pete: a resentencing for the men then does brothers opening a pathway for their release, the trial happening decades ago so let's bring you up to date. if you recently watched a netflix documentary about the men in their series of start to 1989, the brothers shot and killed their parents in their beverly hills home, lyle menendez was later arrested, his brother eric turned himself in a few days later. then in july 1993 the menendez brothers go on trial, the jury's were deadlocked for both brothers and their trial but the retrial began in 1995. ultimately in 1996 both brothers were convicted of first-degree murder sentenced to life without possibility of parole. in 2023 the brothers attorneys asked the court to reconsider the conviction and look for a new sentence.

a netflix drama released in september this year based on the brothers case and several documentaries have come out recently. this seems to have inspired george gascon's office to review new evidence in the case and from that, recommends now resentencing. is it a good idea? here to debate is president of the west coast trial lawyers, thank you for being with us this morning. i know you are on separate sides of this issue but before we get into that debate let's talk about the new evidence and why there would even be a possibility of resentencing the menendez brothers. this has to do with sexual abuse by their parents, no evidence suggesting that was perhaps true. what would that mean for resentencing? >> it has nothing to do with

the resentencing. even if you are sexually abused that doesn't give you a license to kill your parents, shoot them in the back of the head while they are watching tv. we don't know what happened and we shouldn't be making decisions based on a netflix documentary or kim kardashian saying they were abused. hold an evidentiary air rehearing and then maybe you might consider resentencing but not based on what's happening outside the courtroom, witnesses testifying and authenticating allegations, and the letter eric allegedly wrote to his cousin 8 months before the murder. will: that letter is key and that is something you point to, this letter seems to confirm, 8 months before the murders, seems to give some validation to the claim that their father was sexually abusing them. in your mind, this is grounds for resentencing. explained to us why.

the length of the sentence they got compared to other people who might have been motivated by similar abuse. >> at the time in the first trial, it's important to remember that there were two hung the jerry's when the defense was able to bring up the extent of the abuse. they were hung juries because they were able to hear all that. they were convicted and sentenced to life in prison. and the second trial they were both able to hear it and i think society has come a long way. one of the prosecutors made the argument in the second trial men can't be raped to. society has changed its views on domestic violence and sexual abuse. given their ages at the time and also those meta-gating factors those should have been taken into account. will: if i look at other murders motivated by abuse,

they receive smaller sentences than the men and as brothers. >> i understand the argument. they got 10 years, kaiser got 11 years but there's justice and there's the law. it doesn't fall within any of the four corners of the law. california law, you kill multiple people, life in prison without possibility of parole. you are going around the law to give them a break. maybe they deserve it but is it the right call when it is based on politics when the district attorney is doing this two weeks before he is elected? will: we want to get it right for the sense of justice. i'm tired of time. they killed the mother too. if he is alleged of the abuse doesn't that undercut the motivation if they killed the mother too? >> i see the argument but it is important to remember this is not a pardon and not even a recommendation they walk free. this is a recommendation they be eligible for parole.
