prosecutors and flipped to pleading guilty on all nine of his federal tax charges yesterday. he said he didn't want to subject his family to more pain and embarrassment. perhaps they've seen the youtube videos, too. the sentencing for this case is set for december 16th. that will be soon after the sentencing in his gun case. i'm harris faulkner and you are in "the faulkner focus." hunter biden faces many years in prison in the tax evasion case particularly. president biden vowed he would not pardon his son. and the white house seemed to double down on what the president said yesterday. >> i can say that it is still very much a no to the questions that i've gotten about if the president is going to pardon his son. i don't have anything else. >> can you comment a commutation would be on or off the table? >> that's a no. >> harris: he is exposed to 17

years by pleading guilty. he could have leverage and get it down. some people don't have big doubts whether or not biden would keep that pre-campaign promise because he is not campaigning anymore. kamala harris is. whether he would promise not to pardon his son. maybe he will do it now. nothing to lose. the "new york post" cover reads i beg your pardon? legal scholar jonathan turley hunter biden ruined himself every step of the way and now betting on a pardon from dad. >> i think they have placed hunter biden in the worst possible position. they could have reached a plea agreement months ago when they had something to offer. by waiting until the very last minute, they are guaranteeing he gets very little benefit from a plea deal. i have never in my career ever heard of a plea being proposed without speaking to the

prosecutors beforehand. that's like a jump scare in the middle of the courtroom in front of a judge is not a good idea. >> harris: there is a reason why that doesn't happen that way because that kind of plea isn't just a plea of guilty. kerri urbahn is with me now. he wants his cake and eat it too with ice cream and a cherry on top. >> normally as jonathan turley was saying the government offers it, not like you say i'll take this kind of plea. as it turns out he pled guilty to all the charges. as i predicted on your show yesterday, high drama yesterday afternoon. having worked at the department of justice and press releases there was a tears sentence in the release saying there was no deal. that is a pointed remark from the department of justice and another thing i thought of

throughout all of this that was happening over the last couple of days we wouldn't even be here if not for the i.r.s. whistleblowers when everything changed. they were the ones who exposed the special treatment that led to that ridiculous plea deal that fell apart and the government tried to get aggressive because they realized we look bad here because we give the president's son special treatment and hunter biden ended up pleading guilty to anything. >> harris: one of the two i.r.s. whistleblowers that testified to congress that the d.o.j. gave special treatment to hunter reacted to the plea yesterday. >> this is a little bit of vindication but it is not why we came forward and now we're more fo focused how will we hold d.o.j. accountable for the way they handled this case and hopefully some mechanism to do so.

>> harris: "new york post" opinion headline says hunter biden's plea proves i.r.s. and d.o.j. helped tilt the 2020 election for joe. that is problematic, kerri. >> it is problematic and i think hunter biden this entire time has been -- when i say entire time i talk about the years when he started making money off his father's name when he was vice president through now thought i can get away with it because i'm the vice president's son and the president's son. it will be okay. another thing called the delaware way, which is basically a known soft corruption situation in delaware where the bidens just get away with stuff. i think that's why we saw jill biden at that trial every single day, including a jury selection. she assumed it is delaware. the bidens get to do what they want in delaware. david weiss, the special counsel in all of this, has spoken out about the delaware way in the past saying it's a bad thing,

it's true and that's why it was also especially upsetting when they weren't doing anything on hunter for so long. here we are, pled guilty to it all. it is seemingly over but -- >> harris: and he reserves the right if they take that alfred plea. he is not really guilty. he can cop to it but it doesn't taint him at all. that's the part of the deal the government can offer you that. most people aren't brazen enough to say i'll plead but i won't say i did it. >> the reason we can pretty much assume that joe biden is going to either pardon or commute his sentence. no effort to work out a plea deal. that's crazy. normally you go in with all these charges and say what can we work out here so i don't go to prison for 17 years? the fact you show up when the trial starts and say i will plead guilty to everything means that you have something in your back pocket or you wouldn't feel so confident. >> harris: it has been there all along. not even the back pocket. probably a headline.

former president trump has pleaded not guilty to special counsel jack smith's superseding indictment in the federal election case against trump. the judge granted smith's request to jump start the case with immunity arguments in place from the u.s. supreme court. that same judge also set a string of court deadlines for trump over the next two months to insure the trial will not begin until after the presidential election. however, damaging revelations could still come out in the final weeks of the campaign in the form of public filings. kerri, walk us through what we're watching here. >> for starters, this is a judge who is obviously hostile to donald trump and she made a couple of comments yesterday in court that revealed that she is not the most impartial of arbiters, one being to trump's lawyer she said i don't need rhetoric how serious and grave this is. rhetoric? we're talking about a former

president and possible future president of the united states being convicted of federal crimes and going to jail. of course it's grave and serious. it is a very big deal. she likes to say i will treat him like everyone else. sure, crime is crime or alleged crime an alleged crime but talking about the former leader and possible future leader of the free world. it is different and should be looked at differently with the stakes as high as they are over the next couple months. right now where is some contention is trump's team is saying the supreme court decision says there is a presumptive immunity that donald trump's communications and interactions with mike pence takes this off the table and that's their reading of the supreme court opinion. because of that the whole indictment fails. the judge says it isn't how i read it. the next two months we see a lot of trading of paperwork until after the election to see where they land. >> harris: they can bring up the things she allows in court about the revelations coming out

before the election day. interesting to see who is involved in the courtroom. we have seen many things, many connections, even, to certain places in the biden administration with people inside courtrooms against donald trump. we'll watch every bit of it and cover it, too. good to see you, kerri, thank you. the suspect in the deadly georgia high school shooting was in court today. minutes later his dad was in court, too. the suspected shooter was charged with four counts of murder. his father was arrested yesterday for quote knowingly allowing his son to process a weapon. today he was charged with second degree murder, involuntary manslaughter and cruelty to children. former federal prosecutor with this. >> you'll see in these cases where parents are charged that there has to be some sort of evidence the parents were aware that their child had some sort of issues on the mental health

side of things and/or had exhibited violent tendencies. they seem to have lined up a lot of that information early on in the investigation. >> harris: four people died and i want to show you them and take some time. a 14-year-old who had just started high school last month. and we'll go. he is in the pink hoodie there. christian, also 14 years old, a freshman at apalachee high school. richard, a math teacher who coached the school's football team and christina irimie a math teacher. nine others hospitalized with injuries from the shooting. wounded. all expected the make a full recovery when the police chief

gave a press conference last night. some will be released and possibly have already been but he couldn't give a number on that last night. let's get more now. dana marie mcnicholl is in winder, georgia, an hour east of atlanta. dana marie. >> good morning, harris. it was a quick first appearance for the father and son, both facing murder charges. now moments ago, the d.a. of barrow county stepped out and addressed the media sharing that colt gray will face additional charges. the day of the shooting on wednesday they were not able to assess the conditions of the injured victims. the d.a. said that once those victims are healed the court will bring those additional charges. i do want to bring you into the courtroom this morning. ist was full of the victims' friends and family. judge addressed the teenage shooter telling him he faces life if prison but the death penalty. now minutes after the hearing

was finished, colt gray was brought back into the courtroom for a correction by the judge stating he would not face the death penalty. now although the teen is being tried as an adult, the u.s. supreme court banned death penalties for juveniles back in 2005. colt did remain composed during the hearing, unlike his father. 54-year-old colin gray visibly distressed rocking back and forth and appeared to be even crying during the extent of his hearing. he is facing involuntary manslaughter, second degree murder and cruelty to children. the most severe charges ever filed over an alleged school shooter. the judge broke down the possible sentencing for gray's charges. >> for a maximum total of possible penalty for the charges you currently are facing of 180 years imprisonment. >> police are also questioning the mother of colt gray who has

a criminal history. she was charged with family violence and drug possession after being found in meth and fentanyl. arrested this year for theft but not involved in this case. the father and son's appointed counsels did state today the defendants will have different representation, which makes it seem like the grays will be hiring a different lawyer. they are both scheduled for another preliminary hearing december 4th. the d.a. also mentioned that he spoke with the victims' family. had a conversation with them laying out what is next, what is the criminal justice system means and a sense of support for the families moving forward, harris. >> harris: they are going to need it. our support, our prayers, all of it. dana marie, thank you very much. a violent venezuelan gang is spreading into more cities across america. now we had been warned we might see something like this coming from venezuela. they have had a lot of problems

customs enforcement is confirming to fox news the four of the known suspected members arrested in a july shooting in aurora, colorado are here illegally. well, are we shocked? they were released into the nation under the biden administration's cash and release policy. again no shock. these men are separate from those in this now viral video from an apartment complex in aurora, colorado, members from that same gang, tda, are accused of taking over the complex very violently and famed denver based law firm was hired to look into the concerns. it says the gang had a quote strangle hold over the complex adding this. the evidence we reviewed indicates the gang members are engaging sex abuse of minors and

darren burks was gunned down next week. the gunman shot two officers who responded to the distress call. he led police on a high speed chase before officers shot and killed him. just look at your screen. 243 police officers have been shot and injured in the line of duty so far this year. the names you see there scrolling are the 32 men and women in blue intentionally killed just this year by gunfire. we welcome correspondent brook taylor to fox news. new member of our fox family. she have starts with hard news for us today. glad you are on the story for us, brook. >> this is a tough one here. the vice president of the fop tells me that attacks like this against officers are escalating. he called this an all-out raging war against police. officer darren burke, as you just mentioned, is the latest

example of this. an officer just killed simply because he was wearing a badge. a long time teacher and coach and recently became an officer to serve his community in a different way. he was murdered less than a year on the job. dallas police say he was sitting in his patrol car between shifts when a shooter went up and murdered him. check out this dash cam footage here shows the final confrontation between the shooter and police following a 25-mile chase. the shooter identified by police as corey, stops in the middle of the freeway. walks towards those officers, a shotgun you can see in his hands. the officers are yelling at him to drop that gun before he is shot. according to fox research there have been 32 officers intentionally killed so far this year. now, remind you we aren't done with the year yet and already close to the total of all of what we saw in 2015 where there was 35 officers killed

this is an expanding problem, hit jobs on cops. we cannot tolerate this as a nation. >> it does signal a change in culture, doesn't it? to put a few numbers on it. numbers compel. last year we set a record in 2023 for cops shot, 378. the most we've ever had. here is the number that start also. 115 of those were ambushes. so it's not like the cops got shot because they interrapted a robbery or crime in progress. that's essentially an ambush about once every three days. we have never seen anything like that in this country. you have to say what is causing it? one of the things you have to go to is the fact that since 2020, police officers, policing as a profession has been vilified and cast in the worst terms and for those who are perhaps maybe leaning towards doing something like this, they have just been validated and given their excuse by the powers that be and they

go. >> harris: i can't not say this because i'm certain people are thinking it. tda in this country, the venezuelan gang is a threat to national security. i never hear the vice president mention them and she is a former prosecutor and attorney general of california. it is a problem when your leaders, who say they have a specialty in a category, don't see the danger that americans are under at this moment. it is our cops and it is our citizen, too. let me get to this. former president trump sees all this and speak this afternoon to the fraternal order of police at a critical time for law enforcement. the organization's national vice president posted yesterday the war on cops rages on, seven officers shot in the last 48 hours. the historic violence against law enforcement we're seeing is a stain on our society. we should not and cannot allow this to be accepted as the norm. president trump has made crime a key part of his campaign with his commitment to quote make

america safe again. we saw that at the rnc convention. he has been critical, highly critical of president biden and vice president kamala harris. >> joe biden and kamala harris formed the worst presidency and vice presidency by far in the history of our country. this election will decide whether we reward kamala harris with re-election and four more years of crime. >> harris: we've seen kamala harris trying to frame herself as tough on crime with her background as i just mentioned to paul as a prosecutor. however, critics have pointed out her actual record. a liberal record. she pushed to overhaul the criminal justice department. expressed support for the defund the police movement and in 2020 posted a plea for donations for the bail fund for the 2020 george floyd rioters. her record speaks for itself and it won't help us out in this moment. >> it is not.

that's the record she is running away from and what i'm talking about when i say there is some sort of implicit sanction. i don't mean any of the progressives are actually saying go out and shoot police officers. but when you stop the enforcement. when you let this laxity begin to enter the criminal justice system. decarceration movement like we've seen in manhattan. in new york city we've all been gas lighted how crime is down. in new york city violent crime, the stuff that matters is up well over 30% over the last -- >> harris: we never hear that. >> property crime isn't reported. well over 2/three of property crime doesn't get reported to the police. if you look at metrics matter. >> harris: we know nothing will happen. >> when you talk about the migrants you have to look at that. add to all this chaos the overlay of an armed organized criminal gang like tda never mind migrants who are just
