only one that makes sense for a federal crime for non-citizens to vote. also consistent with virginia law. they have a law that is essentially lie a dmv rule as you a verify as non-citizen you can't vote. governor youngkin and his team has been enforcing this for a couple of years now. in august they issued an executive order simply formalizing what they have done all along. and then at the 11th hour the department of justice in october swoopsd, in sued them, and said you have to keep these non-citizens on the voter rolls, which, you know, brian, just as an american is a bit concerning. now they said it was because he was disturbing the so-called 90 day quiet period and said no we are not. we are following the law and we have been doing this all along but the supreme court weighed in and said yes, for now, virginia can keep those non-citizens off the rolls. >> brian: all right. let's move over to pennsylvania pennsylvania three cases you want to go through let's begin.

>> if pennsylvania there are a number of things happening. one, there is a situation with ballots with errors and here there were two people who mailed in their ballots this with in the primary and failed to put their ballot in this thing called the secrecy envelope, instead they put it in a regular envelope. few rules that govern mail-in ballots in pennsylvania. you have to put it in this particular envelope and have to sign it and date it. they didn't do that rather than wait for the county to make their determination on those ballots, they went ahead and voted again this became a problem the pennsylvania supreme court recently said we are going to pretend like they never voted at all and we are going to take these second ballots instead. the problem with that is that it is in direct violation of pennsylvania law look, if you mail in your ballot in time, we're not going to take a second ballot after that because think of the chaos that could cause by it. people could vote multiple times and you wouldn't know. that's up for litigation and the rnc is litigating that.

>> brian: let's talk about lancaster, you mentioned that. here is what the d.a. said in a statement. this officer remains committed to using all resources to investigate these acts and file all applicable charges should we find it necessary to do so. we're investigating who is responsible for this many speculation at this point is premature lancaster pa are investigating 2500 reporter registration applications for potential fraud. they are going to go over this individually and? >> and they determined that 60% of those voter registration forms were in fact fraudulent. this is one to watch, brian. we are not talking about some random person saying i saw people throwing ballots in a garbage can. hearing from plol officials saying someone or a group dropped off thousands of voter registration forms and in your county it was voter registration forms plus mail in ballot requests and took a look at these on their face they were suspicious, do you know why? a lot of them were in the same handwriting, same date. didn't match up with social

security numbers. what they have done there is separated out these suspicious forms and they are investigating. apparently there are up to four counties in pennsylvania right now who are dealing with what they think may be a wide scale voter operation fraud situation. >> brian: i just hope the governor is vigilant and the attorney general. because we got to get to the bottom of it. i hope everyone's objective is the same. north carolina the rnc is suing the north carolina state board of electors they say 225,000 people not properly registered because their forms did not require a driver's license or partial social security number. >> yeah. just earlier this week, a court of appeals panel said that had to stay in federal court. so now goes back to the same judge who has to divide whether this action violated the north carolina constitution and if, in fact, this case can go forward. as you mentioned, brian, 225,000 people, that's a lot. so, we'll see what happens and if this case can move forward or not. >> brian: especially in north
