shootings. then a few months later, december, christmas time, the dad bought the gun as a christmas present for his child. think about that, after the dad realizes there have been school shooting threats his son allegedly wrote online and you give your son a gun a few months later. >> brian: neighbors account shows how chaotic the house was. there were nights the mother would lock them out, no clean clothes, i'm not exaggerating, constant abuse, very sad. former federal prosecutor talked about charges to him and the dad. >> here in georgia, we've had negligent homicide as relates to children and crimes against children for many years now. i'm not surprised he is charged

seen this in hundreds of cases and an alford plea is an admission that the facts are bad and you will be convicted, but you maintain your innocence and the government was not going to accept that. >> ainsley: when it comes to donald trump, this judge ruled the trial for trump on charges stemming from j 6 will not be held until after the presidential election. did you expect this? why do you think the judge decided this? >> the judge in d.c. was looking at the calendar knowing there was not enough time to have a trial and president trump has reasons to not be available for a trial. this case was so delayed by the supreme court hearings of the immunity issue and decision in that issue, the clock ran out. ultimately, this case remains

weak after the fisher case and immunity and no matter what smith tries to do, i think this case remains a week case. >> brian: judge will decide if to postpone at request of trump team sentencing in the new york case, supposed to be september 18th, what do you think the judge does since he has postponed the sentencing? >> i was in court one day with this judge and saw him up close as to how he interacted with prosecution and defense. i think the issue here is not that he wants to sentence trump, he has to review all of the evidence admitted at trial and decide if it is affecteds by the supreme court immunity, which i think some of it was, especially the hope hicks testimony. he's got multiple decisions whether to hold sentencing and
