position she took in 2019 during the primaries. whether it was on immigration or crime or anything else. everything now it's been a walk to the back including when she talked to people the press off the teleprompter a few days ago in michigan and. she said yes she would be open to an arms embargo with israel. in 48 hours later that has been expunged. it is time for harris to sit down and answer some questions. i totally understand why her campaign is refusing to do that. eric: at that detroit meeting, meeting with some pro- palestinian supporters she said should be open to a meeting about it. since then mr. gordon, phil gordon national security advisor to her said she is against an arms embargo. do you think these type of -- -- just a fact to raise that instead that media is given the rallies, the cheering, the support you get the soundbites

from behind the podium. is that a purposeful narrative to show her in a positive light for as long as they can? >> totally it is. let's remember it was a nanosecond ago that kamala harris was considered such a terrible candidate that democrats would rather run joe biden who they knew was incapable of serving four more years than having kamala harris become the candidate. she was like a threat to the democratic party and now they have embraced her whole hog. i think david axelrod was correct this irrational exuberance cannot last. for one thing, she has now made it a very consequential decision not so much in terms of what her administration might look like but in terms of who she is by picking a very left wing tim waltz as her running mate. that was an important sign as to who she really is.

but remember it is not democrat she has to win over. those people showing up at rallies and being excited joe biden is no longer on the ticket those are democrats but she needs to win over independence. they are looking at tim waltz and all that is coming out about him and says maybe kamala harris has made more of a progressive than we think more of a liberal that we think i don't think that's really what i want to sign up for it. eric: finally did you think she can settle some of this if she does give an interview? we heard her in the soundbites and talk to my team we will have one by the end of the month you think that's enough? >> three weeks off. don't rush. yes it's very important for her to sit down. what we have seen in the past it doesn't go well but very often off the teleprompter she gets into these terrible word to salads and doesn't make much sense. that is why she's not doing it we will see if she sits down with mark levin or rachel maddow

(♪) arthel: five columbia university students and graduates filed a class-action lawsuit this week against organizers of the anti- israel protests that shut down

the campus at the end of the spring semester. the suit also list some lawmakers who were defending those protest appeared to similar cases at harvard and mit have already been tested. one judge ruling the harvard law suit can proceed but another shut down but one are brought against mit. fox news has reached out to the defendants in the columbia case for comments that we have yet to hear back. meantime lead counsel in the columbia suit daniel joins me know. so first of all, who are the organizers and what is the legal complaint against them? >> it starts with students for justice in palestine. it's a radicalized organization with networks and nationwide. the fact these happen on campuses across the country at the same time is not an accident. but it really goes to a larger network of left wing agitators, of people in congress, in that unions that this was a

coordinated effort to highlight this issue. but in doing so they shut down: but university. my clients and tens of thousands of other students paid tuition for an education they did not receive. that is a result of that legal acts of these left wing agitators spread we are suing to get compensation. and hopefully deter this from happening again in the future. arthel: you said you win the loss of the students get compensation for do we have an idea of what you are suing for? can you tell us how much? >> tens of millions of dollars in damages here. if you think of every student in columbia. because every student columbia paid for pulp full education for that is how they got. they paid for a commencement too. every member of the class of 2024 was denied that commencement ceremony because of the security risk and the unsafe environment that was created by these on-campus agitators. arthel: let's take a look at a

scrolling list of anti- israel protests at all of the top 50 universities. we are talking about what is at stake with this lawsuit. what is at stake in terms of a precedent? >> this is hugely important not just for columbia but for every university across the country. when school goes back in just a couple of weeks that we are going to see another surge and activism. and the question is simple. are the active is going to follow the rules and follow the law? are universities going to ensure anti-semitic behavior has no place on their campus? hate speech has no place on their campus? we have already seen in columbia what can happen when these things get out of control when the students take over. that is not what we want at any of these top universities or any of the schools our kids are paying so much they deserve a good education that is with the school should be providing.

we should not tolerate illegal activity by some student activists. >> are you working with the universities to keep the agitators off-campus are you working on that end as well? >> the universities have it seek separate obligation known as title vi. hood there students have a safe learning environment they are not discriminated against based on race or religion. i think there are serious concerns from the university side they need to ensure their anti-semitic behavior or hate hatespeech happening on their campuses. but the real foundation for that is that we should not have student activists breaking the rules, taking over campus, taking over buildings taking janitors hostage, shutting down schools in the first place but those the people he sued because ultimately they're the ones who broke the rules. they're the ones who broke the law they need to be held

accountable. >> those students you are suing students they don't have money to their parents have to pay? >> there is a large nationwide network that is behind the student organizations. we have sued not only the student groups but the faculty who enabled this. the faculty unions and some will remember the visual image. correct some lawmakers at as well as three members of the so-called squad actually showed up on campus illegally trespassed onto columbia's campus and encouraging the sto continue in their illegal behavior. you cannot do that. we encourage people to break the law we call that incitement it is not protected by the first amendment. you can be legally liable as i think these lawmakers will be for inciting other people to break the law or you cannot do that the first amendment does not protect that. arthel: incitement is not protected by the first
