good to be with you, john. i'm sam smith in new york. this is "america reports." the president-elect has 79 days until he takes the right house white house. filling key cabinet positions and newly remitted republican senate could be a big help. >> john: fox news team coverage to kick us off, mollie hemingway with the second trump white house, bryan llenas has the latest on the democrats post-election autopsy, as well as the still-undecided senate race in pennsylvania. >> sandra: but we begin with bill melugin live from west palm beach, florida, for us with more on the trump transition. bill, one big name has taken himself out of the running? >> sandra, that's right, that would be senator tom cotton. he had reportedly been under consideration by the trump team for secretary of defense, but sources tell fox news that cotton politely asked the trump team to please pull his name from consideration for family reasons and because he would like to stay in the senate and potentially run for a senate

leadership position. now a lot of other cabinet positions that have got to be filled so let's talk about some of the names that are floating out there, take a look at this graphic here. one of the names obviously people are talking but is north dakota governor doug burgum, he is being looked at potentially for energy secretary, then you have marco rubio being floated for possible secretary of state. elon musk obviously going to be involved, likely in a noncabinet position that has to do with government spending. the department of government efficiency is something they have been talking about. and then lastly, rfk jr., trump has said, will be heavily involved in some way when it comes to public health. the trump transition teams as they are already well underway. they are in the process of vetting all potential candidates, and trump senior advisor jason miller says trump himself is going to hit the ground running on day number one with multiple executive orders. take a listen. >> window those policies, whether the border, even some of the things on energy exploration and others, can be put back in place with a simple signature on an executive order.

get those going literally on day one, so that might not be a 12:01 p.m., maybe 12:05 p.m., but he is going to move quick. >> and we are starting to see more and more democrats come out and indicate they may try to resist this future trump administration. just a short time ago california governor gavin newsom announced he is calling for a special session of the california legislature to "safeguard california values in the face of an incoming trump administration," specifically he says he wants to bolster california resources to "protect civil rights, reproductive freedom, climate action, and immigrant families." sandra, we will send it back to you peered. >> sandra: bill melugin out of west palm, thank you. the. >> john: mollie hemingway, editor in chief at "the federalist" and fox news contributor. the election is behind us, campaign emails have stopped, campaign ads have gone away, so

trump will come into a second term with the momentum that few other presidents have had. here's what axios said. trump will come to power better organized, better staff, exponentially better position to dominate his party and the nation then he was last time. trump sources tell us he will consolidate power by steering who runs the house and senate and unleashing his agenda out of the gate, starting with an immigration crackdown. so he is coming into the office with a mandate for change that most brand-new presidents have, but he knows the job, he's been there, he knows were all the traps and the pitfalls are, and he knows how to avoid them if he wants to. >> so his dorky speaking if you have a two-term president, they gpast majority done in the first two years of the first term. this is going to be a very different administration. this is an administration that understands where the obstacles were, quite a bit of resistance, unconstitutional resistance to some of what president trump had planned and was doing in the first term.

there is just a greater acknowledgment of how some of that resistance might be within the republican party and how to avoid the pitfalls of welcoming those people in, but there's also things like you take the border. it took a while for the trump first term to understand how to fix the border, and the kind of worked it out -- >> john: until 2019. >> but they now know what it takes to do that so they can hit the ground running without some of that experiment to mixture. they also saw what biden did on day one, signed one of 100 executive orders to dismantle every thing they have done so they understand they have the power of the pen. they also have the power of a much better house republican caucus and senate republican caucus that will actually try to work with them more than be hostile. >> john: may even have control not only the senate but the house, as well. you mentioned biden on doing a lot of what trump did, it seems to me that on day one, trump's to-do list contains a lot of undoing, as well. >> so it is undoing but it will have to be more than that because we can't just have it go back and forth between one administration and the next. there are some systemic problems within the bureaucracy, and you

have seen this permanent d.c. establishment that sort of things that they run things regardless of where the people vote and who they vote for, and so much of what trump was able to accomplish even if it is terms of lawfare, going after political opponents, that was through the administrative state so i think that is one change you will see with the second administration is tackling the problems of these unaccountable, unelected bureaucrats who try to run things despite with the american people have to say. >> john: let's talk about potential cabinet members, and bill melugin alluded to this a moment ago, chief of staff, big group from florida, brooke rawlins, the ceo of the american first policy institute, maybe for chief of staff. treasury secretary, hedge fund billionaire john paulson or scott besson, secretary of state ric grenell, who is a real stalwart trump loyalist. senator marco rubio could be in line for that job, some other names being floated out there for positions in the administration. don't know what yet. doug burgum, vivek ramaswamy,

elon musk, who might be the czar in charge of waste fraud and abuse. art rfk jr. >> one particular thing about this campaign as it was a coalition of people you would not initially put, not old neocon era of their republican party so a lot of interesting names to pick but i would also say the trump administration needs to focus on the department of justice, that does seem to be where we have been getting signals the resistance will take place, where the russia collusion hoax was run out of so you need someone to run the department and understand how again to root out some of the corruption and the bad things that have been happening there, so i will be interested to see who he picks there. there have been some names floated from eric schmitt, the senator from missouri who is very good on a lot of these issues, even a ron desantis, who seems to be able to take on bureaucracy, although no one wants to loosen from florida, which is being run well. >> john: i also heard to santos' name floated for secretary of defense. cotton has asked not to be considered, concentrate on the senate, but maybe desantis, we will see, molly, a lot to chew

over between now and the 20th of january. >> it will be fun. >> john: it will be, thanks. where is the bidding going with you in terms of who goes where? >> sandra: i'm going to lay it out for you right now. marco rubio is an interesting one for secretary of state. we thought it was so interesting, we called him and asked him to come on and expand where he stands on that. he will be joining us top of the hour, 2:00 eastern time, john. >> john: looking forward to that. >> sandra: certainly this is a big discussion for many inside the trunk camp and beyond, so we will see. >> john: brian kilmeade is being considered for hhs secretary. he is going to join us. sean duffy, as well. >> sandra: bill hagerty and robert o'brien. there is a lot of names being floated around for the same position. we are going to talk to marco rubio about. that will be an interesting discussion, and it will be here soon. >> john: all right, now this. >> if anyone has seen "game of thrones," it was a red wedding, it was a bloodbath. i hope that we can do an honest assessment and not criticize the

people who have ideas and solutions about how we can move forward because we do not acknowledge the rightward turn of america, we are going to keep losing. >> sandra: that his hair surrogate lindy lee joining us yesterday with those stern words after the election loss. pennsylvania tip the scale for trump and her pelicans could still pick up a senate seat there, too. bryan llenas is live in philly for us, brian, could that race beheaded for a recount? >> hey, sandra. currently it is in recount territory but they are still votes out there to be counted. the pennsylvania senate races ststill to close to call but the republican challenger dave mccormick is ahead of democratic senator bob casey by about 30,000 votes, or less than half a percent. and in pennsylvania, according to law, the margin is .5% or less, there is an automatic recount. now the mccormick campaign is confident they have won this thing because they say they expect to win about 75% of the remaining ballots or so that are

being hand processed in red cambria county. right now mccormick is up with 61% of the vote. mccormick's team says not only are there not enough votes out there to close the gap, they don't think this will end up close enough for a recount. still, democratic senator bob casey's campaign is not backing down, arguing there are still ballots, including provisional ballots to count in blue allegheny and philadelphia counties. "with tens of thousands more votes to be counted, we are committed to ensuring every pennsylvanian's vote is heard and confident that in the end of that process senator casey will be reelected." now democrats are already sending fundraising emails potentially in preparation for a legal fight. important to note, sandra, mccormick, this could be his second automatic recount in the primary in 2022 against dr. oz, he lost by 972 votes. after the recount, that total shrunk by only 21 votes. sandra?

>> sandra: all right, and bryan, where pennsylvanian democrats telling you about harris' loss there? >> well, we kind of previewed this yesterday in the show but i spoke to philadelphia's democratic party chair bob brady on camera yesterday, and he said that if it was president joe biden, he would have won the commonwealth, and then he blamed the harris campaign for neglecting philadelphia. >> the national campaign, nothing, zero. they have no respect, no coordination. i never even had a conversation with the lady. they didn't even do the right thing as far as giving us the resources that we need, and they want to blame us? and now i understand they are blaming joe biden? can you imagine blaming joe biden for her loss? she lost, he didn't lose. >> the harris campaign fired back, blaming brady and a philadelphia democrats for not doing anything to help. sandra? >> sandra: bryan llenas live in philly for us, thank you. john? >> john: we are awaiting sandra the first white house

♪ ♪ >> john: marine veteran daniel penny back in a new york city courtroom today, jurors hearing from more witnesses who were on board subway when the deadly choke hold of homeless men jordan neely happened. cb cotton is live outside the new york state supreme court. cb, what has happened so far today? >> hi, john. well, so far, we have heard from several eyewitnesses that were there that day to including woman who said she heard jordan neely making threats and she was so scared she thought she might die. she says at the time she didn't know whether neely had a weapon, so she felt relieved when daniel penny placed neely in the choke hold, and john, this is all part of the dramatic testimony we are hearing from the witness stand to include from nypd officers who told jurors earlier this week they initially felt a pulse will trying to revive neely, so those officers told jurors they did chest compressions, followed by

the opioid reversal drug narcan, thinking that neely may have overdosed, and an nypd sergeant testifying that the officers did not administer mouth-to-mouth as neely appeared to be a drug user, and he feared they could contract a disease. a 19-year-old officer testified as prosecutors played this never before seen cell phone video that she captured of daniel penny holding neely in the choke hold, with the camera moves you can see one of her hands shaking uncontrollably. she testified that neely said he didn't care if he went to jail, but he didn't touch or approach anyone. she recalled burying her head in her friend's chest and wanting to "getaway," and the man who cs widely circulated video also testified, telling jurors neely's tone seemed violent and desperate. prosecutors say penny went too far, but penny's attorneys argued their client was trying to protect other subway riders. as penny walked into court

and this as stocks continue to record highs after president-elect strums historic victory. although down slightly at the moment, it has been up and down, john, they go up, they go down. >> john: they do. when you say down slightly, that is pretty slightly. >> sandra: we should point out that is a record high that the dow is sitting at right now despite -- let's bring in our panel, robert wolf, fox news contributor, former economic advisor obama, and steve moore, trumped up economic advisor. as i always used to say, those awesome trading days i lived through sharply unchanged the market today. steve, to you first. what's going to happen with interest rates here because so many people are waiting for these interest rates to come down to make it more affordable to get into a home. what do you expect? >> you know, i'm skeptical of this, and as you know, sandra, i was skeptical of the last rate cut that happened shortly before the election because i still worry about inflation. it still keeps me up at night.

i was thinking about this stuff, how in my lifetime there have been three presidencies that have been lost because of inflation. jerry ford lost the election in 1976 because of high inflation, jimmy carter lost the election in 1980 because of high inflation and i think a major reason joe biden and kamala harris lost this election was inflation. if i am trump, i want to make sure i am keeping inflation under control and i don't know how robert feels about this, i'm not so sure right now it is a good time to be pumping more money into the economy. >> sandra: lets ask him. robert? >> first i have to congratulate my pal steve moore, always after an election. >> sandra: we have to get steve's reaction to that. about long-term inflation, and obviously, sandra, you have been way ahead of everyone that although inflation rate is coming down, prices are still 20% -- >> sandra: thanks, robert. >> with all of that being said, the labor market is less tired, the labor numbers last monday were somewhere between awful and horrendous, even if you include the helene and the different storms and the boeing, still going to come in around $100,000 and the revision was off. my recommendation, i was not for the fed doing the basis points, i was 25, but i would recommend doing another 25 today, otherwise that last 25 was purely too political, so i think they should stay at 25. and my view would be to continue to stay at 25 because obviously i am not supportive of former president trump to be president trump's tariff across the board. my view it is a wait-and-see but

i repeat based on the last labor numbers i would stay with the 25. >> sandra: really interesting. steve, i want to ask you about what the first hundred days of this administration will look like, as we now have president-elect donald trump. i can put that in the context of this federal reserve meeting coming up because those prices are still high and that is why this is a consideration to lower those interest rates again. this is what we heard from trump on his economic promises. let's play this. >> i will massively cut taxes for workers and small businesses, and we will have no tax on tips, no tax on overtime, and no tax on social security benefits for our seniors. i will terminate the green new scam and i will cut your energy prices in half within 12 months. we will give our companies the lowest taxes, the lowest energy costs, the lowest regulatory burden. if these companies don't make

their products here, than they will pay a very stiff tariff. >> sandra: you know, it's interesting come on election night i was closely monitoring the u.s. markets, not just the stock market, which was rallying as it started to look more and more like a trump victory. rallied all the way into the night. but i saw oil prices start dropping. i mean, these are big promises, once that the american voters are counting on, they voted for. so what does this look like? these are massive undertakings. >> well, sandra, kudos to you, did a great job on election night -- >> sandra: thanks. >> explain what was going on. so thank you for that. the reason they call people like me supply-side economists is because i want to expand the supply of goods and services in the economy, pro-production president, and when trump is talking about more oil and gas production, if you increase the supply of something, sandra, what happens to its price, it goes down, if you cut taxes on businesses and they produce more prices will go down. that is what happened under

reagan when he came in and we had pro-supply-side policies. we will be very attentive to making sure inflation doesn't come back, but the way to do that is put more americans back to work and produce more here at home. >> sandra: to bring this all together with the few seconds we have left, robert, i know that you are for a lot of those policies. i mean, you always said you weren't a biden guy. you happen to think that some of what the harris team was pitching throughout their campaign, you agreed with, and you supported, but what about this policy could work for the economy, from your view? >> yeah, so steve and i use to agree completely that neither of us were for broad-based tariffs, and we were both for free and fair trade, so we have been agreed on that for years, so i'm nervous about protectionism. i am not for an increase in capital gains. i was against that was harris, i wasn't for a wealth tax. i am nervous to see capital gains go from, you know, or corporate taxes go to 15%

to make a decision on whether immunity applies to trump in that case because of the supreme court ruling so even if immunity, you could argue immunity doesn't apply here because the actions trump took in that case were really before he became president. it would be a way for merchan to get out, politically save face, say look, i did every thing i could do but the supreme court ruled, and that's it, and then he wouldn't be in the position of attempting to possibly sentence the president-elect of the united states. as we see, going after trump has become a bit of a personal passion project. >> john: trey, how do you come as a judge, i mean, i guess you could go ahead and do this, damn the torpedoes, how do you as a judge sentenced the president-elect to anything from probation to jail time? >> you don't. he's got a couple of off-ramp's. the one kerri mentioned to you. he can also rule but yet allow
