♪ >> ainsley: good morning. it's 6:00 a.m. here on the east coast. it's friday, september 6th. and this is "fox & friends." we start with a fox news alert. this morning the 14-year-old suspected georgia school shooter expected in court as his father is also arrested on the most severe charges ever filed against a parent of an alleged shooter. here is the exchange he had with a concerned officer last year. >> brian: plus, in a move that stunned the department of justice and prosecutors, hunter biden pleads guilty to nine tax charges but will the president pardon him? question mark? question mark? >> steve: is he going to pardon him just watch. lawrence is in the battle ground state of north carolina where ballots could be sent out as early as today. he is going to be talking to voters behind him who are ordering coffee. i'm telling you. hey, lawrence. >> ainsley: already. >> steve: "fox & friends" for

this friday starts right now. ♪ >> steve: our top story is a fox news alert. at 8:30 this morning the teenager accused of murdering two teachers and two students at his georgia high school is expected to make his first appearance before a judge. >> ainsley: this comes after his father is arrested and charged in connection with with the shooting rampage. >> brian: brooke singman has this story, brooke? >> the father of the suspected school shooter has been arrested and facing charges of his own this after telling investigators he purchased the gun used in the deadly shooting as a christmas present for his son in 2023 which was months after the teen was flagged for allegedly making an online threat to shoot up his middle school. georgia officers also spoke to the father when investigating that 2023 threat. listen. >> do you have weapons in the house? >> i do. >> are they accessible to him? >> they are. i mean, there's nothing loaded but they are down.

we actually do a lot of shooting and hunting. he shot first deer this year. >> 8 counts of cruelty to children. these are the most severe charges ever filed against the parent of an alleged school shooter these charges stem from allowing his son colt to possess a weapon. is a very difficult time as we know for students and parents and so many i know of students and parents here in this county and around this state are afraid public records show the mother has criminal record 2007 aggravated battery, criminal trespassing and possessing methamphetamine and fentanyl. four people were killed in the shooting this week. two students and two teachers and nine others were injured. the georgia bureau of

investigations announcing that police have made multiple arrest new york city additional threats made against schools across the state. guys? >> steve: brooke, thank you very much. >> brian: it's amazing. mom as questionable as the father's behavior that's why he has been charged. mom a huge drug problem. according to the neighbor, lauren vickers, there were nights when their mom would lock him out and his sister out ever the house and they would be banging on the back door just screaming mom, mom, mom, crying. it was absolutely devastating no. clean clothes. i'm not exaggerating. it was constant abuse. it was sad. so this was a time bomb of two children. >> ainsley: grandfather said he was a good kid but lived in environment that was hostile. his dad beat up on him oi'm not talking physical. screaming and horg he did the same thing to my daughter. aunts said he was begging for help for everybody around him. the adults around him failed. >> steve: surely. so the father has been charged in connection with this

essentially for smiling the weapon. they say apparently for christmas in 2023, that man bought his son an ar-15. after the cops come to your house and tal talk to your son making online threats. i know they dismissed them. i think a gun is probably not a good thing to buy somebody for christmas. >> nonetheless, we have gotten our hands on auto little bit of the sound where the sheriff goes to the house and talks to the father after online threats were made about a school shooting on the discord app., which is used by a lot of gamers. >> ainsley: this was in may before that christmas when he allegedly bought his is on the gun. >> steve: that's right. this is after the fbi tipped him off. the sheriff goes in. they have this conversation. >> he knows the seriousness of weapons and what they can do and how to use them and not use

problematic mom with a drug problem in and out of jail and mom wanting to get him out of the house. >> ainsley: big deal when you shoot first deer put blood on his face. most people use these guns to go hunting or to protect their families in case someone broke into their house. something that we need to be reminded of, we need to remember these four victims. the 14-year-old young boy chaplain spoke i was outside of the school trying to comfort his mom. his mom got a message from nathan saying mom, i'm in the bathroom. she shows up at the school and can't find her son. so she talked to the chaplain and he said he talked to the detectives and the lieutenant and how many times did we do the sweep? do you know that the school is empty for sure? and it turns out that her son apparently was found in the bathroom and he was no longer breathing. and the chaplain said he loved life. he didn't have any issues with anyone. he did have a condition. he was autistic. but that didn't stop his glow.

the president suspects son is facing significant time behind bars. hunter biden avoiding a second criminal trial after pleading guilty to all charges in his tax evasion case. they included three felonies and six misdemeanors. now, hunter, formerly admitting that he failed to pay $1.4 million in taxes from 201 to 2019. now, facing up to 17 years in prison. and up to 1.3 million in fines, the white house still maintains the president will not pardon his son. >> i can say that it is still very much unknown to questions i have gotten about is the president going to pardon i don't have anything else. >> can you comment on whether or not a commutation would be on or off the table? >> that's also no. >> griff: hunter left the court holding hands with his wife issuing a statement why he pleaded guilty. i will not subject my family to more pain, more invasion to privacy and needless embarrassment for all i have put them through over the years, can

i spare them this. his high powered attorney abbe lowell praised his client's decision. >> hunter decided to enter his plea to protect those he loves from unnecessary hurt and cruel humiliation. this plea prevents that kind of show trial that would have not provided all the facts or served any real point in justice. >> griff: this comes after hunter was convicted earlier this year on three felony drug charges for lying about his drug addiction to purchase a gun. he is facing up to 25 years in prison for that case. now, hunter remains free today on bond. sentencing in this tax evasion case is set for december 16th. guys? >> steve: all right. griff, we thank you very much. now, when we hear abbe lowell say that hunter wanted to avoid the humiliation of a trial. he you saw exactly what it was three months ago in the delaware gun trial, which he also faces, you know, substantial time in

prison for that as well. apparently, hunter was worried that his daughter's naomi and mazi would be called to testify. and the prosecution knew that and that gave them a lot of leverage, they were not willing to make a deal. and early in the day, when it looked as if alley -- abbe lowell was going to try to pull -- ask for alford plea, that essentially is they say okay, there's enough evidence to convict but he's innocent on some charges. essentially the prosecution said we'll never go for that because we have got the goods on everything he did. >> ainsley: in this case you either have to -- you have to plead guilty if you didn't pay your taxes. because either you did or you didn't. there is an easy paper trail for that. >> steve: is he going to do not guilty. >> ainsley: why? either you pull out your tax returns? did you pay it or did you not? it's pretty simple. >> steve: because he says he was addicted to drugs and did a lot of dumb stuff and paid it back

and first time offender that's what they're going to say. >> ainsley: yeah. to everyone else who does pay their taxes on that jury they are not going to have sympathy for that he says he did pay it back including all penalties, free of drugs clean for five years and didn't want to put his family through that so he wanted to plead guilty. >> brian: it was a thorough investigation and james comer gave them a huge head start. of course you don't want your kids to testify against you. the calls you made in the middle of the night. i get it. that's sincere. obviously. but the other thing is, was not brought up. is forensically when you try to find out actually how much money he owes, you usually would say how much did he earn? and then when you find out how much he earned, to do that you are going to have to go to different money that's coming in from different countries. and then you see where is that money? and then you see it fanned out to 8-year-old grandchildren and maybe a former president who happens to be his dad, and that, i think, has as much to do with

his kids being forced to go out there and the humiliation of everything on the laptop, which i had no idea it was real until recently. i was really in the dark on that. >> steve: i read it somewhere. >> brian: forensically as we saw in congress as they reconstruct where all this money comes. there is millions of dollars that were given to him that is just gone. and i'm pr pretty sure the irs doesn't look kindly on that. >> ainsley: lawrence is down at a diner in north carolina. lawrence, joe biden is sticking to what he said over the summer. he is not going to pardon his son. >> lawrence: well, i guess time will tell will it be joe biden or kamala harris or will it be donald trump that says hey, i just want to unify the country, put this behind us. i'm just not buying the whole trying to protect family from embarrassment. i don't think going to be embarrassed about tax charges. embarrassed by all the stuff he put out there publicly with that laptop and things that he uploaded to the youtube channel.

so, i mean, there is plenty of stuff, text messages and everything that is already embarrassed the family. i'm not sure the tax charges is really the problem here. >> steve: yeah. lawrence, you are there in north carolina today because today is the day at noon they were supposed to start mailing out the absentee ballots; however, r.f.k. jr. has been suing and so he has got until noon to -- a judge does, noon to decide whether or not those ballots will go out with r.f.k. jr.'s name on it. so, right now you are the epicenter of political interest that's exactly right. there is for the election to proceed on as planned 12:00. if a judge doesn't step. in everything is going to be carried out as usual and north carolina will be one of the first states to start the ballot process, guys. >> brian: yeah, so it's going to be interesting. r.f.k. said no you have to stay

on the ballot. i would like to appeal it. the judge says okay we will wait a day. >> steve: until noon. >> brian: going to gain your appeal. he has to battle to get on the ballot cost him millions of dollars. $100 million to super pac to keep him off the ballot. then he endorses trump and now they are putting money on to keep him on the ballot. it is head spinning. but, let's take look root now at the early voting battleground states we are sitting at in north carolina. no doubt about it, guys, that has become a battleground state. some people in the northeast have moved down to north carolina for lower taxes and better climate and maybe nicer people if the northeast doesn't ruin it, so 1 pointed race in the latest polls. the number one issue remains the economy. >> ainsley: next one is going to be pennsylvania on the 1st. mail-in ballots will be sent out. 17th it's georgia with absentee ballots sent to military and overseas. september 19th is wisconsin. the absentee ballots will be sent. and september 26th michigan and

october 9th, arizona. in person early voting begins mail-in ballots will be sent. >> steve: indeed. so, today donald trump is going to have a press conference trump tower at noon. i got a feeling we are going to see some of that right here on the fox news channel. also, is he going to go talked to the fraternal order of police in north carolina where it is just a 1 point race as brian mentioned a moment ago. the former president was down on 42nd street yesterday. there it is right there. that is, by the way, the same margin that he beat joe biden by in 2020. it was just a one point race. and he would like to obviously win it as well. meanwhile, the former president speaking to a bunch of economic wizards and gurus from wall street jedediah down on 42nd street. and he promised something really interesting. he said essentially there is so much waste in government, music

hey, francey, thanks for joining us. >> hey, ainsley. >> ainsley: timeline is this may of last year in 2023 before christmas authorities say they won't to the dad's house to veto online school shooting threat or several threats made online allegedly by the son. they go to investigate. they ask the dad if he had guns, yes we have guns, they are not put up. there aren't any bullets and we used them to go hunting. few months later, christmastime. authorities say that the dad bought that gun that his son allegedly used from the store a local store and gave it to his son as a christmas present. now the dad is facing these charges. is this going to be the new norm? >> it sure looks like it, ainsley. certainly the michigan case is the precursor for all of this. now, here in georgia, we have had negligent homicide especially as it relates to children and crimes against children for many years now. i'm not surprised that he is charged with these two counts of cruelty to children facilitated

second degree murder, if you will. and for that he is facing anywhere from 10 to 30 years in prison. on each count, and, remember, ainsley, while he said last year to investigators that there were no bullets in the gun, his son is not legally allowed to purchase bullets in this state or any other. no one under 18 can purchase ammunition in this country, so the father had to have not only supplied the gun. but also the ammunition. >> ainsley: what do you make of the child's background? it sounds like the neighbors are saying it was pretty bad. there were nights when the mom would lock him out and his sister out of the house. they would be banging on the back door and screaming mom, mom, mom, and crying. it was absolutely devastating no. clean clothes, i'm not exaggerating. it's a constant abuse. very sad. grandfather saying the dad was beating up on the son not physically and hollering and screaming at him. and the aunt is saying the child was begging for help. from everybody around him. and the adults around him failed him. >> well, it sounds like a sad and tragic situation all around.

but, and this may become relevant at sentencing, right? so why he did it or the fact that he has this tough background. might be relevant to a judge at sentencing. it's not relevant, however, to his guilt. and abuse is never an excuse. for committing a crime. and what most people don't know because tv portrays it always wrong is that children who are abused are no more likely to become abusive than the general population. it's something people think because defendants use abuse as an excuse all the time. i'm not saying it didn't happen here. but it's definitely not an excuse for the horror that this child inflicted on this state and the country on wednesday. >> ainsley: we want to also get your reaction on hunter biden pleading guilty. we thought he was going to plead not guilty to all nine counts in his federal tax case. but now facing a maximum of 17 years in prison and fine of up to $1.35 million, now, do you think he will actually spend time behind bars? do you think his dad will pardon

him or maybe kamala or donald trump? >> i think he will get pardoned. his dad will pardon him going out. i don't think there is any question about that. i don't think hunter biden is this brave selfless person is he trying to portray by pleading guilty to save his family. if that's what he wanted to do he could have done it years ago. he could have done it when the charges were lodged against him. he could have negotiated a plea with the government. he could have pled guilty during that ridiculously soft plea agreement that they offered him last year. and he backed out of. so, i think that he'll never see a day in jail. and i think that the timing of this was such that it protects his father in pardoning him after the election rather than before. >> ainsley: like brian said, won't allow them to open up the books to see where the money came from and where it went. thank you so much, francey for coming on. >> thanks, ainsley. >> ainsley: you are welcome. lakewood church pastor joel osteen coming up with his daughter.

incumbents father had the seat 11 years before that and three months to run and no money. 58% of democrats, 58 -- 62% black district. when you have the right ideas, and when you know the voters have given you a mandate to run, to move forward, then you have just got to press forward. you have hostile legislature's who want to stop you at every way. because they are thinking they are going to get a win. but the win is for the people. and so, you know, we have got to have economic development, which means how many jobs are you going to create? we need lower taxes which means when you come right down to it, how much does my hard earned money do i get to keep? or are you going to take everything from me? when it comes to safety and security, are you going to cause morale to be so low that we lose law enforcement, we lose department of corrections personnel or you are going to put legislation forward that

causes criminals to not go to jail. because you think that well, they need a third or fourth or fifth chance. >> brian: attorney general considered running. jason. you explained to him you are going to be running. what do you think if he challenges you for the nomination? >> well, we'll see what happens. but i'm moving forward. forward is the only way i know. and, look, we have got to do it now. we got to be able to talk about 24 and next year. because that's what leaders do. leaders get a basket of challenges that come before them and they have to be able to prioritize and they have to be able to make bold and decisive decisions. that's what i do. i have done that my whole life. i mean, you can't shirk from challenges and so, we're pushing forward. the democrats have had a whole year, a whole year to really campaign for their ideas. we're trying to make up ground. >> brian: spanberger with c.i. a
