iran a charge of a murder-for-hire plot is facing a judge. >> john: live in west palm beach, florida, with the very latest. we heard a lot from the sheriff of martin county. bring us up to speed. >> john, we know ryan ruth was inside that federal court room and he smiled as he walked and shackled with his hands and feet and he was speaking with his court appointed attorney and we saw him laughing multiple times. the judge did have present two separate charges. a possession of firearm by a convicted felon as well as position of a firearm within obliterated serial number. combine he could face 20 years in prison and half a million dollars in fines. fox is told that additional federal charges are possible but we understand these charges today will keep him in jail. he told the judge she only makes about $3,000 a month with no assets other than to trucks in hawaii. the sheriff said yesterday when routh was arrested, his demeanor was perplexing and that

continued in the courtroom today with his smile and laughing. >> made the stop and then at gunpoint ordered him out of the vehicle. he complied. his demeanor was perplexing in some ways. despite the fact that we had numerous people out with rifles, uniformed personnel and helicopters. >> the affidavit said routh was driving a car was stolen plates when he fled the scene and also his mobile phone was pinged in the area of the golf course for 12 hours before the attempted assassination from 2:00 a.m. until 1:30 p.m. in the afternoon. also in 2002 he was convicted of felony charges of possession of a weapon of mass death and destruction. routh is being held in the federal wing of the palm beach county jail. his next court appearance is expected for next monday september 23rd. if there's any updates of course we will bring those to you also

he's accused of trying to arrange the assassinations of u.s. politicians and government officials right here on u.s. soil. his attorney complained that he is not getting the proper diet and he has lost 15-20 pounds since he has been behind bars since his arrest over two months ago. the american officials who prosecutors say he was gunning for have not been named but chuck grassley has said former president trump, president biden and nikki haley were possible targets. he arrived in our country from pakistan in april but he flew from houston, texas, to new york city and met with a confidential source and a pair of hit men. prosecutors say he paid them $5,000 to carry out the assassination plan but those hit men were undercover fbi agents. for several years now iran has threatened the former president and other trump administration officials for retaliation for trump ordering the order of

2002 he barricaded himself inside his office with a gun during a three-hour standoff with police after fleeing a traffic stop. he has had numerous arrests for drug possessions, driving without a license, expired inspection, operating a vehicle with no insurance. there was a charge of being in possession of a weapon of mass death and now the charges facing him possession of a gun while a felon and a gun within obliterated serial number. when you add up all of these things together, what does it say to you? >> when you add all these things together, you have to come to the conclusion that there is many more guys like this out there. look at what this guy said when he was stopped by the local police. he was doing this because it was his mission. he had to do this because trump is a threat to democracy. these are all things that have been espoused by the current biden-harris administration for years now and that type of statement, those incendiary statements directed toward president trump and his family are bringing out every fringe

not job in the world and this guy just happens to be one of them. if anyone is out there thinking there are not more people like this were just waiting to come out of the woodwork to take another shot at president trump or his family, you are absolutely wrong. the entire world realizes that president trump's threat number one in the entire world but the only ones who don't seem to realize that the leadership of the united states secret service and the secretary of homeland security. >> john: the martin county sheriff will snyder said he does not know if this guy was acting alone or if he was part of a broader conspiracy. he said if he was acting alone, donald trump should feel safer knowing this guy is in custody. but if it was a part of a broader conspiracy, that's a whole new kettle of fish and here's what jonathan gillam said is going through his mind at the moment. listen here. >> i believe he did surveillance. i believe he had somebody telling him or some way to find out what trumps movement words.

whether or not he staged it earlier, we don't know. but the reality is he was able to set up a shooter's hide and himself for the shot and let the president get within max effective range of that as ks. >> john: and we know according to the affidavit that he was in that position outside of trump international golf course for about 12 hours. from 2:00 in the morning until 1:30 in the afternoon when he fled. >> i can't disagree with the thing that navy seal said. you have to assume these people are out here doing surveillance grid you need to assume that there is going to come an instance when there is going to be more than one shooter. had this been two or three or multiple shooters, this would've been a much different conversation. again, where are the resources, the assets, and the manpower of the u.s. secret service? why is president trump not being afforded the presidential level of security? granted he does not need the military aid and he may not need

the armored limousines with the flags up but he certainly needs to be afforded every resource that the president of the united states has from the united states secret service. there are currently 31 protect these that president biden has authorized the secret service to protect. that includes members of the biden family to include hunter biden who by the way has not paid taxes and five years. yet is getting taxpayer afforded secret service protection. you also have how many other people that are getting set to come to the united states for the u.n. general assembly yet the united states secret service whose primary responsibility and zero fail mission is to provide protection to the president of the united states can't afford the resources and the manpower to a person who is probably going to become the next president of the united states? this is absolutely unacceptable and shows a lack of leadership and foresight on the part of the u.s. secret service leadership. >> john: you wonder why after two assassination attempts that

joe biden's first action was not to say give him the full presidential package because clearly he is at risk. two big questions in all of this. how did he know that trump was going to be at the golf course. the evidence might suggest that he figured it's the weekend, he will show up there at some point so he hides out in the woods and eventually trump comes along. the other question is where did he get the weapon? he is a convicted felon appeared he couldn't just go to a gunshot but in florida because he would have to go through a background check. that would've picked up the felon in his background. also the serial number was at least partially filed off. we don't know if he filed it off but it suggests to me this might've been a black-market purchase. what do you think? >> let start with that first. it probably was a black-market purchase. let me remind you the ak-47, that weapon is the most widely produced weapon in the world. these things are readily available anywhere you go. i have been to gun shows in alabama, kentucky, tennessee. you can buy these things across the table for a hundred dollars.

it's not inconceivable that he went to a gun show somewhere in the u.s. and bought one of these weapons. not impossible and highly probable. the second situation that you talked about that deals with how did he know about president trump's movements? these chat rooms are full of presidential movements as well as celebrity movements and so on and so forth. anyone you want to track to find out where their next appearance will become a u turn to google and you turn to the internet and there it is right there. it's not that difficult which makes it even more inconceivable that the secret service is not on top of this. you put it perfectly not too long ago when you said this is the weakest cabinet he's ever seen. and the number 1.4 they weakest cabinet member as alejandro mayorkas. ultimately he is the deciding leader, the deciding factor and the supervisor to the director of the secret service. yet where is this guy? no statement has been made and

>> he did and what stood out was his tone and asked how he was talking about the tren de aragua gang. he said this is a dangerous game. he called them ms-13 gang members on steroids. something we learned of this press conference he said there's about 100 crimes linked across the country to the tda. he highlighted the incident at a hotel out of el paso that we reported on. now shut down because of a crime tied to this game. video from inside the hotel showed people shooting guns, fighting, using drugs, all while kids were nearby. abbott says 20 people were arrested near and at that hotel on charges from smuggling to drug possession. he said since 2021, more than 3,000 illegal immigrants from venezuela have been arrested here in texas and more than 200 are wanted. but the big issue here he said is identifying which are gang members. they are harder to identify than ms-13 members and right now they are working on creating a

for president trump. as chairman kelly was just mentioning, he is a former president but he is also the leading candidate to be president and he is under threat from a foreign nation state for actions he took to protect the country while he was president. president trump, donald trump is a unique individual pier and he's probably the most famous person in the world and we need to protect them. as far as the secret service saying they need more money, the whistle-blowers that i talk to from the secret service aren't singing the same tube. they are saying we need to spend it correctly. there's things they can do but they have 8,000 employees and a $3 billion budget. no extra money was needed to mitigate the age are complex peer they just didn't do it and they left president trump and great danger. >> john: all president biden would have to do is tell his chief of staff tell them to put the full presidential package on the former president. he wouldn't even need to pick up the phone himself or pick up his pen to do it. why do you think he does not do it? >> it is a head-scratcher. that's what he should do and it

is the proper thing to do. by the way, what is the secret service's mission? they do things other than protection but as far as the protection realm, to protect the president, the vice president, and you should be protecting presidential candidates. that is making sure that they are secure and then you will have other protective spirit you will have some cabinet members and foreign heads of states and other things but they should be the very first thing at the top. you should be protecting those folks and you have the resources to do that and they failed on two different occasions in the last two months. >> john: after the assassination attempt in butler where bipartisan calls to lower the temperature of the political rhetoric. that lasted about a day and a half. and now here's what trump is writing about what was behind the latest assassination attempt. he said he believed the shooter, the rhetoric of biden-harris and he acted on it. there rhetoric is causing me to be shot at when i'm the one that's going to save the country and they are the ones destroying the country both from the inside

and the out. is the the former president right? >> i don't think he's wrong. he is been skewered over the last eight years being compared to nazis and hitler and fas fascists. attacked the ideas, not the person. i don't like president biden's policies or kamala harris. i think she has been m.i.a. on so many things but i just want to defeat her at the ballot box. i don't want them harmed in any way and the left needs to do a better job of making those distinctions and sometimes you get lazy and it is emotionally driven to get people to the polls. >> john: your task force is acting for a meeting with the secret service and this is what you said in a statement on sunday. we have requested a briefing with the u.s. secret service about what happened and how security responded. we are thankful to former president was not harmed but remain deeply concerned about political violence and condemn it and all of its forms.

you are investigating july 13th. are you going to add this onto your plate as well? >> it's a great question. absolutely we should. we have the task force already working and we are focusing on butler but we should definitely take a look at this because yes, this assassin was not as close as the butler assassin, but he was pretty darn close. 300-500 yards. that's in the danger zone for sure. so we need to look at where that was and where that broke down and the secret service agent that did see the muzzle of the rifle and did present president trump from being harmed. >> john: at the time he was discovered, he was four or 500 yards away from the president but his intention was to be within a few yards of him and had that secret service agent not miraculously spotted the muzzle of that rifle sticking out from the trees, it looks like he was waiting until trump was right beside him to pull the trigger.

"the new york times" reporting on leaked memos that expose internal court deliberations. it is titled how roberts shaped trump's supreme court winning

streaks. let's bring in kerri urbahn fox news legal editor to get into it. here's a quote from "the new york times" reporting. they say the chief justice's february 20 the discussion on where to hear the case offered a scathing critique of a lower court decision and a startling preview of how the high court would lead a row. he said not only does the supreme court should take the case which would stall the trial but also how the justices should decide it. >> for starters, it does not surprise me that roberts issued a scathing rebuke or analysis of the lower court's decision because it was a terrible decision. think of the dio days position in that case there are no president should get immunity for anything ever. that's untenable. how could a president govern? if a president work to issue a drone strike, they could be held criminally liable whereas if i were to ask for a drone strike on my neighbor i would be put away in prison for a long time. >> john: much as you might

and the same applies to kamala as well. i think the secret service should do everything in their power and have the full backing of the government to do everything in their power to protect them. >> gillian: i want to loop us back to the reporting from "the new york times" that includes leaked deliberations from the supreme court justices. it seems in this instance a deliberate maybe not attack but a target of the chief justice himself. they are saying he has had a hand, he has inserted himself into this managerial role for all of the trump related cases but isn't that his job? meaning even if these leaks -- put aside the fact that it was leaked for a second because that is the real grievance here but even if he is guilty of the things that are outlined in these leaks, is that news to anyone? >> no. and it shows that i think in that position you can't win. when you are attorney general, they will be mad at you in any

given point. he has been lauded by democrats for being this consensus builder wears republicans have criticized him for being a squish for lack of a better word. this is a criticism. he has had to undergo it in the past but i thought the most uncharitable line in "the new york times" piece was when they said -- they accused roberts of plunging the court further into politics despite what he said he wants to end the reason i thought that was particularly unfair is because you only need four votes to get a case granted. an order for a case to appear before the supreme court, only four justices need to say yes but we never know who those justices are. these cases that involved trump, we have no idea if roberts wanted them or not. to say that he has suddenly become trump campaign manager and is out there searching for cases that will help trump and he knows how he will land and he knows where the justices will land, it is a stretch and it is inconsistent with everything we know about this guy.

>> john: let me get back to the idea of a leak because the big leak as we recall was in the spring of 2022 and the dobbs decision got leaked. now we have someone else out there who is trying to shape the supreme court or discredit it or whatever by leaking internal deliberations but here's what "the wall street journal" site. this is a betrayal of confidence that will affect how the justices do their work. the leak bears a possible fingerprints of one or more of the justices. the story in the times as part of a larger progressive political campaign to damage the credibility of the court that justifies democratic legislation that will destroy its independence. democrats want to undergo big reforms in the supreme court and this would all appear to be part of that program. what's interesting to me is after the dobbs leak, there was a big investigation and they couldn't find out who is behind it. at least not to the satisfaction that they had a case against that person. >> which is surprising to me. i think there are things and tools they could've employed to

get to the bottom of that and i do wonder if that is a mistake that chief justice roberts made that he is paying for now because no one was held accountable. there is no incentive not to leak. leaks are obvious the bad for the court because it discourages candor. we are not supposed to know these things. justices are supposed to have open and free conversations where they hash things out. that is how decisions get made and it's a way to convince your colleagues of your opinion. that's the whole point of having a nine justice supreme court. as much as these pieces are fun to read, especially if you're a supreme court heard, they are not good for the justice system and really the health of the nation. >> gillian: that's the most important point here. thank you for staying with us. >> john: great to see you. the israeli military now says three hostages found dead in december were likely killed as the result of an israeli ale strike targeting a senior hamas militant in gaza. nate, what is the idf learning

as a result of the invest investigation? >> john, it shows how hamas commanders will hold israeli hostages close as a shield, as a form of protection. in this specific strike back in november, israel had bad information. they thought the hostages were elsewhere so they proceeded with the strike and it turned out those three hostages were in the same tunnel complex as home offices in northern brigade commander. you see the hostages who were killed there. the idf bases the assessment on where they were found relative to the strike's impact. military says the idf shares in the grief of the families over the devastating loss and will continue to accompany them. meanwhile, for the first time parts of a missile fired by the rebels in yemen landed in central israel. they claim it as a hypersonic missile but israel disputes that. an interceptor hit the missile but did not destroy it. there are no reported injuries. you remember back in july a
