court to toss out a $5 million verdict that found him liable for sexually abusing carroll. nate, what have you got? good morning. >> just in the past minute oral arguments started with lawyers for former president donald trump speaking first. both trump and carroll are inside the courthouse as their lawyers are given ten minutes each to make their cases before a three-judge panel why the jury's verdict should or should not be vacated. last year they found he defamed carroll. $a 5 million. a second defamation trial cost him $83 million. in court filings trumps lawyers maintain he is innocent and trial politically motivated arguing plaintiff offered and emphasized inadd missible evidence to the jury wrongly admitted by the district court and made other arguments that

president trump was prevented from addressing through improperly precluded questioning and evidence. they argue the court limited what they could ask carroll during her pros examination and the judge allowed testimony from other women and the inclusion of the access hollywood tape. it is a busy week in court for the former president. yesterday his lawyers entered a not guilty plea on his behalf for special counsel jack smith's new indictment in the federal election interference case and down the street judge merchan is expected to issue a decision on trump's request to delay his sentencing in his manhattan criminal trial. trump wants that to happen after the november election. as for trump's appeal in this case, we are not expecting a ruling from the bench today but we are expecting a news conference with former president trump at trump tower at noon. >> bill: watching all that. nate foye there in lower manhattan. >> dana: he will be hustling

back from up downtown to uptown. shannon bream is the anchor of "fox news sunday." want to show you the status of trump cases. there is a lot. a lot of things going on and his team has to manage all this. what about the situation right now? >> if he will hear from judge merchan whether he will be sentenced in the new york case on september 18th, that's huge. his team has pressed to get that beyond election day. yesterday they find out the january 6th case here in d.c. will press into 2025. they've wanted to get these things off the table and not be discussing this in the final weeks. election. waiting for judge merchan to find out if they get that part of the puzzle piece. trying to map all these things out is like a beautiful mind. >> bill: it's a big deal. when we were talking earlier in the week we thought there were two days in the month of september that stick up more than anything else. one is the debate tuesday night and the sentencing the following wednesday if it happens.

we'll wait on that. hunter biden. sentencing dates for him. they won't happen until after election day, either. call for number three, november 13th in the delaware gun case and december 16th in the california tax case. the president has made it clear that he says no pardon, no commutation. but you have five months to rethink it. what is your view of that? >> listen, he is not running again and going to be leaving office january of 2025. i think most americans would say if their kid was facing potentially years in jail behind bars they would understand if president biden changes his mind on the way out the door. i have think that's very feasible. you heard hunter in his statement yesterday saying i don't want to drag my family through this again. the judge issued an order last week in the case saying when it comes to all of this stuff about prostitutes and sex clubs and strip clubs, if he allegedly took those things as business expenses it is relevant the jury

hears that. hunter knew all that stuff would come in and potentially other payments more broadly to james biden or other biden family members. he wanted to keep that out of the public eye. >> dana: the "wall street journal" editorial board said president biden said he won't pardon his son. hunter took one for the biden family team. he is fortunate to be the president's son. one of the things that's interesting about this is anybody else in this situation wouldn't even have the option. they would never be under consideration for a pardon or commutation and what the white house is trying to say now. i find it hard to imagine that it will stick that way. >> you know better than anyone about messaging from the white house. they have said repeatedly they didn't want to get involved this week and hunter is a private citizen and the president will stay out of it. maybe once the dust settles there will be no act situation oh the president is pressuring

d.o.j. cases will be done and maybe he decides i have to step up. november 13th the gun charges will be treated as a first-time offender. nobody thinks it will be jail time. january 16th could be a tougher sentence and change the calculation for the president. >> bill: senator john cornyn from the right and chris murphy and one from the left. senate foreign relations committee for murphy and a lot of these stories from overseas. an american citizen was executed by a terrorist group and there is a lot of people wondering where is the outrage and where is the outcry? and where is the american leadership when it comes to this? and this was a really hot story for us last weekend at the beginning of this week. like so many of the stuff it seems to fade away quickly. >> that's in contrast to what

now starting to see these gang members as well and telling fox news we've had gang activity in the north dallas area linked to the tren de aragua gang from venezuela yeah. our department is collaborating with other agencies to address possible crimes linked to this and other gangs in our city. tren de aragua has already established presences in new york city and chicago and tied to violent crimes in those cities including the shooting of two nypd officers in june. back live you guys want to hear crazy statistics, according to cbp data half a million venezuelans have been caught crossing the southern border illegally during president biden's time in office. ice data shows last year less than 1,000 venezuelans were deported from the u.s. venezuela does not cooperate with the u.s. we don't have any relations with them. as it stands now, the massive majority of venezuelans who show up at our border get released into the country often with little to know vetting. we'll send it back to you.

proceedings. the number of senators supporting impeachment has been growing by the day. you are starting to now see people, newspapers that have been advocating for more censorship online saying this is too much and outrageous and the kind of censorship they saw during the dictatorship in brazil. we expect to see hundreds of thousands of people on the streets demanding free speech guaranteed in the brazilian constitution. >> dana: do you know what the difference is what is happening in brazil with x and requests that have come from turkey and china asking them to pull things down in those countries? what's the difference here? >> the difference is just how extreme it is. with the case of turkey, that was also ongoing when turkey requested censorship, elon musk and x posted those demands online. here in the case of brazil they were not only demanding that people's posts be censored, but demanding banned from the platform, which is illegal

according to brazilian law. you had people, the supreme court justice was demanding that independent politicians and journalists be banned for things they hadn't actually done claiming election misinformation. in one case after the elections. it is very extreme. they are demanding that people be -- effectively destroying a person's career. if they can't be on social media you have no journalism or political career. both kamala harris and tim walz have endorsed similar kinds of censorship over the last five years. the big concern is you will see countries like the united states, brazil and europe working together to take control over social media platforms and engage in mass censorship. >> dana: you said biden and harris haven't said anything in particular. has the state department said anything? >> they have not. that's their job. all we've seen is one member of the federal communications commission carr issuing a strong letter.
