fascist. but they have said that about most republicans over the last four or five decades. also, today, both candidates are going to be in texas. she is in texas, which will go for donald trump. but she is there for one reason. and it's the one of the issues that they are going to drive home. that is abortion. essentially she is going to say when you look at texas, and they are very restrictive, abortion laws, where they start banning abortion at conception. violations could wind up with 99 years in prison or $100,000 fine. essentially she is going to say do you have 50 texass across the country? you will get that with donald trump. and so that why beyonce is going to be there tonight and she is going to get enough viral moment where it's all about abortion. so, will that drive people to the polls? there is a "new york times" article out this morning that talks about how this is a big issue for a lot of people with

moderates and independents but, at the same time, the "new york times" is saying a lot of those people who vote for the abortion measures are actually going to vote for trump. >> lawrence: what she has going against her i would make it from my perspective a little note it's not conception what we have in texas is we have the heartbeat bill. the moment that you can hear the heart beat of the baby, that's when they ban it in the state of texas. >> brian: i would love to hear kamala harris' answer to that. you are for abortion, yes. when you hear the heart beat of the baby are you still for it? how do you feel about that? >> lawrence: exactly. >> brian: everyone forgets about the baby. >> ainsley: donald trump tried to ask her that what is too extreme? seven months, 8 months, 9 months she couldn't answer it. he denies it. in his bill he said there are no exceptions. can you have an abortion all the way through. the catholic church, if you look at the stats, the catholic voter is in favor of trump. this might be the reason. 53% of catholics are voting for trump. 45% are voting for kamala

harris. >> brian: meanwhile a new report from the house judiciary committee goes like this. showing that almost 1 million illegal migrants are staying in the u.s. indefinitely under the biden administration. it's called a quiet amnesty. you can't toss them. >> lawrence: it's insane. look at this report. the report says 700,000 migrants had their immigration cases dismissed. terminated or closed throughout the biden-harris administration. and that the homeland security failed to file the necessary documents for nearly 200,000 cases. >> steve: this is all new. this comes after vice president harris was pressed on the administration's late actions to secure the border. >> do you wish you had done those executive orders in 2022, 2023. >> i think we did the right thing. but the best thing that can happen for the american people is that we have bipartisan work happening. >> ainsley: well, president trump reacting to that statement in an interview with our own bill melugin.

as a former law enforcement officer, she is fundamentally a law enforcement officer. that's how she spent most of her career. i believe she would be tougher on border security. >> brian: but the problem is she got this job right away on some level, and this is the first visit walking with donald trump's border wall. if she cared about the job, even if she did bad and say it's not my policy, i'm only vice president, she would have been there, mr. secretary. >> well, as the person who owned this issue and this problem for 37 months, border security is more than just a photo op. at the border. you spend lots of times in migrant holding stations, you spend time. >> brian: she didn't. >> spend came in central america and in washington. >> brian: she didn't. >> all of the above. it's not just going to the border. you have to understand -- hold on, you have to understand the border, obviously. >> i visited texas, arizona probably 12 times in three years. but she is vice president. she had overall responsibility for dealing diplomatically with

central america, which is what vice president biden had during the obama years. >> lawrence: how do you square i know you are supporting kamala harris. you said you believed she was going to be tougher. we can only go by her record. i know you said she was a prosecutor. but kamala harris of 2019, when she did -- when she was running as a candidate talked about decriminalizing the crossings coming across the border. >> , every politician is consistent between the primary and general elections. >> lawrence: different section changes this this is when she had the authority. then when she went over to the biden administration, when she had some authority as taking the issue with central americans, her policies came under his. so, i'm just trying to figure out because she hasn't told us where was the e. lucien of the kamala harris of 2019 that had all these positions, when show quote to speak it was no -- there was no joe biden mitigating her response. where do you see that evolution? >> lawrence, you are talking as if no politician has ever

changed their position from a primary. >> brian: you have to explain it though. >> and you are right. as vice president, she is part of the biden administration. i believe she will be tougher on border security than the current administration. she has said so. she has said that she would raise the numeric bar on when you lift the current executive order that is in place now that has had the effect of driving down the numbers dramatically over the last five, six months or so. she is in full support of the very pro-border security bill. >> steve: right. >> that chris murphy that, jim lankford, kyrsten sinema negotiated which is good bill my judgment. i guarantee if that bill became law, the numbers would go down on a longer term basis. >> steve: that's what we have heard from her people. let me ask you about this. because, when you compare the two of them, trump vs. harris, trump is way ahead when it comes to this particular issue. >> brian: 15 points. >> steve: donald trump has said

that if elected he would have mass deportation, mr. secretary, a majority of americans like that idea. so, it's like if she is going to run as somebody who is going to be tough on the border, at the same time, people are sick and tired of what they perceive is going on down there. >> i will make two points. one of which i know i have made on this show before on this couch. first point is this: there are short-term and long-term effects on border security. illegal migration reacts sharply to perceived changes in our e policy. so, for example, when trump took office in 2017, the numbers dropped dramatically. but only short-term. they started to creep up, that long slope upward you see the chart started in 2018. family separation actually had very little deterrent effect and the numbers reached almost 900,000. trump's third year in office

because there has been a dramatic hemispheric shift northward from central america, from south america and the only way to effectively deal with that, and i have said this numerous times now, is you have to deal with the problem at the source. a lot of people don't like to hear that they want quick, easy answers. >> brian: no, i love it. >> deal with the problem at the source. and get mexico to do more on their southern border. >> brian: remain in mexico and the pressure on the central and south american countries. just on this. we are getting chinese, tajikistan, congo. >> ainsley: terrorist watch list. >> >> brian: it has gotten so much bigger since you left. it is come one, come all. the word came out, if you come, you can stay. >> that trend line began while donald trump was president. the other point i want to make is this. >> brian: you're kidding. >> when we talk about mass detore station, that's frankly that's a bumper sticker. you have to have priorities.

you know, the criminal gang members from venezuela, i want to see ice ero out there focusing looking for those guys versus focusing on somebody who has been in this country 12 years who runs a bakery somewhere and hasn't committed a crime. >> brian: he did say he was going to talk about criminals first. >> kids born in this country. i want to see ice ero. >> lawrence: mr. secretary they can't sanctuary cities have non-detainer status when the ice officials try to go there, you have democrat cities that run those departments and say no, we're not going to cooperate with you. >> lawrence, and, if you -- if you embark on a policy of mass deportation in this country, that will, i guarantee, turbo charge the sanctuary city movement in blue state, blue city communities. just like it did during trump ains mr. secretary. >> and even before trump. so the key in going after public

safety threats, national security threats, is working effectively with local law enforcement so when they're released from local jails, they go straight into ice custody. >> ainsley: so you said that the numbers started going up under donald trump. when you look at the numbers as a whole, he allowed 2.4 snuck in, got, in whatever it is. >> brian: million. >> ainsley: 2.4 million. under kamala and joe biden 8.4 million. so, a lot more under this administration. you say you think she will do better with this issue. >> yep. >> ainsley: than joe biden. that is a very low bar. who will do better kamala harris or donald trump? >> again, you have to look at the larger picture, ainsley. there has been a hemispheric shift north because of corruption, drought, violence that began during donald trump's presidency and will continue through whoever is president as long as we fail to deal with the problem at the source. multiple administrations.

deporters in chief and now you have an administration not running the department that way. don't you have a problem with that? >> look, g. several things can be true at once. several things must be true at once. i believe it is entirely possible for us to be tough on border security, send the message there is a right way and wrong way. >> lawrence: were they tough like you though, sir? >> hold on. and at the same time be fair and humane to those who are here. those are ho are de facto americans. like the young daca population. why can't we find a way to give them some legal certainty in the future. >> brian: i think. >> multi-pronged approach to immigration policy. >> brian: until you seal the border, you can't talk about some type of pathway to citizenship. >> and the bill negotiated earlier this year, last year, would have done that. >> brian: no, it wouldn't have. you can't have three people negotiate something for all of congress. even senator lankford would tell you that he even said there was nothing for unaccompanied

minors, most of the money that was coming in was going to go to ngos to house people temporarily and then they get to stay. and the original bill they put together was more of an amnesty pathway to citizenship. that's the one that joe biden keeps talking about in 2021. which he didn't even put together, didn't even put out there, even though he had a democratic house and senate. >> actually, i disagree. jim lankford is a pretty conservative republican from oklahoma. it would have raised the bar on asylum claims, establishing credible fear would have put more judges out there, more asylum officers. >> brian: i could stop you i talked to him extensively. aren't judges, people essentially deputized. left the discretion up to people like the joe biden administration who has a reputation of come one, come all. there was no provision if you were unaccompanied minor you get to stay then you eventually send for your family. >> brian, i guarantee you if that bill becomes law, the numbers will go down. just politically, we have this -- this is what people hate about washington. that was a good bill. and the political forces decided
