endorsing trump saying the choice is clear to put the nation on the right path. former house speaker kevin mccarthy joined us here earlier calling out harris for calling trump as a fascist. >> she has spent a billion dollars and nobody can tell me the three things she would do if she was elected president. she can't answer that question. >> bill: that from last hour. this now. mark meredith live upstate traverse city, michigan. how goes it, mark? good morning. >> good morning to you both. former president trump will be all over the battleground states and all over the airwaves including tv, radio and internet. later today he will sit down with joe rogan for a podcast interview on spotify reaching millions of voters with young men where trump has a lead. vice president harris turned down the opportunity to speak with rogan. the campaign says it is trying to get its message out. as you mentioned, bill, last night former president trump was in las vegas for a rally.

thousands of people there. he is feeling more confident now. >> she is imploding worse than him. she is actually imploding. if you take a look. i'm not supposed to say it, but we are leading by so much. [cheers and applause] >> you can hear the large crowd applauding that and trying to look at the battleground map and where trump will be going with stops in texas, here in michigan and pennsylvania as well as new york to give an indication how the campaign is laying out its final strategy right before election day itself. there is a new poll out today from "the new york times" that shows the race between trump and vice president harris still tied at 48% each. it is an indication it may be a bit surprising the times adding a high profile debate. two attempts on trump's life and dozens of rallies, hundreds of millions spent on ads have seemingly done little to change

the trajectory of the race. both candidates are increasing their attacks on each other. trump himself pushing back on the idea he would be a fascist. the trump family insists they're enjoying this strategy that they have put out there. the back and forth in the final stretch. >> first of all i'm proud of the guy. i'm not sure -- if i've ever seen locked in having more fun. a lot of things seem to be going his way right now and everybody is kind of feeling that. >> the event tonight here in michigan will get an airport hangar. fly in and continue on and another stop in michigan tomorrow. we'll hear about immigration from trump in texas and campaign the texas senator ted cruz while down there. >> bill: thank you, mark, nice to see you in michigan today. >> did call me a fascist and everyone knows it is not true. they call me everything. they are running out of time. the people that are bad as these

to be the hopeful, positive, upbeat gang. as polling has tightened and unfavorables have gone out for harris and walz it feels like there is a specific shift in strategy quoting people who worked with president trump as we've had people come out to say those allegations are not true. i saw a different picture of him. it very much knowing they will use the imagery of january 6th it is clear what the closing argument is. >> marc thiessen's headline. your town. harris's closing argument is dishonest and hypocritical. talking with the former speaker last hour, you have prominent senate democrats in these upper midwest states that are using trump in their ads in the final weeks of the campaign. roll the clip. here is casey in p.a. >> he sided with trump to end nafta and put tariffs on china

to stop them from cheating. >> bill: in the first part you didn't hear casey bucked biden to protect fracking, wow. is that how close pennsylvania is or does he see something in the numbers that forces him to fight back that way? >> i think it is that close. that electoral prize, the commonwealth of pennsylvania, is a must-win on either of these tickets whether the path is through rust belt or sun belt or whatever happens. pennsylvania is key. we've seen in other races tammy baldwin in wisconsin and slotkin are using trump in their ads. is he a threat or somebody you can work with in a reasonable way? listen, if he is all of these things the vice president is calling him now, when it comes to if he would win, certification of the election would she as vice president certify it or say no, there is too much of a danger here? you can't have it both ways.

>> dana: not only will you help us cover the election but covering the lawsuits that might come from it as well. you have senator marco rubio on your show this weekend. what are you trying to tease out of him? >> a lot of things involving him being the ranking member on senate intel but he is on the campaign trail with president trump. issues of abortion, hispanic vote. a lot of things we'll talk about with him and a short lister for secretary of state should trump win? your state at some point. colorado governor polis, i mean listen, they have a huge problem with gang violence there and some serious problems he has had to deal with. the issue of abortion is big there, too. we'll talk to the governor about that. >> bill: we'll be watching on sunday. thanks. now a federal judge could decide any moment now whether or not the state of virginia, the commonwealth there, has the power to remove 1600 people from

the state's voter rolls. virginia saying they were self-identified as non-citizens but justice department said the clear-out happened too close to election day. griff jenkins waiting on the decision live in d.c. >> good morning. you put it right. any moment now we're waiting for the judge to make a decision. we can take you now to the courthouse in alexandria as we wait to see what the judge will decide about the fate of those 1600 individuals who were allegedly i.d.s as non-citizens and removed from the voter rolls. early indications from the court suggested that the judge is likely to restore the voter rolls. it started after youngkin issued an executive order to remove monday citizens from voter rolls. the justice department violated the national voter registration

act when it purged voters during the 90 day quiet period before an election. >> this is an individual process that starts with somebody saying i'm a non-citizen. i think this case is political and undermines people's faith in the justice department. >> court adjourned at 9:30. the judge heard the arguments yesterday so we expect a bench ruling fairly soon. whichever way it goes we could see an appeal. unclear if that challenge would run course. the election is just in 11 days. it all comes as a new gallup poll shows 83% of americans support requiring proof of citizenship when registering for the first time. it is a hurry up, wait and watch and also watching a similar case in alabama where a federal judge temporarily blocked alabama's voter removal program after the d.o.j. sued. we'll bring you the latest as we get it. >> bill: thank you, griff. if we get it we go back to you.

trafficking is on the rise saying the border craves is is to blame. this after a state agency raided nine businesses last weekend suspected of trafficking. brook taylor is live from dallas with more. what did you find out? >> dana, 84 women were found inside of these bars. dozens of dozens of possible victims of human sex trafficking. back on october 18th authorities raided nine houston-area bars suspected of human trafficking. the texas alcoholic beverage commission, tabc, led the investigation. the chairman says the bars look like normal establishments on the outside. inside he calls them houses of horrors with secret rooms with concrete doors and soiled mattresses pointing the finger at the open border and cartels. we've seen that ourselves. in a recent ride along just last month nearly el paso nearly every migrant we encountered said they had to pay thousands

of dollars to the cartel to get across. many end up in debt to cartels and caught up in a web of trafficking. >> the cartels are a parasite. they invaded our country and infecting our nation. they are the true threat to this republic and operating everywhere. what we have created, ladies and gentlemen, is not the american dream. but for these people it is the american nightmare. >> we were in this same exact spot reporting on another case of human sex trafficking earlier this week. authorities say that it has become the second most profitable criminal enterprise after drug trafficking and the chairman put it there the harsh reality of this, he says that drugs can be replaced where as human beings are reusable. unfortunately, dana, that's why it has become such a lucrative business. >> dana: it is a terrible story and the picture you showed at

to beyonce but it is a fair question, why do i care that she is on stage with kamala harris? this should not be a popularity contest when you have human trafficking that is making billions of dollars for the cartels and when you see these young girls abducted and raped and then murdered like the 12-year-old you just mentioned, and a mother that is begging for help, and people that are begging for help, and then she comes in and says hey, here is colin allred, vote for him and here is beyonce. that is the warning to the rest of the country now. it is not resonating with texas. >> dana: allred and cruz are locked in a battle but cruz is ahead at 48 for cruz and 44 for allred. do you have concerns about the

race. >> absolutely. we host a podcast together and i can tell you looking at the polls we've seen we're very concerned because when kamala harris became the candidate it inspired a lot of people to relook at the race and changed the dynamic of the race in texas. so what it comes down to now is explaining to people allred is a guy running a basement strategy. a lot of great ads he is running. a former nfl football player. reality is he voted 100% in the time the first four years he was in office with nancy pelosi and voted 100% of the time for the policies of joe biden and explain it to people this is a man sitting there trying to turn texas into california. when you have a popularity contest and you have beyonce and people that come together like let's have a party, vote for this guy, he is hip and trendy, you have to worry. i do think this race has changed since the debate they just had about a week and a half ago and people saw he is a wide open border policy guy and he says

it's a race as well. he called the wall the racist wall and now running ads in texas saying he would build the wall. he said it was a racist wall. it's not working so i have to change it. the question is can people be faked out by this? this is why people are early voting. the numbers we're seeing in texas are massive. that will help. this is going to be a tight race. democrats are flooding the state with money. >> bill: i want to squeeze this in. trump in austin will do the podcast with joe rogan. 20 million followers plus. she, however, will not and apparently there were negotiations. this is what was said the other night on the town hall about that wall you just mentioned. >> construction of the southern border wall continue in your administration? >> i'll tell you my highest priority is to put the resources into insuring that our border is secure and why i've been very clear i will bring back up as president the bipartisan border security bill and make sure that

it is brought to my desk so i can sign it into law. >> bill: that was yesterday in philly. i was referring to the town hall the other night. there were long winded answers, three and five minutes at a time. is that the reason why she has chosen not to do rogan where she could get massive reach with that interview? quick answer. >> the problem is if you can't answer questions and lying to the american people about the wall and your stance on the open border and you are the border czar and allowed all the people and death and destruction and convicted rapists and murderers and you let them go by the thousands into america's country, into the interior, it is hard to go on joe rogan's show even 20 million plus people when you have to answer questions. she couldn't even answer questions on liberal cnn when anderson cooper is trying to hold her hand. this is the problem with her. she is not ready to answer these tough questions because she has never had to. the media courted her, no one

interference case against the former president argued jack smith was not confirmed by the senate and unlawfully appointed by attorney general garland in late 2022. the judge over seeing the case in florida bought this and dropped the entire case. trump said if he wins smith will go. it is so easy. i would fire him within two seconds. one of the first things addressed. if he doesn't win the former president could see a trial perhaps as soon as the first few months of 2025. dana. >> dana: i guess we keep telling the news then. david spunt, thank you. >> thanks. >> i have to tell you that after a very careful review of all the arguments that were made for people on both sides of this equation, i came to a place where i believe under the law

resentencing is appropriate and i am going to recommend that to a court tomorrow. >> bill: that's george gascon pushing to resentence kyle and eric menendez for the murder of their parents from back in the late 80s. my next guest represents the brother's uncle who opposes that decision. the attorney is kathy cady with me from california. make the case for your client. what is he saying? >> thank you so much for having me. what i would say first off is that despite repeated requests to mr. gascon that he meet with my client so he could hear both sides of the argument, he has never done so. he has never responded to mr. anderson. he has not listened to mr. anderson and ignoring mr. anderson. that is what he does whenever he doesn't like people who have opinions who go against him. it is very unfortunate that he has made this decision just 11 days before the election. and even yesterday when he was talking about it, he said he

wasn't sure what his decision would be until an hour before he made it. this kind of decision that has this serious consequence should not be an off the cuff decision. it should be something he has been thinking about, talking about with people in the office who are very familiar with the facts and the law, and we think that any decision to change the sentence is a mistake. mr. anderson firmly believes that what the verdict that the jury rendered when they convicted lyle and eric is correct and that the sentence that was imposed was also correct. >> bill: i apologize but i was reading where you mentioned numerous attempt were made to reach the d.a. and you get no response. and your client has no response, either. you mentioned politics. now, you can make the argument that a soft on crime prosecutor in l.a. is showing that side of himself again. or you can make the argument

that people aren't voting on something from the 1990s. they are voting on crime that is happening in their city today. what is your view on that? >> well, i think that the polls right now show him being down 30 points. so it is pretty clear he will lose. but it is also clear he hasn't gotten any money, been able to raise any money. holding press conferences are essentially free media for him to get his face in front of the viewers. i think it was a last-minute grab on his part to try to get his face in front of viewers, remind people of who he is, try to show he is whatever, sympathetic guy. i can't begin to get into his mind. >> bill: i want a play a clip. here is gascon again yesterday talking about debt to society. >> i believe that they have paid their debt to society. and the system provides a

vehicle for their case to be reviewed by a parole board and if parole concurs with my assessment. it will be their decision. they will be released accordingly. >> bill: i don't know when that decision comes down, maybe you do. today what legal recourse do you have? >> we have filed something called an amicus brief. essentially a brief that the court may or may not consider providing additional information and also the perspective of mr. anderson. we hope that the judge will consider what we have to say when it comes to a time to make a decision. but our concern -- i pointed that out to mr. gascon. i have received a number of emails and information that would seem to indicate the evidence that the menendez brothers are trying to put forward now may not be true and

so i've let mr. gascon know that and said i have this information. you would think as the elected district attorney he would want to look at all the information to make sure that if he is making this kind of momentous decision, that he is doing it based on accurate facts. but unfortunately, gascon has not reached out to me. i don't have investigators or anyone who can look into the information that i have been provided but i would be happy to share it with him. >> bill: we'll stay in touch with you and see how it goes. process is going to happen, maybe whether some people like it or not. kathy cady, thank you for your time in california today. >> thank you so much. >> we have the opportunity to turn the page and chart a new way and a joyful way forward. >> please open your eyes to the danger that this man poses to our country. >> dana: democratic messaging taking a dark turn with just 11 days to go.

big accident. and i think that part of this is her campaign of not taking strong positions on things. and one of the great myths of presidential politics is that they are about taking strong positions. they are really not. presidential campaigns are based upon how the candidate makes the voter feel in the context of what is happening in the country at the time. and i think that what she is doing, she is not engaging as much as she is surfing these answers. generally spinning, the more you attack trump is stronger he gets with two exceptions. when you talk about crowd size or him not being a billionaire he loses his mind. what's interesting is that the democrats tweak this from time to time but really don't stay with it. then we get this issue of the term fascist.

fascist is one of those words you call your parents when you are grounded. i think people are more likely to understand the idea of a president who doesn't want to give up his job calling for the overthrow of the u.s. government. whether you agree with that characterization or not. and so i think that they are flailing a bit now but it is too early to tell whether or not some of this is resonating because we're dealing with an election that will be determined about whether aunt clara calls cousin howie and tells him to drive to the polls. >> dana: a lot of reporters say they're being pitched an october surprise that could take down trump's campaign. >> hilarious. >> dana: tell me more. >> you are seeing this about both campaigns. it is one of my favorite concepts. you don't have a story but what you do is you say the media are sitting on an explosive story

and you get on television or you tweet that someone is sitting on an explosive story about trump or about harris and that this causes a debate about it and hopes that the story will surface. so what this is, it's a mechanism on injecting a controversy into the news without necessarily having the story. my view is that if anything is certain, it is that trump's negatives are built into his stock price and that unless it is extraordinary it is not going to have that much effect. i think harris is far more vulnerable on an october surprise provided -- provided that the story is sufficiently negative with one exception. the mainstream media are likely to characterize any october surprise negative story about harris as right wing dirty tricks. both of these cancel each other out. >> dana: thank you for being here. >> thank you. >> dana: have a good day. >> bill: we go to the commonwealth of virginia and we have an answer from the judge

right now. federal judge now has issued a ruling on about 1600 non-citizens removed from virginia's voter roles. the doj sued the commonwealth after they were removed. the judge has given the verdict and those 1600 people appear to be restored. griff jenkins has the news. griff. >> bill, so we do have this ruling. the judge has ordered all 1600 individuals to be restored to the voter rolls and as we're talking, bill, i'm getting a statement from the virginia attorney general, who says this, quote. it should never be illegal to remove an illegal verity. a court urged by the department of justice urged the names to be put back on the rolls before the

election. they pulled this stunt 25 days before election day challenging a virginia process signed into law 18 years ago by a democratic governor and approved by the department of justice in 20006. in the meantime i encourage every virginian to vote. i will never stop fighting to preserve the integrity of our election process. dating back to august 7th when governor youngkin issued the order, the judge has weighed in and the 1600 individuals have been reinstated to the voter rolls. likely we'll see virginia try to appeal but unclear that we would see any ruling on that because we were just 11 days away. we'll bring you more reaction as we get it, bill. >> bill: good quick work there, griff jenkins in washington. >> dana: we can bring in fox news contributor jonathan turley to react to this decision we're getting now, the 1600 restored

to the voting rolls. jonathan. >> you know, this is consistent with the decision of the court in alabama which also blocked their effort to remove what they believed to be non-citizens voting. non-citizens voting is a crime. the biden administration that some or many of these were citizens who simply had bureaucratic problems or errors when they were at the dmv filling out forms. but the problem is that virginia is a little different from alabama. as governor youngkin pointed out, this was approved by the department of justice years ago under then governor kane who ironically is on the ballot this election. and they say this has been used within the 90 days before an election, which is that critical so-called quiet period. and so the state is saying look, this is a rather odd timing of the event.

department of justice green lights, no objection? past years used by democrats allegedly even during this period and suddenly when we use it when we remove non-citizens it becomes a problem. the other thing virginia was saying, which has considerable credibility. this wasn't a systemic change. the law only deals with systemic change. virginia was saying that this is -- these are basically actions that have been taken on the books for years. when the dmv kicks back information to us saying that someone has identified themselves correctly or incorrectly as a non-citizen. that person then has 15 days to correct that and even if they don't correct that, they can file provisional ballots so that their vote will count as they continue that effort. but this federal judge is saying no, just put them back on the voting rolls. >> bill: you will appeal this and i imagine you will have to have another court's opinion and

you could do exactly that. allow the 1600 to vote, make it a provisional ballot. set it to the side and if it matters ultimately in the determination of a particular outcome, then you really your back is up against the wall and have to make a decision. but can i say when you are clearing out voter rolls, that's hard stuff. you have to go deep into the weeds and committed to do it. youngkin showed a desire to get that done in virginia and this was the result. >> yeah. what the governor is saying is look, this is information supplied by the voter. it is an automatic system. virginia doesn't know who these people will vote for. not like it is an effort to target one group. this is an automated system that kicks over and says there is an anomaly here, conflict. this person has identified themselves as a non-citizen.

many may have done it incorrectly or an error and why they have the belts and suspenders. but part of the problem the states have here is that they feel like they've been harassed and sued by the biden administration at every turn over voter i.d. and other laws. a new poll just came out that showed that over 80% of american citizens support voter i.d. and citizenship proof for voting. over 80%. how many issues in today's politics can you name where there is over 80% of agreement? yet the biden administration and many of the democratic pundits and politicians are running on this and they have succeeded to some extent. georgia -- atlanta lost the all-star game because they were accused of voter suppression. well, this year they are facing record numbers of voters and yet they lost that game and all the benefits it would have brought to atlanta. >> dana: jonathan, why is this

happening now? it is so late. >> that's a very good question. the problem here is 90 day quiet period. they said it was a reminder for officials to carry out the law that has been carried out since governor kane first signed it. the biden administration are seeing it as a change within 90 days. i don't understand why the biden administration couldn't have gone and said let's find a compromise. these are not a lot of voters. >> bill: that's right. youngkin came out with a statement. i'll draft and get your answer. they will appeal. if necessary take it to the u.s. supreme court. here is the key paragraph. let's be clear about what just happened. only 11 days before a presidential election a federal judge ordered virginia to reinstate over 1500 individuals

who self-identified themselves as non-citizens back on the voter rolls. almost all these individuals had previously presented immigration documents confirming their non-citizen stats. a fact recently verified. he stands by the decision he has made, professor. >> right. and these states are between a rock and a hard place. it is a crime for a non-citizen to vote and this is information coming from the people who are seeking to vote. so the state is saying we're simply doing individual determinations based on information given by the individuals to the state through the dmv. nothing systemic here. no targeting. and the position that the biden administration has for them seems completely absurd that they are being required to put back on the rolls people that they allege said i'm not a citizen. whether that's an error or not,

they're saying we have a system in place to correct errors. just use the system. >> dana: shannon bream is with us as well. jonathan turley, stand by. shannon, i know you have been looking at this. you are a resident of virginia. do you think the supreme court would turn around a decision if the governor appeals quickly? >> it's possible because they do have this emergency docket that operates on a pretty regular basis. whether they decide to go through the fourth circuit or straight to the supreme court. they do have options. the court knows having talked to a number of the justices recently they're likely to wind up in the middle of some kind of election case. they're very well prepared for that. not anticipating anything specific but knowing it will likely land on their emergency docket. if there is as much litigation out there including the federal cases like this. i don't know if you talked about it but having governor youngkin on last week he talked through all of this which i heard
