attack people. this guy had myriad number of arrests, mental problems, it is alleged he was high on drugs, his pupils were dialated. it was a dangerous situation. this will be tried by 11 of the 12 jurors who have ridden on subways. they will have to think about what was reasonable based upon circumstances. prosecution will say, they did not have to put him in a choke hold. this guy does not have a problem, he served four years and went to college and was coming back from school, going to teach swimming lessons. this guy did not have an agenda. this guy will have to decide was it negligent, reckless or was he justified and that is what the jury has to decide.

>> steve: judge, new york city subways can be scary places and this guy stepped up and now he's on trial. what is interesting, the judge did allow prosecution to reveal this guy did not have a gun at the time. was that a good call? >> well, the judge is not allowing prosecution to show that jordan neely had a gun. but what the judge is allowing prosecution and defense, i should say, to show is the fact he's got a number of criminal convictions within the past year just before this. this happened in i maof 2023, just before that he knocked a woman out on a subway platform, broke her nose, assaulted other citizens in a violent way. he's a violent threat and indicated he was a threat.
