freely. joe biden is the singular reason kamala harris and democrats lost. biden was told privately this summer that he had a zero percent chance of beating trump but, after that, harris got a huge bounce when she joined the ticket. picked tim walz and had a glitzy convention and now campaign staff are getting email from their boss that says i know the vice president isn't finished in this fight and i know the very people on this email are also going to be leaders in this collective mission. view this as the beginning, not the end. that was the gist of the vp wants remarks at howard university yesterday that seems what hastily organized. an invite was texted to supporters just hours ahead of time and msnbc news is reporting the harris team did not spend much time writing a concession. they thought her initial remarks were just going to be about keeping the faith during a days' long vote count. >> while i concede this election, i do not concede the

fight that fuels this campaign. the fight for freedom, for opportunity for fairness and the dignity of all people. that is a fight i will never give up. >> peter: we don't know how exactly the vice president plans to keep up that fight as a private citizen come january. back to you. >> peter: hey, peter. you mentioned that donald trump was invited by joe biden to go to the white house before the inauguration just to work things out. did you see the lead of drudge right now is the conservative publication national review said they gave some advice to joe biden. joe biden should pardon donald trump of all the pending charges, relieve the special counsel jack smith of his duties and then ask the new york governor to pardon trump from crimes he was convicted n new york state. is there any chance joe biden could actually pardon donald trump?

[laughter] >> lawrence: we will let them grab it. >> ainsley: what did you all think of the concession speech yesterday? >> steve: it wasn't a concession speech. essentially she said i'm not done fighting. but america took a vote on her fight and said no. no thank you. what is interesting about as we talk a little bit about the blame game. there are a number of stories this morning that the people in biden world, the people who told joe biden that he should stay in it and encouraged him to run a second term, even though he had not achieved the stratospheric legacy of fdr which they told him he would do. is that people around joe biden

are blaming nancy pelosi, and they say he could have won the white working class voters harris creed to donald trump. and to joe biden having essentially nancy squeeze him out was like when barack obama in 2016 said joe, sit down, i'm picking what's her name hillary rodham clinton instead to run as my successor. >> ainsley: they have should have looked back and remembered she was the first one that had to drop out of the race when she ran before. america did not want her. >> lawrence: still not getting her attention. essentially the concession speech. >> brian: hated it. >> lawrence: the start of the resistant movement, before he has even been sworn. in made it very clear even though the country rejected whatever agenda that the staff wrote, because we never heard from her about policy, there was not an economic policy. there was not a border policy, there was all these flip flops that the staff communicated, not her. she still says. >> ainsley: several things when you watch the concession speech, first of all she waited until

4:00 in the afternoon to do it. i understand if she wants to wait until the next morning, fine. to wait until later the next day in the afternoon, i just didn't think that was the right move. and then when you do hear it, she talks about i'm not giving up the fight, a, and, b, she said this time it will be an easy transition of power or something like that. like throwing it in trump's face from before. >> brian: i expected it. i did expect that. but what i thought was i had a great conversation. >> steve: like move on, right? wish him all the best. >> brian: you think there might be a cease and desist at least short-term from all of them. i would not be surprised if donald trump does an interview tomorrow if he doesn't go out and say she is a terrible vice president and doesn't say joe biden's mind is melting down. i think that there might be a cease and desist. i know sometimes president trump when meghan mckee and he was sparring. he would not go back to meghan mccain. he didn't touch michelle obama on purpose.

getting rid of all the cases. the only thing left is the new york sentencing. and i can't see that -- i don't know if the president of the united states can touch a new york story. if you saw letitia james with her bizarre press conference yesterday. >> steve: he would have to go to the governor. >> ainsley: all right. we are going to talk more with that in a little bit. for now turn to bill melugin "fox news live" palm beach, florida to talk who could be on president trump's cabinet going forward. hey, bill. >> bill: hey, ainsley. democrats put all their hopes in the blue wall. the blue wall got hit by a red wave. donald trump was able to sweep all three of those states h a late call from michigan yesterday. is he now just short of 300 votes in the electoral college. we still have arizona and nevada left to call. they are both looking good for him. as you mentioned he is now focusing on his transition team. they are already getting to work. take a look. part of that team says, quote: in the days and weeks ahead, president trump will be selecting personnel to serve our nation under his leadership and

enact policies that make the life of americans affordable, safe and secure. now, according to the "the washington post," these are some of the names being tossed around for some of the cabinet positions for chief of staff, you are looking at maybe susie wiles or brooke rollins. for secretary of treasury. john paulson, scott bess sand. secretary of state ric grenell marco rubio. secretary of defense senator tom cotton. more on him in a second. r.f.k. jr. here is what jason miller said about all of this last night. >> he knows exactly what he wants to do. he knows many of the people that he wants to bring with him. some of these issues can't wait until he gets sworn. in obviously we have what is happening at the southern border there are different things that president trump can do. simply by being the president-elect. >> and axios is reporting that even though senator tom cotton's name is being tossed around, is he politely declining an

opportunity to serve in the cabinet. he wants to stay in the senate and run for senate leadership. and with republicans, flipping the senate, taking control of it, guys, is going to make donald trump's job of getting his confirmations done a whole lot easier for those cabinet positions whether it's dhs secretary, ice director, you name it. that road got a whole lot easier with republicans now going to be in control of the senate. back to you. >> steve: bill, you are absolutely right. thank you very much. senator barrasso who is going to be the senate whip yesterday said that the senate will move quickly on donald trump's cabinet picks and, you know, if they have got unified government, it should not be a problem. >> brian: with tom cotton it looks like he is really concerned about his family. the family involved secretary of defense. >> ainsley: what are you hearing. >> brian: for of a family thing. plus, is he so young. his kids are like 10. >> it would be really hard to move -- your children are so happy in their elementary school and you are pulling them out away from their friends. i know you do it for country and works for some families. but, for others, they might be involved in sports.

>> brian: do you know what i think it is. not only moving but you're not going to be home. so you are not going to be home ever. that's a problem. you are in a rhythm somewhat. he said if he can get something in leadership that, will probably work best for him right now which opens up the spot maybe for a mike pompeo to move in there as secretary of defense. because you don't want him to do the same job again he was at cia and secretary of state. i also think that marco rubio would be a brilliant secretary of state. and i think he has been -- that's something that he is passionate about. >> lawrence: he was like the runner-up to be the vice president. >> steve: he was. >> lawrence: on the ticket. marco rubio was. >> brian: brian governor burgum is going to be valuable. >> ainsley: and r.f.k. jr. >> lawrence: the true belief if you talk to the trump camp and you compare this campaign to the last one it. it was almost like leak proof they want people like brian talked about in the 6:00 hour, that they debate with the president-elect. they don't want people putting

the information back and forth and when he makes a decision to go with that decision. he respected a lot of those generals. that was in the administration. but part of the conflict was once he finally made a decision, they disagreed with it and they made the world -- will he they let the world know that. >> steve: that's why all these names for the most part are being floated by other people. because, if you are the person and did you go hey, they are considering me, you know, get out the pen. they just scratched you off the list. it's interesting because ron desantis the great state of florida is lobbing for surgeon general dr. joseph to be the hhs secretary which would be -- >> ainsley: you know, i will tell from you our perspective because i don't know if the average american knows. this that team, when you look at their faces, we would call them all the time asking for interviews with donald trump, with melania, with the kids. they worked so hard. and when you see behind the scenes of people that are raising money for the politician

that they love, the pacs that are involved, the money that's involved, the commercials that they are building on both sides. these are people who love this country. and they have a vision. and they have a passion for this country. people are giving up time with their kids to go work on the campaign trail, to knock on doors. so so much goes into this. it makes me proud to be an american. >> brian: look how this whole thing is being covered because two things. what's the new regime going to look like and what happened to the democrats? nbc writes shadow democrats grapple with harris' lost. "the washington post" what just happened making sense of democrats blow out loss. "newsweek" democrats in disbelief over election loss. they are not promising trump a honeymoon but they're looking in instead of blaming the russians this time and say well he didn't win the popular vote. >> lawrence: they are acting like they need this major autopsy. i can tell you exactly what happened. you didn't listen. you just did not listen to the american people. they made it very clear in the polling, telling you what the

number one issues were. they said it was the economy, immigration, inflation, and you literally spent the entire campaign talking about everything else. >> ainsley: you are so right. it's just common sense why would you let criminals over the border to come into our country. common sense, why would you pay for them to go to college and not pay for americans' food or whatever it is. it was just common sense. we saw that in virginia with glenn youngkin. he was the one who was listening to the parents. >> steve: before the last election, we went to a diner in virginia. that's the beauty of the diner. fox news did the voter analysis, talking to 111,000 people coast to coast. but over the last couple years. actually over the last 8 years we have been going to the diners and taking the pulse of the people. we have put together a little montage, had the democrats listened to our people who showed up and talked in the diners, they would know what america was hurting over. and it would have told them how to win this time but they didn't

trump lost voters? >> brian: white people, 3%. go ahead and figure that the o. meanwhile, straight ahead, following president-elect trump's historic comeback to the white house. the future of his legal cases are looking much brighter, especially after special counsel jack smith is reportedly winding down his multiple investigations. former attorney general bill barr says it's time for the cases to end. >> it's always a question of what's in the best interest of the country. and in this situation, there is no doubt in my mind that the best interest of the country are served by them dismissing the case. these cases are not meat and potato criminal cases. they are very novel cases. they raise all kinds of constitutional issues. and at the end of the day, the juice is not worth the squeeze. >> steve: he is right. meanwhile, major critics of trump, like new york's attorney general who claim -- who charged him in a civil case say her office is prepared to continue the fight. >> ainsley: here to discuss former assistant u.s. attorney

[chuckles] >> that's a tough one. former attorney general barr is exactly right. and i also think from what i can gather that sort of a deal is coming together. because everyone understands that president biden is going to pardon his son hunter that is not going to go down well -- at least if it's in a vacuum because he vowed he wouldn't do it. not that anyone took that too seriously. but i think it goes down easier for the country if it's kind of like a clemson clemency packagee the biden harris justice department dismiss the cases against former president trump

president-elect trump. they can't prosecute him at this point anyhow. he will be the sitting president of the united states. then biden pardons hunter. i think the signal that sends hopefully to these progressive prosecutors at the state level is that, you know, it's time to turn the page from law fare which proved to be a disas for the democrats in the election. >> steve: that would be brilliant he wants his son pardon dawned even though he said i'm not going to do it. he is going to do it. makes it more palatable if he also pardons trump, poof, all that stuff is gone. >> steve, i think that's right. because it's him doing it. and the other thing that is important here in dismissing the case, you dismiss it at the justice department level rather than having to pardon the incoming president, which is almost like an admission of guilt that trump doesn't want to make if they dismiss it and

biden-harris justice department that dismisses it. i think the judge goes along with it more easily. whereas if trump's justice department asks to dismiss the case, they may get pushback from judge chutkan. >> lawrence: what about the state, andy, even if they decide not to do anything with the case when donald trump takes the administration, that case is going to go away in the departments of justice, okay? but when it comes to the state, what happens there? is there a pause while is he president of the united states? does that case continue in fulton county as well as new york? >> yeah. fulton county thing, lawrence, is kind of a mess because disqualification litigation around fani willis and they haven't even gotten to the immunity stuff with respect to trump. so, that case will be paused while he is the sitting president. the interesting one is the new york case because judge merchan is supposed to rule next tuesday on the immunity issue. and immunity, no matter -- he usually rules against trump, right? however immunity comes out, it's

appealable. so trump should be able to appeal that and that will be tied up for a long time in new york and otherwise suspended. but, what i hope happens is that president biden and his justice department, by doing what they do, what that hopefully does is give kathy hinojosa the governor in new york the space she needs to make that case go away. because she has got to deal with the crazy progressives in new york. >> brian: the attorney general is as crazy as it gets. the $900 million they charged the organization, that civil case has got to go away. i know the judge is going to revault the penalty. but they have a monitor on the trump organization. they got a check with them. this really hamstringing the company, for no reason. there was no plaintiff. >> yeah. i think, brian, that i was surprised to hear her defiant remarks yesterday. because i think her problem is with the appellate courts in new

>> bryan: yeah, to say it mildly, steve, that's exactly right. the infighting in pennsylvania among democrats is intensifying. we spoke to philadelphia's democratic party chair and former congressman bob brady who blamed the harris campaign for losing pennsylvania. and then he defended president biden saying that biden would have won the common wealth and he then attacked the harris campaign for not even campaigning with biden in his hometown of scranton. >> how do you not invite the president of the united states to his hometown? everybody loves joe biden, even in the city. he gave up seat united states president not to run again for her. that's the way they are treating him now. talking about him now. it's a total absolute disgrace. indicative to the way they ran their campaign. >> >> bryan: brady went on to say the philadelphia democrats did not get nearly enough resources to run an effective campaign by the harris team. then he said that that philadelphia concert on the eve

thing you guys tackle? >> i think so important the border has a legislative solution. the border has been, you know, in the hands of the executive and of course a hot potato issue, back and forth. one executive sealed it and next administration unseals it. we need to pass legislation that by law secures the border in perpetuity in addition to the border, create metrics around immigration and funding for border security that are going to be enduring and can't just be undone over overwritten with an executive order. yes that will be if not the first among the top and then, of course, we have got to get inflation under control. stop printing money. of course those issues are linked. massive immigration into this country is a direct impact on the economy of this country. we have more people come into this country than we have ever had in the history of our nation in a very short period of time whether it's housing, whether it's healthcare, whether it's inflation that, issue has a direct impact on the economy, too.
