minutes, as we mentioned. fox news legal editor karrie urbahn in a moment. first the justice department david spunt who has the report to begin a new hour. hello. >> good morning to both of you. we're awaiting ryan routh, the 58-year-old suspect in this case to appear in federal court in florida telling us there will be federal charges. we don't know specifically what charges he will face. we don't want to speculate. we know he is appearing before a magistrate judge. we are also told that those charges are sealed at the moment. we're expecting them to be unsealed at this point. what's not clear if he will face some sort of state charge. this is a coup for law enforcement because they have this person alive. they are happy to be able to talk to him and get in his mind, find out motive, and see what he is willing to spill now that he is in custody. he has been at the palm beach county jail where he spent the night and making that appearance here as we speak in federal court. we'll be getting a read-out from

our producer in the courtroom, bill and dana. >> bill: what's getting a lot of attention this morning the acting secret service director is meeting with the former president at mar-a-lago. see what they have to talk about here. many are suggesting that dhs now runs the secret service and it should be back under the department of treasury. for those who believe that, why would that make a difference when it comes to presidential and/or candidate security? >> the department of the treasury ran the secret service from when it was founded back in 1865 at the end of the civil war. the department of homeland security took over the secret service back when the department of homeland security came to be 20 something years ago. rank and file agents in the secret service have told fox news repeatedly they want to go back to the treasury department. they feel dhs is a bureaucratic agency. ron rowe in florida who is in west palm beach was a police

officer in west palm beach and took over the agency two months ago when kimberly cheatle resigned at the end of july days after the former president was shot in the ear at the pennsylvania rally. he was supposed to release the agency findings about this shooting this week. unclear if that's been clad because of what happened in florida yesterday. the secret service, justice department and f.b.i. all taking different pieces of this case. the f.b.i. investigating the suspect himself ryan routh, his background, potential motive. d.o.j. is looking at the charges and secret service looking in the mirror this morning and doing some self-reflection how this happened. several u.s. officials told fox the service is not staffed to handle trump the way they handled joe biden or kamala harris. that's a fact. the reason joe biden the sitting president with nuclear launch codes. kamala harris the second in line to that position. trump is a former president in a unique situation as a candidate who wants his old job back is

still a former president. barack obama, george bush have the same protection as bill clinton and jimmy carter. trump's security apparatus falls somewhere in the middle of ex presidents and the current president and vice president. once again secret service conversations underway now to change that perimeter wherever he goes and start beefing up that perimeter as if he is the current president and i'll end it on this. once again conversations. those conversations happened two months ago after the shooting in butler and here we go, those conversations about expanding that perimeter once again. >> bill: 1865, abraham lincoln. david spunt. good reporting. >> dana: karrie urbahn. since we're waiting for routh to be in court what kind of charges he may be facing? >> i would think at a minimum it would come into play if there is any kind of language from this individual.

i think there is, saying things about donald trump. i think david spunt spoke to this where it gets tricky, a very black and white federal statute that says to assassinate a president it is obviously a crime. a current president or president elect. now donald trump doesn't fall within that bucket. what's interesting to me, dana and bill, is typically the state goes first with charges and federal comes in after. a d.o.j. policy they won't prosecute a defendant for a federal crime if they've been prosecuted by the same act by the state unless there is a compelling federal interest. here that compelling federal interest would send a message about political violence. i can't help but wonder if there has been conversations going on behind the scenes and the department of justice is saying we want to go first and bring some hefty things. >> bill: we'll cue up a sound bite. we mentioned this with a reporter about an interview he did speaking on behalf of

ukrainian military and their war with russia. when we get that queued up we want our viewers to hear it. find it online in 11 or 12 minutes. he probably did a number of these interviews. listen to what speaker johnson had to say earlier today about the threats the former president faces. he was on with "fox & friends" and got stuck in a traffic jam for an hour as the motorcade went back to mar-a-lago. >> had they not been there and acted so quickly we might have having a different conversation today. president trump needs the most coverage of anyone. the most attacked, most threatened. even probably more than when he was in the oval office. we're demanding in the house that he have every asset available and we'll make more available if necessary. i don't think it's a funding issue. i think it is a manpower allocation. >> bill: the current president referred to that leaving the white house 45 minutes ago.

the sound bite, one of many, from routh talking about ukraine and the war there. >> i was talking to over 100 soldiers every day. pretty much everybody, all of our contacts in ukraine, are adamant, yelled at me every time i suggested that we bring in afghan -- >> bill: he was not well received in ukraine. this guy was all over. it's really a twisted story. >> it is a twisted story and if you read through what was learned about him so far with the rap sheet. he is all over the map politically. he strikes me a bit of an anarchist perhaps guided by a mental state that's off. i will say this about the secret service. this situation does strike me differently than the one we saw in butler. for starters, the fact that this secret service agent was able to spot the barrel of a gun coming through a bush. that's pretty impressive.

take care of that right away. also i think from a public relations perspective the fact that the secret service acting director is on the ground there today meeting with the president, we did not see that at all in the last situation so it's clear he is taking his job very seriously and should be commended for that. as far as allocation of manpower it's possible. it could be a manpower issue. secret service has discretion over how many people they can protect someone. here it is warranted and a simple bipartisan letter saying we want to protect donald trump in the interest of his life but the welfare of our nation would do the trick. >> dana: thank you for joining us. if we get more out of this court appearance we'll bring you back. joining us now is former f.b.i. assistant director chris swecker and robin drake, former chief of the behavioral analysis program. we showed video of routh in an

interview from 2023. chris, from your perspective, what could you expect from what you've learned about him so far he is in court any minute now? >> he looks to me like he is sort of that proto typical person that takes up a message, acts on this heated rhetoric. he is unbalanced. he has at least six arrests, if not more. doesn't like authority. doesn't like the police. had a stand-off with them in greensboro for two hours. somehow escaped through the net there and not done any serious time. he has a very -- anti-trump ideology and liberally posting on social media. he is that type of wing nut that will take the message up and act on his own and do one for the team. i think the motivation here is going to come -- that's the motivation the f.b.i. already knows about. they'll protect their prosecution right now and not

put out a lot of information but i think that motivation is pretty clear. >> bill: apparently he is not talking is what the sheriff said earlier today. that's by design. my two questions, robin, where did he get the motivation and how did he know trump would be there at that time of day on a sunday afternoon? what are your questions? >> that's the big question there, bill, is where did he get that information? whether it came from social engineering, people around him. that's really disturbing where that information came from where trump would be. kind of building on what chris was saying also, his motivation is going back to utilizing political ideology that is being spewed out by a lot of the media and using that for the thing called criminal notoriety. taking that message and going after trump. again, i think the spur moment that kind of might have fueled him was the first attempt back in july seeing how easily this kid could do that.

that's why i think they need a lot of really big build-up of resources and personnel around trump. this is something we've never seen before with a political candidate, that is he has a lot of attention. so people that are going to try to have this criminal notoriety are going to use his celebrity to try to get their message out like he did. >> bill: we don't know if this was his first visit to case the joint. we don't know that answer yet. >> dana: the other thing is i'm wondering, chris, a lot of presidents love to play golf. secret service has protected them. they are big, open spaces but is there something that has been done in the past that they could maybe ratchet up in terms of a tactic for somebody like president trump even if it doesn't involve more money or more personnel for the agency? >> well, the first thing that comes to mind is don't -- be very careful about the president's schedule. in other words, limit the number of people that know that he is playing golf.

keep him off the putting green and the driving range before he goes out and plays because people could post that on social media and say the president is here and that would give would be assassin at least an hour in this case or an hour and 15 minutes to post up and set up the sniper's nest on the sixth hole. be more careful with that. i would have thought they had someone walking the fenceline outside the fenceline. that's where the danger will come from, not on the golf course itself. but from just outside the golf course exactly where this person set up. he clearly had set up a sniper's nest with the backpacks and the ceramic tiles and mounted the gopro going straight out from his position. he was -- i think he was going to try to take a fairly close-in shot of the president as he went from the fifth green to the 6th tee.

>> bill: this is a massive area. it is larger than the fairgrounds in butler, pennsylvania or the farm field. it might be two or three or four times as large as butler, pennsylvania. the sheriff said did he have a place to stay and how did he travel? those are two of the questions he offered earlier today. do you think they know that yet? >> i'm guessing they have a really good understanding of that by now. the difference between this guy and the kid was that he has a large social media presence. he has been spewing a lot of information for a long period of time. he got there somehow and that creates a great footprint and guarantee they've already got records on his phone and a lot of subpoenas out and gathering a lot of information really rapidly on this one. >> dana: chris, any final word before we wrap things up here? >> i don't think we'll get a lot of information out of the f.b.i. at this point. from my perspective as a former

prosecution they'll protect their prosecution unlike butler where the would be assassin was already dead. we aren't going to get a lot of information unless it leaks out through the sheriff and he seems liberal with his appearances in front of the press. they will muzzle him. i know the f.b.i. knows his motivation. they know whether he fired his gun. they know a lot of things right now. we won't hear about it. may come out in dribs and drabs but they will protect their prosecution. >> bill: these words are telling. >> yes, the threat level is high. we have increased the amount of assets that we've supported. so we are -- we live in dangerous times, so yes. >> bill: we live in danger times. last word, robin. >> we definitely live in dangerous times. these are different times and

first one. he said no ears were harmed. carry on with your sunday afternoon. if you believe hook, line and sinker things said about president trump, you believe that he wants a national abortion ban, that he is against ivf and for project 2025 and he wants a bloodbath. all those fact checked as faults. you see jeffries two hours tweet out extreme maga republicans are the party of a national abortion ban and project 2025 and condemns this. we all need to look at rhetoric on both sides. not say mistruths. we're in a very dangerous time. >> dana: abc news poll that came out yesterday showed a little bit of a upswing for harris at 52-46. and then asking who won the debate the poll 86-36 on that front. president trump still up in the

swing states or at least within the margin of error, and in talking to undecided voters who will decide the election, they thought that trump won. they did on the economy and their most important issue. what should we make of all this? >> i think back to the personal anecdotes outlined by forties and one was a woman named judith a mile outside of the harris event in pennsylvania friday. she said i thought harris did a wonderful job in the debate but more where she stands economically. she works for the school. makes 7.25 an hour. her rent went to $1 thousand and finds herself supporting president trump because of the economy. when you have a universe, 3% persuadeable likely voters, only 3%. on the margins things matter. economy is in trump's. the polls are razor think. harris had the biggest audience in the debate 67 million people.

when will she get another audience like that? maybe never. >> bill: see whether they go back and forth on this debate. fox news update now what we're hearing from the former president. he spoke with fox digital a moment ago and he blames biden and harris's rhetoric, kaley, for causing him to be shot at. he went on to say let me get the quote here, guys. he, ralph, believed the rhetoric of biden-harris and acted on it. their rhetoric is causing me to be shot at when i'm the one who will save the country and they are the ones destroying the country both from the inside and out. they are the opposite. these are people that want to destroy our country adding that it is called the enemy from within. they are the real threatened quote. really, yesterday it was thank the secret service, you guys did a great job, i'm okay. thanks for your support. today it is much different after meeting with the acting secret service director this past hour.

on a saturday evening two months ago mid july and now we have a saturday afternoon mid september. 1:30 the secret service agencies the suspect, fires at him and he fleece. within the hour the campaign said the president is safe. two hours the suspect was confirmed in custody 40 miles north of where the shooting took place. 5:45 eastern time the f.b.i. then said it appears to be an attempted assassination. i know the phones were blowing up on what was the beautiful sunday afternoon and i know a lot of folks that i was with that it was just stunned. has it happened again? another attempt? this is what we've got now from the f.b.i. we'll see what happens based oh than this court case and we'll wait for maybe a perp walk or something that could be forthcoming still this hour. stand by for that. we're waiting on it, dana. >> dana: pakistani national with ties to iran is facing new

terrorist charges. merchant is the orchestrating behind a murder for hire plot targeting u.s. politicians. his arraignment gets underway soon. eric, what do we know here? >> here is another case. this has to do with this alleged assassin. officials say president trump was a possible target of this alleged assassin, as were other officials. he will be arraigned in court in a couple of hours. he was acting on orders from iran is what they believe. 46-year-old is a pakistani born terror suspect and a wife and kids in iran charged with trying to range the assassinations of u.s. politicians or government officials on u.s. soil. also facing a terrorism charge. the indictment does not name his alleged targets but iowa senator chuck grassley has said the former president, current president biden and former u.n.

trump with two assassination attempts so close together. essentially the service is protecting three presidents and that will draw a lot of resources. that's the first thing i thought about besides thinking thank god the former president is okay. >> dana: bill, you golfed with obama many times meaning as an agent. so you were either ahead or behind. >> not on a personal level. >> dana: one of the things you told our producers you think trump has to be less predictable. his golf course is different from other ones. why? >> people pay hundreds of thousands of dollars to join the club because they want to be close to the former president. take pictures with him, so it is a semi public golf course. that means it is sort of open to the public in some ways, military courses, i've worked many times when i was in the secret service with president obama golfing. and i have been on military courses where high ranking

generals and colonels turned away from tee times and obama decided he would golf that day. you can't do that on a public or semi public course and this course also sort of borders public areas, major highways and thoroughfares. very difficult for the secret service to set up perimeters in that kind of environment. it is not like you see on tv where the secret service will come in and have this mile-long corridor and shut everything down. there are adjacent businesses. it is not possible to do that. very difficult for the secret service to establish a protective bubble here on a semi public golf course. >> dana: you said that people can come and go within reason around that bubble and that's not going to stop. so then what happens? you say in a perfect world the secret service would have more agents and would not be understaffed. >> yeah. dana, i said this back in july on your show and other fox shows. perfect world the secret service at that golf course would have

had 1,000 agents, 50 counter sniper teams. it is not the reality. a lot of cases i'm very proud to have worked there. i have friends that still work there. in my opinion the best federal law enforcement agency there. the best protective agency in the world. however, every director since 9/11 really missed an opportunity to ask for more funding and more resources. when you look at the comparison of the budget of the f.b.i. and secret service there is no comparison there. so the secret service has got to take a hard look after this second attempt and ask some serious questions. do we want to lose investigations and just solely focus on protection? additionally they need to go to congress saying we have got to have more funding. >> dana: one last quick question based on your experience, do you think it matters that the secret service be under department of homeland security or go back to the treasury department? >> yeah, dana, i hear that debate all the time. it was debated when i was there.

criminals into our country. last week we reported in houston on the case involving 12-year-old jocelyn nungaray with two venezuelan immigrants accused of murdering her. her mom testified before congress blaming open borders for her daughter's death. dps sources experts the gang tren de aragua to be a topic at that press conference. we want to show you the video. hotel in el paso that we reported on is temporarily shut down now because of out of control crime. people partying, doing drugs, shooting guns inside the hotel. officers say that the spike in crime is tied to tren de aragua gang members. dps tells me that many of the trern tron gang members are kre recruited by cartels. a confirmed tren de aragua member was arrested in el paso while wearing an ice tracking watch days after another

smuggling attempt. dps tells me the tough part about this is being able to identify these tda members. the venezuelan government doesn't work with the united states and providing any criminal history of these suspects. our law enforcement here have to depend on self-admission, gang history and tattoos that most of them wear. again this press conference is expected to kick off in just about an hour. we'll bring you the very latest on what comes out of that presser in our later shows, dana and bill. >> dana: thank you so much. >> bill: here in new york nypd officer among four people injured in a shooting in a subway car on sunday. officers followed a man on the train after he didn't pay his fare before opening fire because he threatened them with a knife. is suspect arrested at the scene and not sure if the other three victims were struck by gunfire.
