back to you. >> gillian: it will be the longest five days of our lives i think. >> john: it goes by very quickly. >> gillian: let's hope so. i am gillian turner and for sandra smith. the candidates are swinging out west to try and shore up more support among latino voters. arizona and nevada combined represent 17 electoral votes. that will be crucial for trump or harris on that path to 270. fox news this week pushing arizona from toss-up to lean republican because trumpets held a consistent edge in most major polls though, of course, still anyone's race. >> john: immigration remains a hot-button issue for voters in both of those dates and will be the focus of the former president's speech today in deep blue new mexico. >> gillian: president of the national border patrol will join us in just a moment but first we have fox news team coverage for you. peter doocy's and las vegas where vice president harris will rally later today. >> john: we begin with bill melugin on the ground in albuquerque, new mexico, where trump is about to speak. how many campaign events does he have today?

>> he has three events today. the first stop is going to be right here in albuquerque where he is scheduled to take the stage any minute now for one of his rallies here. you might be wondering why is trump coming to deep blue new mexico? this late in the cycle we are five days out from the election. his campaign tells fox news they want to try to expand the map and they want to keep building these inroads they have been making with latino voters. we see a lot of latinos out here. take a look at some of this video peered some of the crowd showing up earlier, they were lining up for hours before trump actually got on the ground with his plane here. we estimate there is about 5,000 people here to see him. another reason trump is out here is for house races peered he wants to help republicans get elected. if trump goes back to the white house, he needs a congress in order to pass his agenda. that's one of his biggest priorities as well. but trump will have an uphill battle here new mexico. take a look at the most recent albuquerque journal poll from

earlier this month. it shows vp kamala harris up over donald trump by about nine points. 50-41%. now obviously the border is a significant issue out here in new mexico. the state has big problems with their border. new mexico has had the most recorded known got a ways of any spot along the southern border so far this year. as for trump's plans today, once he has done here in albuquerque he will fly over to henderson, nevada, where he will help another campaign rally and then he goes to phoenix, arizona, for another campaign event. we will be traveling with him the entire time. we will send it back to you. >> john: what a bluebird they are in albuquerque. >> gillian: now to the harris campaign. she is heading west coast battlegrounds and the vp will touch down in arizona soon but then head over to nevada. peter doocy is live in north vegas. what can you tell us?

>> i can tell you we are now seeing one of the very few examples of vice president harris trying to distance herself from president biden. she has now gone and the last couple weeks from saying vice president's don't really criticize their presidents to saying this about the president's slip that trump supporter's are garbage. >> first of all i think that the president has explained what he meant but i've said it earlier, i strongly disagree with any criticism of people based on who they vote for and i have made that clear throughout my career. >> vice president harris continues trying to make the closing days of this race less about policy and more about personality. trump's personality. >> this is someone who is unstable. obsessed, obsessed with revenge. consumed with grievance.

for a major rally at the airport. we will see trump force one pole up in the scene any minute now. he's expected to focus on top election issue, the border peered let's bring in paul perez the national border patrol council president. welcome to the program for the first time. trump right now is it trailing kamala harris in new mexico by seven points peered he lost it by 100,000 votes or 11% back in 2020. this would seem to be more about down-ballot races and they are running as republicans. immigration is going to be probably the front and center issue at this rally i would think. what is the situation they're in new mexico when it comes to border crossings? >> absolutely. if people in new mexico had been paying attention it has been one of the biggest crossing points because of the actions that the governor and texas took to secure the border here in texas. they push the traffic out west and the governor in new mexico has not done anything like what

governor abbott has done to push that traffic even further. so the people in new mexico need to understand that there is a border crisis and it is really impacting new mexico new mexico. >> john: kamala harris gave this speech at the ellipse the other night where she seemed to take a step forward in her position on immigration. listen to what she said. >> when i am president we will quickly remove those who arrive here unlawfully, prosecute the cartels and to give border patrol the support they so desperately needed. >> john: do you by any of th that? >> absolutely not. with the same breath she is talking about incentivizing illegal immigration by talking about a pathway to citizenship. that's a magnet. that only causes more people to come into the country illegally to try and establish themselves so they can say i was in line waiting for this pathway to citizenship that you talk about. i don't buy that at all. >> john: the morning after she

was headed to raleigh, north carolina. she was in andrews air force base and she talked to the press pool that follows her and was asked about the idea quickly removing people who cross the border illegally. listen to what she said in response. >> what i intend to do on the issue of immigration as i said last night and say continuously as we need to fix our broken immigration system in a number of ways. we need to strengthen the border and put more resources at the border. i have done the work in my policy going forward will strengthen what we need to do to deal with illegal entries between ports of entry. that is something that we need to tighten up. >> john: that was her answer to a specific question about madam vice president can you elaborate on what you said about quickly removing people who cross the border illegally. what does that say about her commitment to follow up on what she has said in that speech? >> just like everything else, she dances around the issue. she dances around the questions. why hasn't she done it in the

almost four years that she has been the border czar? we know it is lip service. she won't do anything. she will allow more and more, millions of more illegal immigrants to cross the border under her watch if she gets elected. we all know that and that's why we are hoping for a president trump victory on november 5th. >> john: i want to just point this out because donald trump did when he was president have his problems at the border. i want to run some video from 2019 where there was suddenly a huge surge in illegal immigration. it's one that his administration was forced to deal with but he did it have this problem creep up on his watch with the border patrol council has thrown their support behind donald trump. why after pictures like this do you believe donald trump is the one to handle the border security situation? >> i can tell you i was in meetings with president trump and a big problem was his former chief of staff john kelly but i can tell you that congress was

not willing to work with him to give him the tools necessary to actually close the border which is why he had to take executive actions. we know he can do it because he's done a before and he will do it again and he's not going to necessarily need congress to act but we do want congress to act as well. we know he can do it. >> john: kamala harris said much of the same thing in that anderson cooper town hall on cnn where anderson cooper said why didn't you take the executive action earlier and she said we were trying to work with congress at the time. but then there's this idea of canty walk and chew gum at the same time? if you can't get relief from congress, you have to do something which is what president trump did. >> he figured it out. he said i'm not going to let the democrats hold me back. i'm going to do what i need to do to secure the border because talk is cheap and he walked the walk. >> john: paul perez the national president of border counsel. good to chop you and hope to see more of you in the future.

quite a picture there with trump force one behind the rally goers there in new mexico and a big-screen tv just flashed up early voting. make sure you get out an early vote which is a big change from 2020. there was all this talk about don't trust mail-in ballots. >> gillian: it's an interesting switcheroo. one of the trump surrogates yesterday, i forget who, said going to places like where he is going in new mexico today and north carolina is like a power move meaning it's not something that his own election chancellors are going to hinge on but he's hoping to help the down-ballot races and it's something he think he can afford to shoot a couple blinks at this point so late in the game speaks to the strength of his campaign. that was an interesting argument. i'm going to take not necessarily hit pause on my own interests but i'm going to take a moment even amid this last minute scramble and it always is for the white house, to go help out the down-ballot races. >> john: i've seen that other

>> john: just moments away now from a trump rally and albuquerque, new mexico. there is the rear door of trump force one. most of the staff has come off already and we expect the former president to come down the stairs. immigration expected to figure prominently in this speech as he goes to a state that he lost by 11 points in the last election but there is some very important down-ballot races and maybe the idea that trump could peel off a few more voters than the democrats would like to think that he could. we will bring you that rally as soon as he gets underway. concerns of voter broad and battleground michigan after university student who is from

china and not a u.s. citizen voted over the weekend. it appears that the students ballot will count despite the fact that it was illegally cast. alexa asked ms. adams is live in detroit. a lot of people would say how can you count it if it was illegally cast? >> people all across the country are wondering what is going on. it's happening right here in michigan according to the secretary of state's office who said this chinese student who is not a u.s. citizen who goes to the university of michigan used his student i.d. card to register to vote on campus. the ballot has artie been put in and tabulated so at this point it could count here in election in about a ground state. this is the campus there. the university of michigan pair this went down on sunday according to the investigators who were telling us that this student is now facing serious criminal charges including perjury. the investigation continues but here in detroit in this area, it is coming down to the wire as these new poles we will show you

on your screen show just how close of a race it is. these new fox poll's coming into the newsroom, harris leading former president trump by two points in michigan. that's on the expanded ballot. that means 5% of the vote is going to other candidates like rfk jr. people are thinking what you mean he isn't in the race? but they won't take them off the ballot here in michigan. when it comes to the economy, harris is even with trump but trump is gaining traction on his middle east policy. that is important because the arab and muslim vote in michigan could help swing the election in the state. democrats fearmongering and fearmongering to scare people to get those voters back. watch. >> former president trump is getting support from the arab and muslim communities but democrats are saying he will put muslims in camps. what do you think about that? >> he didn't do that. i didn't see that in his eyes

among muslim and arab americans that he might bring an end to the middle east war and that is saying he might be they want to go with. alexis mcadams for us. thank you. >> gillian: while we are following several big legal battles in key swing states kerri urbahn fox news legal editor. flagging this in from our epically talented justice department and supreme court producer. he reports that he has found 150 lawsuits filed in the past year and over three dozen states. they include everything from voter eligibility, ballot cast rules and declaring winners. some have been decided already but some are still pending. it illustrates the tremendous scale of litigation in this election cycle. it is something when you see the numbers put that way, isn't it? >> it really is. and i have to credit the rnc in particular for really having their act together. in the lead up to the cycle.

the organizations they've displayed on the lawsuits they have been filing, the bucks county lawsuit that was resolved very quickly this week is a great example of that. they saw a problem on the ground and people were waiting in line for hours to get these mailing ballot applications in person. they were turned away because it was 5:00 p.m. and people were upset. the rnc took a look at that, filed a lawsuit and within a day the judge not only gave them an extra day for people to come back and get those, he gave them three days. i think it is a testament to how much better organized things are this time around because it is much better to resolve these issues before the election then after because it becomes much harder once the voting has already occurred. >> on that bucks county instance really quick. it was a legal victory for the trump campaign but will it help him in the state? >> i think it helps everyone. these are people that i've been waiting for hours for these applications so they can mail in

their ballots and it was very frustrating when they were told they would be able to get them and then they were turned away because it was 5:00 p.m. and i think what happened there is that office was overwhelmed by the amount of people who showed up but it's always a good thing when more people i think are able to vote and because of the rnc lawsuit there, that was able to happen and is able to happen. >> and you think by this week, by friday, tomorrow from the supreme court on the other pennsylvania case? >> that is an interesting case. it's a little complicated but important because what happened here there were two people in a primary in pennsylvania who mailed in their ballots. unfortunately they did not put them in the secrecy envelope that is required by law there. there are three rules you need to put your ballot and a special envelope and you need to sign it and data. if you don't it will be deemed invalid. they put it in just a regular envelope. county officials got those ballots and they put them aside but without having the determination yet, those two

individuals went on election day and voted again. and we are told those votes were not valid because it was in violation of pennsylvania law. pennsylvania law says if you mail in your ballot on time that's it. you have one shot and the reason is obvious because otherwise it would create chaos where people are voting multiple times. the pennsylvania supreme court just recently essentially throughout the long-standing pennsylvania law and said even if you mailing your ballot on time we will pretend it doesn't exist if you vote again. this has been taken to the supreme court and an emergency appeal. we expect to hear tomorrow on that. >> gillian: probably tomorrow. we will be waiting. we need to leave it there. president trump is getting off of trump force one and we will take our viewers to the rally in albuquerque. thank you for taking the time with us. >> john: we are watching the back door of trump force one as the president is expected to

to take the stage. they will be rolling lee greenwood and a second which means we have 3 minutes and 15 seconds to talk to michael whatley republican national committee chair who joins us now. new fox news polling shows a dead heat in three of the battleground states. it's 4848 in pennsylvania, north carolina 49-47 for trump, 48-46 for harris in michigan. you said the other day you are cautiously optimistic about next tuesday paired are you feeling that way? >> yes, i am and if you look at these polls, there's two key takeaways. number one, we are doing dramatically better in every one of those states then we were at this point in 2016 and 2020. number two, and if you look at the early votes, the absentee votes, the polling and voter registration, all of the metrics you are watching right now, donald trump is in a great position and all seven of our battleground states to be able to win on election day. we know it will be tight but

these are solid durable leads that we are seeing across all of the polls over the past several weeks. >> john: there's been a big push by the republican party and you've been leading it to get the early vote out. it is that just shifting votes that would normally be cast on election day or are you managing to get out low propensity vo voters? >> we are getting out the low propensity voters. it's very important to us to make sure that that is the target audience for a lot of our grassroots efforts. a lot of the ground game that we have been building over the course of the last six months. we are not cannibalizing election day. we expect they will have very good returns but our message continues to be the same. president trump is in a great position to win on election day but we are going to have to have everybody come out and vote and double down and make sure that they are working for the next five days. >> john: we released a fox news poll in the state of michigan that had an interesting finding. it found that the economic advantage that president trump had on the issues with voters is

really narrowed. he only leads kamala harris by two points in michigan. what do you attribute that to? >> we just have to take a look at what that looks like on the ground up there but what i will say is that spirit when it comes to economic issues, president trump has a very real plan. on day one he is going to reduce inflationary spending, he is going to unleash american energy to bring down prices and he is going to make permanent his tax cuts as well as no tax on tips, no tax on overtime, no tax on social security. kamala harris is going to double down on every single one of her disastrous plans over the last four years and raise taxes to boot. >> john: michael, the bosses at the microphone. we thank you for joining us and now let's listen to donald trump at the rally in albuquerque, new mexico. >> i said why? they don't want to stop the people pouring across the border that are murderers, they are
