what next? >> the application is officially docketed at the supreme court as of the last hour. it is now up to the nine justices to decide if they will take a look at this controversial case if the chief justice gives them that opportunity. he could decide himself likely he will give that to him. it is a case that prompted a federal judge and federal appeals court to reinstate some 1600 people on the virginia voting rolls. critics say many people have questionable citizenship in the list. glenn youngkin insists its simple. if you say you aren't an american citizen on a state form you should not be able to vote. >> i have to say that again because it is almost astonishing for me to even say it. a federal judge just ordered the commonwealth of virginia to reinstate over 1500 people who had self-identified as non-citizens back on the voter rolls. >> in early august youngkin signed an executive order that resulted in frequent sweeping of

voters rolls in the state to make sure all voters were american citizens. the justice department sued saying it was within the 90 day quiet period of an election and violated election law. they persuaded a judge there is hard evidence to show that some people skipped over a box on drivers's listens forms or filled it out wrong. lawful citizens were mistakenly taken off voter rolls and disenfranchised. some became citizens after filling out the application. the voter roll data youngkin is using is old. the league of women voters said our elections have proven to be safe and secure and still a concerted effort of state officials purging eligible citizens. a federal judge and appeals court agreed to put them back on the rolls. doj filed a similar lawsuit in

"wall street journal" has trump up two. cnn dead even. abc says kamala up two, fox news survey has trump up two. everything is within the margin of error. let's go forward one time. here is your seven battlegrounds now. arizona slight lead for trump. nevada slight lead for trump. wisconsin almost dead even. same for michigan. pennsylvania maybe a half point separation, north carolina just about a half point here. down in georgia trump leads there in the polling by two points. super close stuff here. when you think of these seven states for a moment, let's go back and look at 2020. let me set this up for you, okay? biden and trump. seven battleground states, all right? receive what biden did? kept a blue wall intact, wisconsin, michigan, pennsylvania. sun belt, nevada, arizona, georgia in the southeast. all for biden. the only state among those seven

that trump won in 2020 was here in north carolina. then you ask yourself okay now in 2024, what is the easiest path for kamala harris? what's the easiest path for donald trump? 225, 219. that's what we believe. her easiest path even today after all of this is picking up that one electoral vote in nebraska and then going wisconsin, michigan, pennsylvania. that puts her dead even at 270. what about trump? the easiest path come election night. his easiest path of all is flipping georgia, holding north carolina, and winning in pennsylvania. that would do it. mark penn with me now, fox news contributor. hello to you. how do you see it eight days out, mark? what do your numbers tell you? >> i see pretty much as you do. the interesting thing about the national polls is virtually every one of those polls, if you

go back to the previous poll, was somewhere between two and four points more for harris than they are today. and so when you think of elections being about momentum and polls being snapshots trying to identify that momentum at least since october 10th or so the momentum has been in trump's direction. and second, they seem to have caught up on the mail ballots considerably. about a 2-point pickup there. maybe 1-point pickup by counting on people to show up on election day. you have it basically right in your order, nevada and arizona likely georgia and north carolina all likely to go for trump and then the question is pennsylvania, michigan, wisconsin. what happens there? those polls are really close. trump has done a good job in pennsylvania with fracking and in michigan with auto workers

race. we have known it the entire fall. we're very focused on that and built for these moments right now and what we are seeing from turnout to our volunteer operation to the enthusiasm growing is exactly where we want to be and we're confident we'll win this thing. >> bill: michael whatley told dana and me he said on election day we will be winning in nevada and arizona and north carolina. that doesn't get them there but that's what the two sides are saying. do you agree with some of what was just spoken there, all of it or just a bit? >> look, harris is doing well. she -- people are showing up for her rallies. there is a lot of enthusiasm among democrats for her. this is not a failed campaign by any means. it is a reasonably successful campaign but their problem is trump has been showing this momentum. his personal favorables are at a

record and they will -- for these last days. i think it's clearly what their strategy is. they have to stop his momentum. they aren't where they want to be on some of these polls and not where they want to be on some of the mail-in ballots but not out of the game and it is the strategy they have adopted. >> bill: kamala harris on what her instinct tells her. >> can you give us the sense of your internal polling as a campaign and how it is influencing your decisions what to do over the next nine days? >> to be very frank with you my internal polling is my instinct. i let the campaign people deal with all that other stuff and i am responding to what i'm seeing. you see the people showing up last night. every event that we do. and the feeling is one of energy and excitement. >> bill: what do you think of that comment, mark? >> my favorite comment by politicians of course i'm not

paying any attention to the polls. they are paying attention to the polls. they have a strategy, too. they are implementing that strategy. you see that trump unveiled a new slogan after all these years, right? he will fix it. she has really sharpened her attacks on trump and neither of these campaigns is going to give an inch. trust me she is listening to the polls and they are crunching the numbers and seeing where the deficits are and trying to figure out how to stop this juggernaut. i didn't really think trump would be as strong as he looks right now. it is still so close here that they could stop it with a split. they have a couple hundred million in the bank and want to know how to spend it. >> bill: do you know how to drive yourself mad? look at the early votes that are coming in these battleground states by the hour. you will go crazy. i know both campaigns are doing it. we'll see how it sorts out.

home to the county election board. the former president will be in philadelphia. he will go joined by bruce springsteen for a concert performance in support of vice president harris. the vice president was in the city yesterday. she visited a congregation and also small businesses before hosting a rally. saturday president trump was here appealing to young voters. bob casey and david mccormick locked in a tight senate battle with the economy and energy coming out as the top talking points. voting security is also top of mind. 1.2 million ballots have already been returned. pennsylvania's results were delayed four days due to a backlog of mail in ballots in 2020. the republican secretary of state weighed in on fox this weekend. >> elections in pennsylvania have changed so much in the last five years. there is a voter verifiable
