campaign. he was right on the issues. we have four years of experience in life was good under donald trump. i think part of the lesson here is you cannot bifurcate and try to treat everybody as if they are different. the democrats would say they try to unite the country they did everything they could to divide the country. they started speaking to people as if they were different and based on the color of their skin. the message from donald trump, and i know the democrats have not figured this out but donald trump was hey, you are americans and we all want the same thing. when economic security when security overseas, security on our streets we want low prices, we will low prices we believe in america with the american dream if you treat everybody the same, guess what the message resonates you don't get treated differently just on the base on your skin that's uniting message. eric: 19 he pours a white working class and helped reagan do you think the democrats were really surprised that it was

the income it district attorney? >> it turns out i believe safety is a crossover issue. i had the opportunity to speak with thousands of people across this county from ultraleft liberals, independence black, white, latino, asian groups every different religion across a 4000 square mile county. while they do not agree on a lot they do a great safety for themselves and their families matters. the current district attorney instituted pro- criminal extreme policies that made them feel and experience less safety over the last four years than before. he actually said even though we are not going trigger on to agrn everything, the game plan that you have 34 years of criminal justice experience as a prosecutor and defense attorney bring it back proportional accountability for crimes makes a lot of sense. in fact they said he's finally

gone. we can get. >> what happened to the movement we've seen across the country not just there but elsewhere to give them the carrot so to speak? reducing or increasing the amount you can shoplift and not call that a felony but a misdemeanor and not even prosecuted at all. what happened to that? >> what happened in california we had a proposition pass as well as being elected proposition 36. it's not rest now restored somes back to das office for repeat offenders. commit three different violations get convicted for $150 for drug use. meth, heroin, fentanyl. go to state prison if they keep doing it more than three times. we have additional tools for conventional poisoning. fentanyl poisoning. which is incredibly important.

fentanyl as you know the largest killer of 18 -- 35 -year-olds. i'm going to launch a massive education and enforcement effort to go after these fentanyl poisoners. >> about any cash avail or the end of cash bail the supporters of that set unfairly targeted do not have the money and poor people may not be able to make bail did that fuel an increase in crime? >> boot from cash built all which of the other end of the pendulum swing 20 cash avail people understood if you got arrested and that certainly embolden criminals. but we have to go back to is it risk-based analysis. figure out the appropriate bail to committing more crimes and deal with the risk of showing up. sometimes that can be higher than the cash avail schedule. sometimes lower. we've got to apply that much more thorough analysis of four

bail to make sure the right bail is being given to the right person. >> gus cohen gave this statement imparts after his defeat the other night he said quote the right word shift across america last night is heartbreaking. democrats have long road ahead the work is more vital than ever our commitment will not waver. i'm deeply proud he said of what we've accomplished over the past four years grateful to the communities who have been and always will be the heart of criminal justice reform. as you know there are problems with the system. how do you perform it and what needs to be reformed without going too far? >> the problems with the system are real. we have to deal with police accountability issues. we have to deal with explicit and implicit racial bias in the system. this is work to do a much better job of gascon on his own agenda. twenty-four years of defense practice i have had it done with hundreds of cases to actually

institute a real and effective criminal justice reform agenda while prioritizing public safety. gascon failed on both agendas. i won't fail. eric: meanwhile there's a high case the ad menendez brothers having served so many decades in prison for the killing of their parents. you've got the documentary, there's a series on netflix, family members have come out and said they should be paroled. what is your sense of that it may be a campaign stump effort trying to make that an issue. will you do the same or studied this case do you think the menendez deserve to get out of prison? >> the timing for gascon's decision to weigh in on the menendez case was just political party could have weighed in on it eight -- 16 months before when he got the original motions. he could've actually weighed in on it after the election he will be the d.a. until december 1 burrell take office on

december 2. but as for the substance of whether or not the menendez motion for resentencing is just or just a political ploy the problem with him doing it at the time he did it he cast a cloud of credibility over that decision. what i will do differently thorough review of the facts and the law. i will review thousands of patients of confidential prison files, thousands of patients of trial transcripts. i'll speak to the prosecutors, law enforcement defense counsel victim family members and only at that point to a weigh in on this decision. >> it seems the criminals are on notice with the new sheriff in town district attorney of los angeles elect again thank you for joining us and look forwardo getting you back. thank you very much. >> we have a scary story from overseas. an american nurse found dead in a suitcase after she went missing on vacation in europe.
