along straight ideological lines the high court has cleared the way for virginia to remove non-citizens from its voting rolls basically up holding virginia's election laws. former u.s. attorney andy mccarthy moments ago. >> it's the only result that really makes sense. what virginia was trying to do was take people off the ballot who are not voters because they are not americans and that's by their own admission. and this idea that this could prevent or mistakenly result in american citizens from virginia not being able to vote is bogus because under virginia law, let's say they've taken you off the ballot mistakenly. under virginia law, if you show up to vote on election day and you attest that you are an american citizen. >> harris: matt whitaker, former acting u.s. attorney general and trump campaign surrogate with me

now. so you have looked at this issue before this quick vote or quick ruling by the u.s. supreme court. by the way, we've just heard governor glenn youngkin is at an event now and will step up and call into us just moments from now. want to let the audience know that. this seemed very quick, matt. >> it does but it's a pretty simple issue. the issue is whether or not these were individual voters cleaned off the rolls or whether it was systematic cleaning of the rolls. obviously the district court and appeals court suggested it was systematic. the state of virginia was adamant these were individual non-citizens. remember, it is illegal for a non-citizen to register and say they are a citizen and illegal for a non-citizen to vote and they should expect if they vote illegally they will be prosecuted. >> harris: what's interesting about that, then, is it really goes in concert with what virginia's law is over this

issue and what the governor has told me on this very program when it popped up last week with a lawsuit from the justice department. and that is simply you check a box saying whether or not you are a non-citizen or you leave it blank. they both accomplish the same thing. you are in question now and you have to cure that in several ways, the state gets in touch with you to repair that. so this isn't just a matter of someone thinking so and so was a non-citizen. >> no, that's a good point, harris. if you are taken off the rolls there is a way to cure that. they send you a letter, you can cure it before or go to the polls on election day attest you are a citizen and vote. there are many ways to make sure this doesn't violate people's ability to vote. but remember, it is illegal for non-citizens to vote and non-citizens to register and say they are a citizen. >> harris: great to have you so quick on the breaking news and also this. virginia governor glenn youngkin

joining me now. governor, joining us by phone. when you and i spoke just last week had you any idea that this decision would be made so quickly by the highest court in the land? >> as you can imagine, i'm incredibly pleased with the decision today and the supreme court reacted quickly. i want to thank our attorney general and his team's amazing work. this is a victory for common sense. it is a victory for the constitution and i also believe it is real clarity that, in fact, someone who self-identifies as a non-citizen should in virginia be treated by the law, which says you get two weeks, you will be notified, and if you can attest you are a citizen you will be allowed to vote. if you can't, you are taken off the rolls and we do have the ultimate safeguard, which is you can come day off and you can register same day and cast a provisional ballot. therefore, no one is being

precluded from voting who is a citizen in the united states. this is a victory for common sense and i thank the supreme court for moving quickly. of course, the great legal team that we have here in the commonwealth of virginia under our attorney general. >> harris: i know you stepped away from an event and won't hold you long. what happens with the 1,600 approximate people who were removed for either checking a box or it was proven they were none citizens? what happens with them? >> the voter rolls are as they are today. they will not be added back. we had a stay on the injunction and therefore the 1600 people who self-identified as non-citizens are not being added back and if someone can come attest that they are a citizen and wants to same day register and cast a provisional ballot please come vote. all citizens in america and virginia should vote.

this is an incredibly important election. the future of the country hangs in the balance. i encourage everyone, go vote. >> harris: there are concerns in other states right now. this quick action by the u.s. supreme court, what does it sort of maybe inform the voting public, teach people who are heads of state like yourself about how quickly the u.s. supreme court will act? some might have said well, they wouldn't get involved right before an election. >> well again, i think this is a victory for common sense and a victory for the constitution. and as governor, i swore that i would support and defend the constitution of the united states of america, constitution of the commonwealth of virginia, and i'm just so proud of the team's fortitude to stay with what we know is right. it is constitutionally correct, it is consistent with our law that has been on the books for 18 years, and on top of that common sense says that

non-citizens should not be in the voter rolls. >> harris: quickly, with the influx of millions of people, many illegal in the last 3 1/2 years, is there a concern that people who are here would try to vote? does it make the job even more important to identify non-citizens? >> again in the commonwealth of virginia we have taken this issue head on and made sure that we are using a legal process that starts in our dmvs when someone comes in for a temporary driver's license or something and they self-identify as a non-citizen to make sure if they're on the voter rolls the process starts to remove them if they're non-citizens. this is a very good law. let me just take it one step further. speaker johnson's advocacy of a national law to demonstrate that you are a citizen before you are allowed to vote is critical.

i do hope that america will extend our majority in the house, flip our senate, and put donald trump back in the white house for lots of reasons, one of which is we need federal legislation to make it very clear on what it takes to register to vote in america. >> harris: that's interesting. i wrote that down, speaker johnson's national law on that. do you think this helps that along? does this give that more power in terms of getting people's attention on this issue? >> again, the constitutionality of this is critical and on top of that, common sense wins today. again, i have said over and over and over again that americans and virginians want common sense in leadership and the white house and congress and do the things that address the problems of the nation. secure the border, be strong

kellyanne on fox nation. great to have you in "focus." first of all, because you've been in the white house, what do you think of the cleanup of this? how is that going? >> not well at all. this is not a distraction for harris but a reflection of what she believes, too. she has been peddling a lot of hate and vitriol for years. it's not as if she, hillary and the obamas are out there routinely and with a certain fever pitch attacking people because of their political opinions. this started with senator obama running in 2008. people clinging to their guns and god and bibles and their religion and they say it with this dripping sarcastic elitist cast to it. stop insulting those of us who call it garbage saying we don't know where the put the apostrophe. without biden there would be no vice president harris.

wisconsin, michigan, ohio, pennsylvania, nevada and arizona, open seat. with the democrats slightly ahead? they'll be asked do you agree that donald trump's voters are garbage and karrie lake and sam brown and -- they haven't been saying much about kamala to begin with. a lot of them trying to bear hug donald trump. the senatorial committee did a smart thing and pulled all the past comments from the democratic senators sounding like tim walz. john tester who is a goner now in montana has called trump supporters racist. he has said -- they are always putting us down. this is how trump got elected in the first place. forgotten man and woman talking about manufacturing and trade but the system that looks down on you because you don't have a certain degree from a certain ivy league university. you don't wear a certain clothes, you don't live in a certain zip code. this is sort of the non-college educated versus college educated election to begin with.

>> harris: kamala harris was making her closing argument before trump rallied supporters in pennsylvania. if joe biden wanted to do some damage he certainly had some things going on where it would do some damage. the harris campaign billed her speech as optimistic. hard to know whose version of optimism this is. >> donald trump has spent a decade trying to keep the american people divided and afraid of each other. that is who he is. donald trump has told us his priorities for a second term. donald trump, donald trump, donald trump. we know what donald trump has in mind. more chaos, more division, and policies that help those at the very top and hurt everyone else. i offer a different path. and i ask for your vote.

brothers, sons, co-workers. we can't talk about division based on gender. i take issue with nikki haley in one way. i that i donald trump tried to have a message for all voter. we beat hillary clinton on the precipice, majority of voters were female. how? you trust them to hear your message of no new wars, border security, economic wherewithal and the like. but also it is that women tend to hear things a little bit differently. if it really mattered that their first woman president is enough to grab your vote, she would be succeeding president hillary clinton and way ahead of trump. the issue i would say is that this is 16th consecutive presidential election where women are the majority of the vote. hillary beat trump by 13 points but made up the deficits among different groups of women.

white women and women without college degrees. i want to say one thing. trump had the og statement on november 9th at 3:00 a.m. when he won. he said i will be the president for all americans including those of you who didn't vote for me and said there are more than just a few of you. i watched him take the sharpie and change the speech to include that. he has said this from the beginning. lots of presidential candidates say it. they are on the record of calling us deplorable, irredeemable. overly religious, guns in our hand. joe biden two years ago mega maga extremist, the latest insult. it's when they get caught and now garbage. if donald trump will be held to account for some comedian's poor taste joke in madison square garden kamala will be held to account with what the president is saying. >> harris: they are feeling it and six days away. >> six days away.

georgia has been phenomenal as we just heard is breaking all records. when you look at who is voting it is really interesting. skewing younger, fairly diverse and in the metro area where we were a couple of weeks ago. this is amazing. i think we'll break all voting records not early voting but also next tuesday. >> harris: what i love about this is everybody as you said, fred, republicans, though, this has never really been their thing, david. it is their thing now. you see people and numbers popping up for registered republicans talking about it themselves early vote in person, blah, blah, blah, what do you make of it? >> you think about nevada, arizona, and north carolina where the actual number of ballots cast is more for republicans than it is democrats. let's talk about nevada for a second. donald trump is doing one thing that vice president harris is not, which is going into a state

that has been reliably for the democrats. we haven't won nevada since 2004. he has put a state reliably for the democrats into play and there is not a single reliably republican state that the vice president can now say she is competitive in. you have nevada along with wisconsin and pennsylvania and north carolina all states that going into election day you had hillary clinton leading in the polls, you had joe biden leading in the polls and now you have donald trump leading in the polls. why is that, harris? you look at the president's coalition, president trump's coalition and you see him improving. he is doing better with non-educated voters and better with men voters and better with minority voters. that's why he is positioned to win. >> harris: let's get to this. it is a "wall street journal" headline with nikki haley has made her peace with donald trump. not all of her supporters have. it reads harris is aggressively

courting haley supporters. political action committee called pivot pac financing haley voters for harris is spending $4 million on digital ads to encourage suburban republicans and independents in wisconsin, michigan, pennsylvania, to support harris. nikki haley said her choice is clear. here it is. >> i am choosing policy over personality. that is what i think we have to do to move america forward. when it comes to policies, living our life from an economy, having immigration under control and being energy dominant and getting national security those things affect every american family and we need to be voting on policy, not personality. >> harris: she got 14 1/2 million votes in the primary even if a fraction of those people are in battleground states that would matter, this matters if the party is coalescing. >> it absolutely matters. unlike what david said the reality is democrats have only

won north carolina and georgia once in the last three decades or so. kamala harris is competitive in both of those states. i think part of that is because there are a number of disaffected republicans and what happened in 2020 here in georgia. i think now we can call them nikki haley voters or call them chris christie voters. >> harris: you heard david talk about the disaffected democrats that trump is going after. they both have this. a thought on that, fred. >> that's why this race is close. disaffected people on both sides. what we see in early voting numbers and there was a release this morning about it. on the republican side you are seeing people who normally vote on election day vote early, on the democratic side you are seeing low prop pensty voters. there is more democratic votes out there to be had. >> harris: if some of them as we talked about are black men and they are still not in the camp for her, statistically speaking in the next six days we have to see how much those make a

difference. low propensity voters. last thought. >> the vice president has to find new members of her coalition. while donald trump has expanded his coalition, non-college educated voters among black and hispanic voters. the vice president isn't doing as good as joe biden did. it will be a problem for her. >> harris: it is an issue after today with his latest insult to republican voters and trump supporters for her having to clean that up and distance herself from him. it makes it complicated if he did better than you are doing. great to see you. vice president kamala harris dismissing claims she is slipping in support from black voters. what david avella was talking about. poll after poll shows that's exact will i what's happening. when it comes to courting the black vote, kamala harris says -- >> joy comeeth in the morning.

>> harris: all right. it is time to walk those closing arguments around the country and so both candidates are pitching it to battleground states. they are courting an important voting bloc in all of this that could swing the election. we've been talking about black voters, particularly black men. in the state of georgia, that critical group is lower than past years. mark meredith is in athens, georgia. mark. >> good morning to you. we're seeing early turnout break records here in georgia more than 3 million people voting early in the state. we're also seeing black voters trail white voters in terms of early turnout. a lot of questions how the vice president's support may compare to president biden's in the blom community compared to four years ago. yesterday here in northeast georgia we were there as black civil engagement groups got out the vote going community to community door noing trying to encourage people to make sure

2016. >> harris: this has been compared to that when she went into that preacher mode with her voice. it was -- a lot of people said how insulting it was to people in the clergy. what was she actually trying to do? when you talk with black voters particularly black men, what are they telling you about the different accents and what i just called a verbal flex >> black men largely at this point -- i love the piece right there, mark's piece. they are not accepting the democratic party's quote, unquote, giveaways anymore and not looking at this as an opportunity to build the community. they have had decades upon decades of black voter support and we haven't seen things get better. harris, i have been a conservative for almost two decades now and i can tell you there has never been a time in my life where i've seen so many african-americans across the country talk to them personally

saying you know what? i'm voting for donald trump. they aren't afraid to say it. it used to be you had to whisper and you may not even have told your family. >> harris: will they vote? >> i believe they will. i was talking to a friend of mine from atlanta, georgia, a black woman telling me she does not want kamala harris to win and her rationale for that is she wants the democratic party to stop, her quote, playing in black people's faces and not delivering on promises or providing tangibles, getting out here and making racial comments every election cycle but yet and still you are left with an empty bag of nothing. they provided nothing. now democrats are really upset because donald trump is targeting these voters who have been left out in the cold by their party for decades. there has never been a person that they can go to and say on the republican side for many of them that they can say you know what i may not agree with him but i like what his policies can do for my life. i've seen it for four years
