the jury watched most critical piece of evidence, two cell phone videos, one video a witness can be heard saying, he's dying, let him go. a teen on her way home from high school told the injury, i was nervous and thought i was going to pass out. i got scared by the tone, the way he was saying it, he was saying it in an angry tone, i have seen escalation, not like that. another passenger testified, i said, if he's defecating or urinating on himself, you're going to let him go, you are going to kill him. he did not respond. that is truth of what happened. penny's defense argues actions were justified. he could face 15 years if convicted, guys. >> steve: thank you.

on drug charges. >> brian: the winner, nathan hockman. america is glad you won. what's the message we get from your overwhelming election? we should get from it? >> the message is that the voters of l.a. county rejected extreme pro-criminal policies. gascon, the current d.a., had brought in four years ago where he said that certain crimes and certain criminals will not be prosecuted notwithstanding the facts of the law. i rejected those policies. i also rejected the mass incarceration policies and i came down in the middle and called the hard work middle. you have to do the work to make sure that each individual case is being considered individually. you look at the defendant's backward, the crime committed, impact on the victim to determine who the true threats are to public safety and need to be behind bars, the repeat offenders, and the ones that

aren't. non-violent first-time offender could serve their punishment proportionally through community service, restitution or diversion program. >> lawrence: you have a big job. you got good ada's in the office but a ton of public defenders now acting like they are district attorneys. you have to clean house. how will you do that? >> it's great. i got the endorsement of the 750 deputy district attorneys and those are the guys that 98% of which rejected and actually supported the recall of their boss. that's a talented, di verse group of prosecutors and i will rebuild that. the l.a. county district attorney's office used to be the gold standard by which all d.a.'s offices were measured and we'll resume that stouts. >> steve: one of the big cases is the menendez brothers and your opponent wanted them resentenced. a lot of people are saying they have rehabilitated and should be out on the street.

you are the boss now. what will happen? >> the methodology to examine that case is the same whether it gets media attention or not. in menendez you have to do the hard work of the facts and law. you have to look at thousands of pages of confidential prison files and thousands of pages of transcripts and speak to the prosecutors, law enforcement, victim family members and the defense. only then can you form an opinion on whether or not the resentencing is appropriate. if it lands on my desk. it might not. if it does i will do the hard work to form an opinion that i can justify in court. >> ainsley: are they rehabilitated do you believe? >> you would of to look at thousands of pages of confidential prison files that the public doesn't have access to. only the d.a.'s office does. again, i would take power on december 2nd. there is a hearing right now set for december 11th. if that hearing stands we'll be
