state elections so they did for her to the highest ct. in pennsylvania. another ruling by the pennsylvania supreme court that effectively estate, and earlier order that would have allowed some defective ballots to be counted their missing dates, mail in ballots, that decision went the of airway. those of us who covered presidential elections before, this is starting a bit early. we've seen 200 lawsuits that have been filed so you have that jaws music starting where you begin to get a little bit concerned about how this was mounting for the day. the concern we often have is if you make changes and election laws it fuels a lot of distrust about election integrity. two of the justices on the supreme court raised that in the second decision and said we

told you we don't want to be changing election laws close to the election. pete: this is more than could have been anticipated, more than we've done in the past when it comes to lawsuits ahead of an election. this is a conversation this morning about comments about donald trump and lose cheney, we've been talking about the media's role but there's another angle here and that is that there are reports the arizona attorney general is looking into trump's comments. off of false representations of trump's comments but an investigation by the arizona attorney general? >> i wrote about this this morning on the blog because there is no basis at all to allege that there's a criminal threat. it's not a closed question. this is political pandering of the worst kind, the attorney general knows there is no basis

at all for a criminal complaint and any type of prosecution would collapse within minutes of making it into a courtroom, threatening another round of lawfair two days before an election is really concerning because i can't understand any ethical basis upon which a prosecutor could allege that this is a criminal threat. the entire quote makes it clear that this was a political statement. if you could prosecute statement like this you could criminalize most of the rhetoric in presidential campaigns when they involve these types of inflammatory terms. this was clearly not a threat. you can disagree with the tenor and the rhetoric but it's not a crime. will: this would be election interference by arizona, beyond ridiculous, this idea to me is criminal. we will explore it more but thanks for getting up early with us this morning. >> thanks.
