week. hitting the state hard. after that he will then fly to green bay, wisconsin, for another rally where he will be joined by a special guest legendary former green bay packers quarterback brett favre is speaking at that event. nikki haley may soon campaign with president trump. she said she hasn't spoken to trump since june. take a listen. >> they are very aware we're on stand by and be there to help. i've helped with some fundraising letters and text messages and those types of things. we've done that. we're on the same team. >> dana, the early voting numbers here in north carolina have been pretty staggering. the state reported just yesterday that so far 3.2 million people in north carolina have already cast their ballots. it represents 40% of the registered voters in the state who have already voted in the

election. you need to get the message out early before election day. >> dana: and the people in asheville still digging out after hurricane helene. >> bill: breaking news. supreme court just ruled that virginia will be allowed to resume its purge of voter registrations. the governor said there were some 1600 who were admitted non-citizens. david spunt is live with that in d.c. what's the word, david? >> this is significant and controversial issue in virginia. while dealing with only 1600 voters or so, it is something that could have national implications as we're now less than a week away. governor glenn youngkin signed an executive order in august. the department of justice sued youngkin saying he can't toy with executive orders and take people off voter rolls within 90 days of an election.

governor youngkin said 1600 people didn't present citizenship status. non-citizens of the united states and not be able to vote. the justice department said some did not properly fill out a dmv form. they skipped over a box or some became citizens later resulting in actual u.s. citizens being removed from the rolls in error. the supreme court ruling on that today. these are the states right now where legal challenges currently exist. many are battleground states. north carolina a federal appeals court ruled the state republican party's effort to question some 225,000 ballots must stay in federal court and not move to state court. a temporary win for democrats there. in pennsylvania the supreme court expected to rule about provisional ballots there. while the justices are busy the court crossed off one case or two cases yesterday. robert f. kennedy's junior's name will remain on the ballot in michigan and wisconsin. he wanted it taken off after

endorsing president trump. people can still vote for him in those cases even though he isn't a candidate. the high court involved in several pre-election cases. they have recruited thousands of lawyers across the country, some on volunteer basis for pre-and post election fights. getting the pace of the results in. many states if you count the ballot early it can be counted early but not in six states including the state of pennsylvania where everyone is watching. officials can't even open the ballots until election day. the results may not be known in pennsylvania for days. state officials in pennsylvania say nothing nefarious about that. back to you. >> bill: we'll make all that clear as mud come election night for our viewers watching at home. nice to see you. >> dana: andy mccarthy is a fox news contributor. talk about the breaking news from the supreme court. >> i think it's the only result that makes sense. what virginia was trying to do was take people off the ballot

who are not voters because they are not americans and that's by their own admission. and this idea that this could prevent or mistakenly result in american citizens from virginia not being able to vote is bogus because under virginia law, let's say they've taken you off the ballot mistakenly. under virginia law, if you show up to vote on election day and you attest that you are an american citizen, they have to let you vote. so there wasn't a chance that an actual american citizen was going to be prevented from voting here. on the other hand, it is a federal crime for aliens both to represent themselves as american citizens in order to register to vote, and it is a federal crime for them to cast votes. so virginia's law promotes election integrity in virginia. it supports federal law, and it doesn't result in americans

being kept from voting. >> bill: i grew with everything you said. every legal analyst says the courts want to stay away from elections -- the closer we get to them. and i was of the understanding this court was just like that. now we get this ruling which i think might come as a bit of a surprise, am i wrong on that? >> well, i don't -- here is the thing, bill. courts want to stay out of a lot of things that they are thrust into. they are in the problem solving business. there are lots of problems that are very hard. i think with elections the thing with courts is they don't want to be perceived as deciding the election. so if you bring the court a dispute before the election takes place and before the election has been announced, you can frame that as something that is just fixing the rules under which we're going to proceed. i think the real problem comes after the election when the

result is known and what you ask the court to do is potentially reverse what it seems like the voters have decided. that's a position they never want to be in. we're much more likely to get decent decisions out of them in the run-up to the election than post facto. >> dana: let's go to pennsylvania now. the republicans are asking the supreme court to block the counting of some provisional ballots in pennsylvania. this is the second presidential election in a row that pennsylvania's mail vote messes have drawn in the u.s. supreme court at the last minute. the state's laws need an overhaul. we're reading this last night. i felt like did i read this four years ago? why is this still a problem? >> well, they haven't been forced to fix it. we had a chance, dana, with the moore case before the supreme court last time around where they could really have rendered a clear decision to set up clear

guidelines for what the states have to do and you would have expected the states to be able to fix it. the thing is, i thought the court's decision was kind of ambiguous so they don't really come out and say that the state legislature makes the rules and the courts and executive officials are not at liberty to change those rules in the run-up. since they clearly didn't -- they didn't clearly say that, there is still a lot of ambiguity who is allowed to do what in the run-up to the election. so we need clearer rules. the state has to do a better job but they could be pushed to do a better job. >> bill: last question. do you believe we are headed for some sort of legal collision next week, or do you believe that depends on how close the race is and in which states? >> i think historically, bill, while there has been a lot of noise around these disputes, if you take the ballots that are

actually impacted by these different categories of controversy and you set them aside, it is very, very rare that you have anything close to something that will be big enough to close the margin in an election. i know we expect a very, very tight election, but i would be surprised if something like, you know, they didn't put the ballot in the envelope that is supposed to go inside the envelope. i would be kind of surprised if stuff like that turned out to be so numerous and so expansive it could change the result of an election. >> dana: andy mccarthy, we've got you on speed dial. >> bill: we'll ride you shotgun. thank you very much. >> thanks, guys. >> bill: joint base andrews outside of washington, d.c., the first sighting of kamala harris. she may make a comment in a moment about the garbage comment from last night. >> we had the chance in front of

i respect the challenges that people face. i respect the fact that we all have so much more in common than what separates us and that most people want a president that understands that and gets that and approaches the role of leadership that way. i've been very clear. from my earliest years as a prosecutor. i never asked anyone are they a democrat or republican? the only thing i asked is are you okay? that's the kind of president i will be. >> what did you talk about the w the president? >> last night you mentioned removing people in the country who are here illegally. what do you mean? that's an immigration statement. were you referring to people who have come here before illegally or can you expand what you meant by that comment? >> what i intend to do on the issue of immigration as i said last night and said continuously we need to fix our broken immigration system in a number of ways. strengthen the border and put more resources at the border which is why i support the

bipartisan bill that donald trump killed that would have otherwise put 1500 more border agents at the border, put more resources into prosecuting trans national crime and very importantly put more resources into stemming the flow of fentanyl that's killing people around the country and when i'm elected president i will bring that bill back and sign it into law. i also have done the work and in my policy going forward will strengthen what we need to do to deal with illegal entries between ports of entry. that is something that we need to tighten up. i will do the work also about insuring that we have comprehensive immigration reform in a way that we allow hard working people who have rend citizenship a path to actually be able to gain citizenship from farm workers to dreamers. >> follow up on the -- >> do you sympathize with any

that one question toward the end do you sympathize with any voters who were offended? she gave an answer but didn't say yes or no. >> dana: the white house staff, press staff changed the transcript. big no no, right? and tried to make it look like it was singular using an appear -- you know the president didn't write the tweet trying to match it up with the white house press office. another thing. that is some of the best answers she has given in terms at least she had some energy and unfortunately for them i don't know why they do this. she is going to give comments on something that could turn the election against her with half of the country saying he called us what? she kind of distanced from him for the first time. i felt there was a little distance but she does it in front of the plane while the plane is on and you can't actually hear her. it is not clear and they can't

not good on pivoting on and getting them out of the news cycle. she was on "the five" and we talked about whether she would try and keep him away from her new campaign. they tried to do that. you have already distanced yourself. why not immediately come out and say we condemn these comments. the credibility problem they have the harris campaign in a matter of two days has tried to shift from calling madison square garden and a hitler rally and then saying she will be the unity candidate and bring everybody together. it really plays into this idea that she is not different from joe biden and she didn't distance herself in an immediate way and as you mentioned, dana, she is in front of the plane. it doesn't have the seriousness

an edge. and so then with the white house so unethically trying to change the transcript and fix it. she could have added on and said he clarified it and he was right to because it was wrong and then what is the white house going to do, complain about her? i doubt it. >> it is this rolling dishonesty that you've seen. you have seen the vice president, who is meeting with the former president for years but especially over the past six months before the president dropped out of the 2024 race saying that he is fine, his staff was lying to the american people saying he is running circles around everybody. going at great lengths to discourage the hurt report and attacking reporters talking about this and reporting on what we could all clearly see. now they've taken the strategy of trying to continually fake these things which is what they did with the transcript.

during the biden years, that went up by $826 billion to 1.6 trillion. art. which of these candidates, whoever wins on tuesday, will do something about that? >> well, i think trump will do a lot better than he did the first term. he won't be hit by the covid-19 pandemic and that was a large portion of what caused the deficits under trump. and i don't think anything will change frankly if kamala harris is elected. this is all covered very carefully in our book. we go through all of these things and the numbers there and i just don't see any change in anything if kamala harris is elected and trump, i think you will see the first couple of years of trump be the template, if you will, for what will happen under the full four years of a trump presidency. >> bill: one of the things absent from these campaigns is talk about debt and deficit.

it is crushing us, all right? what do you think? >> both republicans and democrats are responsible for this enormous debt. biden has the worst record on deficits in the history of america. we just got a report that came out on the economy this morning about an hour ago. i've been looking through it. if you look at the headline number it looks pretty good growth. then bill you look at where the growth of the economy was. guess what sector it was where the economy is growing? government. government was the biggest -- the government is growing now twice as fast as our private sector employment and private sector industries. that can't happen. we need a growing private sector and big increases and need to start shrinking the government. i like the idea of having elon musk, government efficiency

commission to find the waste, redundancy, the fraud, and the obsolescence of these government programs and get rid of them. i am with them. >> bill: i remember al gore talking about that 24 years ago. >> i know. >> two dozen years later. art, final question. if you bought the car in january of 2021, you would pay $40,000 for it. now you are up to nearly $48,000. insurance has gone from 1500 to 2300. how are people voting on that come tuesday, art? >> i think clearly they are voting on that. prices have gone way up and no sign of them coming down. the inflation rate is a little lower but they are looking at the prices. if donald trump gets in with deregulation, tax cuts and economic growth and more goods and services available i expect inflation to come down substantially over the next four years if trump is elected. >> bill: a big debate about that.

transcript wasn't right. what do you see? >> i don't think the impact of biden misspeaking last night will be the same as what hillary did. >> dana: do you think he misspoke? >> i don't think he intended to be -- he is not a candidate now. >> dana: the comedian who spoke at trump's rally wasn't a candidate, either and they tried to run away like the cat ran away with the spoon. >> especially because trump is leaning in so much and trying to get the support of latino voters and hispanic voters at this time and insulting puerto rican voters won't be helpful. if trump supporters take offense with it they weren't probably voting for harris anyway. she is trying to reach out to the swing voters and suburban voters and people who might still be undecided and who she is trying to speak to right now.

>> bill: there is already names popping up and there will be a lot of them. who knows what trump does with what could be another political opportunity? >> yeah. i think it's a little strange that joe biden apologized. this seems kind of consistent with the message here. i understand the vice president talked about unity tuesday but she also called trump a petty tyrant, a threat to the country. she attacked the supreme court. this has been a nasty, divisive message. with president biden this is kind of consistent. we recall him going after states that required voter i.d. as jim crow 2.0. you look at his divisive speech at morehouse college in the spring. he sees america as structurally racist. this is not new for him and not that different from the rhetoric she is offering. obviously for tactic call

reasons they thought he went too far. it is not that far off from what she is saying or out of character for him. >> dana: we were at the dnc in chicago and joy at the convention but the closing argument last night. >> unlike donald trump, i don't believe people who disagree with me are the enemy. he wants to put them in jail. i'll give them a seat at the table. >> dana: the super pac that is trying to help her win saying that's a message not working. last night the original estimate i saw was 75,000 people at her event. when she came out to the plane a moment ago she said it was 100,000 people. it was a lot of people, right? what do you think about the mixed message from future forward and the campaign trying to have this debate in the pages of the "new york times"? >> i think at this point in these last few days there will be multiple messages coming out

from harris campaign and pacs supporting her. she is trying to make the broad appeal looking like a leader and looking presidential trying to reach these people that might not like what trump stands for and hoping to be able to pull them in. future forward. >> dana: why not close on the economy? >> that's why there is future forward and their ads to do that as well. in her speech she went into specific about her plan to address the economy and bring costs down the cost of living and touching on all of that right now. >> but nothing really still about the last four years. there is still this effort to pretend he is the incumbent. she talked yesterday about turning the page on division and chaos. she has been in office nearly four years, democrats have held the white house three out of the last four terms. strange. we'll see if it works. >> bill: she had a line in that speech last night about deportation. was that new? has she been talking about that
