we did a really good synopsis of what's going on. let's start the fed cases. we have documents, we have election interference channels mentioned that doj longstanding policy, a sitting president, cannot be prosecuted . that phrase wind down jack smith's case. describe what wind down of jack smith's cases looks like. >> well, i think big picture, if you haven't been able to convict someone in the court of public opinion, there's really no legitimate way you can convict them in a court of law. and every prosecutor has discretion about what cases they bring forward. these cases, we call them lawfare. and that's because there are cases that have stretched the bounds of any prior precedent. there they're never before seen interpretations of criminal law. so in terms of winding down these cases, they essentially can dismiss them really at any time. or obviously, donald trump takes office, he will dismiss the cases and summarily jack smith. so there's many different ways that the cases could end. they're not practically going to trial anytime soon.

even if trump had lost. but at this point, i do agree that they need to be concluded . so the take away on the fed cases, they're done finito over . then there is the new york state court case. all four focus now goes there. this is the stormy daniels case . he's got sentencing less than three weeks from now. what happens there? well, that case also is complicated because of the supreme court's ruling regarding immunity. so essentially there is sentencing scheduled. but before that, can even proceed, judge merchan is expected to rule on whether that actually is tainted by the immunity ruling, meaning that they allowed in inadmissible evidence and that the case would essentially have be reversed and go back to trial or ultimately go back up to the supreme court to determine whether the immunity ruling impacted it. so for all intents and purposes, again, that case could also be dismissed, but it doesn't have to be if there is any adverse ruling to president trump, it's immediately appealable

that if judge merchan says the immunity case does not end that case summarily, that would be essentially appealed anyway. and then, of course, i guess he could sentence at some point to to jail time again, something that would be immediately appealable and probably stayed pending a decision by the higher court. so for all practical purposes, i don't think it's going to go anywhere. the question is how far these people will continue to push these cases. >> there's also the logic of all this. >> you find me, the nypd officer, department of corrections, or new york state police, that's going to physically put donald trump in handcuffs. there are zero of them. not one of them is going to do it because they the ramifications to that would be massive. so i think that's logic aspect of this that we need to pay attention to. let's sit down to georgia, the georgia election interference case. >> the president does not have the right to pardon themselves or have attorney general end the cases.

the georgia case has so many legal issues on appeal, even if trump would have lost that case would not head to trial any time soon. the case has a chance to be overturned, if it is not, it will have significant problems getting reviewed by supreme court anyway. it won't proceed while he's in office and it is basically dead in the water. >> todd: is lawfare dead? >> i would hope so. i think it failed and talking about lawfare, use of legal system against a political opponent. democrats claimed trump was going to be doing that and they have been doing it for years and it blew up in their faces. >> todd: to the media not taking election results so well. >> i can't help but wonder if the american people have given

the popular vote, we are competing for a majority in the house and president overperformed with young voters, females, black voters, hispanics, they want to head in president trump's direction of america first and making america great again. >> carley: compared to 2020, president trump saw major gains among key voting blocks, particularly latino and minority voters. he is up two points with women, three with men, up six with noncollege educated voters, up six with -- up seven with black voters and up 10 with young voters. these numbers, star county, texas, population 97% hispanic went nine for trump. plus four for trump. new jersey is 45% hispanic with

plus nine for trump. and down in florida, population 56% hispanic and trump up seven points. how do you explain these gains? democrats have repeatedly said they were shocked by these results. >> well, i'll tell you, our campaign was not shocked by the results. president trump put in the hard work and we know that was inflation, in my community, hispanic community, it was inflation, securing border and the economy. president trump's plan to secure the border and bring down crime and safety and restoring our position on the world stage. president trump treated voters like whole voters and he had a record to run on. you were better off when i was

will president-elect from pennsylvania's seventh district joined us before the race and joins us after his victory. ryan, congratulation to us. tell us what wednesday was like for you seeing donald trump win the state and also seeing yourself win tightly watched congressional race? >> yeah. thank you for having me back on and it feels great to be after election day. can i breathe a little bit easier. it was a long arduous campaign hard fought on both sides. but, ultimately, the message that we were talking about for the past year and a half about change, improving our economy, securing our border, bringing peace back to the world. that resonated with people in your community. they were tired of the failed policies coming out of washington, d.c. i'm grateful they awarded me with their votes. >> carley: how closely are you watching these other tight races

because the majority is a jump ball. >> the maps drawn across the country make the u.s. house very evenly divided. even in wave years like this where we had a president winning across the board, all of the swing states, there are still these competitive is seats in blue states like new york and california that maybe don't follow the national trends. and so it's going to be extremely close. the republican also have the u.s. house majority when all is said and done. but it's going to be a shift of, you know, just a couple seats one way or the other. i'm looking forward to getting there, actually having the house, the senate and the presidency lined up. we have an agenda in place and now we actually need to go and pass real results to help the american people. >> carley: we're watching it all and looking forward to seeing all the official results roll. in. >> carley: what do you think the next four years are r. going to be like. donald trump has a lot of day one agendas, democrats are already preparing to fight back

tooth and nell. >> which is unfortunate because the american people have spoken. means ending the massive spending coming out of washington, d.c. to help them right now we need to provide real tax relief. that's going it be something on the very early agenda. the other thing that was a big issue in this campaign was border security. and democrats were called out. my opponent was called out. we took her to task for it for border funding 10 times. she realized that was a problem. oh no she was in favor of the bipartisan border bill. she didn't mention all of the terrible things that were in that bill including allowing illegal immigrants to come into the country for a year with no procedures and vetting. what i look at though on the campaign trail, republicans and

democrats i believe we should go out and do those things that the american people voted for. for me it's the art of the possible. that's where the agreement is. let's get that done. help america secure our country and move forward from there. >> carley: how do you think dave mccormick is shaping up in the senate. >> that's an extremely close race. he ran a great campaign here in e. pa. i know that there are roughly maybe 20 or 30,000 votes separating the two of them. i have heard conflicting opinions on if there are enough outstanding ballots to actually change that outcome he ran a great campaign and if in a great position to win. make sure only legal ballots are counted. nothing going on behind the scenes. i'm confident they have the operation in place to actually execute on that. to say make sure that the campaign is fair and free. i think hopefully we will see a senator elect in dave mccormick here it would be great for pennsylvania. >> carley: in case of your constituents are watching why

hope they are. you are going to be a freshman going into washington, d.c. there is going to be a learning curve. how do you deal with that? any committees you are hoping to be on? >> as a state representative that was one thing i talked about on the campaign i do have legislative experience. obviously it's a whole different world in a number of ways in washington, d.c. i'm going to rely and focus on the things that i was on the state house of representatives. things like workforce development and financial services reform and i actually passed legislation through the house here in pennsylvania to expand everify and crack down on the hiring of illegal immigrants in some industries. a lot of these issues are both state and federal nowadays. that gives me a great set of knowledge and experiences that i can go to and start hitting the ground running on day one on all those topics. looking forward to the committees that i get assigned to in a couple weeks. we actually have freshman orientation as they call it. >> carley: like college all over
