>> wisconsin is going to get visits from both candidates today, bill. >> bill: all right. as it should, right? thank you. mike tobin in the bellwether of door county. >> dana: the final countdown. with four days left before election day the candidates are crisscrossing the country focusing on key swing states as the race for the white house enters the homestretch. welcome to a new hour of "america's newsroom," i'm dana perino. >> bill: do you have a favorite county in the united states of america? >> dana: favorite county? >> bill: you can think about it. door is cool. i wouldn't want to be there in wintertime. summertime okay. >> dana: i would say westin. >> bill: yes. >> dana: my uncle -- >> bill: right along the border in eastern wyoming. i'm bill hemmer, good morning. are we done yet? we're seeing a heavy turnout across the country. both sides paying real close attention to the early voting trends in the three key

battleground states, arizona, georgia, nevada big turn-outs there. today is the deadline for early voting. idaho, louisiana and massachusetts, texas and utah wrapping up early voting today. georgia's governor brian kemp was out today saying he sees a lot of enthusiasm among republicans in the peach state. >> we told people we have to get the vote out. i believe the enthusiasm and energy is more on our side than theirs right now, at least in georgia. our people have said look, we'll stick it in your eye and go vote and win this thing and keep georgia red like it should be. >> dana: georgia reporting strong early voter turnout, 3.7 million ballots already cast up 60% from 2020. >> bill: in nevada early fiftying returns show republicans so far out pace democrats. a large number of third party voters casting ballots as well. >> dana: jeff paul in nevada. the state sends a ballot in the

mail to every registered voter. first madison is in forsythe county, georgia, just north of atlanta. hi, madison. >> good morning, dana and bill. yes, we're here in georgia for the final day of early voting. the state is on pace to see the highest record of early voting in the state's history. as you mentioned at last count we've seen 3.7 million people cast their early vote. that is over half of the active voters here in this state. we are going to probably break the early voting record. secretary of state telling me he also expects it to be a record turnout come tuesday. republicans have been doing a good job of getting their base to vote early. two of the counties right now that have the highest percentage of early voters turnout arery monde and town counties seen 64% of early voting and 69% of active voters turn out. those are two counties that

voted for trump in the last election but nearly 80%. while some of these typically republican counties have seen early voting success, other typically republican counties are getting bluer by the year. forsythe county has consistently voted republican but the margin continues to get summarily. 2016 romney took home 80% of the vote. 2020 trump walked away with 65% of the vote. i've been doing exit polling here. majority told me they are voting for trump but got a couple of people who wouldn't share who they were voting for and one person who wanted to send a message with their vote. take a listen. >> voted for donald trump because i believe that when he gets back into office it will be better for the country and better for americans in general. >> i voted for the libertarian because although i am by history a conservative, but i do believe

that the values that trump is currently representing are not mine. >> last time i voted was in the clinton era. today is a very important time to get your vote out there and vote. >> that last gentlemen you heard from who hasn't voted since clinton said he will be voting for trump today. when it comes to georgia, harris is pushing on the state and be here this weekend. as of right now there are no official trump events in georgia this weekend but we're keeping an eye on that. dana and bill. >> dana: thank you for bringing us interesting people as we get into the homestretch. >> bill: so the illegal immigrant accused of murdering laken riley arrived in court a moment ago. this morning's hearing will focus on evidence for his trial in two weeks' time. madison is watching that in atlanta. >> this is expected to be one of

the last hearings before jose's high profile murder trial which starts in less than two weeks. all of this happening around eight months after laken riley was found brutally murdered on uga's campus. the hearing just got under way in the last few minutes. looking at jose right now in court. i want to mention that it was up to the judge who made the decision that he would not be shown on camera wearing shackles and would be in non-jail clothing. he is of course facing ten charges in this case including malice murder. the hearing is set to focus on the use of dna evidence. prosecutors say dna from riley's fingernails is some of the evidence against the suspect and his defense said that evidence should be tossed out. we expect to hear about his cell phones. investigators seized two of his phones during the surge for riley's alleged killer.

the defense argues the search warrant is unlawful and wants the phones tossed out. >> you can infer the defense believes that that information, that evidence would be harmful to their case because if it is not harmful why bother going through the motions to suppress. >> investigators accuse him of trying to sexually assault riley and seriously disfiguring her skull. it happened in broad daylight police say on uga's campus in february. the 22-year-old nursing student was running on trails by the -- when he was killed. both the defendant's brothers are in the country illegally and summoned to testify in the trial. unclear if they testify for prosecutors or for their brother's defense. >> bill: something to watch. >> dana: paul mauro fox news contributor, what kind of

defense could he mount and could you speak to what it is like when you bring family members into a courtroom and not knowing how they are going to -- i guess the prosecutor probably knows, but we don't yet. >> right. i mean, the issue, a number of legal issues underway here relative to the evidence. he wants this evidence thrown out, as phil said, because presumably it will be very damaging to him. it will be a fact issue as to whether and when the evidence was gathered. the implication seems to be the phones were seized illegally. they were then searched pursuant to a search warrant. a number of ways that could have happened. very good chance it was consensual. that they got to him and he allowed the phones to be taken. they took the phones and then had the search warrant. they wanted the phones quickly so they wouldn't be tampered with. the defense could argue that

sure, he gave up the phones but didn't understand what was being asked of him and that's why he did it. the same goes to the dna. they did a dna swab of the cheek. the defense wants it thrown out. good chance that swab was collected before the search warrant is their argument. he did it consensually. presumably all the evidence is damaging because they made a quick arrest. >> bill: the judge made an interesting decision with television cameras in the courtroom here. he has ruled that the cameras cannot be on the accused, the defendant, while he comes in or out of the courtroom wearing shackles. how often has that happened? >> it's very rare. let's remember this is a very high-profile case. sometimes in cases like that you see things you haven't seen previously. let's recall the jury hasn't been selected yet. that's a few weeks out still. the defense has already made a

motion to have the case moved from that county. athens county. the judge is doing everything he can to insure that there is no indication that the jury pool has been prejudiced and that the defendant will get a fair trial and seeing him going in and out of court in cuffs lends the idea of presumption of guilt. so i assume he is trying to do everything he can to keep the jury pool untainted. >> dana: what about the brothers coming to testify? >> interesting question. it comes down to which side of the fence they are being called in to testify for. are they being subpoenaed to testify or in the grand jury? we don't have that information right now. we don't know the circumstances. the brothers were arrested subsequent to jose's arrest. the circumstances of that are murky as well. they may be called in by the defense to give him an alibi to say he was at work or didn't

consent and doesn't understand the language and didn't understand what was going on and why he gave the phones. they are fact specific. they haven't come out in motions yet. interesting to see what happens when the case unfolds stimulates this month. >> bill: we're told an f.b.i. agent on the stand now and follow his testimony. i don't recall off hand how they tracked down this person after laken riley was killed. do you recall the details for that? >> yeah. the strongest initial indicator was the video. the university of georgia had good video of the area even in this relatively remote area where laken riley had been jogging. remember something else, which is getting a little lost in the sauce here. there was a previous complaint of a peeping tom. not clear when the police became aware of that but it may play into all this as well. they may have had probable cause to arrest him as the peeping tom

allowing this emotion to seize the phones at that point. but they may have been already acting to your question, bill, on the complaint of a peeping tom and been in the area. either way, the video evidence seems to have led them in the direction of jose and made a quick arrest. >> dana: when we talk about migrant crimes. most of the times the victims are women and you have spoken about that. expand on that here. >> he is reported lay member of the tren de aragua, as are his two brothers reportedly, allegedly. and this is a phenomenon we're just seeing nationwide. it is at this point i think inargue able that we're seeing a roster of female victims from these young men who are here illegally and who are members of a prison gang. there is no indication it is any kind of initiation or anything but what we're seeing undeniably across the country is not only

violent crimes like this but a great deal of human trafficking going on relative to women. these tren de aragua is a prison gang and know how to grab territory and hold it and in some instances using the migrant centers that we are paying for, in some cases flying them in to put them up, they are using those locations to bring women in and keep them under their control in these centers and traffic them out on the street. i'm not a psychologist enough to say is that what reads to some disrespecting of women of a perception of them being victims? i don't know. what i would say is we have to accept the fact that the roster of female victims the tren de aragua and other prison gangs is unignoreable but being ignored by much of our media. >> bill: a couple things the f.b.i. agent is testifying how they open up phones and defense

wants it moved out of the county. this is the university of georgia and has been -- the story for the last year. paul, thank you for your guidance and advice and analysis now. paul mauro, thanks. today also marks the final day of early voting in key battleground state nevada. more than 930,000 ballots have been returned and the numbers show republicans with a slight advantage at the moment. former president trump expressing confidence that it can stay that way during a campaign stop just yesterday. >> the fate of our nation is in your hands. this is a very big state for us, a very big state. i love it. i'm here a lot without campaigning. i want to tell you, this is a big one and looks awfully good. i don't want to say. just keep voting, keep voting. >> bill: jeff paul live in las vegas, clark county. you have a lot of the vote for the entire state that comes right where you are in vegas. good morning, jeff. >> good morning, bill.

it is the last day for folks in nevada to cast their ballots early and for republicans here in the state so far they like what they are seeing. according to the latest numbers from the nevada secretary of state, republicans are outpacing both democrats and third party or nonpartisan voters. the latest numbers show a widening gap with registered republicans casting 40,000 more votes than democrats. it's a big part of the reason why we're seeing both candidates hitting nevada so hard. vice president kamala harris speaking in reno and las vegas. she reminded nevada voters to take advantage of early voting. nevada congressman issued this stark warning. >> i hate to tell you this but nevada is falling behind. no. in fact, the republicans are kicking are ass for early voting. we cannot let that happen. >> trump meanwhile stopping off

and saying the fate of the nation is in their hands. nevada is a big state and mentioned how republicans are leading early voting. it is a state that trump lost both in 2016 and 2020. the chairman of the republican party of nevada told the crowd to not take their foot off the gas just yet. >> historic levels of voting for the republican party. but it is not over yet. you have to get out there and you have to plant that flag so there is never a question of what happens in nevada ever again. >> there is also the ever tightening u.s. senate race between republicans and the democratic incumbent. we also know this highlights how serious the presidential campaigns are taking this. both tim walz and jd vance are expected to stop in the las vegas area over the weekend. >> bill: jeff paul, thanks. >> dana: let's bring in shannon

bream, anchor of "fox news sunday." you are coming to new york. it will be great. before that we want to talk about the battleground states. listen to josh shapiro on with bret baier last night talking about surrogates on campaigns. >> folks understand it is a race between kamala harris and donald trump. i don't know that they are foixed on things trump surrogates say or anyone associated with what the vice president say. >> dana: are they, shannon? >> there are a lot of headlines coming from people who aren't the top two candidates. when you have surrogates or somebody part of a program or shares a stage with you, a lot of headlines come from that. when there is something controversial and you have to spend time walking things back, you or a surrogate and people want the candidates to make remarks on what somebody said it takes people off their messaging game in the final days. you think about tonight the vice president, both of these guys will be in wisconsin.

the vice president is having another big star studded event there tonight including cardi b. remember last year she was furious with this administration over taxes and costs and spending on foreign wars and wouldn't endorse a blanking president and wouldn't vote this year. now she is back on board. i don't know how much the surrogates move them but they are entertaining. >> bill: lebron james for harris. one thing that the governor of pennsylvania suggested yesterday is that he wants his counties to commit to getting the job done tuesday night, wednesday morning. a big job. we'll see whether or not they can, shannon. >> listen, you guys know we're tracking more than 200 cases of litigation involving this waiting on a decision from the supreme court right now about some ballots in pennsylvania,

and then i saw -- i would watch cnn and msnbc and read "the new york times" and oh, wow, the republicans are terrible. but then they would also say elon is terrible and i think why are they lying about elon? so when i resigned from the democrats i felt such a relief i'm not part of the party that is now malicious and dishonest. >> bill: the perspective she has is unique, right? this was blood. it was her son that they were talking about. and it helped her to crystallize her view and see right through it. how did you see that? >> yeah. right now, bill, there are millions of women that are still undecided and they are trying to crystallize their own view and why this is such a terrible closing message, as it were, from the harris campaign. we have in swing states now 5%

>> dana: fox news alert. last jobs report before the election released this morning and it was not good. employers added only 12,000 jobs. far lower than the 113,000 expected. the unemployment rate did hold steady at 4.1%. edward lawrence from fox business live at the white house. >> i'm at the labor department now. got done talking with the acting labor secretary. we'll run over to the white house after this. i can tell you we knew the report would be bad. we didn't know it would be this bad. the last time the economy created fewer than 12,000 jobs was december of 2020. when you look inside this report you can see it is upside down from what a free market report should look like. you have the private sector losing 28,000 jobs in this report and the government sector actually adding 40,000 jobs. you see where some of the other jobs are. manufacturing lost 46,000. retail down 6400.

leisure and hospitality down 4,000. i asked about taxpayer money supporting most of the jobs in this report. >> we've seen multiple industry recovered to their pre-pandemic level but exceed that now. and when you talk about local government, these are your police officers, your firefighters, your local -- someone who approves building permits, growth in the local economy is also indicator of a strong economy. >> government jobs good according to her. the jobs report also reflects the fact hurricane helene hit right before the survey was taken and the hurricane milton struck during florida -- in florida during the survey period reflected in the numbers. she tells me the boeing strike impacted the number. the bureau of labor statistics said manufacturing would have still shown a job loss. >> overall numbers for manufacturing still up some 600,000 more than that in this

administration. that is also not by accident, right? the investment we're making into creating things in america again. opening up shuttered factories closed in 2019 and 2018. we are seeing that those effects but we won't see them immediately, right? >> this is a little exaggeration we're hearing in the closing arguments. the economy created 93,000 manufacturing jobs under the biden term because we have added back all of the manufacturing jobs that were paused in the pandemic and now created against 93,000 jobs, not 600,000. last report before the tuesday voting people will have to decide is this the trend or do they want to see more? >> dana: edward lawrence at the labor department. thank you. >> i'm only here for one reason. they all said don't come. they said oh, a republican can't win that state. they said a republican can't win. we have to win it.

we'll win it. >> it was near the border donald trump making a play in new mexico, a blue state but the former president continues a slight battleground detour. rich lowry editor from national review and harold ford junior co-host of the five. tomorrow in virginia, deep in roanoke county will be there with governor youngkin. youngkin thinks he has a state wired and he said this yesterday. >> virginia is far more competitive than any of the pundits would have believed. i remind everybody, donald trump, of course, against joe biden in 2020, joe biden won by ten points. we came back the next year and were able to win virginia and virginians are ready for strength back in the white house. that's why this state is far more competitive than people would have thought. >> bill: harold, i will start with you. i don't know if you want to talk about virginia or maybe the fact that keep your powder dry.

we could very well have surprises come tuesday night. >> no doubt. rich and i were talking in the greenroom. this is an unusual election. cheney endorsing a democrat and kennedy endorsing a republican. interesting things are happening. if you listen to governor youngkin, two years ago he mounted a campaign to win the house and senate there in virginia and lost it on the abortion issue. interesting to see how that plays. we talked on the show before, i don't think that the winner of this election will win by a narrow margin. i still believe we look at 280 or 90 or higher. the three what they call blue wall states, michigan, pennsylvania, wisconsin since 1980 have only gone not together one time only in 88. wisconsin won wisconsin your boss's dad won the other two states. i think if you look at the data i think it is trending one way or the other. i don't know who will win.

i have my choice. i want kamala harris to win. this is a close race. i hope that vice president harris stays on the road these last few days and even if she finishes monday night at midnight like bill clinton did in 1992 that's what has to happen. this is razor thin close in a lot of states. >> dana: look at new mexico. the margin of victory was biden 54, trump 43 in 2020. in virginia it was biden 54, trump 44. there could be some major changes. i believe jim garrity at national review did a piece yesterday there are other reasons to go to these places including congressional races. >> a swing district in new mexico that democrats hold and donald trump doesn't want to win the presidency and not win the house. democrats would impeach him immediately just for winning the election. these aren't swing states. these are outer ring blue wall states in theory.

if trump sweeps the sun belt he could win in new mexico and virginia and not need the blue wall. he will only win them if there is a sweep and he doesn't need them. so some people compare this to hillary going to texas. it is not that. he hasn't neglected the blue wall states. i don't know if he will get much from these visits. >> bill: in that spin you can find something that looks like some factual information and details that may lean one way or the other or make you feel one way or the other. how do you feel today? >> i feel like i thought yesterday. it is incredibly close race. some of the criticism that president trump is experiencing facing this morning about the language from liz cheney. some of the criticism that joe biden was leveled at him because of the garbage comment. give people space to clarify and give people space to say what they meant and what they meant or didn't mean and let the candidates get back to positive and talking about where the country is going to go. one of our in-house newspaper

the journal said whoever wins will inherit a pretty good economy. three of the last four presidents inherited an economy that was near or in recession. the only one that didn't was donald trump. tell us how you are going to take us not only out of this moment meeting us where we are but what you will do to give us more innovation and cures and their putt ickx and more energy and more wealth and more importantly how can more people participate. i this -- i think the american people are smart. tell us where you are going to lead us. not all the attacking. >> dana: how do you feel, rich, what do you pay attention to? >> it's not exactly an issues race in the news cycle, right? it is wars over gaffes. if you pay attention to what they spend money on. the message from harris is he has an enemy's list, i have a to do this. his message is she broke it, i

fix it. that's the struggle in the race. if you believe the polling averages, look at the "new york times" swing state polling averages trump is leading in enough states to win in the electoral college with some margin of error. but who knows, right? it is a functionally tied race. >> bill: how do you feel right now >> i thought trump will win all year long. he is leading on the economy. harris narrowsing the gap but now leading by double digits. >> 54%, 44% women and men early vote. 67 million people voted early and she is leading with women. you may not be wrong. as you look at the numbers there is reason for her to be excited. >> bill: historically women vote 52% of the electorate are winning and leading by two points it could make a huge difference in the states you mentioned. >> bill: i have to correct harold on something.

single electoral vote could be the difference maker for kamala harris and her campaign is spending millions of dollars in omaha to try to win that one electoral vote. in the hypothetical scenario that polls suggest could be a reality if donald trump wins all of the swing states in the sun belt and kamala harris wins the blue wall states in the midwest she would have 269 electoral votes. one shy of the 270 needed to win the white house which is where nebraska's second congressional district comes in. nebraska and maine are the only two states that don't use a winner take all system for electoral votes. in nebraska two of the seats go to the winner of the popular vote and each of the other three go to whoever wins each of the state's three congressional districts. nebraska is very much a red state. here in omaha which makes up most of the state's second congressional district things are more purple. president obama won in 2008 and joe biden did in 2020. because the race is so tight across the country, both

he is a third generation person from montana. a dirt farmer keeps winning elections that people expect him to lose in this red state. he paints himself as a conservative on the border and energy. political experts say the head winds are the strongest they have ever been against him. >> what's different this time is we have a more polarized electric yacht. trump is on the ballot again. republican party is more strongly pro-trump. >> republicans also have a stronger candidate this year in tim sheehy, a businessman and decorateed retired navy seal received a bronze star and purple heart. new to politics and is being outspent by tester 3-one. attacks on his character may be working to make this race closer, though. polls had sheehy up six to eight points a couple of weeks ago. the two most recent polls done show him up four points. the latest one has them tied. there is an abortion rights measure on the ballot. that plays to tester's advantage.
