"the faulkner focus" is next. >> harris: so sweet on a friday we have breaking news. a federal judge just ordered virginia to reinstate the more than 1,600 voters taken off the state's voter rolls after being identified as non-citizens. you have to check the box if you leave it blank, they contact you, there are lots of ways to cure it. those names allegedly remained non-citizens. the justice department filed a lawsuit after their removal, which alleged that virginia violated federal law by systematically removing those alleged non-citizens from the voter rolls during a 90-day quiet period ahead of the november election. now, quiet period we'll have to get into. is it like an understanding, is it a law? we've let a lot of people into this country illegally. so looking for non-citizens and looking for identification

purposes and all of that is important. jonathan turley with this. >> this was approved by the department of justice years ago under then governor kane who ironically is on the ballot this election and they say that this has been used within the 90 days before an election, which is that critical so-called quiet period. and so the state is saying look, this is a rather odd turn of events. the department of justice green lights the law, no objection in past years when it was used by democrats allegedly during this period and suddenly when we use it we remove non-citizens it becomes a problem. >> harris: we want to go now live to alexandria, virginia where griff jenkins is live outside the courthouse. actually you are inside at this point. and i want to know what you have

been able to gather. this is fresh, 1,600 people identified by virginia as non-citizens and now what? >> harris, in just in the control room. i don't have audio with you but you are coming to me. let me start with this news getting word just as this moment from a statement from governor glenn youngkin saying virginia will immediately petition this and appeal to the north circuit court of appeals and if necessary the supreme court for a stay. in the statement he says this, let's be clear about what just happened only 11 days before a presidential election. a federal judge ordered virginians to reinstate 1600 individual who self-identified themselves as non-citizens. governor youngkin is upset about that. the attorney general is also putting out a similar statement.

so we shall see now the big question, harris, is how quickly you could see the fourth circuit court of appeals or supreme court intervening with 11 days to go on a case that all started on august 7th when youngkin issued that executive order to remove the non-citizen voters from the rolls and the d.o.j. and several groups sued. we'll bring you more as we get it. >> harris: thank you very much. this is moving very swiftly. we're all hands on deck to react to this. appreciate your reporting. whether democrats like it or not, vice president kamala harris will not be in the pivotal blue states, the blue wall states. instead she is going to rally in the red state of texas today and there are reports that pop superstar beyonce may join kamala harris on stage. former president donald trump will be in texas today to campaign alongside senator ted cruz and will then head to the critical battleground state of

michigan. so red and battleground for trump. many democrats are upset that kamala harris has chosen to take a red state detour. a poll shows donald trump leads kamala harris by seven points in texas. the real clear politics poll is similar. critics say the visit at best is useless. at worst insulting. >> kamala harris comes to texas today to hang out with beyonce. the question that texans are asking themselves is no offense to beyonce but it is a fair question, why do i care that she is on stage with kamala harris? this should not be a popularity contest when you have human trafficking that is making billions of dollars for the cartels. that is not connecting with voters in texas and that's a warning to the rest of the country now. >> harris: kamala harris will focus her rally on abortion rights with the hope battleground state voters will

take notice. trump in just more than an hour will focus the biden-harris's administration's failures to secure our borders, a key part of his campaign. >> over the past four years, kamala harris has orchestrated the most egregious betrayal that any leader in american history has ever inflicted upon our people. she has eradicated our sovereign border and she has unleashed an army of migrant gangs who are waging a campaign of violence terror against our citizens. >> harris: a new report is revealing there are about 1 million illegal immigrants benefiting from what's being called that quiet amnesty where this particular administration under joe biden and kamala harris has quietly let people in who normally might be called illegal. they are flying them in through programs that they are leaning on. the apps and so forth. not accounting for them.

how are they vetting these people? it is a huge question. the department of homeland security terminated or closed 700,000 of those types of cases and failed to file another 200,000. so who the heck is here among us that they've let in? republican congressman mike waltz of florida member of armed services and foreign affairs committees and author of a brand-new hot book right now, hard truths, think and lead like a green beret. that opening exercise in the first chapter amazing. first of all, i want to get your thoughts on what is happening. both in texas, why is texas in "focus" today? >> thank you, harris. thanks for raising the book. all proceeds go to veterans charities, not to me. and in terms of texas, one of the hard truths that i talk about in the book is how a green

control of the situation. not only do they dominate our border now, they are setting up outposts and gangs in our inner cities. we have to get this situation under control. green berets have a unique mindset through law enforcement and others to do that. i talk about it in the book. >> harris: when i was at the border a couple years ago doing a ride along with border patrol i saw more syndicate behavior from the cartels where they would connect with other gangs on the other side of the border in states like texas and fan out across the nation working with other gang members. now they have direct links we're learning just in the last week inside the country. they don't need to work with other gang members. they have so many people here they can run their own gang. >> harris, it's even worse. these cartels now are connecting with our foreign adversaries and acting as proxies. iranians are working with them for assassination attempts and

infiltrating hezbollah, isis is infiltrating. we arrested eight in three cities plotting to attack us again. most significantly are working with the chinese communist party, who we know that chinese know that these precursor chemicals and killing hundreds of thousands of americans to weaken inner cities and middle america and proxies for our greatest adversaries. we have to take it on. president trump will do that. >> harris: you've seen the pictures of the caravan that's coming and the current administration has now gotten in place, they will stay south of our border until election day. why couldn't they stop these caravans over the last 3 1/2 years? they can do it for an election but can't do it for 3 1/2 years of presidency and vice presidency because she is in charge of that, kamala harris? your quick thought on that and we'll move. >> tens of thousands of migrants are surging north because they

know they've got just a few more months left to go while the getting is good and get into this country and they are chanting for harris along the way. it is not just the migrants, it is not just the migrants chanting for kamala. our adversaries are also on the march. this is a moment of maximum danger because they know that there is nobody in charge in the white house and they smell weakness and opportunity. >> harris: let's move to this. your point. the global threats now with election day around the corner. new polling shows, congressman, voters are continuing to trust trump more than the vice president when it comes to handling foreign policy. the biden-harris administration is facing enormous pressure and criticism over its deadly botched exit from afghanistan still. people are focused in on their failures in foreign crises because they made us weaker in

our enemy's eyes around the world. that's indisputable. other crises under their leadership include putin's war on ukraine. israel's war on hamas after hamas committed massacre and basically having killed more jews since the holocaust tipping the entire middle east into chaos. exploding tensions across that region. and the emerging axis of our enemies, iran, china, you mentioned some of those people getting together with troops on the ground now and north korea on the list doing that in russia. chilling evidence of new cooperation among our enemies. photographs show what ukraine says or north korea troops training in combat zones inside russia. vladimir putin yesterday referenced the partnership during a news conference. defense secretary lloyd austin confirmed the move this week and delivered unsettling warnings.

democracy with their world order and chairman xi of the chinese communist party said it to putin in their first gathering. he said this is a moment of maximum opportunity that we haven't had in 100 years. what he was talking about is the weakness shown in this white house and harris, the voters, whether they are contrasting lives were better off with the economy and crime and the border from four years ago to now, if you look at world events, it is obvious and clear you had isis defeated, iran broke, and peace deals being signed on the white house lawn under president trump because he understood how to project strength. he understood deterrents and most of all he understood that our economy is our biggest and most forceful weapon for leverage. if he would simply flood the world with cheap oil and gas, american oil and gas, right now we have an lng ban in place, you drive down those prices,

reaction. >> it is a stunning ruling bay federal judge who is ordering virginia to reinstate individuals who have self-identified as non-citizens back on the voter rolls. what is even more astounding is the vast majority of these folks had presented immigration documents confirming that they were non-citizens and we recently had that verified by federal authorities. here we are with a judge saying put people back on the voter rolls who you know are non-citizens. this is under a law in virginia that has been in effect since 2006. it has been applied by republican and democrat governors alike into this 90 day period. here we are 11 days before a presidential election and a federal judge is ordering them back on the voter rolls. this is astounding to me this could possibly happen. common sense says non-citizens aren't on the voter rolls.

the constitution and law say it as well and why we're immediately petition the fourth circuit for an emergency stay on this injunction and we'll immediately go to the u.s. supreme court if necessary. but we're not going to sit by and let this happen. >> harris: i am reading the executive order requiring the removal of them came on august 7th, which was 90 days before election day. so clearly you had begun this process far ahead of when the d.o.j. was coming for you. i don't understand why there is any question about the timing of this >> this process has been going on for years, for years. this is not something that just started in the 90-day window. by the way, it doesn't -- the 90-day window doesn't apply. these are non-citizens who shouldn't have been on the voter rolls to begin with. to begin with. this is an individualized process. these people have

self-identified as non-citizens and either by accident or purpose ended up on the voter rolls and they should have not been there in the first place. to suggest that we have to put them back on the voter roll is why everyone is just reacting with this immense sense of amazement. how could this possibly be? we have to immediately petition for an emergency stay on this injunction and we will do that as fast as we possibly can. >> harris: quickly, i know you have to get back at it. quickly now, what happens, it is 1,600 and people may say it's not many. every race in american is going to be tight. let's get that straight. what happens if those voters are put back on the rolls and concerned there may be others out there trying to register before election day? can they even do that in your state? >> at this point in our state we do have same-day registration but they cast a provisional ballot. then we can go back and confirm

whether that was a valid ballot or not. in fact, that is the ultimate safeguard here for anyone in this procession which is they can same-day register and cast a provisional ballot and confirmed with the light of day on it. the reality is we have safe and fair and accurate elections in virginia. we have paper ballots and counting machines, not voting machines. they aren't hooked up to the internet. we have extensive custody laws and really clean voter rolls. this is what i'm concerned about is a federal judge telling us to put these people back on the voter rolls after we had done everything constitutionally consistent and with our law and by the way common sense. we are going to immediately petition for this emergency stay of the injunction and make sure that our voter rolls stay clean. >> harris: why can't they just keep those votes aside like they would on election day if there are any questions about anybody and just put those aside and let

the federal government vet those people themselves? even though they've already done it and gave you the go ahead these were non-citizens. let them redo that process. i don't understand what the rush is. it feels political. your last comment. >> harris, common sense is clearly not at play here and that is our issue. the common sense answer is of course that if people have been taken off the voter roll, they aren't able to affirm that they are a u.s. citizen, they shouldn't be voting and they can affirm they are a u.s. citizen and get back on the voter rolls. that's common sense. that's the process working in virginia for 18 years and to have a federal judge order that we reinstate over 1500 individuals back on the voter rolls doesn't comply with common sense, the constitution, or virginia law. >> harris: every american needs to be focused on virginia and what is happening with the non-citizens. >> last comment.

>> harris: in a sliver close race former president trump and vice president kamala harris are vying for every single vote. you know that. a very large new poll now shows just how much support president trump is getting among black voters, particularly men. far outstripping the support he received from that group in 2020. the survey shows 26% of younger black men, 44% of younger latino men are backing trump. harris still has a majority among all black men but again a

men? >> i think president trump has done a good job showing up in these communities meeting people where they are. whether it's college campus or inner city neighborhoods. i think that shows a lot of respect to these people. and i think him showing up and delivering his message is resonating with people and building a lot of momentum and enthusiasm and making more men want to vote for president trump. >> harris: did you have any thoughts about barack obama on the campaign trail? we had the man planing moment if you are a black man and don't vote for kamala harris you aren't a black man. i'm paraphrasing. >> another day he was rapping on stage. i don't think he is any place to come from his estate and talk to people about how they should think and vote. it very out of touch. >> harris: the harris campaign seems to be heavily leaning on black star power not just politically but this way, too. obama is in the picture, though.

does he have an acting job i don't know about? she held her first rally along president biden. earlier this week of course other stars. your thoughts. >> i think kamala harris is using all these celebrities because nobody wants to see her. i don't think people want to pack out an arena for her but coming to see the celebrities. they want to see usher on stage. she needs the celebrity impact to gain more excitement around her and more momentum. >> harris: nobody wants to come see her from that community of men particularly that trump is now doing well with. what are they seeing in trump they like they thaw they don't see in kamala harris. >> he stroerng on the economy. they want to start businesses and build wealth and provide for their family and secure jobs. president trump is a stronger candidate on all those issues and the one that can deliver

these things. people have seen four years of president trump and what he is capable of and four years of the biden-harris administration and the disaster they're in right now. i think people want to return back to the strong trump economy and why people are looking towards them. >> harris: i know you have talked with a lot of voters. you are on the ground a lot going to these events and organizing black events for the campaign. do you think there is this number out there of black men who are going to vote for trump? is it they won't vote at all? are they disaffected enough to the mainly sit out of the voting process? what are you finding. >> they are wanting to vote more now than ever, you know. giving people a lot of inspiration. they want to get out of their situation and see country turn back into a positive direction. i don't think anyone wants to sit out. there isn't a sentiment of people who want to sit out. it is creating more momentum around president trump.

>> harris: the only place we're seeing a lot more members of a voting group, you know, just in terms of how many there are and smaller numbers than 2016 or 2020 registering is young voters. and yet both candidates are going after that voting block pretty hard. it is great to have you always. thank you. glad you are back in new york. good to see you. republicans are calling out hillary clinton. haven't said her name in a while. for her comments about trump's upcoming rally at madison square garden. she likened -- wow, to a 1939 nazi rally at the very same location. it is fueling more concerns about democrats' dangerous rhetoric in the final days before the election. dangerous for the people at the rally, too. is she not gaming this out?

protected from those threats. end quote. look, this is serious and i don't know if politics are ever a reason to do wrong. what needs to happen next? >> well, i think this is a great statement because after november 5th, we have to come back together as a country and if you are using this language against donald trump what you are saying is half of america, those who support him are also fascists and nazis and it is really hard to come back and unify as a country if one half thinks the other half are nazis. campaigns are tough. use tough language and aggressive language but this kind of language makes it hard to put that family back together. this country more than anything needs the american family back together. >> harris: i love hearing you say that. it makes me think, too, this is hate speech now. you are quoting antifa, which stands for fascism. so now are these just the
