from both campaigns to get folks who are still holding onto those mail and ballots to go ahead and return them or make plans to show up on tuesday and cast their ballot in person. that's a big part of the reason for groups like this is a group of democrats here and a las vegas neighborhood. they're going to be out canvassing they believe this race is really going to come down to every single vote. they have a real sense of urgency given some of that latest voting numbers. more than 1 million people in nevada have cast their ballots as roughly 50% of those registered. republicans have the edge right now outpacing democrats by nearly 50000 ballots cast so far. that's a big part of the reason why we are seeing trump and harris campaigns focused so much on this date. both the candidates were here just two days ago. today it's the running mates return to court voters. jd vance and tim walz holding rallies where they emphasize the top of the ticket. >> the main reason to go to the

polls to elect the most qualified person is understood to be president of the united states. >> just remember at least you do not have to do what tim walz has to do is go around and try to persuade the american people that kamala harris is somehow fit to be the president of the united states. that is tough work. that's very tough work. >> four years ago democrats had an advantage of total registered voters in nevada that nearly 87000. this year however they only hold an edge of a republicans might roughly 9000 votes but for the compliment and the picture due to the new automatic registration law in nevada. nonpartisan voters are the biggest voting bloc in the states. who from that group shows up and how many show up could tip the scales in this election this year. >> all eyes on those nonpartisan voters for sure. jeff paul live in las vegas thank you. eric: turn out for early voting shattering records. according to the university of florida nearly 3 million more

early voters have cast their ballots in person this year than in 2020. in total over 72 million people have voted already for the next president of the united states but state leaders working 24/7 to take on the overwhelming voter turnout. pennsylvania secretary of the commonwealth al schmidt in the last hour of "fox news live." >> result long planes pennsylvania department of state has been in close contact with all of our county partners to provide whatever equipment that we can provide. that they have requested and fulfilled every request from every county. but staffing is ultimately left up to the county. to accommodate the needed there voters. what is early voting mean? professor and the university of florida political science department and lab, professor good to see you. what trends can you define if any from what we are seeing so far in terms of the massive overwhelming early voting that we have?

>> we expected jeff that numbers are down. we cannot possibly even reach the 2020 numbers. but there is a pandemic going oonto that make some sense. but we are looking for is how much of the shift is going to move into the in person early voting and into the election day vote. we kind of expected democrats are the ones doing well and early person voting is doing well and starting in 2020. we kind of expected that pattern. something different happen this election cycle. in previous cycles trump had disparaged all forms of early voting. his supporters listen to him and said that really was not a method of voting for them. they would wait until election day. this time around the campaigns putting out the message in person early voting is good. and his supporters i'm listening to him. and like you just saw it pennsylvania they don't have

early person voting. they have a form of voting you can go to an election office, cast a mail ballot in person. it's a clunky process that leads to long lines and now the registrar there in pennsylvania are trying to struggle with how did they manage this? how did they serve the people they did not expect about that way. that stuff is stuff going on ard the country. it is upset some of the patterns. we would have expected have lower levels of in person early voting there would not have been so many democrats. instead we are seeing excuse me 70 republicans. instead we are seeing a big large numbers of imp person in y voting with more republicans. >> the republicans are usually gone election date. let's look at some of the stats the percentages as you just pointed out. democrats, as you can see right there in person 31%. mail and 42. still ahead of the republicans. but the mail in his up for republicans. what does this mean you think

elections going forward the weight we will votes, but we will get to the point where it's not just election day as it is in so many states you have this opportunity to exercise your franchise earlier. what can we determine if anything at all from that? >> interestingly this is how we started in this country. at the founding quit multiple days of voting. it was really to help people get to county courthouses. we used to just have one location devoted to the county courthouse. people living in rural or mountainous areas like virginia appalachia, north carolina, they would traverse some real terrain to get to the courthouse. they've had voting over several days. that change in the mid- 1800s. back in 1970s we start seeing states adopt in person early voting. they also start adopting more expaexpensive forms of mail balloting. that is been the trend. as more states are offering

early voting you get more voters that way. which also get more voters because people like it. once they vote that way they're more likely to vote that way again. you start seeing these numbers after state offers early voting of some sort you start seeing the numbers creep up from election to election. eric: everyone is trying to analyze these numbers and yes there are more women 54%. there is a gender gap in so that could help vice president harris. or is it a case with its harris or trump voters they are the same pole, the same people, they're just not going on election day. they are choosing to do it earlier so you may not be expanding that pou pole to send major political trend. >> you put your finger on the main question that we have here. all of these republicans voting in person early voting is that the sign of new enthusiasm for trump or sign of people shifting their voting and listening to trump saying yes, it's okay to do that.

that is the big question we have yet to answer. they just like it always is will have to wait until election day and see what comes in with the election day vote to really find out who wins the election. eric: this is secretary of state talking about the progress they have. let's listen. >> all the early voting we have seen all of the absent votes that have come in and up. that all has to be tabulated that will happen on tuesday. the people will be sequestered they will tabulate that no later than one hour at the polls close that has to be uploaded by that is about 8:00 p.m. the bulls should close at 7:00 p.m. they'll be 65 -- 70% of the early voting we have. and then the balance of the votes we got from absentee. will be uploaded you'll have that no later than 8:00 p.m. eric: and secretary of state of the commonwealth al >> of pennsylvania told me earlier they have impro improved the syn pennsylvania to get a faster.

any idea when we will get the vote? as you know some states don't count until election date. >> if you vote in person either early or on election day there's a check in process. for you present your identification, you do it all at a table partner given the ballot and you go vote. the real balance is a different process. there's an envelope that comes in maybe identifying information on the outside of the envelope that has to be verified. maybe have to open up the envelope and look inside for that information. i depends on the state with the laws are regarding how you have to provide that information. this is the extra step election officials happy with each of those ballots for adaptive prody the information on the ballot. then they have to separate the ballot from the envelope because it's a secret ballot you do not want people to know how you voted for it so they separate that out. and then they can run the ballots. in some states, like my state of florida or georgia election officials have a leadtime to do

all that preparation work. it's really fast for them to count the ballots. that's all they're doing on election days counting the ballots. but in some other states like pennsylvania and wisconsin they do not have as much lead time to do the prep. and so they have to do all the prep on election day and slows down the process for them. we could see in some slower reporting. we've got some states like in arizona we could be waiting for a while we see a lot of belts coming in very late. so just hold tight. as we are going to be doing that is the best advice. patients hold tight make sure the information they have questions they can get that back and vote on a provisional ballot. hold tight and have patience doctor michael p mcdonagh from the university of were not thank you. arthel: hold tight for sure for

from counting provisional ballots with defective mail in ballot supreme court justice samuel alito wrote quote the lower court judgment concerns two votes in the long completed pennsylvania primary. stating that judgment would not impose any binding obligation on any of the pennsylvania officials who are responsible for the conduct of this year's election. the spring constitutional law attorney translate justice alito's argument explain what's at issue in this case. >> essentially the supreme court ruled on a case out of pennsylvania and that dealt with two voters in pennsylvania primary who had cast a mail in ballots that were rejected because they do not include the secrecy envelope. they are not permitted to cast a provisional ballots. there is a dispute about what the actual law allows for in

that state. republican national committee had hoped to get the supreme court to essentially weigh in and say anyone who had a mail and ballot rejected would not then be able to cast a provisional ballot. [inaudible] only dealt with those two prior votes. there's not any sort of advisory opinion they could issue. arthel: so the republican party apartyannounced a lawsuit today. this one is over counting in georgia accepting absentee ballots over the weekend. rnc chair michael whatley had this to say. fulton, cab, cab burnett counties decided at the last minute to accept ballots over the weekend which disregard the law. they failed to let her poll observers in to wash the process. the secretary of state with

republican poll watchers in local officials refused. can you speak on the merits of this lawsuit? >> it's very concerning these reports coming out and in advance of such a big election tthey're not complying with the laws. we know based on the supreme court ruling last year the state courts and federal courts ultimately the supreme court can weigh in on illegal election handling. so ultimately this is something that could be adjudicated by the courts. when will they get involved how can they stop this when they're doing in violation of the law. ultimately for all of americans and everyone across the world it's important to highlight any of these issues that come up as soon as possible. this is expected to be a very close election and any sort of deviation from the law and the

legislature's intent need to be looked at as soon as possible and address to soonest possible. arthel: but to be clear and these are claims that not all claims are valid. let's move on this could continue will be on tuesday. former u.s. assistant attorney andy mccarthy on that. listen. >> if you bring the court a dispute before the election takes place in before the election has been announced you can framed that as something that is fixing the rules under which we are going to proceed. i think the real problem comes after the election when the result at least presumptively is known. we are asking the court to do is to potentially reverse what it seems like the voters have decided. that is a position they never want to be in. are much more likely to get decent decisions out of them in the run-up to the election. >> what will you and your colleagues be tuned into while

assessing the integrity of election lawsuits filed after november 5? >> i think a lot of the lawsuits will have to come after election day if it's a very close call. it's important or preliminary challenges made to establish whether there are concerns with some of the issue and integrity in the way the states are running their elections. but practically speaking unless there such a small margin one side can show a certain number of all alleged irregularities wl reverse the outcome then they are not going to have much of a leg to stand on. it is important for them to address these issues ahead of time to the greatest extent possible. that's going to ward off any of the pothepostelection challengey opinion. >> we thank you for joining us katie, take care we will see you after the election. >> republicans currently hold a
