removes noncitizens off of our voter rolls is anything else other than common sense and constitutional. this is a lot that has been on a book since 2006. there was a law that was signed by the then democratic governor, tim kaine. this is why i find this to be a very unreal moment that is stunning. that they file this suit 25 days before a presidential election when, in fact,, this has been going on in accordance with our constitution, the federal constitution and state law since 2006. >> jesse: it is simple. we just want free and fair elections. democrats are trying to loosen the rules and get republicans to certify the results of an election that has not happened yet. >> will you accept the election results of 2024 now matter what happens? will you accept to commit to the election results in this election cycle, no matter who wins? just simple yes or no. with you commit to accepting the results of this year's election? >> in 2024, will you certify the election results? you plan to object or will you

accept the results were carless of who wins the election? >> jesse: asking you to accept the results of an election before the election? it's like a waiter demanding you agree that the dinner was good before it was served. and if a republican said, let's make sure everything is fair and square before we certify, you are called a threat to democracy. but now that trump is up in the polls, democrats are saying trump is already stealing the election. a democrat congressman said he definitely doesn't assume that trump would use free, fair and honest means to secure victory. trump is doing whatever he can to try to interfere with the process. and it is not just him. another democrat from illinois says this. i don't know what kind of shenanigans he is planning. and any election we would have to make sure all rules have been followed. now if democrats really want a fair fight, why are they working so hard to change all of the rules?

jonathan is a fox news contributor and constitutional law attorney who i call, often times before the five so that i can pretend like i look like i know what i'm talking about. professor, the shenanigans it looks like are coming from these left-wing lawyers that are trying to stop any effort by republicans to make sure that voting is easy but that cheating is not. >> jessie, this is very familiar territory. i have actually been a part of the coverage of the last five presidential elections and every time the margin shrinks, the number of lawyers increases. and you have campaigns that are planning to eke out that perhaps marginal victory through challenges. or at least to protect what margin they have. these lawsuits against virginia, alabama are really disconcerting because these are states and

they are saying, we found noncitizens voting. the department of justice says we think that you actually identified citizens incorrectly. but alabama says, look, we scent them a form, we put them on the inactive list, we said you cannot vote early and you have to send us back that form. in virginia, they say look, this is not a systemic violation of federal law. these are individual flags that we have received through the department of motor vehicles systems. and the government mentioned it would be in place for many years. this will be a colossal fight because the estates are saying, are you really saying that if we believe there is a noncitizen voting, that we are not allowed to do anything about it? and so this is just the first salvo of the final elections season and the mitigation of courts. >> jesse: but professor, why with the department of justice want to keep, likely noncitizens

on a states voter rolls before an election? why would they want to do that? >> they are insisting that these are likely citizens and they are probably your mistake, not theirs. or that they missed a box or failed to check the right one. but the states are saying look, they slowed off like in our system right now. the system is reporting them as having this conflict that they are presumptively noncitizens. and we have a right to pursue that. and what the states are also saying is, look, you have opposed us at every stage of voter identification to try to protect of these elections. so these will be very heated and heavily fought apples before the election. >> jesse: as always, "lawyers are screwing everything up. no offence, professor. but you know it's true. do see.
