trump or harris? and who is driving business to their party and who is driving business away? >> it is very hard to tell. certainly there's cases both the candidates at the top of the ticket making harder for down ballot candidates. if you think of bob casey in pennsylvania for instance, he has campaigned so hard on a moderate message. it's pro tariff if you can believe that in his latest campaign ad. he is campaigning on tax cuts and potentially he is out pulling harris in pennsylvania and there's other states were trump hurts mary hogan in maryland, that's a blue state through and through but he is a popular former governor. you could see moderate republicans they'll take a chance on him but they probably do not like the idea of trump at the top of the ticket. cuts both ways. arthel: speaking of both ways its flip that around again are

there any down ballot races you are focusing on that are outperforming the top of the ticket? >> yes. i think bob casey is a good example of that. i think these races are were ts a really popular democrat incumbents are races where republicans are perhaps overconfident. ohio is a red statement brown is been there for a long time. a lot of people like him. i would say the same exact thing about jon tester and montana. it is a red state, yes. it's a year were people angry with democrats for their anger is biden and harris. but these are people who have run and red places because they have enough peeling statewide message. i do not think republicans can just set those aside and say this is a good year for us. there may be some surprises there. arthel: what about they're down ballot races performing not as good as a candidate for example some republican candidates

trying to out trump trauma. but there is only one donald trump. >> oh yes. kerri at lake in arizona is a great example of that. you know, she is more maga than the former president himself. that does not seem to be working for her. it's also a state where abortion is very much on the ballot. there is an outright ban and now they have 15 weeks they allow abortion up until. this is a constant issue and some of these states. where weight may have had a very strong reaction to rowe being overturned. but it is still on voters mind. even like a state like arizona where the immigration issue absolute benefits republicans bridget kerry lake has driven 70 moderate republicans away and her opponents has a border security message. some democrats are getting the message that pay republicans are doing well and we might shift a little closer in that direction.

arthel: listen, no doubt this will be an nailbiter until the end. neither side can take their foot off the pedal at this point. any races or trends that you are focusing on the home stretch? >> oh well, it sounds almost too obvious to say. but frankly we have no idea how these hurricanes r recently are going to affect voter turnout. whether they are even able to get to the polls or can concentrate on something other than taking care of their homes and their families. so all the way from north carolina to north florida. a lot of these districts that were strict they voted for trump in 2020 were utterly destroyed by these hurricanes. i don't think we know how that's going to play out. and that is just a logistical challenge in addition to a political one. arthel: definitely a logistical challenge for sure. it is my understanding all the folks in charge of the elections

arthel: jury selection set to is set tobegin tomorrow and the manslaughter trial of daniel pennpending the marine caught on video putting homeless jordan neely in that chokehold. police eight neely was unarmed his family said is only asking passengers for food. but penny's lawyer said it was an act of self-defense but let's go to cb cotton with more. >> hi arthel we just heard back from daniel penny's attorney. he told us in part they look forward to selecting a fair and impartial jury in this case. we want to mention protest could erupt for jury selection.

this case has really become a flashpoint for conversations about race, crime, and mental health in this country. the jury selection could last up to two weeks for daniel penney. he is the white marine veteran captured on cell phone video placing jordan neely a black homeless man and a fatal chokehold on the subway and may of last year. at the issue is what led up to it and what was penny's intent? penny has pleaded not guilty to second-degree manslaughter and criminally negligent homicide. prosecutors state witnesses differ and threat assessments in a recollection about neely behavior on the train. cell phone video from a subway writer captured the chokehold about two minutes after it first began. according to prosecutors who say the entire chokehold lasted approximately six minutes. penny's defense team said the marine veteran was not trying to kill or hurt neely but instead trying to protect others who felt scared.

very large groups anywhere from 100 -- 200. in those groups you have 20 or 30 unaccompanied children but also special interest immigrants from other countries as well. what's a very striking about the number of unaccompanied children is the factor singing on a daily basis. what really illustrates want to share the images on the videos, really underscores the perilous journey of these children are making from their home countries to the united states. and how, because of the government policies there is loopholes were criminal smugglers exploit and take full advantage of by that's when they continue to smuggle these children across various countries into the united states alone. these children only come across they have a piece of paper and an address to an alleged sponsor which we do not know who the sponsor is and how they get there once they turn the children over the border patrol but our interaction, our state troopers, national guard soldiers is very brief we come

across these children but all we can do is check for signs of physical abuse. we document what we see, the pieces of paper anything that shows what they may have we document that before he turned over to border patrol. it just really highlights this is still an ongoing problem and we are seeing an increase in unaccompanied children. >> lieutenant, do parents give up their children and put them on this journey? is that how they get them to the united states through these smugglers? who are the kids, how does that work? >> exactly brisk book and to some of these children myself being on the ground and i have asked them how do you get here? where are you going? where you going to the specific location? for the most part these criminal smugglers that are exploiting these children they instill fear in these children. they're not saying a criminal paid -- the family page at the curb criminal across they have that fear if they talk to police

they may not make it to their destination but that is how much leverage these criminals have over these children, the power and control. but for the most part when these children are coming from their home countries who ever is supervising these children whether they be or their friend there paying a criminal smugglers for the various countries. another smugly will then take over and smuggle them into the united states and make it to the final destination but for the most part once i get across the river, turn themselves into border patrol they are free of the next destination. which leads to these alleged sponsors. eric: you describe once they get to that process they are released, a they released to anybody? or themselves to an alleged sponsor what happens to them and what will happen to them in the best couple of years? >> the disturbing part we don't know even us as a police agency in the state of texas we do not know exactly what happens. there has been reports over 32000 children are unaccounted
