president harris facing big bash lash over their response to the brutal murders of six hostages held by hamas terrorists. some say they are both showing the world that america doesn't actually have israel's back. this is "the faulkner focus." i'm john roberts in for harris. the idf found the bodies of the six hostages in a tunnel in gaza over the weekend. one of them, 23-year-old israeli american hersh goldberg-polin, the deaths bringing fresh attention for the need for a deal to get those in captivity at home. instead of blaming hamas terrorists, president biden said this. >> mr. president, do you think it's time for prime minister netanyahu to do more on this issue? do you think he is doing enough? >> president biden: no. >> well netanyahu heard that and fired back during his own news conference. listen here. >> it's really an out rage that people say that. no one is more committed to

israel and butcher 1200 israeli civilians. we know that hamas has now put out orders. they have bragged about it, that if israeli defense forces are close to rescuing hostages, kill them. that's exactly what happened. your hearts go out to the victims and their families. what we need to do is make sure that every single hostage is either rescued or brought home in a cease-fire deal that makes sense for israel. the reason there isn't one has nothing to do with netanyahu and israel. everything to do with hamas sensing an opportunity to exploit divisions between washington and jerusalem. >> john: opinion piece in the "washington examiner" said biden is wrong. negotiation won't work with hamas. a bid by his attorneys to dismiss the charges. jury selection set to start on thursday. matt whitaker, former acting attorney general, with us now. hard to believe that 13 months ago hunter biden thought he would wash his hands of all of this with this crafted plea deal that blew up. >> good to be with you, john. the plea deal taking the gun charges and tax charges and given him probation and pay a fine and had deferred prosecution agreement with these gun charges that he was convicted of. now facing years in prison. remember, we know so much about this case, john, because of the i.r.s. whistleblowers that came forward and shared so much of the inside the room decision making where charges were allowed to laps because of the statute of limitation had run. the most serious charges. burisma money was allowed to never be considered. this is not part of this trial.

>> john: there will be other things that come to light. his attorneys with mount the defense he was an addict and in such bad shape he didn't know what he was doing. he couldn't have intentionally not paid his taxes because he is an upstanding citizen. that defense fell apart in the gun trial. what do you think will happen this time? >> i have a feeling the jurors are going to look at this defense that is trying to be made and be a little critical as to why they are telling all of this drug and addiction testimony and why he still was coherent enough to file taxes. the problem was he tried to deduct things not close to being allowed under federal law. at the end of the day it was those decisions that will what get him in trouble. >> john: his father said a couple of times he would not

pardon his son. that was back when biden thought he was running for re-election. do you think he could change his mind before he walks out the door on january 20th or if kamala harris were to win the presidency could she do it or a gesture of good faith in trump won do you think he could pardon hunter? >> i think that what president biden said was politically expedient at the time to get him past that story and through an election. now not a candidate i would expect he would pardon hunter biden after the election. certainly that would be the timing. i don't expect that president trump -- i haven't talked to him about it. i don't expect he would pardon hunter biden. i can't imagine the agreements that kamala harris made with joe biden in order to get him to move aside. i think there is a lot we don't have visibility to but i don't think hunter biden will go to four or five years in federal prison. >> john: that's probably a safe

bet. the fight for free speech is expanding across the globe. the latest front brazil. the country's supreme court has just upheld a ban on x, the platform formerly known as twitter that blocks the site for tens of millions of users. grady, what is this all about? >> x's owner is not happy with the court's ruling in brazil to put it mildly. musk fired off several posts on the platform since the top judge banned x and its supreme court upheld that ban. in one post musk says free speech is the bedrock of democracy. unelected pseudo judge in brazil is destroying it for political purposes. musk also suggested he should be impeached and locked up for imposing the ban. brazil's highest court ordered the country's telecom regulator to shut down x accusing the company of violating court orders and allowing hate speech

destroyed and it is in the interest not just of israel but of america to see it destroyed. look, the lesson we can take away from these most recent killings is that there really can be no negotiation. there is no path to some kind of deal that has existed for a long time as a fantasy from the biden administration. i think that these students are just a reminder that this faction within the left is not going to shut up or go away. they are going to stay around and going to be an active problem and a thorn in the side of those who would like to see the democrats prevail in the fall and be able to navigate this coming sprint toward the election without any kind of hiccups. in chicago the protests were there. i was among them for quite some time. we heard similar things echoed there. i think once people start coming out and this nice weather going back to campus they start to start making a lot more noise

by the vice president and now democratic presidential nominee kamala harris. she did break her media silence with tim walz. now she appears to use a new method to dodge press questions. a pair of ear buds. watch this. so when she have really on a call or was it a faint? harris has a slight lead but that is not really much of a change for polls taken before the dnc. that poll also shows voters trust trump much more on key issues like the economy, inflation and the border.

early voting starts in just three days in north carolina. almost 40 states begin early voting this month including seven battleground states. the last two cycles indicate more than 2/three of americans will cast ballots before november 5th. only 29% of people voted on election day in 2020. 30% voted early in person, 41% mail. we have our power panel now. so let's start with you, matt. this could be a big problem for the republicans. they've always lagged behind the democrats in early voting. they like to do it on election day. by that time as we pointed out so many votes have been cast and polls could change significantly now and november and kamala harris is taking no chances by putting herself out there in any way altering the outcome of the election. what are republicans going to

do? >> first of all that video you showed reminded me when they show the nfl quarterbacks walking in before the game with headphones. look, this is why the debate on september 10th is so important. her advisors will hire away. they don't want her in unscripted scenarios. the debate is so important coming up on september 10th. president trump has to make sure he prosecutes the case and able to press the case why the 3 1/2 years haven't worked. >> john: all the absentee and early ballots started being counted and the direction of the election changed in 2020. do republicans have any plan to try to fight the democrats one-to-one on early voting and absentee voting? >> i would be the wrong person to ask as a democrat to ask.

i don't know what republicans are doing. i look at the sufficient jock poll this morning that has kamala harris leading on national level by 5%. it's not double digits but a number outside the 3% margin of error. here is one of the problems where republicans and i hate to use shot themselves in the foot is the saying because you have them saying we don't want this, right? we don't want mail-in ballots and early voting. we want everybody to have same day voting and they changed it. matter of fact former president trump himself voted early the last time he voted in the state of florida. so you can't have those mixed messages like that to the voters. i think it is confusing. also democrats, i have to say for my party we have had that ground game for a very long time to get to everybody, people who are doing mail and voting early as well as those who show up. democrats do have an advantage over republicans with that.
